CIRCULAR
Regarding the implementation of the plan to simplify administrative procedures in the field of payment activities and other fields pursuant to the Government's Resolution
on payment activities and other fields
within the scope of management functions

Pursuant to the Law on the State Bank of Vietnam No. 46/2010/QH12 dated June 16, 2010;
Pursuant to the Law on Credit Organizations No. 47/2010/QH12 dated June 16, 2010;
Pursuant to Decree No. 96/2008/NĐ-CP dated August 26, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;
Pursuant to Resolution No. 60/NQ-CP dated December 17, 2010 of the Government on simplifying administrative procedures within the scope of management functions of the State Bank of Vietnam,
The State Bank of Vietnam (hereinafter referred to as the State Bank) amends, supplements, replaces, abolishes, or cancels provisions in documents issued by the State Bank to implement the plan to simplify administrative procedures in the field of payment activities and other fields as follows:
Article 1. Amend and supplement Article 6 Regulation on Issuance, Use, and Management of Bank Card Issuing Organization Codes promulgated together with Decision No. 38/2007/QĐ-NHNN dated October 30, 2007 of the Governor of the State Bank of Vietnam to implement the simplification plan mentioned in Clause 85 Section III Part A Resolution 60/NQ-CP "Article 6. Procedures for Issuing BIN Code as follows:
1. When there is a need to be issued a BIN code, the card issuing organization submits directly or sends via postal service to the State Bank (Payment Department) one Application Form for BIN Code issuance according to Model No. 01 promulgated together with this Regulation;
2. Within five working days from the date of receipt of a valid Application Form, the State Bank shall issue the BIN code to the card issuing organization."
Article 2. Amend and supplement the Regulation on Supplying and Using Cheques promulgated together with Decision No. 30/2006/QĐ-NHNN dated July 11, 2006 of the Governor of the State Bank of Vietnam to implement the simplification plan mentioned in
1. Amending and supplementing Clause 1 of Article 6 as follows:
- An application for blank cheque form registration according to Appendix No. 01.ĐGH promulgated together with this Circular; accompanied by the design dimensions, colors, and detailed elements of the blank cheque form;
- A certified copy of the business license of the cheque supply organization (in case of first-time registration) or a photocopy for subsequent registrations."
2. Supplement Appendix No. 01.ĐGH attached to this Circular into the Regulation on Supplying and Using Cheques promulgated together with Decision No. 30/2006/QĐ-NHNN dated July 11, 2006 of the Governor of the State Bank of Vietnam.
Article 3. Amend and supplement the Regulation on Issuance, Payment, Use, and Provision of Support Services for Bank Card Activities promulgated together with Decision No. 20/2007/QĐ-NHNN dated May 15, 2007 of the Governor of the State Bank of Vietnam to implement the simplification plan mentioned in
Clause 87 Part III Section A Resolution 60/NQ-CP 1. Amend the name of Article 9: as follows:
"Article 9. Conditions and Procedures for Registration of Card Issuance"
2. Supplement Clause 4 into Article 9:
"4. Procedures for Registration of Various Types of Bank Cards
a) When issuing new types of cards, the card issuing organization submits directly or sends via postal service to the State Bank (Payment Department) one set of application materials, simultaneously sending through the Internet the electronic version of the Bank Card Registration Form. The application for bank card registration includes:
- The Bank Card Registration Form (using Unicode font) (according to the model at Appendix No. 02.ĐGH attached to this Circular); and an electronic data file reflecting all elements such as the paper Bank Card Registration Form (transferring the data file by disk or through the network to the address: [email protected]);
- Physical samples of the card;
- Certified copies of contracts with organizations providing support services for bank card activities and related documents (if any), agreements to join international card organizations.
b) The State Bank (Payment Department) is responsible for reviewing the application for bank card registration, except in cases where the application is incomplete or invalid, the staff receiving the application will guide the card issuing organization to supplement or reissue.
c) Within five working days from the date of receipt of complete application materials as stipulated, the State Bank (Payment Department) shall provide a written confirmation of the registration of the card for the card issuing organization."
3. Supplement Appendix No. 02.ĐGH attached to this Circular into the Regulation on Issuance, Payment, Use, and Provision of Support Services for Bank Card Activities promulgated together with Decision No. 20/2007/QĐ-NHNN dated May 15, 2007 of the Governor of the State Bank of Vietnam.
3. Supplement the Rules on Issuance, Settlement, Use, and Provision of Support Services for Bank Card Operations issued together with Decision No. 20/2007/QĐ-NHNN dated May 15, 2007 of the Governor of the State Bank of Vietnam, Appendix No. 02.DGH attached to this Circular.
1. Amend and supplement Clause 1 of Article 2:
"Article 2. Subjects eligible to open deposit settlement accounts
1. The State Bank shall open deposit settlement accounts for the Central Treasury, credit institutions, and foreign bank branches, including:
a) The State Bank (Trading Department) shall open deposit settlement accounts for the Central Treasury, headquarters of credit institutions, Payment Centers, branches of credit institutions authorized to conduct transactions on the Interbank Electronic Payment System, and foreign bank branches.
b) The State Bank branch in provinces and cities shall open deposit settlement accounts for the Treasury, credit institutions, and foreign bank branches within their respective jurisdictions; in cases where accounts are opened outside their jurisdiction, approval in writing from the State Bank is required."
2. Add the following content to Article 4:
"5. Documents for opening deposit settlement accounts at the State Bank
To open a deposit settlement account at the State Bank, the Treasury, credit institutions, and foreign bank branches wishing to open an account must submit directly or send via postal service to the State Bank (Trading Department) or the State Bank branch in the province or city where the account is to be opened one set of documents, including the following papers:
a) An application for opening a deposit settlement account signed by the legal representative of the Treasury, credit institution, or General Director (Director) of the foreign bank branch, accompanied by a sample stamp registration form and signature specimen (in accordance with Form 03a.ĐGH, 03b.ĐGH attached to this Circular).
b) Original or certified copies of documents proving that the Treasury, credit institution, and foreign bank branch have been established in accordance with the law:
- Decision on establishment, business license, business registration certificate.
- Decision on appointment of General Director (Director) or Chairman of the Board of Management (account holder) and Identity Card (Diplomatic Identity Card, Passport) of the account holder.
- Decision on appointment and Identity Card (Diplomatic Identity Card, Passport) of the Chief Accountant, accounting supervisor, or transaction document control officer conducting transactions with the State Bank.
c) In cases where accounts are opened outside the jurisdiction, in addition to the documents specified in points a and b of Clause 1 of this Article, the Treasury, credit institutions, and foreign bank branches must also submit to the State Bank a commitment to comply fully with the State Bank's regulations on opening and using deposit settlement accounts; documents defining the scope of use of deposit settlement accounts outside the jurisdiction and other relevant regulations when participating in interbank electronic payments."
3. Supplement the Regulation on opening and using deposit accounts at the State Bank and credit institutions issued together with Decision No. 1284/2002/QĐ-NHNN2 dated November 21, 2002 of the Governor of the State Bank with Form 03a.ĐGH, 03b.ĐGH attached to this Circular.
Article 5. Amend and supplement Section I Part II of the Electronic Interbank Payment Settlement Technical Procedures issued together with Decision No. 457/2003/QĐ-NHNN dated May 12, 2003 of the Governor of the State Bank of Vietnam to implement the simplification plan set forth in Clause 92 Section III Part A Resolution No. 60/NQ-CP "I. Conditions, standards for bank members participating in interbank electronic payment and procedures for requesting participation in electronic interbank payment settlement. as follows:
Article 8. Conditions, standards for bank members participating in interbank electronic payment and procedures for requesting participation in electronic interbank payment settlement.
1. To become a member participating in interbank electronic payment, banks must meet the following conditions and standards:
a) Required conditions:
- Having a decision on establishment, a license for establishment and operation, a business registration certificate, and being granted a license for operating payment services.
- Having opened a transaction deposit account at the State Bank of Vietnam's branch and ensuring the ability to make payments regularly.
- Having a good record of compliance with cashless payment system regulations, voucher systems, and accounting records.
- Committing to strictly and fully implement all regulations related to interbank electronic payment issued by the State Bank of Vietnam, including:
+ The Regulation on Electronic Fund Transfers.
+ The Regulation on Electronic Interbank Payment Settlement.
+ The Regulation on Information Transmission and Data Processing.
+ The Regulation on Voucher Preparation, Circulation, and Preservation.
+ The Regulation on Accounting in Banking Units.
+ The Regulation on Bank Codes, Vouchers, and Foreign Currencies.
+ The Regulation on Service Fee Collection for Payments.
b) Necessary standards:
- Technical equipment meeting the standards to conduct interbank electronic payment:
+ Having sufficient types of information technology equipment to handle and process payment transactions generated by the bank.
+ Developing appropriate software to connect with the interbank electronic payment system, including connecting to the interbank electronic payment network and security measures to ensure asset safety.
+ Having an information technology infrastructure that meets the standards prescribed by the State Bank of Vietnam and can support interbank electronic payment as well as internal bank payment requirements.
- Generating interbank payment transactions (including check payments, transfers between banks, net settlements, etc.) with a minimum daily volume of 30 transactions.
- Committing to issue guidelines and direct subordinate units to comply with State Bank of Vietnam regulations.
- Committing to adhere to credit discipline regarding overdrafts in market-based payment mechanisms (higher market interest rates) when borrowing from the interbank market, commercial banks, or the State Bank of Vietnam.
- Having a staff with the necessary qualifications to perform accounting and payment operations, including:
+ Banking accounting,
+ Proficiently handling payment operational processes,
+ Being able to handle technical and computerized payment operations.
- Having complete accounting procedures for processing, handling, and preserving accounting documents in accordance with State Bank of Vietnam regulations.
2. Procedures for requesting participation in electronic interbank payment settlement
a) When banks have a need to participate in interbank electronic payment settlement, they submit directly or send via postal service to the provincial branch of the State Bank of Vietnam where the bank requests to open an account (referred to as the main bank) one Application for Participation in Electronic Interbank Payment Settlement (according to Appendix No. 13). Within seven working days from the date of receiving the complete application, the main bank must resolve the request of the banks.
b) After being officially recognized as a member participating in interbank electronic payment settlement by the main bank, the Director of the member bank must send a direct letter to the main bank requesting the issuance of digital signatures and security keys for the staff (Director or authorized representative, Head of Accounting Department or authorized representative, settlement accountant) involved in the technical and operational procedures of interbank electronic payment settlement, clearly defining the tasks and responsibilities of each staff member introduced to carry out specific tasks in electronic interbank payment settlement.
Each staff member of the member bank introduced to participate in the technical and operational procedures of interbank electronic payment settlement will be assigned a digital signature and security key by the main bank according to their functions and responsibilities (as stipulated in Article 9 of the Regulation on Interbank Electronic Payment Settlement).
c) The main bank has the responsibility to notify the list of newly admitted member banks participating in interbank electronic payment settlement to relevant member banks seven days in advance to prepare for electronic interbank payment settlement transactions.
d) Member banks authorized (as stipulated in Clause 2, Article 2 of the Regulation on Interbank Electronic Payment Settlement) must inform the main bank and other member banks of the list of authorized member banks to facilitate electronic interbank payment settlement transactions."
d) Member banks authorized (as stipulated in Clause 2, Article 2 of the Inter-bank Electronic Payment Settlement Rules) shall be responsible for notifying the list of member banks authorized by their own bank to the lead bank and other member banks to implement electronic payment settlement transactions.
Article 6. Amend and supplement some provisions of Circular No. 23/2010/TT-NHNN dated November 9, 2010 on the management, operation, and use of the Interbank Electronic Payment System to implement the simplified scheme as set out in Clause 90, Section III Part A Resolution No. 60/NQ-CP as follows:
1. Amend and supplement Clauses 2 and 3 of Article 45:
“2. Members wishing to participate in low-value payment services must submit one set of documents to the Management Board, including:
- Application for using low-value payment service (Form TTLNH-01);
- Confirmation letter from the Trading Department establishing the net debit limit.
3. Members wishing to participate in debt payment services must submit one set of documents to the Management Board, including:
- Application for using debt payment service (Form TTLNH-01);
- Pre-authorization contract for debt payments among members. The contract must include the following elements:
+ Maximum daily amount that can be paid in debt between members;
+ Maximum amount of a debt payment order without confirmation of debt;
+ Duration of validity of the contract.”
2. Appendix 04.DGH attached hereto replaces Form TTLNH-01 attached to Circular No. 23/2010/TT-NHNN dated November 9, 2010.
1. Amend and supplement Clause 2 of Article 9 to implement the simplified scheme as set out in Clause 93, 94, Section III Part A Resolution No. 60/NQ-CP:
“2. Within ten working days from the date of establishment of a new entity or change leading to the cancellation of the bank code, the individual responsible for managing bank information shall submit a request for issuance or cancellation of the bank code directly or by mail to the State Bank of Vietnam (Department of Information Technology) along with one set of documents of the entity applying for the code, including:
a) Decision of the parent organization regarding establishment, merger, consolidation, division, separation, transformation, dissolution, or cessation of operations;
b) Decision of the State Bank of Vietnam regarding establishment; approval document of the State Bank of Vietnam regarding merger, consolidation, division, acquisition, transformation, or dissolution, cessation of operations (for organizations under the jurisdiction of the State Bank of Vietnam);
c) Court declaration of bankruptcy decision in case of organizational bankruptcy.”
2. Amend and supplement Clause 2 of Article 10 to implement the simplified scheme as set out in Clause 95, Section III Part A Resolution No. 60/NQ-CP:
“2. Within five working days from the date of change in bank information of the entity holding the code, the individual or organization responsible for managing bank information according to Articles 7 and 8 of these Regulations shall submit a request for change in bank information directly or by mail to the State Bank of Vietnam (Department of Information Technology) or through the Bank Code Management application at the Bank Code Information website of the State Bank of Vietnam.”
Article 8. Implementation clause
This Circular takes effect from October 14, 2011.
Article 9. Implementation Organization
The Director of the Office, Heads of relevant units under the State Bank of Vietnam, Governors of the State Bank of Vietnam branches in provinces and centrally-administered cities, and Chairmen of the Boards of Directors (Boards of Members), General Directors (Directors) of credit institutions and other related organizations and individuals are responsible for implementing this Circular./.
