THE MINISTER OF CULTURE AND INFORMATION

BASED ON THE LAW ON ENACTING LEGAL REGULATORY DOCUMENTS dated November 12, 1996;

Pursuant to the Government Decree No. 81/CP dated November 8, 1993, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information;

Considering the proposal of the Director of the Training Department;

DECISION:

Article 1.The attached Decision hereby promulgates the "Regulation on Teaching Ballroom Dancing."

Article 2.The Regulation on Teaching Ballroom Dancing issued together with this Decision shall take effect fifteen days from the date of signature.

Article 3.The Heads of the Ministry's Office, heads of the Departments and Bureaus under the Ministry of Culture and Information, Directors of Provincial and Municipal Departments of Culture and Information directly under the Central Government, and relevant organizations and individuals are responsible for implementing this decision./.

REGULATIONS

BALLROOM DANCING
(Issued together with Decision No. 23/2001/QĐ-BVHTT dated [month day] [year] 2001 of the Minister of Culture and Information)

I- General Provisions

Article 1.

Ballroom dancing is an art form expressed through dance movements, involving coordinated hand, foot, and body actions following musical rhythms performed by male-female pairs or groups, aimed at entertainment, emotional exchange, and enhancing aesthetic appreciation.

Article 2.

The State encourages all organizations and individuals to organize ballroom dancing classes that promote national cultural traditions, absorb the finest elements of world ballroom dancing arts, and meet the cultural life needs and improve the spiritual life of the people.

Article 3.

1. This regulation governs the teaching of ballroom dancing by Vietnamese individuals, foreign individuals in Vietnam, and the organization of ballroom dancing classes by Vietnamese organizations and individuals throughout the country.

2. The organization of ballroom dancing classes in public cultural and artistic schools shall be governed by separate regulations and shall not apply the provisions of this regulation.

Article 4.

The organization of ballroom dancing classes must comply with legal regulations, specific provisions of this regulation, and must not contravene the traditional customs and aesthetics of the Vietnamese nation.

II- Specific Provisions on Activities of Teaching Ballroom Dancing

Article 5. Conditions for organizations and individuals to organize ballroom dancing classes:

1. The person registering to organize ballroom dancing classes must be a Vietnamese citizen, residing permanently in Vietnam, at least eighteen years old, without prior criminal records related to disseminating obscene materials, and not currently under investigation for criminal responsibility.

2. Ballroom dancing classroom:

- Must have a minimum area of 20 square meters;

- Must ensure lighting of at least 10 lux;

- Must ensure sound levels do not exceed the national standard for maximum permissible noise levels (Vietnamese Standard VN 5949-1995) and must not affect public order;

- Must meet fire prevention and firefighting conditions as prescribed by the Law on Fire Prevention and Fighting.

3. There must be an operational regulation clearly defining the responsibilities, obligations, and rights of the organizer, instructor, and student; specifying the detailed curriculum, content, and schedule of each class. This regulation must be communicated to each instructor and student.

Article 6. Rights and Obligations of Organizations and Individuals Organizing Ballroom Dancing Classes:

1. Organizations and individuals organizing ballroom dancing classes for profit must submit business registration files to the local business registration authority. The business registration certificate copy will be sent by the issuing authority to the local cultural information agency according to Article 20 of the Enterprise Law.

2. Organizations and individuals organizing ballroom dancing classes as non-profit entities must notify the local Department of Culture and Information in writing. The notification must include:

- Name of the organization or individual organizing ballroom dancing classes, residential address;

Location of the classes;

Training Programme: Content taught and duration of classes.

3. The organization of dance teaching within agencies and organizations does not require notification to the Department of Culture and Information, but shall not use music tapes or video discs prohibited from circulation for teaching purposes, nor teach dances that contravene Vietnamese national customs and traditions.

4. Organizations and individuals organizing dance teaching as prescribed in Clause 1 and Clause 2 of this Article shall only enter into contracts with persons who meet the conditions stipulated in Article 7 of this Regulation and must jointly bear responsibility for violations of the regulations committed by teachers and students during their presence at their premises.

5. During the process of organizing dance teaching, they must comply with the provisions of Clause 2; 4; 5; 6; 7 of Article 20 of the Regulation promulgated together with Decree No. 87/CP dated December 12, 1995 of the Government.

Article 7. Dance teachers must meet the following conditions:

1. For Vietnamese citizens:

a. Regarding personal background:

- Be a Vietnamese citizen aged 18 or older;

- Have good health suitable for teaching dance, free from infectious diseases, and without physical deformities affecting aesthetics;

- Not have criminal records or prior offenses related to disseminating obscene cultural products, and not be under investigation for criminal responsibility;

b. Regarding professional qualifications, they must meet one of the following conditions:

- Hold a professional certificate in dance level issued by a legitimate training institution, or be a member of the International Dance Teachers Association;

- Hold a certificate of achievement in dance competitions at provincial level or higher;

- Hold a certificate of dance level issued by the Department of Culture and Information where they reside;

2. For foreign nationals:

a. Regarding personal background:

- Must be 18 years old or older;

- Have good health suitable for teaching dance, free from infectious diseases, and without physical deformities affecting aesthetics;

- Have a good political attitude towards Vietnam;

b. Regarding professional qualifications, they must meet one of the following conditions:

- Hold a degree or certificate in dance issued by specialized arts schools in Vietnam or abroad;

- Hold a certificate confirming status as a dancer or membership in the International Dance Teachers Association;

- Hold a certificate of dance teaching level issued by the Department of Culture and Information where they reside.

Article 8. Rights and Obligations of Teachers:

1. During the teaching process, teachers must:

- Adhere strictly to the techniques of the dances;

- Not use music tapes or video discs prohibited from circulation for teaching purposes;

- Teach dances that do not contravene Vietnamese national customs and traditions;

2. Dance teachers are entitled to lawful income from their teaching activities.

Article 9. Handling Violations

1. Organizations and individuals organizing dance teaching or individuals teaching dance who do not meet the conditions stipulated in this Regulation must be suspended from operations.

2. Organizations and individuals organizing dance teaching or individuals teaching dance who violate the provisions of this Regulation will be subject to handling according to the law depending on the severity of the violation.

3. Organizations and individuals subject to penalties have the right to appeal in accordance with the law.

III- Implementation Provisions

Article 10.

1. The Training Department (Ministry of Culture and Information), Provincial Departments of Culture and Information directly under the Central Government are responsible for monitoring, guiding, and inspecting the implementation of this Regulation.

2. Provincial Departments of Culture and Information are responsible for assessing and issuing certificates of dance level to subjects specified in Point b Clause 1 and Point b Clause 2 of Article 7 of this Regulation.

Article 11.

Specialized Inspection Units of Culture and Information perform inspection and handling of violations in dance teaching activities within their authority.

Article 12.

This Regulation takes effect fifteen days from the date of signature, all previous provisions contrary to this Regulation are hereby abolished./.
