Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Construction dated November 26, 2003 and Decree No. 08/2005/NĐ-CP dated January 24, 2005 of the Government on planning for construction;

Considering the proposal of the Minister of Construction in Document No. 87/BXD-KTQH dated January 12, 2007 and that of the Director of the Management Board of the Border Economic Zone at Bo Y International Gate in Document No. 05/TTr-BQLKKT dated January 16, 2007.

DECISION:

Article 1. Approves the adjustment of the Master Plan for Construction of the Border Economic Zone at Bo Y International Gate until 2025 with the main contents as follows:

1. The scope of the Master Plan for the Border Economic Zone at Bo Y International Gate (hereinafter referred to as the Economic Zone): 70,438 hectares, including the communes of Salaong, Bo Y, Dak Su, Dak Duc, Dak Nong, Dak Kan and the town of Plei Kran under Ngoc Ho District, Kon Tum Province, with the following boundaries:

- North: adjacent to Dak Glei District;

- South: adjacent to Sa Thay District;

- East: adjacent to Dak To District;

- West: adjacent to Laos and Cambodia.

2. Nature: a driving economic zone, a center in the development triangle of Vietnam-Laos-Cambodia, with its own operational regulations, equipped with modern and synchronized technical infrastructure and social infrastructure; developing into a border city of type II, connected to the East-West economic corridor of the region, aiming to effectively utilize geographical-political-economic-social conditions; having an important position regarding security and defense.

3. Population scale:

- In 2015 approximately 150,000 people, of which urban population is about 100,000 people;

- In 2025 approximately 293,000 people, of which urban population is about 220,000 people.

4. Land use scale: total natural land area of 70,438 hectares, including:

- Urban development land approximately 18,704 hectares, of which residential land approximately 4,948 hectares;

- Rural residential area construction land approximately 3,377 hectares;

- Tourism development land approximately 18,836 hectares;

- Commercial international airport construction land approximately 700 hectares.

5. Orientation for spatial development and architectural landscape:

a) Spatial development direction: from the current central town of Plei Kran, developing along four main directions as follows:

- North: the Northern Bo Y urban area, developing along National Highway 14, from Plei Kran Town to Nong Nhay Commune, Dak Duc Commune; natural area approximately 3,300 hectares;

- South: the Southern Bo Y urban area, developing along National Highway 14C, from Plei Kran Town to Sa Thay District to Salaong Commune and Farm 732; natural area approximately 1,600 hectares;

- West: the Western Bo Y urban area, developing along National Highway 40, from Plei Kran Town to the Bo Y Gate to the border with Laos and Cambodia; natural area approximately 1,200 hectares;

- East: the Eastern Bo Y urban area, developing along National Highway 14, from Plei Kran Town to Kon Tum City to the Po Ko River; natural area approximately 2,700 hectares.

b) Spatial organization and system of centers

- Comprehensive Center:

+ Period 2006-2015: Plei Kran Town is the administrative, commercial, industrial, service, and tourism urban center serving the development of the Economic Zone; simultaneously, it is the administrative, economic, cultural center of Ngoc Ho District, Kon Tum Province; population scale approximately 100,000 people;

The General Plan for Construction of Plei Kran Town remains unchanged according to Decision No. 1577/QĐ-UBND dated December 20, 2005 of the Chairman of the People's Committee of Kon Tum Province.

+ Period 2015-2025: forming an economic comprehensive urban center for commerce, industry, tourism, services, and agriculture-forestry in Southern Bo Y, developing into a comprehensive urban area of the border region; population scale approximately 220,000 people.

- Specialized Centers:

+ Commercial-Financial Center: located in the southern part of the Northern Bo Y urban area, including the international commercial center, financial center, and other public facilities;

+ Educational Center: located in the Northern Bo Y urban area, including universities, vocational high schools, boarding schools for ethnic minorities;

+ Medical-Cultural-Sports Center: located in the Western Bo Y urban area, including hospitals, sports complexes, cultural centers;

+ Scientific Center: located in the Southern Bo Y urban area, including high-tech zones, nurseries, seedling gardens, research centers belonging to the Bo Y University;

+ Service-Market Control Center: located in the Western Bo Y urban area, including a complex of market control facilities and commercial, service, warehouse facilities serving the activities of the gate;

+ Tourism-Service Center: consisting of integrated or specialized tourist areas, including five tourism-service centers at lakes Dak Su, Dak Nong, Salaong, central lake, and Kem Put mountain;

+ Cultural Exchange Center among Ethnic Groups in the Central Highlands, Craft Culture, Traditional Culture: located in the Northern Bo Y urban area.

6. Functional Zones

a) Public Facilities:

- Administrative offices:

+ Administrative management offices of the Economic Zone and central agencies operating within the Economic Zone are concentrated in the administrative center area in Quang Nong Village, Dak Su Commune, south of the Northern Bo Y urban area;

+ Offices and representative offices of business entities are arranged in the main centers, regional centers, and some specialized centers;

+ Administrative office of Ngoc Ho District: retains the location determined in the General Plan for Plei Kran Town.

- Health facilities:

+ Central and regional level: including general and specialized hospitals arranged in the health center area (approximately 39 hectares) in Ngoc Tien Village, Dak Su Commune, Western Bo Y urban area;

+ Secondary level facilities: apart from the existing district hospital, three additional regional general hospitals will be arranged in the remaining urban centers, each approximately 3 hectares;

+ Primary level facilities: arranging community health stations, each station approximately 10-20 beds in the centers of residential areas.

- Educational facilities:

+ Bo Y University in the southern part of the Northern Bo Y urban area, including university, college, secondary, vocational training systems, serving the training needs of the border region of three countries; scale approximately 7,000-10,000 students; area approximately 100 hectares;

||| Two boarding schools for ethnic minority children in the region, located in the urban areas of North and South Bo Y, with a scale of 1,000 to 2,000 students each. The system of secondary, primary, and kindergarten schools meets the national standard criteria, suitable for the population size and development situation of the Economic Zone at different periods.

||| Cultural facilities:

||| Urban cultural center of South Bo Y (approximately 14 hectares) including an international conference center, national cinema, youth and children's cultural palace, exhibition hall, and comprehensive museum;

||| In the center of each remaining urban area: a comprehensive cultural house with a total area of approximately 15 hectares;

||| At each residential center: a cultural house with a capacity of about 200 people; in each cluster of residential points (population of about 5,000 people): a community activity facility;

||| Sports and physical education facilities:

||| A sports complex (approximately 66 hectares) in Xuan Tan village, Dak Su commune, West Bo Y urban area;

||| In the center of each remaining urban area: a regional-level sports center serving about 100,000 people, with an area of approximately 15 hectares;

||| Small-scale sports and physical education facilities are arranged in specialized centers and residential areas to meet grassroots sports activities;

||| Commercial and service facilities:

||| Duty-free zone: in the center of South Bo Y urban area;

||| International trade zone (customs services, approximately 251 hectares), including facilities for customs transactions, border control, and located adjacent to the border, at the end of National Highway 40; it is a duty-free trading zone applying special preferential policies of the Economic Zone;

||| Market system:

||| Border market located adjacent to the Vietnam-Laos border, with an area of approximately 10 hectares;

||| Wholesale markets include: northern wholesale market of North Bo Y urban area, adjacent to National Highway 14 towards Da Nang at entrances to the urban area; southeastern wholesale market adjacent to National Highway 14 towards Kon Tum; western wholesale market adjacent to National Highway 40 towards the border gate;

||| Central market of the Economic Zone located in South Bo Y urban area;

||| Three district markets are arranged in the remaining three urban areas;

||| In residential areas with a population of about 5,000 people, a small market is arranged with a service radius of about 2 kilometers to serve regular buying and selling activities of residents;

||| Five retail fuel stations with a distance of about 5-7 kilometers in urban areas and Plei Kan town, combined with parking lots, bus terminals, and other intermediate transfer warehouses;

||| Trading station (approximately 5 hectares) serving business, transactions, sales, and purchases of agricultural, forest, and aquatic products, adjacent to the bus terminal on National Highway 14 towards Kon Tum;

||| Tourist service facilities:

||| Forming a hotel system in urban, tourism, and service areas;

||| Concentrated entertainment complex (approximately 143 hectares) and two regional entertainment complexes (approximately 70-100 hectares each) in North Bo Y and West Bo Y urban areas;

||| Golf course of 36 holes in the southern part of South Bo Y urban area (approximately 272 hectares);

||| Tourism zones and clusters:

||| Tourist spot near the service customs area, west of the Economic Zone (total area including water surface approximately 339 hectares), main product is comprehensive sightseeing and recreational tourism;

||| Sa Loong Lake tourist area: south of the Economic Zone (total area including water surface approximately 956 hectares), combined with a scientific research center; main product is ecological forest tourism, resort, and comprehensive recreational tourism;

||| Chu Mon Ray National Forest: south of the Economic Zone; main product is ecological forest tourism, including a small central management and service point with low construction density;

||| Tourist areas around Dak Su Lake and Dak Duc Lake in the west of the Economic Zone, behind the Kem Put range; main product is ecological forest tourism, resort, comprehensive recreational tourism, and specialized tourism;

||| Tourist spots at Kem Put Mountain and Bia Mountain: north of the Economic Zone along National Highway 14 towards Da Nang, with an altitude of 1,250 meters; main product is mountain climbing and scenic viewing tourism;

||| Tourist spots in urban areas within the Economic Zone: around cultural heritage sites, historical and war memorials, water reservoirs, traditional craft villages, and cultural villages of the Western Highlands ethnic groups, and other concentrated entertainment areas; main product is comprehensive recreational tourism, historical tourism, research, and humanities;

||| b) Urban residential areas: each urban residential area has a population of about 2,000 to 5,000 people, with an area of approximately 30 to 50 hectares, arranged as follows:

||| - High-density urban residential areas: on relatively flat land areas south of the center of North Bo Y urban area and in the center of South Bo Y urban area;

||| - Low-density urban residential areas: on sloping land areas in the north and west of North Bo Y urban area; southwest of South Bo Y urban area and southwest of West Bo Y urban area;

||| - Residential area for foreigners: southwest of South Bo Y urban area, adjacent to the international trade center area, with an area of approximately 182 hectares;

||| c) Rural residential areas are concentrated around the commune centers or on land areas convenient for daily life and agricultural and forestry production:

||| - Dak Duc commune arranges two areas: Area I adjacent to North Bo Y urban area, approximately 220 hectares, with a population of about 6,200 people; Area II surrounding the Dak Duc Lake tourist area, approximately 210 hectares, with a population of about 5,800 people;

||| - Dak Nong commune: in the north of the Dak Su Lake tourist area, approximately 350 hectares, with a population of about 13,000 people;

||| - Dak Su commune arranges two areas: Area I southeast of Dak Su Lake, approximately 245 hectares, with a population of about 8,600 people; Area II southwest of Dak Su Lake, approximately 180 hectares, with a population of about 6,400 people;

||| - Bo Y commune arranges two areas: Area I adjacent to the north and northeast of the border service area, approximately 275 hectares, with a population of about 7,000 people; Area II southwest of the border trade service area, approximately 135 hectares, with a population of about 3,500 people;

||| - Sa Loong commune arranges two areas: Area I northeast of the Sa Loong Lake tourist area, approximately 485 hectares, with a population of about 11,500 people; Area II southwest of the Sa Loong Lake tourist area, approximately 105 hectares, with a population of about 2,500 people;

||| - Dak Kan commune: south of South Bo Y urban area, about 1 kilometer from National Highway 14, approximately 490 hectares, with a population of about 12,000 people;

||| d) Green park and square network:

||| Parks:

+ A forest park with an area of approximately 1,248 hectares located in the western part of the West Bo Y urban area, combining isolation between residential areas and industrial zones, serving the local population, and simultaneously functioning as a wildlife museum;

+ A central lake park with an area of approximately 724 hectares, serving recreational and cultural activities, education; and simultaneously displaying and preserving flower varieties in the region;

+ A cultural historical park of the Central Highlands with an area of approximately 536 hectares located in the western part of the administrative center zone, serving recreation and entertainment; and simultaneously functioning as an outdoor museum exhibiting cultural and historical artifacts of the Central Highland ethnic groups;

+ Several parks combined with water surfaces with areas ranging from 100 to 120 hectares in the centers of urban areas, serving entertainment, and simultaneously functioning as nurseries for flowers and ornamental plants serving the urban areas;

- Squares: each urban area shall be arranged with a central square, within which there will be monuments or architectural works of artistic value reflecting the characteristics of the Central Highlands;

- Urban greenery system: apart from street trees, park trees, and square trees, undeveloped land areas shall be planted with trees, flowers, and grass;

d) Other areas:

- An ASEAN Cultural Village with an area of approximately 230 hectares located in the southern part of the Plei Kran town;

- A Cultural Village of the Central Highland Ethnic Groups with an area of approximately 127 hectares located in the northern Bo Y urban area for cultural exchanges among the Central Highland ethnic groups, serving the preservation and maintenance of ethnic identity and tourism;

- A Heritage Conservation Area of the Plei Kran Victory with an area of approximately 366 hectares located in the northwestern part of the Plei Kran town for the conservation and exploitation of heritage values;

e) Industrial, small-scale industrial, and warehouse areas:

- Industrial and small-scale industrial areas:

+ A concentrated industrial zone (approximately 1,566 hectares) located in the northern part of the West Bo Y urban area. This is the main industrial zone, driving the development of the Economic Zone;

+ Various medium and small industrial and small-scale industrial zones: Zone I (approximately 217 hectares) located in the southwestern part of the Northern Bo Y urban area; Zone II (approximately 278 hectares) located in the southern part of the Southern Bo Y urban area for building light and clean industrial facilities;

+ Establishing craft villages in the Northern Bo Y urban area (approximately 140 hectares), representing miniature images of traditional Vietnamese craft villages;

- Warehouses:

+ A general warehouse (approximately 278 hectares) located in the north, adjacent to the concentrated industrial zone, being the largest warehouse in the economic zone, including raw material warehouses, fuel warehouses, reserve warehouses, and other types of warehouses;

+ Arranging four bonded warehouses兼备内陆河港,包括:毗邻口岸服务区的仓库区(约151公顷);毗邻国道14号通往Kon Tum方向的东南部Plei Kran镇(约55公顷);位于北方Bo Y城镇内的国道14号通往Da Nang方向的仓库区(约30公顷)和位于经济区南部的国道14C号南侧的仓库区(约30公顷);

+ Transit warehouses: arranged in conjunction with truck terminals and oversized vehicle terminals;

+ In addition, at various commercial service points, a system of transit and distribution oil depots and retail oil depots is arranged;

g) Scientific research and technology development area (approximately 750 hectares) located in the southern part of the Southern Bo Y urban area, including high-tech experimental research zones, nurseries, experimental gardens, gene banks for flora and fauna, and experimental research centers of the Bo Y Comprehensive University;

h) Maintain current military positions and allocate military land according to the requirements of the Ministry of Defense;

i) Agricultural, forestry, and fishery production areas:

The standard area for agricultural and forestry land allocation in the planning is based on the land usage quota for agricultural and forestry production as stipulated in Decision No. 134/2004/QĐ-TTg dated July 20, 2004, of the Prime Minister regarding support policies for production land, residential land, and housing for ethnic minority people;

- Total agricultural and forestry production land area by 2015 is approximately 43,786 hectares; by 2025 it is approximately 27,788 hectares;

- Aquaculture zones: in planned lakes, approximately 718 hectares;

k) Strictly managed forest areas:

- Protective forests (approximately 6,211 hectares) along the Vietnam-Laos border, protected and utilized according to legal regulations;

- National Forest Chu Mon Ray (approximately 8,640 hectares) in the southeastern part of the Economic Zone, bordering Sa Thay District and the Vietnam-Laos border, strictly protected, with ecological tourism exploitation subject to national forest management regulations;

7. Orientation for the Development of Technical Infrastructure

a) Transportation

- Road transportation:

+ International transportation: by 2015 upgrade and expand National Highway 14, 40, and 14C through urban areas. By 2025 organize ring roads around urban centers, including Western South, East, and Southeast routes with road widths from 24 meters to 36 meters; improve inter-district roads from the Economic Zone to Dak Glei, Dak To, and Sa Thay districts to meet Class III mountain road standards;

+ Urban transportation: organize an urban traffic network and squares to meet urban type 2 traffic standards;

+ Rural transportation systems are connected to urban transportation and regional transportation routes, ensuring that motor vehicles can reach all concentrated residential areas according to Class IV mountain road standards;

+ Key transportation facilities: arrange one central bus station and four suburban stations; cargo and bus parking lots are arranged at entrances and in urban centers;

+ Construct several bridges over the Poko River, over the Dak Long stream, and立体交叉交通节点在城市主干道与国道14号交汇处;

- Air transport: study the proposal for constructing an international commercial airport in Tan Canh commune, Dak To district, Kon Tum province (opposite the old Phoenix Airport), with an area of approximately 700 hectares;

b) Land preparation techniques: utilize natural topography, adopt localized earthwork solutions when necessary. Fully utilize rivers, streams, and lakes for rainwater drainage;

c) Water supply:

- Domestic water consumption standard: 120 liters/person/day-night for urban areas; 60 liters/person/day-night for rural areas;

- Total water demand by 2015 is approximately 18,000 cubic meters/day-night; by 2025 it is approximately 47,000 cubic meters/day-night.

- Water source: use surface water from Sa Loong Lake, central lake, and Po Ko River; combine with supplementary underground water sources during dry months according to the centralized water supply plan.

d) Power supply:

- Electricity consumption standards: urban residential electricity to reach 0.17 kW/person by 2015 and 0.34 kW/person by 2025; rural residential electricity to reach 0.04 kW/person by 2015 and 0.12 kW/person by 2025; industrial and small-scale industrial electricity at 100 kW/ha.

- Total electricity demand is estimated to be about 45 MW by 2015 and about 130 MW by 2025.

- Power source: initially use power from the 110 KV Dak To substation. In the future, use power from the Plei Krông hydropower plant connected to the national grid and supplement commercial power from the Xê Ca Man hydropower plant in Laos.

đ) Drainage and environmental sanitation:

- Rainwater and wastewater are designed to flow through separate sewers and are treated before being discharged into the environment.

- Solid waste management: collect and treat approximately 180 to 200 tons/day-night by 2015; approximately 400 to 440 tons/day-night by 2025.

Arrange four solid waste treatment areas:

+ The northern area within Dak Duc commune's jurisdiction (approximately 122 ha) serves the North Bo Y urban area and Dak Duc commune;

+ The northwestern area within Dak Su commune's jurisdiction (approximately 115 ha) serves part of the South Bo Y urban area, West Bo Y, Dak Su commune, and Dak Nong commune;

+ The southwestern area within Bo Y commune's jurisdiction (approximately 107 ha) serves the remaining part of the South Bo Y urban area, West Bo Y, and residents of Bo Y commune;

+ The southeastern area within Dak Kan commune's jurisdiction (approximately 144 ha) serves the Plei Kần town, East Bo Y urban area, and residents of Dak Kan commune.

- Cemeteries are located near the solid waste disposal areas.

e) Underground utility system for various types of wires and pipes in the urban area such as high, medium, and low voltage cables, water supply, telecommunications, and other special cables, constructed under main urban roads.

g) Telecommunications system: includes telephone systems, digital cable transmission systems for multimedia communication, postal services, radio and television broadcasting, designed according to urban type II standards.

8. Investment projects for the 2006-2015 period:

a) Establish, approve, and implement resettlement projects to proactively create land for investment in building the economic zone.

b) Organize detailed planning and investment projects for the following functional zones:

- North Bo Y urban area (approximately 1,444 ha);

- South Bo Y urban area (approximately 970 ha);

- West Bo Y urban area (approximately 1,240 ha);

- International trade zone (approximately 375 ha);

- Border service and customs control zone (approximately 139 ha);

- Border market, storage area for pre-export and import procedures, national gate (approximately 112 ha);

- Technical infrastructure for administrative management of the economic zone (approximately 450 ha);

- Industrial zone (approximately 750 ha), warehouse (approximately 463 ha);

- Border gateway tourism zone (approximately 120 ha), Chu Mo Ray forest tourism (approximately 20 ha);

- Rural residential areas of six communes (total area approximately 1,887 ha);

- Cemetery and landfill areas within Bo Y and Dak Su communes;

- Construct social infrastructure projects including administrative, educational, health, cultural, sports, commerce, service, and telecommunications facilities suitable for each stage of economic zone development.

Article 2. Implementation

1. Assign the Management Board of the International Border Economic Zone of Bo Y:

- Announce the General Plan for Construction of the International Border Economic Zone of Bo Y until 2025 for organizations and individuals to know and implement;

- Organize management and implementation of the plan and promulgate Construction Management Regulations according to the approved General Plan for Construction of the Economic Zone;

- Organize preparation, review, and approval of detailed plans and investment projects within the Economic Zone in accordance with current regulations;

- Prepare an overall project for constructing essential technical and social infrastructure within the Economic Zone, submit for approval according to regulations;

- Lead and coordinate with relevant ministries, sectors, and localities to organize research on the proposal for building an international commercial airport in Tan Canh commune, Dak To district, Kon Tum province, and submit to the Prime Minister;

- Utilize land funds to create capital and effectively exploit various sources of capital according to Decision No. 217/QĐ-TTg dated September 5, 2005 of the Prime Minister;

- Be permitted to call for various sources of capital from domestic and foreign investors to implement projects under the BT, BOT... models to accelerate the development of the Economic Zone;

- Lead and coordinate with relevant ministries, sectors, and localities to arrange residents, housing, production land, and stabilize the lives of people within the Economic Zone according to the approved General Plan.

2. Assign relevant ministries, sectors, and localities:

- The Ministry of Natural Resources and Environment leads and coordinates with the People's Committee of Kon Tum province, the Management Board of the International Border Economic Zone of Bo Y, related departments, and levels to promptly organize the transfer of all land and water areas to the Management Board of the International Border Economic Zone of Bo Y for management according to the approved General Plan for Construction to proceed with subsequent steps;

- The Ministry of Home Affairs leads and coordinates with the Management Board of the International Border Economic Zone of Bo Y and related agencies to promptly complete the organizational structure of the Management Board of the International Border Economic Zone of Bo Y to meet the requirements for managing and operating the Economic Zone;

- The Office of the Government, the Ministry of Planning and Investment, the Ministry of Public Security, the Ministry of Finance, the Border Guard Command, the Tourism Administration, the People's Committee of Kon Tum province, and related localities shall, based on their functions and responsibilities, coordinate with the Management Board of the International Border Economic Zone of Bo Y to accelerate the development of the Economic Zone.

Article 3. This Decision takes effect 15 days after the date of signature.

The Minister of Construction, the Chairman of the Management Board of the International Border Economic Zone of Bo Y, the Chairman of the People's Committee of Kon Tum province, and heads of related agencies, organizations, and individuals are responsible for implementing this Decision.
