Decision No. 23/2008/QĐ-BGTVT on announcing the opening of the floating oil export terminal for the Golden Lion oil field at block 15-1 offshore the continental shelf of Vietnam

REGARDING THE ANNOUNCEMENT OF OPENING THE FLOATING EXPORT PORT FOR CRUDE OIL FROM THE GOLDEN LION FIELD

IN BLOCK 15-1 OFFSHORE VIETNAM'S CONTINENTAL SHELF

MINISTER OF TRANSPORT

Pursuant to the Maritime Code of Vietnam dated June 14, 2005; Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 71/2006/NĐ-CP dated July 25, 2006 of the Government on management of seaports and maritime channels;

Based on the proposal to announce the opening of the Golden Lion crude oil export port located in Bình Thuận Province submitted by the People's Committee of Bình Thuận Province in Circular No. 5298/UBND-ĐTQH dated November 3, 2008;

At the proposal of the Director of the Infrastructure Department and the Director of the Vietnam Maritime Administration,

DECISION:

Article 1. Announce the opening of the Floating Export Port for Crude Oil from the Golden Lion Field in Block 15-1 offshore Vietnam's continental shelf to serve the export of crude oil from the Golden Lion Field, specifically as follows:

1. Name of the port: Floating Export Port for Crude Oil from the Golden Lion Field;

2. Location: Block 15-1 offshore Vietnam's continental shelf, coordinates 10021'49" N, 108022'37" E (according to the WGS-84 coordinate system);

3. Pilot reception area and quarantine zone (according to the WGS-84 coordinate system):

a) In normal weather conditions: it is the water area limited by a circle with a radius of 01 nautical mile, with the center at the position with coordinates: 10020'00" N, 108026'04" E;

b) In adverse weather conditions: it is the water area limited by a circle with a radius of 02 nautical miles, with the center at the position with coordinates: 10049'00" N, 108017'32" E;

4. Types of ships and tonnage limits of ships allowed to enter and operate: domestic and foreign oil tankers up to 150,000 DWT;

5. Safety zone boundaries around the port area and requirements for ensuring maritime safety: the safety zone distance from the outermost edge of the facilities or from the anchoring position for floating vessels of the Floating Export Port for Crude Oil from the Golden Lion Field is 02 nautical miles. Within this 02 nautical mile range, vessels without assigned tasks shall not anchor.

Article 2. The Vung Tau Maritime Branch shall be responsible for:

1. State management in the maritime sector in the area of the Floating Export Port for Crude Oil from the Golden Lion Field and collect fees as prescribed by law;

2. Based on actual conditions and relevant laws to permit vessels with technical specifications suitable for the design of the port to enter and operate and provide other maritime services to ensure maritime safety, maritime security, and prevent environmental pollution.

Article 3. The investor shall organize operations in accordance with the provisions of this Decision, relevant laws, and operational conditions of the port to ensure its purpose, maritime safety, maritime security, prevention of environmental pollution, and collect fees as prescribed by law.

Article 4. Relevant specialized state management agencies shall organize the implementation of professional activities in the area of the Floating Export Port for Crude Oil from the Golden Lion Field based on the provisions of this Decision and relevant laws.

Article 5. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 6. The Head of the Office of the Ministry, the Inspector General of the Ministry, Heads of Departments under the Ministry, Director of the Vietnam Maritime Administration, Director of the Vung Tau Maritime Branch, Director of the Floating Export Port for Crude Oil from the Golden Lion Field, Heads of related agencies, organizations, and individuals are responsible for implementing this Decision.
