THE MINISTER OF POST AND TELECOMMUNICATIONS

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;

At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Director of the Information Technology Application Department,

DECISION:

Article 1. Position and Functions

The Information Technology Application Department is a subordinate agency under the Ministry of Post and Telecommunications assisting the Minister of Post and Telecommunications in performing state management functions regarding information technology application, organizing the implementation of information technology application activities nationwide.

The Information Technology Application Department has legal personality, its own seal and separate account for transactions in accordance with the law, and its main office is located in Hanoi city.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Information Technology Application Department shall perform the following tasks and powers:

1. Organizing the development and submission to the Minister of national programs, long-term plans, five-year plans, and annual plans on information technology application; Proposing mechanisms and policies to implement approved programs and plans;

2. Directing investment management and participating in the appraisal of information technology application projects; Taking the lead in appraising and providing comments on programs, plans, and projects on information technology application in state agency operations; Organizing the management, evaluation of the current status of information technology application periodically and annually; Organizing the assessment and ranking of information technology application in state agency operations;

3. Participating in the development and implementation of mechanisms, policies, and regulatory documents related to information technology application; Guiding the transfer of technical solutions, technologies, and procedures for information technology application in state agencies;

4. Taking the lead in implementing programs, projects, and initiatives on information technology application according to the division of labor by the Minister; Organizing guidance and coordinating information technology application activities for agencies and organizations throughout the country;

5. Performing the function of the Standing Office of the Steering Committee for the implementation of information technology application in state agency operations;

6. Organizing the development and management of information systems, managing information resources; Advising the Minister in performing state management functions over activities related to the construction of national database systems; Guiding, coordinating, monitoring, and inspecting activities related to the construction of national database systems;

7. Organizing the implementation of training and capacity-building programs to enhance knowledge and skills in information technology application for individuals and organizations through direct or indirect means via the Internet;

8. Performing the function of a national digital signature service provider organization in accordance with the law; Guiding procedures, receiving applications, organizing the review of applications for permission to provide public digital signature services, applications for changes in content, and applications for extension of permits to provide public digital signature services; Promoting the use of digital signatures nationwide;

9. Researching, proposing, and participating in the establishment and maintenance of standards and regulations applicable to information technology application;

10. Researching, proposing, and participating in the establishment of economic-technical norms for information technology;

11. Researching, proposing regulations on software testing for information technology applications and organizing the testing of such software serving state agency operations;

12. Organizing activities to promote information technology application through events, seminars, information and material exchanges via media and other supporting activities;

13. Assisting the Minister in directing and managing the construction, implementation, and maintenance of specialized data transmission networks serving Party and State agencies;

14. Participating in the management and supervision of the construction, implementation, and maintenance of information systems within the Ministry of Post and Telecommunications;

15. Developing and maintaining the operation of the Department's electronic information website, organizing technical support for the provision of administrative services by the Department and the sector;

16. Participating in guiding professional content related to information technology application for specialized agencies serving the preparation of budgets for information technology application by state agencies;

17. Cooperating with relevant agencies and units in inspecting the implementation of regulations on information technology application in accordance with the law on inspection and the delegation of the Minister;

18. Leading and coordinating participation in scientific research and international cooperation activities related to the Department's operational fields;

19. Managing the organization, civil servants, officials, assets, files, and documents of the Department in accordance with the law and the delegation of the Minister;

20. Being proactive in developing related public service activities concerning information technology application, organizing the establishment of public service units to generate additional revenue to expand the scope and scale of operations consistent with the Department's functions in accordance with state regulations and those of the Ministry of Post and Telecommunications; Safeguarding and developing assigned resources;

21. Performing other tasks assigned by the Minister.

Article 3. Organizational Structure and Staffing

1. Leadership of the Bureau:

The Information Technology Application Bureau has a Director and Deputy Directors.

The Director of the Information Technology Application Bureau is responsible to the Minister of Information and Communications and to the law for organizing and implementing the functions, tasks, and authorities assigned.

Deputy Directors assist the Director in directing and managing the Bureau's operations and are responsible to the Director for the tasks delegated to them.

2. Organizational Structure and Staffing:

Departments:

Reviewing the notification of compliance and declaration of conformity with food safety regulations for fortified foods; health foods

- Planning Department

- Investment and Finance Department

- Information Infrastructure Department

- Information Systems Department

- Information and International Cooperation Department

Affiliated Units:

- Government Electronic Center

- National Digital Signature Certification Center

The functions, tasks, and authorities of the affiliated units shall be established by the Director and submitted to the Minister for decision.

The functions, tasks, and authorities of the Departments shall be stipulated by the Director. The working relationships between the Departments and units under the Information Technology Application Bureau shall be regulated by the Director.

The staffing of the Information Technology Application Bureau shall be established by the Director and submitted to the Minister of Information and Communications for decision.

Article 4. Effective date

This Decision takes effect fifteen (15) days from the date of publication in the Official Gazette. Decree No. 08/2005/QĐ-BBCVT dated April 25, 2005, issued by the Minister of Posts and Telecommunications on the functions, tasks, authorities, and organizational structure of the Information Technology Application Bureau, is hereby abolished.

Article 5. Responsibilities for Implementation

The Head of the Office, the Director of the Cadre and Civil Servant Department, the Director of the Information Technology Application Bureau, and the Heads of the agencies and units under the Ministry of Information and Communications are responsible for implementing this Decision./.
