Guidelines for implementing the Agreement and Protocol on Road Transport between the Governments of the Socialist Republic of Vietnam and the People's Republic of China.

Based on the Road Transport Agreement between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China signed on November 22, 1994,

National Identification Markings|||The national identification marking of China is CHN."b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."2. The national identification marking of Vietnam is VN according to the model prescribed in Appendix I of this Circular, issued by the licensing authority when transporting. The Minister of Transport issues Circular guiding the implementation of the Agreement and Protocol on road transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China.

PART I

Article 24DECREE CHThe decision to switch the issuance of coats, overcoats, windbreakers, and down jackets to other uniforms for civil servants working at the National Market Management and Development Agency is decided by the Minister of Industry and Trade.NG

This Circular guides the implementation of the Agreement and Protocol on organization and management of road transport activities between the two countries of Vietnam and China (hereinafter referred to as Vietnam-China).

Article 2.No.1.3.4. Fault

This Circular applies to organizations and individuals related to road transport activities between the two countries of Vietnam-China.

Article 3. Distinctive national symbolsiThe distinctive national symbol of China is CHN.ia

1. The distinctive national symbol of Vietnam is VN according to the model prescribed in Appendix I of this Circular, issued by the licensing authority when transporting. Vehicles of Vietnam must display the distinctive national symbol at the upper right corner of the front windshield (viewed from inside the vehicle) and at the rear center position of the vehicle.

Chapter II

SCOPE OF ACTIVITY OF VEHICLES AND MANAGEMENT AUTHORITIES AT BORDER GATESAUTHORITY, ORGANIZATION MANAGEMENT OF TRANSPORT AT BORDER GATESMOBILE SATELLITE EARTH STATIONThe decision to switch the issuance of coats, overcoats, windbreakers, and down jackets to other uniforms for civil servants working at the National Market Management and Development Agency is decided by the Minister of Industry and Trade.

Article 4. Scope of activity of vehiclesDeputy ministers of ministerial-level agencies,a means of transport

2. The list of bus stations, cargo stations, parking lots, and rest stops serving Vietnam-China road transport is prescribed in Appendices II, III, and Ia of this Circular.

3. Management of transport at border gates belongs to the Department of Transport of provinces adjacent to the Vietnam-China border that have border gates, which are arranged with personnel, equipment, operational funds, and working positions at the border gate to perform assigned functions and tasks.VAccording to regulations;

Article 6. Transport Management Authority at Border Gates

1. The transport management authority at border gates is the Border Gate Transport Management Station under the Department of Transportation of provinces adjacent to the Vietnam-China border that have border gates, which are staffed with personnel, equipment, operational funds, and workstations at the border gate to perform assigned functions and tasks.n lby authorized agencies;in permission for passenger transport and cargo transport on roads (hereinafter referred to as enterprises, cooperatives).无效Enterprises, cooperatives must guide drivers to understand traffic conditions, stations, rest points, and sign systems on the route in China; provide drivers and service staff with a passenger list for the trip to present to authorized agencies when requested. Model Passenger List for Fixed Routes and Contracts is prescribed in Appendices IVb and IVc of this Circular.đổFor scheduled passenger transport, contract-based passenger transport, and tourist passenger transport, while also considering the time of submitting valid applications to issue permits to vehicles based on the principle of issuing permits to vehicles with earlier submitted applications.

2. The Border Gate Transport Management Station has the following responsibilities:

a) Issuing transport permits in accordance with regulations;n lOther (photocopies);

b) Supervising Vietnamese and Chinese vehicles when crossing the border gate;

c) Statistics, updating, and reporting on Vietnam-China road transport activities as required by competent authorities;Vehicle list attached with vehicle registration certificates (photocopies);

d) Cooperating with other functional agencies at the border gate to carry out other tasks as prescribed.

Chapter III

,LICENSE FOR TRANSPORT

Article 7. Conditions for Issuing Transport Permits Commercial presence as defined in Clause 1, Article 3 of Decree No. 11/2016/NĐ-CP dated February 3, 2016 of the Government detailing the implementation of certain provisions of the Labor Code on foreign workers working in Vietnam (hereinafter referred to as Decree No. 11/2016/NĐ-CP) includes the following forms: d) Certificate of liability insurance for third parties still valid in Vietnam and China (photocopies).

1. Vehicles eligible for transport permits belong to enterprises and cooperatives serving passenger transport and cargo transport operations on roads (hereinafter referred to as enterprises and cooperatives).n le) Certificate of technical safety inspection and environmental protection (photocopies); lOn-site inspection by authorized agencies.

2. Official vehicles eligible for transport permits are those serving state agencies, Party agencies, mass organizations, and political social organizations at all levels on official business trips., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Emergency vehicles such as fire trucks, rescue vehicles, disaster relief vehicles, and humanitarian aid vehicles are exempt from obtaining transport permits when performing urgent missions.

3. Enterprises and cooperatives must guide drivers to understand traffic conditions, parking areas, stopping points, sign systems along the route in China; provide drivers and service staff with a list of passengers for the trip to present to competent authorities upon request. See Appendix IVb and IVc of this Circular for the format of the Passenger List for Fixed Routes and Contracts.

4. During the process of reviewing the application, if necessary, photocopies of the above documents will be examined and compared with the originals or additional copies will be requested to be notarized.u Border gate transport management station:无效Issuing transport permit types B, C, F, and G from the second time onwards in a year. For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;Procedure for issuing transport permits and introduction letters requesting issuance of transport permitsFUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSProcedure for issuing introduction letters requesting issuance of transport permits type D, permit type A, E, or transport permit type B, C, F, G for the first time in a year:

5. The number of transport vehicles operating on routes deep within the territories of both countries is determined by the competent authorities of both countries. In cases where many vehicles meet the conditions for obtaining transport permits but the quota prescribed is insufficient to issue permits to all submitted applications, the issuing authority prioritizes vehicles for regular passenger transport, contractual passenger transport, and scheduled passenger transport, while also considering the time of submission of valid applications to issue permits to vehicles based on the principle of first-come, first-served.n lOrganizations and individuals submit one set of application documents to the issuing authority. The issuing authority receives the application, reviews it; if the application needs modification or supplementation, the issuing authority directly informs or sends a written notice of the incomplete contents or required modifications to the organizations or individuals submitting the application. For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;Within three working days from the date of receiving complete and compliant application documents, the General Department of Highway Vietnam or the Department of Transport will issue introduction letters requesting issuance of permit type D or issue transport permits according to the provisions of Clause 1 and 2, Article 10 of this Circular.

Article 8. Application Documents for Type A, B, C, E, F, G Transport Permits

1. Application documents for road transport permits for commercial vehicles:

a) Application form for transport permit according to the model specified in Appendix V of this Circular;

b) Road transport business license for motor vehicles for enterprises and cooperatives engaged in passenger transport and container cargo transport; business registration certificate or enterprise registration certificate with registered transport business for motor vehicles for enterprises and cooperatives engaged in other cargo transport (photocopy); issued Vehicle list attached to vehicle registration certificate (photocopy); issued After issuing transport permit type B, C, F, G for the first time in a year, the General Department of Highway Vietnam or the Department of Transport will notify the list of transport vehicles that have been granted permits to the Border Gate Transport Management Station.

c) Receiving applications and delivering results at the issuing authority or through the postal system.

If the vehicle does not belong to the enterprise or cooperative, additional presentation of one of the following documents is required: financial lease contract; asset lease contract; economic commitment of the vehicle owner to the cooperative applying for the permit (photocopy);nationalSafety technical inspection and environmental protection certificate (photocopy);

d) d) Certificate of civil liability insurance for third parties still valid in the territory of Vietnam and China (photocopy).

Procedure for issuing transport permits type B, C, F, G from the second time onwards in a year: in the Field of Teachers and Educational Institution Managers Drivers present vehicle registration certificates to the Border Gate Transport Management Station., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Based on the list of transport vehicles that have been granted permits notified by the General Department of Highway Vietnam and the Department of Transport, the Border Gate Transport Management Station compares the vehicle registration certificates and issues transport permits according to the authority prescribed in Clause 3, Article 10 of this Circular.to Fees for issuing permits are regulated by the Ministry of Finance.

2. Application documents for official vehicle transport permits:

a) Application form for transport permit according to the model specified in Appendix VI of this Circular;

b) Vehicle list attached to vehicle registration certificate (photocopy);amendc) Safety technical inspection and environmental protection certificate (photocopy);

For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;Reissuing transport permits

d) Certificate of civil liability insurance for third parties still valid in the territory of Vietnam and China (photocopy); Party; e) Invitation letter from the Chinese partner specifying the route, border gate, and invitation period (if the original is not in Vietnamese or English, it must be accompanied by a certified Vietnamese or English translation);

e) f) Decision on official travel issued by the competent authority.

During the review process, if necessary, photocopies of the above documents and materials will be examined and compared with the originals or additional certified copies may be requested.đổ Application for reissuing expired transport permits:

For transport permits type A and E: Enterprises, cooperatives prepare application documents according to Points a and c, Clause 1, Article 8 of this Circular and send them to the issuing authority to request issuance of new transport permits. gFor transport permits type B, C, F, G: Once a year, during the initial permit application period of the year, enterprises, cooperatives prepare application documents for issuance of transport permits including Points a and c, Clause 1, Article 8 of this Circular and send them to the issuing authority. If the old transport permit expires during the year, enterprises, cooperatives (through drivers) present the vehicle registration certificate to the Border Gate Transport Management Station to obtain a new transport permit for the next trip.n ln origin or request foru supplementary copy° with notarization.

Article 9. Documents for Issuing Transport Permits not exceeding Domestic air passenger transport service on regular basic economy class

1. For Vietnamese vehicles:

a) Transport permit type D For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;o be issued by the competent authority of China before submitting the application for transport permit type D, enterprises and cooperatives must request the Vietnam Road Administration to issue an introduction letter to the Chinese competent authority. The application for the introduction letter includes:Deputy ministers of ministerial-level agencies,the application form prescribed in Appendix VII of this Circular, and the transportation permit for oversized, overweight goods or dangerous goods issued by the competent authority of Vietnam (a copy). Implementation in the preceding year The Vietnam Road Administration is responsible for guiding Vietnamese enterprises and cooperatives to contact the competent authority of the Chinese side to apply for the transport permit for oversized, overweight goods or dangerous goods from China. After obtaining the introduction letter from the Vietnam Road Administration, the transportation permits for oversized, overweight goods or dangerous goods from both Vietnam and China, enterprises and cooperatives shall prepare the application for the transport permit type D and submit it to the competent authority of China for issuing the transport permit type D.o For Chinese vehicles:

b) Application for transport permit type D according to the model prescribed in Appendix VIII of this Circular;rime Minister cIntroduction letter issued by the competent authority of the Chinese side (original with certified true copy of the translator's signature among the documents and texts from Chinese to Vietnamese or English in cases where the original does not have bilingual Vietnamese and Chinese or Chinese and English);No.c đ ||| c đdevelopment Transportation permit for oversized, overweight goods or dangerous goods issued by the competent authority of Vietnam (a copy); specialized agency under the People's Committee of the province/city.Transportation permit for oversized, overweight goods or dangerous goods issued by the competent authority of China (certified copy with certified true copy of the translator's signature among the documents and texts from Chinese to Vietnamese or English in cases where the original does not have bilingual Vietnamese and Chinese or Chinese and English);n ld) Certificate of technical safety inspection and environmental protection (certified copy with certified true copy of the translator's signature among the documents and texts from Chinese to Vietnamese or English in cases where the original does not have bilingual Vietnamese and Chinese or Chinese and English);rime Minister ce) Certificate of compulsory third-party liability insurance valid on the territory of Vietnam (certified copy with certified true copy of the translator's signature among the documents and texts from Chinese to Vietnamese or English in cases where the original does not have bilingual Vietnamese and Chinese or Chinese and English).development During the examination and review process, if necessary, copies of the above documents and materials will be reviewed and compared with the originals or require certified copies to be supplemented.

2. Article 10. Authority for Issuing Transport Permits

a) Vietnam Road Administration issues:

Organizations and individuals submit one set of documents to the issuing authority. The issuing authority receives the documents, checks them; if the documents need to be modified or supplemented, the issuing authority directly notifies or through written notice the incomplete contents or modifications required for organizations and individuals who submitted the documents;

b) Documents for reissuing transport permits in case of loss or damage but still within validity period: enterprises and cooperatives submit an application for reissuing the permit according to the model prescribed in Appendix IX of this Circular (applicable to permit types A, D, E).For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract. The procedure for reissuing various types of transport permits is carried out in accordance with the provisions of Article 11 of this Circular. 2. For transport permits types B, C, F, G: Once a year, during the initial permit issuance period of the year, enterprises, cooperatives prepare application files to request issuance of transport permits including

Submitting reports on passenger transportation results as stipulated in Appendix XV of this Circular. Submitting reports on cargo transportation results as stipulated in Appendix XVI of this Circular.

3. Submitting reports on the situation of transport operations as stipulated in Appendix XVII of this Circular.

Article 12. Between the Socialist Republic of Vietnam and the Government of the People's Republic of China; abolish Article 1 of Circular No. 24/2011/TT-BGTVT dated March 31, 2011 of the Ministry of Transport.

1. The Director of the General Department of Transportation of Vietnam is responsible for coordinating with relevant agencies in the transport sector to direct and urge implementation. During the process of implementation, if there are any difficulties arising, organizations and individuals should contact the General Department of Transportation of Vietnam for guidance on resolution. In cases exceeding the authority to resolve, the General Department of Transportation of Vietnam will report to the Ministry of Transport for

Article 13. Extension of Transport Permits and Time for Circulation in Vietnam for Vehicles from China

1. Object to be extended: Vehicles from China whose transport permits have expired or exceeded the time limit for circulation in Vietnam due to valid reasons (natural disasters, accidents, breakdowns that cannot be repaired in time) shall be granted an extension of once for a period not exceeding ten days from the expiration date.đổa. 3. Acceptance and processing of documents:

a) The driver or representative of the organization or enterprise submits one set of documents directly to the competent authority.rime Minister chaving such authority.

b) Within one working day from the date of receiving complete documents in accordance with regulations, the competent authority shall extend the transport permit for the vehicle; in case of non-extension, a written response stating the reason must be provided immediately upon receipt of the documents.logoimmediately issue a written notice stating the reasons on the day of receiving the documents.

4. Authority to extend: Provincial Department of Transportation where the vehicle encounters difficulties, consistent with the scope of operation of the transport permit.No.consistent with the scope of activities stipulated in the transport permit.

Article 14. Registration for Operating Regular Passenger Transport Routes between Vietnam and China

1. Enterprises and cooperatives meeting current conditions may register to operate regular passenger transport routes between Vietnam and China. The operating period for the route is five years.

2. Documents for registering to operate the route include:

a) Application for operating the regular passenger transport route between Vietnam and China in the prescribed form at Appendix XI of this Circular;Deputy ministers of ministerial-level agencies,Plan for operating the regular passenger transport route between Vietnam and China in the prescribed form at Appendix XII of this Circular.

b) Receiving applications and delivering results at the issuing authority or through the postal system.

c) Plan for operating regular passenger transport routes.by the Prime Minister During the review and examination of the documents, if necessary, copies of the documents and materials mentioned will be reviewed and compared with the originals or requested to supplement certified copies.

4. Enterprises and cooperatives submit one set of documents directly or through the postal system to the route management agency. The format for approving the operation of the route is prescribed in Appendix XIII of this Circular.

b) Within three working days from the date of receiving complete documents in accordance with regulations, the route management authority issues a document approving the enterprise or cooperative to commence operations.

c) Supplementing and replacing vehicles operating regular passenger transport routes trEnterprises and cooperatives currently operating on the route have the right to supplement or replace vehicles. Within two working days from the date of receiving complete documents in accordance with regulations, the competent authority shall issue a document approving the supplementation or replacement of vehicles.

Article 15. Supplementing and replacing vehicles.i operating regular passenger transport routes.

Article 16. Suspension of operations on routes, suspension of operations of vehiclesi operating regular passenger transport routes.

Enterprises and cooperatives operating on regular passenger transport routes shall notify the competent management authority at least 10 (ten) days in advance if they cease operations or reduce the number of trips being operated.shall reducing the number of trips of the vehicles currently operating.Upon receipt of the application, the competent authority publicly announces to allow other enterprises and cooperatives to apply for operation.No. Within the specified period, if the enterprise or cooperative violates the transport permit, the issuing authority will notify relevant agencies to handle it according to regulations. trThe enterprise or cooperative must inform the competent management authority before suspending operations on the route.

2. Within a maximum of 02 (two) working days from the date of receiving the application, the competent management authority shall publicly announce to allow other enterprises and cooperatives to register for operation.For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract. strictly

Article 17. Handling Violations

1. The licensing authority shall revoke the transportation permit if the permitted vehicle does not comply with any of the contents specified in the transportation permit or if the enterprise or cooperative goes bankrupt or is dissolved. The procedure for revocation is as follows:

a) The licensing authority shall issue a document to revoke the transportation permit it has issued when the enterprise or cooperative violates the provisions trto service quality and transportation safety; Commercial presence as defined in Clause 1, Article 3 of Decree No. 11/2016/NĐ-CP dated February 3, 2016 of the Government detailing the implementation of certain provisions of the Labor Code on foreign workers working in Vietnam (hereinafter referred to as Decree No. 11/2016/NĐ-CP) includes the following forms: of the transportation permit;

Enterprises and cooperatives engaged in regular passenger transport between Vietnam and China shall have their approval document for operating the regular passenger transport route between the two countries revoked by the route management authority if they violate any of the following circumstances:

a) Violating business conditions causing serious damage to service quality and transportation safety;into discuss and resolve or propose solutions to issues related to road transport between the two countries as stipulated in Article 20 of the Implementing Protocol. trPrepare conditions and organize, manage passenger bus stations, stopover points, warehouses, and parking areas for cargo transport to organize cross-border road transport activities between Vietnam and China. For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;Organize and manage ticket sales activities of ticket agents selling tickets for regular passenger transport routes within the jurisdiction.

b) Being found to intentionally misrepresent information in the registration dossier for operating the route;

c) Not complying with any of the contents of the approval document for operating the route;i People's Committee establishes a border gate transport management station (for border gates without a border gate transport management station);

d) Not engaging in regular passenger transport between Vietnam and China for a period of 06 (six) months from the date of approval to operate the route or ceasing such operations for a continuous period of 06 (six) months;n lGoing bankrupt or being dissolved.

đ) Conducting business not in accordance with the contents recorded in the transport permit;

e) EFFECTIVE DATE AND IMPLEMENTATION

Chapter IV

2. Taking the lead and coordinating with relevant agencies in inspecting and handling Vietnamese and Chinese road transport vehicles and official vehicles crossing the border between the two countries.

3. Printing and distributing national identification plates, transportation permits, and transportation permit templates as stipulated in Appendix XIV of this Circular.

4. Exchanging E, F, G permits with the Chinese side.

5. Developing, implementing, and guiding the implementation of software for managing cross-border road transport between Vietnam and China.Announcing additional lists of bus stations, rest stops, and parking areas for passenger and cargo transport vehicles operating cross-border road transport between Vietnam and China for enterprises and cooperatives to choose from.

6. Exchanging information with the competent authority of China regarding road transport vehicles and drivers engaged in passenger and cargo transport, and related information about traffic violations and hit-and-run accidents.

Article 21. 3. The Police Station of the district bordering the Vietnam-China border: ADJUSTMENT

1. This Circular takes effect from August 15, 2012.

2. This circular ENVIRONMENTIt replaces Circular No. 258/1998/TT-BGTVT dated August 18, 1998, issued by the Ministry of Transport guiding the implementation of the Protocol of the Ministry of Transport of the Socialist Republic of Vietnam and the Ministry of Transport of the People's Republic of China implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China; and it abolishes Article 1 of Circular No. 24/2011/TT-BGTVT dated March 31, 2011, issued by the Ministry of Transport guiding the implementation of certain provisions of the Protocol of the Ministry of Transport of the Socialist Republic of Vietnam and the Ministry of Transport of the People's Republic of China implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China.Deputy ministers of ministerial-level agencies, nước Cộng hòa xã hội chủ nghĩa Việt Nam và Chính phủ nước Cộng hòa nhân dân Trung Hoa; bãi bỏ Điều 1 của Thông tư số 24/2011/TT-BGTVT ngày 31 tháng 3 năm 2011 của Bộ Giao thng8. Article 7 is amended as follows:n lIt also supplements and amends some contents of Circular No. 258/1998/TT-BGTVT dated August 18, 1998, issued by the Ministry of Transport guiding the implementation of the Protocol of the Ministry of Transport of the Socialist Republic of Vietnam and the Ministry of Transport of the People's Republic of China implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China; and Circular No. 10/2006/TT-BGTVT dated November 1, 2006, issued by the Ministry of Transport guiding the implementation of certain provisions of the Agreement and the Protocol implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.Deputy ministers of ministerial-level agencies,The Director of the General Department of Roads of Vietnam is responsible for coordinating with relevant agencies within the transport sector to direct, urge, and monitor the implementation of the provisions of this Circular.

Article 22. Responsibilities of the Director of the Department of Education and Training1. This Circular takes effect from July 8, 2016.

Tổng cục trưởng Tổng cục Đường bộ Việt Nam có trách nhiệm chủ trì phối hợp với các cơ quan có liên quan trong ngành giao thông vận tải chỉ đạo, đôn đNo.During the process of implementation, if any issues arise, organizations and individuals should contact the General Department of Roads of Vietnam for guidance on resolution. In cases exceeding the authority to resolve, the General Department of Roads of Vietnam shall report to the Ministry of Transport for direction on implementation.

2. Trong quá trình triển khai thực hiện, nếu có vướng mắc phát sinh, tổ chức, cá nhân liên hệ với Tổng cục Đường bộ Việt Nam để được hướng dẫn giải quyết. Trường hợp vượt quá thẩm quyền giải quyết, Tổng cục Đường bộ Việt Nam báo cáo Bộ Giao thông vận tải để ch无效 The Head of the Ministry’s Office, the Inspector General of the Ministry, Heads of the various Departments, Directors of Provincial Departments of Transport of cities directly under the Central Government; Heads of relevant agencies, organizations, and individuals are responsible for enforcing this Circular./.

3.
