Regarding the organization of fireworks displays during the Lunar New Year and other national commemorative days.

Pursuant to the Government Organization Law dated December 25, 2001;
Pursuant to the opinion of the Central Committee's Secretariat dated January 22, 2002;
Considering the proposal of the Ministry of the Minister of Culture and Information (Circular No. 5568/VHTT-VP dated December 24, 2001) and the opinions of the 26. DECISION:
Article 1.Organization The organization of fireworks displays during the Lunar New Year and other national commemorative days shall include the following main contents:
1.Organizations and individuals in Vietnam, organizations and individuals from foreign countries (hereinafter referred to as organizations and individuals) who have cultural goods for export and import not for business purposes must comply with the provisions of this Decree and other relevant laws. Annual fireworks displays:
a) New Year's Eve of the Lunar New Year:
High-altitude fireworks display for 15 minutes at 5 locations in Hanoi and 4 locations in Ho Chi Minh City. Ho Chi Minh.
Low-altitude fireworks display for 15 minutes at 2 locations for the remaining provinces and centrally governed cities.
Time of display: From 00:00 to 00:15 on the first day of the Lunar New Year.at fifteen minutes on the first day of Tet.
b) Giỗ Tổ Hùng Vương (March 10th of the lunar calendar):
Low-altitude fireworks display for 15 minutes at 2 locations: at the Hùng Temple and Việt Trì city.
Time of display: From 21:00 to 21:15 on March 10th of the lunar calendar.
2. Organization of fireworks displays every five years on the fifth and tenth anniversaries:
a) National Day on September 2nd:
High-altitude fireworks display for 15 minutes at 5 locations in Hanoi and 4 locations in Ho Chi Minh City. Low-altitude fireworks display for 15 minutes at 2 locations for the remaining provinces and centrally governed cities.Ho Chi Minh.
Time of display: From 21:00 to 21:15 on September 2nd.
b) Victory Day of the historic Battle of Dien Bien Phu on May 7th:
2 locations in Dien Bien Phu town.
Low-altitude fireworks display for 15 minutes at Time of display: From 21:00 to 21:15 on May 7th.
c) Victory Day on April 30th, marking the complete liberation of the South:
4 locations in Ho Chi Minh City.
High-altitude fireworks display for 15 minutes at 5 locations in Hanoi and 4 locations in Ho Chi Minh City. Low-altitude fireworks display for
15 minutes at 2 locations for the remaining provinces and centrally governed cities from Quảng Trị inward on their respective days of liberation. Time of display: Hanoi and Ho Chi Minh City will display on the evening of April 30th; other localities from Quảng Trị inward will display on the evening of their respective days of liberation.
State management over the organization of production, storage, transportation, and display of fireworks nationwide:
Article 21. The state uniformly manages the organization of production, storage, transportation, and display of fireworks throughout the country.
2. Strictly prohibit the production and ignition of firecrackers and all other types of fireworks.
3. The organization of production, storage, transportation, and display of fireworks (high and low altitude) must ensure safety, economy, artistic quality, and meet the public's appreciation needs.
The People's Committees of provinces and centrally governed cities are responsible for strictly managing and implementing regulations regarding the type of fireworks to be displayed (high-altitude and low-altitude fireworks), quantity, time, duration, and location of the display. Allocation of responsibilities for implementation:
4.Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).1. Ministry of Culture and Information:
Article 3.a) The Ministry of Culture and Information issues guidelines for annual fireworks displays for localities, monitors the implementation of fireworks displays by localities to draw lessons, compile situations, and propose recommendations to the Government on organizing and directing relevant ministries, sectors, and localities across the country regarding fireworks displays.
Ministry of Defense: The sole agency responsible for producing fireworks shells and equipment, storing, transporting, commanding, training, and providing technical guidance for fireworks displays nationwide. a) Based on the fireworks display plans of localities, proactively organize the safe production of various types of fireworks, ensuring quality, quantity, and reasonable costs.
Direct and guide related defense units to prepare human resources, means, techniques, and equipment to coordinate with localities to properly implement fireworks displays according to regulations on type, quantity, number of display points, time, and duration, and settle accounts with each locality that organizes fireworks displays. c) Issue permits for the transportation of fireworks and fireworks equipment.
2.Ministry Ministry of Finance: Guide the use of local budgets for organizing fireworks displays and settling accounts according to regulations.
Public Security: Direct units within the sector to ensure good security and order during fireworks displays, implement measures to ban the ignition of firecrackers, fireworks, and other types of fireworks causing disorder, security issues, and pollution.
b)Organizing the design, printing of securities, and providing blank seals when requested by credit institutions. People's Committees of provinces and centrally governed cities:
a) Responsible for leading and coordinating with relevant agencies to organize and direct good fireworks displays, ensuring order, security, safety, and economy.
3. The Minister of Finance shall instruct customs authorities to simplify procedures for exporting types of cultural products that are not prohibited according to the Law on Customs dated June 29, 2001 and this Decree. In cases where the content of cultural products needs to be determined, the competent customs authority must request an appraisal from the competent specialized management agency regarding the content of cultural products. b) Ensure funding for organizing fireworks displays locally and settle accounts with the Ministry of Defense promptly from the local budget according to regulations on type, quantity, number of display points, time, and duration.
4.The 6. Vietnam Television and Voice of Vietnam Radio organize broadcasting and live coverage of fireworks displays to serve the entire nation.5.Location selection:

b) Ensuring funding for organizing fireworks displays at the local level andsettling accounts with the Ministry of National Defense in a timely manner fromthe local budget, in accordance with regulations regarding the type offireworks, quantity, number of locations, time of organization, and duration. The Decision takes effect from the date of signature.
6. Vietnam Television and Voice of Vietnam shall organize broadcasting and livecoverage of the fireworks display to serve the people nationwide.
Article 4.
This Decision takes effect from the date of issuance.
