DECREE OF THE GOVERNMENT
Regarding amendments and supplements to certain Articles of the Vessel Registration and Seafarer Regulation issued
together with Decree No. 91/CP dated August 23, 1997 of the Government
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Based on the Maritime Code of Vietnam dated June 30, 1990;
At the proposal of the Minister of Transport;
DECREE:
Article 1. Amending and supplementing certain Articles of the Vessel Registration and Seafarer Regulation issued together with Decree No. 91/CP dated August 23, 1997 of the Government as follows:
1. Supplement Article 10a as follows:
"Article 10a
1. The vessel registration and seafarer registration authority at the regional level shall issue a temporary registration certificate for vessels in the following cases:
a) When registering a foreign-purchased vessel for use but the owner has not yet obtained the certificate of deletion from the vessel registration and the certificate of payment of stamp duty, or when purchasing a newly-built foreign vessel but the owner has not yet obtained the certificate of payment of stamp duty as stipulated in Article 10 of the Vessel Registration and Seafarer Regulation issued together with Decree No. 91/CP dated August 23, 1997 of the Government.
b) When registering a newly-built domestic vessel for trial runs to its place of official registration, the owner must submit copies of the following documents to the vessel registration and seafarer registration authority at the regional level:
Shipbuilding contract or ownership transfer contract,
Technical safety file of the ship issued by the Inspection Authority,
Ship radio station license issued by the Post Office.
2. The temporary registration certificate for vessels shall be valid for 90 days."
3. Clause 2 of Article 24 shall be amended as follows:
"2. Depending on the technical characteristics of the vessel and the professional qualifications and experience required of seafarers to ensure safe operation of each type of vessel, the Minister of Transport and the Minister of Fisheries (as stipulated in Article 4 of the Vessel Registration and Seafarer Regulation issued together with Decree No. 91/CP dated August 23, 1997 of the Government) shall specify the number and positions of foreign seafarers permitted to work on Vietnamese vessels and Vietnamese seafarers permitted to work on foreign vessels."
Article 2This Decree shall take effect 15 days from the date of signature.
Article 3. Ministers, heads of ministerial-level agencies, heads of agencies under the Government, and Chairmen Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Provincial People's Committees under the Central Government are responsible for implementing this Decree./.
