THE MINISTER OF FINANCE

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;

Pursuant to the Prime Minister's Decision No. 853/1997/CT-TTg dated October 11, 1997 on combating smuggling under new circumstances;

Pursuant to Article 4 of Decree 86/CP dated December 8, 1995 on the division of responsibilities for state management of product quality;

Pursuant to Decision No. 14/1999/QĐ-TTg dated February 4, 1999 of the Prime Minister establishing the Quality Management and Food Safety Agency under the Ministry of Health;

Pursuant to Directive No. 08/1999/CT-TTg dated April 15, 1999 of the Prime Minister on strengthening work to ensure food quality and safety;

Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges included in the State budget;

DECISION:

Article 1. The schedule of fees and charges for management of food quality and safety is hereby attached to this Decision.

The entities subject to payment of fees and charges at the rates specified in this Article are domestic organizations and individuals, as well as foreign organizations and individuals engaged in production, business, and import of food products that are subject to quality and safety management by competent authorities within the health sector.

Article 2. The agencies collecting fees and charges for management of food quality and safety may retain funds from such collections before remitting them to the state budget to cover expenses for food quality and safety management and for organizing the collection of fees and charges according to approved budgets, provided that such retention does not exceed ninety percent (90%) of the collected fees and charges, with the remainder being remitted to the state budget according to the classification of the state budget.

The agencies responsible for organizing the collection of fees and charges shall be responsible for declaring, collecting, remitting, and managing fees and charges in accordance with Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance guiding the implementation of Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges included in the state budget.

Article 3. This Decision takes effect fifteen days after its date of issuance; provisions concerning fees and charges for management of food quality and safety that conflict with this Decision are hereby abolished.

Article 4. Organizations and individuals subject to payment of fees and charges for management of food quality and safety; units tasked with organizing the collection of fees and charges; and related agencies are responsible for implementing this Decision./.
