THE MINISTER OF HEALTH

Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Decree No. 171/2004/NĐ-CP dated September 29, 2004 of the Government stipulating the organization of specialized agencies under the People's Committee of provinces and centrally governed cities;

Pursuant to Circular Joint No. 11/2005/TTLT-BYT-BNV dated April 12, 2005 of the Ministry of Health and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of specialized agencies assisting the People's Committee in managing health affairs at the local level;

At the proposal of the Director of the Personnel Department and the Director of the Reproductive Health Department,

DECISION:

Article 1The attached Decision issuesRegulations on the functions, tasks, powers, and organizational structure of the Reproductive Health Care Center of provinces and centrally governed cities”.

Article 2This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 2792/2000/QĐ-BYT dated September 16, 2000 of the Minister of Health regarding the issuance of the "Regulations on the functions, tasks, and organizational structure of the Maternal and Child Health Protection and Family Planning Centers of provinces and centrally governed cities and the Maternal and Child Health Protection and Family Planning Teams under the District Health Centers."

Article 3Directors of the Office, Heads of the Personnel Department, Heads of the Reproductive Health Department, Directors of Provincial Health Departments and heads of related units are responsible for implementing this Decision./.

Chapter 1:
GENERAL PROVISIONS

Article 1. Position and role

The Reproductive Health Care Center of provinces and centrally governed cities (hereinafter referred to as the Reproductive Health Care Center of provinces) is a public service unit under the provincial Health Department, subject to comprehensive management by the Director of the provincial Health Department, and technical guidance by the Ministry of Health.

Article 2. Legal personality

The Reproductive Health Care Center of provinces has legal personality, has its own headquarters, seal, and can open accounts at the State Treasury.

Chapter 2:
FUNCTIONS, TASKS AND POWERS

Article 3. Function

The Reproductive Health Care Center of provinces has the function of advising the Director of the provincial Health Department on reproductive health care work in the province; organizing and implementing professional and technical activities related to reproductive health care in the province.

Article 4. Tasks and Authorities

1. Developing plans to implement professional and technical tasks related to reproductive health care based on the National Strategy on Reproductive Health Care of the Ministry of Health and the actual situation in the province, submitting them to the Director of the provincial Health Department for approval;

2. Implementing the following activities:

a) Implementing professional and technical activities and providing advice on: Women's health care, maternal health; elderly reproductive health care; family planning; safe abortion; preventing and controlling sexually transmitted infections and reproductive tract infections; adolescent and male reproductive health care; early prevention and treatment of infertility and reproductive cancer; child health care, preventing malnutrition;

b) Directing, guiding, and supervising professional and technical activities related to reproductive health care for medical facilities in the province;

c) Cooperating with the Health Education and Communication Center and mass media organizations in the province to organize and implement information, education, and communication activities related to reproductive health care;

d) Participating in training and retraining in professional and technical fields related to reproductive health care according to the provincial and central plans for specialists and other staff;

đ) Conducting research and participating in scientific research and applying advances in science and technology in the field of reproductive health care;

e) Managing and implementing projects within the national health program objectives and other projects related to reproductive health care assigned by the Director of the provincial Health Department;

g) Organizing and implementing reproductive health care services in accordance with the law; based on local conditions, capacity, and actual needs, the Director of the provincial Health Department shall define, within their authority, the examination, treatment, follow-up, and clinical laboratory tests for cases related to reproductive health care at the Center in accordance with the law;

h) Cooperating with relevant agencies to carry out inspection, supervision, and evaluation of activities under their responsibility;

i) Implementing personnel management, policy implementation, rewards, and disciplinary measures for civil servants and officials, and financial and asset management of the unit in accordance with the law;

k) Implementing statistical and reporting systems in accordance with the law;

l) Performing other tasks and powers assigned by the Director of the provincial Health Department.

Chapter 3:
ORGANIZATIONAL STRUCTURE

Article 5. Organizational Structure

1. The leadership of the Provincial Reproductive Health Care Center consists of a Director and Deputy Directors.

2. Functional departments include:

a) Planning and Finance Department;

b) Organization and Administration Department.

3. Specialized departments include:

a) Women's Health and Family Planning Department;

b) Adolescent and Male Health Care Department;

c) Child Health and Malnutrition Prevention Department;

d) Pharmacy and Clinical Laboratory Department.

Article 6. Staffing and Labor Standards

The staffing and labor standards of the Provincial Reproductive Health Care Center shall be implemented in accordance with the provisions of the law.

Article 7. Operating expenses

1. Health service budget.

2. National health program budget.

3. Fees collected in accordance with the law.

4. Aid and other legitimate sources of funding.

Article 8. Tasks of Departments and Divisions

1. Planning and Finance Division:

a) Develop annual, quarterly, and monthly plans for the Center; organize mid-term and final reviews to assess results, draw lessons from the implementation of these plans;

b) Compile forecasts for medicines, materials, chemicals, and necessary equipment to serve the activities of the Center and related units in reproductive health care on the provincial level;

c) Manage and distribute funds for activities serving reproductive health care according to approved plans, and be responsible for settlement and final accounting in accordance with regulations;

d) Participate in organizing training, scientific research, and professional development for staff of the Center and lower levels;

đ) Summarize all aspects of the Center's activities, collect information, analyze data; implement statistical reporting systems as prescribed;

e) Serve as the focal point for compiling domestic and international projects of the Center.

2. Organization and Administration Division:

a) Manage organizational work and personnel; implement legal policies, rewards, and disciplinary actions;

b) Implement administrative and management tasks to support the Center's operations;

c) Manage the Center's assets;

d) Serve as the focal point for organizing seminars, conferences, training sessions, and communication and health education activities related to reproductive health care.

3. Women's Health and Family Planning Department:

a) Develop and implement plans for women's health care, maternal health, elderly reproductive health, family planning, safe abortion, prevention and treatment of reproductive tract infections, infertility prevention and treatment, early cancer prevention and treatment;

b) Guide, inspect, and supervise specialized technical activities related to women's health and family planning in the province;

c) Serve as the focal point for implementing programs and projects and providing services related to women's health and family planning in accordance with the law.

4. Adolescent and Male Health Care Department:

a) Develop and implement plans for adolescent and male reproductive health care;

b) Guide, inspect, and supervise specialized technical activities related to adolescent and male reproductive health care in the province;

c) Serve as the focal point for implementing programs and projects and providing services related to adolescent and male reproductive health care in accordance with the law.

5. Child Health and Malnutrition Prevention Department:

a) Develop and implement plans for child health care and malnutrition prevention;

b) Guide, inspect, and supervise specialized technical activities related to child health care and malnutrition prevention in the province;

c) Serve as the focal point for implementing programs and projects and providing services related to child health care and malnutrition prevention in accordance with the law.

6. Pharmacy and Clinical Laboratory Department:

a) Develop plans for supplies, equipment, medicines, and chemicals to serve the Center's activities and related units in reproductive health care on the provincial level; manage supplies, equipment, medicines, and chemicals to serve the Center's activities;

b) Conduct clinical laboratory tests to meet the requirements of reproductive health care activities;

c) Implement infection control activities within the scope of reproductive health care;

d) Guide and inspect the implementation of standardized techniques in clinical laboratories according to regulations at the district level and healthcare facilities in the area;

đ) Implement clinical laboratory services related to reproductive health care in accordance with the law./.
