Issuing the Regulation on the organization and operation of the Measurement Committee

under the General Department of Standardization, Metrology and Quality

THE MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;

Pursuant to Decision No. 140/2004/QĐ-TTg dated August 5, 2004 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Standardization, Metrology and Quality;

Considering the proposal of the Director of the General Department of Standardization, Metrology and Quality, the Head of the Organization and Cadre Affairs Department,

DECISION:

Article 1. This Decision promulgates the Regulation on the organization and operation of the Measurement Committee under the General Department of Standardization, Metrology and Quality.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Heads of the Office, the Heads of the Organization and Cadre Affairs Department, the Director of the General Department of Standardization, Metrology and Quality, the Heads of related units, and the Head of the Measurement Committee shall be responsible for implementing this Decision. /.

REGULATIONS

ORGANIZATION AND OPERATIONS OF THE MEASUREMENT COMMITTEE

(Attached to Decision No. 23/2005/QĐ-BKHCN

dated December 28, 2005 of the Minister of Science and Technology)

PART I

FUNCTIONS, TASKS, AND POWERS

Article 1. The Measurement Committee is an organization under the General Department of Standardization, Metrology and Quality with the function of assisting the Director of the General Department in managing metrology.

Article 2. The Measurement Committee has the following specific tasks and powers:

1. Proposing and leading the development of legal normative documents on metrology management, guiding and organizing the implementation of such documents after their issuance.

2. Proposing and leading the development of plans, policies, and regulations on metrology management, guiding and organizing the implementation of such documents after their approval.

3. Developing plans for the development of the national measurement standard system; assigning agencies to maintain the national measurement standards. Organizing and guiding ministries, sectors, localities in building the measurement standard system; monitoring the activities of measurement standard laboratories.

4. Organizing the development and guiding the implementation of regulations on measurements, measurement methods, and measurement units, requiring organizations and individuals to facilitate conditions for users to check measurements and measurement methods.

5. Organizing and managing the calibration and verification of measuring instruments; recognizing the ability to calibrate measuring instruments; certifying reference materials, approving samples before production or import of measuring instruments; reviewing certification and issuing measurement inspector cards.

6. Advising and guiding the metrological activities of ministries, sectors, localities, and enterprises to enforce metrological laws and ensure metrology in production and business.

7. Summarizing and reporting on the situation and results of metrological activities of ministries, sectors, localities, and bases.

8. Cooperating with units to organize training for metrology inspectors, improving metrology skills; organizing the compilation of technical documents on metrology.

9. Participating in international cooperation activities, scientific research, training, and information dissemination on metrology management.

10. Monitoring and proposing the management of associations and non-governmental organizations operating in the field of metrology according to the provisions of the law.

11. Managing civil servants, files, documents, and assets of the Committee according to the regulations of the General Department.

12. Performing other tasks assigned by the Director of the General Department.

PART II

ORGANIZATIONAL STRUCTURE

Article 3. The Measurement Committee operates under a specialist system combined with a chief executive system.

The leadership of the Measurement Committee consists of the Chairman and several Deputy Chairmen.

The Chairman is responsible to the Director of the General Department and the law for the entire organization and operation of the Committee.

The Deputy Chairmen perform specialized tasks and assist the Chairman in charge of one or more aspects of work as assigned by the Chairman, and are responsible to the Chairman and the law for the tasks assigned.

Specialists carry out specialized tasks assigned by the Chairman and are responsible to the Chairman for the performance of those tasks.

In the absence of the Chairman, a Deputy Chairman is authorized to manage the Committee's operations and is responsible for decisions made by the authorized Deputy Chairman.

Article 4. The appointment and removal of Committee leadership are carried out according to state regulations, the Ministry of Science and Technology, and the General Department of Standardization, Metrology and Quality.

CHAPTER III

WORK RELATIONSHIPS

Article 5. The Chairman of the Measurement Committee manages all activities of the Committee based on this Regulation and the working regulations of the General Department of Standardization, Metrology and Quality.

Article 6. The Chairman of the Measurement Committee implements the working system and relations with heads of subordinate units of the General Department according to the working regulations of the General Department and other regulations of the Director of the General Department.

Article 7. The Measurement Committee is responsible for closely collaborating with organizations assisting the Director of the General Department, related units to fulfill its tasks.

PART IV

IMPLEMENTING PROVISIONS

Article 8. The Chairman of the Measurement Committee coordinates with the Chairman of the Organization and Cadre Affairs Committee to implement this Regulation according to the guidance of the Director of the General Department of Standardization, Metrology and Quality.

Article 9. Any amendments or supplements to this Regulation shall be proposed by the Director of the General Department of Standardization, Metrology and Quality in coordination with the Head of the Organization and Cadre Affairs Department to the Minister of Science and Technology for consideration and decision./.
