REGARDING AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE "REGULATIONS ON THE ORGANIZATION AND MANAGEMENT OF THE NATIONAL KEY SCIENCE AND TECHNOLOGY PROGRAM ACTIVITIES FOR THE 2006-2010 PERIOD" ISSUED ACCOMPANYING DECISION NUMBER 18/2006/QĐ-BKHCN OF THE MINISTER OF SCIENCE AND TECHNOLOGY ON SEPTEMBER 15, 2006

Pursuant to the Law on Science and Technology dated June 9, 2000;
Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;
Pursuant to Decision No. 67/2006/QĐ-TTg dated March 21, 2006 of the Prime Minister approving the orientation, goals, tasks of science and technology for the 2006-2010 period;
Based on the proposals of the Heads of the Planning-Finance Department, the Department of Science and Technology of Economic and Technical Industries, and the Department of Social Sciences and Natural Sciences.

DECISION:

Article 1. Amending and supplementing certain articles of the "Regulations on the Organization and Management of the National Key Science and Technology Program Activities for the 2006-2010 Period" issued accompanying Decision No. 18/2006/QĐ-BKHCN dated September 15, 2006 of the Minister of Science and Technology with specific contents as follows:

1. Article 5 shall be amended and supplemented as follows:

Article 5. Organizational Structure of the Program Management

1. The organizational structure of the Programs includes:

a) Program Steering Committees and secretariats assisting the Steering Committees;

b) Program Offices.

2. The Program Steering Committee shall be established by the Minister of Science and Technology, responsible for assisting the Minister of Science and Technology in organizing and managing the implementation of the Program.

3. Program Offices are public service units under the Ministry of Science and Technology, established by the Minister of Science and Technology, assisting the Minister of Science and Technology in managing Program activities."

2. Article 7 shall be amended and supplemented as follows:

Article 7. Responsibilities, Powers, and Organizational Structure of Program Offices

The responsibilities, powers, and organizational structure of Program Offices are stipulated in the Charter on the Organization and Operation of Program Offices issued by the Minister of Science and Technology."

3. Clause 7 of Article 8 is amended and supplemented as follows:

"7. Recognizing the results of projects as a basis for considering the eligibility of the leading organization to lead or participate in other scientific and technological tasks organized by the Ministry of Science and Technology."

4. Clause 4 Article 9 is amended and supplemented as follows:

"4. Inspecting and urging organizations and individuals participating in cooperation in implementing projects according to Contracts. Submitting reports every six months and special reports on the progress of tasks, budget utilization of projects."

5.Abolishing Article 29 of the "Regulations on the Organization and Management of the National Key Science and Technology Program Activities for the 2006-2010 Period" issued accompanying Decision No. 18/2006/QĐ-BKHCN dated September 15, 2006 of the Minister of Science and Technology and amending and supplementing Article 30 of the Regulations (now Article 29) as follows:

Article 29. Implementation.

1. The Ministry of Science and Technology guides and implements these Regulations.

2. The Ministry of Science and Technology coordinates with the Central Theoretical Council to issue regulations on the management of social science research program activities on theoretical politics, ideology, and party building for the 2006-2010 period, as determined by the Central Theoretical Council."

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Heads of the Planning-Finance Department, the Department of Science and Technology of Economic and Technical Industries, the Department of Social Sciences and Natural Sciences, the Director of the Ministry's Office, the Heads of the Ministry's units, and the Heads of related agencies and organizations are responsible for implementing this Decision./.
