CIRCULAR
Guidelines on certain provisions regarding cooperation and foreign investment in vocational training under Decree No. 73/2012/NĐ-CP dated September 26, 2012 of the Government on cooperation and foreign investment in the field of education.
Pursuant to the Vocational Training Law dated November 29, 2006;
Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Pursuant to Decree No. 70/2009/NĐ-CP dated August 21, 2009 of the Government stipulating the responsibilities for state management of vocational training;
Pursuant to Decree No. 73/2012/NĐ-CP dated September 26, 2012 of the Government stipulating cooperation and foreign investment in the field of education;
Pursuant to the proposal of the General Director of the Vocational Training Administration;
The Minister of Labor, Invalids and Social Affairs issues this Circular guiding certain provisions on cooperation and foreign investment in the field of vocational training under Decree No. 73/2012/NĐ-CP dated September 26, 2012 of the Government stipulating cooperation and foreign investment in the field of education (hereinafter referred to as Decree No. 73/2012/NĐ-CP),
Chapter 1.
GENERAL PROVISIONS
Article 1. State Management of Vocational Training Institutions with Foreign Investment with foreign investment capital
Vocational training institutions with foreign investment in Vietnam shall be subject to state management in vocational training by the Ministry of Labor, Invalids and Social Affairs, and at the same time be subject to territorial management by the People's Committee of the province or centrally governed city where the institution is located.
Article 2. Regulations on the Organization and Operation of Overseas Vocational Training Representative Offices
The regulations on the organization and operation of overseas vocational training representative offices include the following main contents:
1. Name of the representative office.
2. Objectives and scope of activities.
3. Duration and location of activities.
4. Functions and tasks.
5. Tasks and powers of the head of the representative office and other personnel working at the representative office.
6. Relations with organizations and institutions proposing to establish representative offices.
7. Inspection, supervision, commendation, and handling of violations.
8. Overseas vocational training organizations and institutions must develop and approve the regulations on the organization and operation of overseas vocational training representative offices before registering their activities with the competent authority.
Article 3. Compulsory Subjects for Vietnamese Citizens Studying Foreign Vocational Programs students are Vietnamese citizens studying vocational training programs from foreign countries at vocational training institutions
1. Vietnamese citizens studying at vocational training institutions with foreign investment or vocational training institutions implementing foreign higher vocational college and intermediate vocational school programs must study six common subjects including Politics, Law, Physical Education, National Defense and Security Education, Computer Science, and English (if the teaching program does not use English as the language of instruction) according to the regulations of the Ministry of Labor, Invalids and Social Affairs.
2. Vocational training institutions with foreign investment and vocational training institutions implementing foreign higher vocational college and intermediate vocational school programs must organize teaching and evaluate the learning outcomes of the common subjects specified in Clause 1 of this Article for Vietnamese citizens according to the regulations of the Ministry of Labor, Invalids and Social Affairs.
Article 4. Trades Permitted for Cooperation and Investment
1. Organizations and individuals from abroad are permitted to cooperate and invest in vocational training in the list of code level III within 44 groups of trades as stipulated in Decision No. 38/2009/QĐ-TTg dated March 9, 2009 of the Prime Minister on the issuance of the education and training catalog of the national education system (the list of code level III within 44 groups of trades is specified in Appendix 1 attached to this Circular).
2. Trades not permitted for cooperation and investment are those not included in the list prescribed in Clause 1 of this Article and trades containing content that harms national defense, security, culture, environment, morality, and traditional customs of Vietnam.
Article 5. Registration of Graduation Certificate and Vocational Certificate Templates
1. Foreign-invested vocational training institutions and vocational training institutions that collaborate with foreign vocational training institutions have the responsibility to register graduation certificate and vocational certificate templates with the General Department of Vocational Training under the Ministry of Labor, Invalids and Social Affairs to be recognized for legal validity throughout the territory of Vietnam. The registration of graduation certificate and vocational certificate templates shall be carried out as follows:
a) If issuing graduation certificates and vocational certificates according to the Vietnamese vocational training system, it shall be implemented in accordance with the regulations of the Ministry of Labor, Invalids and Social Affairs;
b) If issuing graduation certificates and vocational certificates belonging to a foreign system, the vocational training institution shall submit one set of documents to the General Department of Vocational Training, including:
- A certified copy of the Investment Certificate;
- A certified copy of the Decision on Permission to Establish a Vocational Training Institution;
- A certified copy of the Permit for Vocational Training Activities;
- Three samples of officially issued graduation certificate or vocational certificate templates for each trade and level of training (each template must be translated into Vietnamese and certified) confirmed by the competent authority for educational and vocational training quality certification from abroad recognized by the Ministry of Labor, Invalids and Social Affairs.
Within twenty working days from the date of receipt of valid documents, the General Department of Vocational Training under the Ministry of Labor, Invalids and Social Affairs will review and confirm the graduation certificate or vocational certificate templates of the vocational training institution.
2. After being confirmed by the General Department of Vocational Training on the graduation certificate or vocational certificate templates, foreign-invested vocational training institutions and vocational training institutions collaborating with foreign vocational training institutions shall implement management and issuance of graduation certificates and vocational certificates in accordance with the regulations of the Ministry of Labor, Invalids and Social Affairs.
Article 6. On Quality Certification of Vocational Training
1. During their operation, vocational training institutions that engage in collaborative training with foreign vocational training institutions and foreign-invested vocational training institutions in Vietnam shall be responsible for:
a) Being self-responsible for the quality of vocational training, regularly implementing self-assessment activities to ensure and improve quality according to Vietnamese or foreign standards. Implementing self-assessment according to foreign regulations or conducting regular quality certification assessments in accordance with Clause 1, Article 4 of Circular No. 42/2011/TT-BLDTBXH dated December 29, 2011, issued by the Minister of Labor, Invalids and Social Affairs, stipulating the procedures for quality certification of vocational training;
b) For foreign-invested vocational training institutions, they must register for quality certification of vocational training no later than three years from the date of receiving permission to operate vocational training for vocational college institutions and no later than two years from the date of receiving permission to operate vocational training for vocational secondary institutions and vocational centers;
c) Training programs of foreign-invested vocational training institutions and joint training programs with foreign vocational training institutions to issue foreign diplomas and certificates must be certified before organizing training in Vietnam;
d) The cycle for implementing quality certification of vocational training shall be carried out in accordance with Clause 2, Article 4 of Circular No. 42/2011/TT-BLDTBXH dated December 29, 2011, issued by the Minister of Labor, Invalids and Social Affairs, stipulating the procedures for quality certification of vocational training.
2. Competent authorities and organizations for certifying the quality of joint training programs and foreign-invested vocational training institutions in Vietnam:
a) The competent authorities and organizations of Vietnam for certifying the quality of joint training programs and foreign-invested vocational training institutions in Vietnam are the Ministry of Labor, Invalids and Social Affairs;
b) Foreign authorities and organizations competent for certifying the quality of joint training programs and foreign-invested vocational training institutions in Vietnam must be recognized by the Ministry of Labor, Invalids and Social Affairs. The recognition process is as follows:
- The foreign vocational training quality certification organization sends two sets of application documents for recognizing the authority to certify the quality of joint training programs or foreign-invested vocational training institutions in Vietnam (hereinafter referred to as the application) to the General Department of Vocational Training. The application includes: A request for recognition of the foreign vocational training quality certification organization authorized to certify the quality of joint training programs or foreign-invested vocational training institutions in Vietnam; A certified copy of the Decision on Establishment or Permission to Establish the foreign vocational training quality certification organization or equivalent documents; A certified copy of the Legal Status Documents of the foreign vocational training quality certification organization; A summary of operational history;
- Within five working days from the date of receipt of the application, the General Department of Vocational Training checks the validity of the application. In case the application is invalid, the General Department of Vocational Training will notify the foreign vocational training quality certification organization in writing to complete the application;
- Within five working days from the date of receipt of a valid application, the General Department of Vocational Training will organize the examination of the application and submit to the Minister of Labor, Invalids and Social Affairs for recognition or non-recognition of the foreign vocational training quality certification organization authorized to certify the quality of joint training programs and foreign-invested vocational training institutions in Vietnam, and publicly announce on the Ministry of Labor, Invalids and Social Affairs' website.
3. Criteria, procedures, and cycles for quality certification of vocational training for joint training program quality certification and foreign-invested vocational training institutions in Vietnam shall be implemented as follows:
a) For vocational training institutions with foreign investment in Vietnam, the criteria, procedures, and quality assessment cycles for vocational training shall be implemented according to the provisions set forth in Decision No. 01/2008/QĐ-BLĐTBXH dated January 17, 2008, of the Minister of Labor, Invalids, and Social Affairs on the system of criteria and standards for vocational secondary school quality assessment; Decision No. 02/2008/QĐ-BLĐTBXH dated January 17, 2008, of the Minister of Labor, Invalids, and Social Affairs on the system of criteria and standards for vocational college quality assessment; Circular No. 19/2010/TT-BLĐTBXH dated July 7, 2010, of the Minister of Labor, Invalids, and Social Affairs on the system of criteria and standards for vocational training center quality assessment; and Circular No. 42/2011/TT-BLĐTBXH dated December 29, 2011, of the Minister of Labor, Invalids, and Social Affairs on the procedures for implementing vocational training quality assessment.
b) For joint training program assessments and vocational training programs of vocational training institutions with foreign investment, if the certificates are issued by foreign vocational training institutions, then the criteria, procedures, and quality assessment cycles for vocational training programs shall follow the regulations of the country where the foreign vocational training institution is legally established and has its main office; if the certificates are issued by Vietnamese vocational training institutions, then the criteria, procedures, and quality assessment cycles for vocational training programs shall be governed by Vietnamese law.
Chapter 2.
JOINT TRAINING
Article 7. Examination, testing, evaluation, graduation recognition, issuance of graduation certificates, and vocational certificatesvocational certificate
1. The examination, testing, evaluation, completion recognition of course subjects, modules, vocational training levels, and graduation recognition shall be carried out in accordance with Vietnamese law if the graduation certificate or vocational certificate is issued by Vietnam; or in accordance with the laws of another country if the graduation certificate or vocational certificate is issued by that country; or in accordance with the specific laws of each party if both parties issue the graduation certificate or vocational certificate.
2. The graduation certificates and vocational certificates of joint vocational training programs are stipulated as follows:
a) Graduation certificates and vocational certificates issued by foreign vocational training institutions must comply with the laws of that country and be recognized by the Ministry of Labor, Invalids, and Social Affairs;
b) Graduation certificates and vocational certificates issued by Vietnamese vocational training institutions must comply with Vietnamese law;
c) Graduation certificates and vocational certificates jointly issued by vocational training institutions participating in joint vocational training programs must comply with the provisions of points a and b of Clause 2 of this Article.
Article 8. Vocational training programs implemented under joint training
1. These are programs that have been certified as meeting quality standards or are programs of vocational training institutions recognized by competent authorities for their quality.
2. The program must specify: the name of the vocational training profession; the level of training or its equivalence to vocational training levels within the Vietnamese vocational training system; training objectives; duration and allocation of training time; list of courses and modules; detailed training programs for each course and module; implementation conditions... The vocational training program must clearly define theoretical study time and practical study time; among which, the minimum practical study time must be at least 60% of the total actual study time.
Article 9. Admissions Objectives Admissions Objectives for Enrolling in Joint Training Programs to Obtain Graduation Certificates and Certificates
Admissions objectives for enrolling in joint training programs to obtain graduation certificates and certificates must meet the following conditions:
1. In cases where the graduation certificate and certificate are issued by a vocational training institution in Vietnam, they must comply with the regulations of Vietnamese law on admission rules for vocational training at the primary vocational level, intermediate vocational level, and college vocational level.
2. In cases where the graduation certificate and certificate are issued by a foreign vocational training institution, they must comply with the conditions for acceptance into study according to each level set by the foreign vocational training institution. These conditions must correspond to the acceptance conditions of the foreign vocational training institution as stipulated in the country of origin and be approved by the Ministry of Labor, Invalids, and Social Affairs.
3. In cases where both a graduation certificate and certificate from a Vietnamese vocational training institution and a graduation certificate and certificate from a foreign vocational training institution are issued simultaneously, the admissions objectives must meet the provisions of Clause 1 and 2 of this Article.
Article 10. Teacher and Lecturer Standards
1. For joint training under a foreign vocational training program, the standards for teachers and lecturers shall be as prescribed by the country providing the program.
2. For joint training under a vocational training program developed jointly by both parties, the standards for teachers and lecturers shall be implemented in accordance with Clause 1 of Article 10 of Decree No. 73/2012/ND-CP.
3. Foreign teachers and lecturers participating in teaching joint training programs in Vietnam must comply with the regulations on foreign labor working in Vietnam as stipulated by Vietnamese law.
Article 11. Procedures and Formalities for Accepting and Reviewing Joint Training Project Proposals industry
1. For Joint Training Projects at the College Level
a) The joint training dossier shall be carried out in accordance with the provisions of Article 14 of Decree No. 73/2012/ND-CP. The proposal for approval of the joint training project with a foreign country shall be jointly signed by all parties and follow the model attached as Appendix 2 to this Circular;
b) Submit six sets of joint training dossiers (including one original set) to the General Department of Vocational Training;
c) Within five working days from the date of receipt of the dossier, the General Department of Vocational Training shall organize the verification of the dossier's validity. If the dossier is not valid, the General Department of Vocational Training shall issue a written response to the parties involved in the joint training project to complete the dossier;
d) Within ten working days from the date of receipt of a valid dossier, the General Department of Vocational Training shall organize the review of the joint training project proposal and submit it to the Minister of Labor, Invalids, and Social Affairs for consideration and decision to approve the joint training project at the college level;
If the joint training project proposal does not meet the approval conditions, within five working days from the date of receipt, the General Department of Vocational Training shall issue a written response to the organization proposing the joint training project and clearly state the reasons;
đ) Within five working days from the date of receipt of the report and review report of the General Director of the General Department of Vocational Training, the Minister of Labor, Invalids, and Social Affairs shall issue a decision to approve the joint training project at the college level;
e) Within two working days from the date of the decision approving the joint training project proposal, the General Department of Vocational Training shall send a copy of the decision approving the joint training project at the college level to the Department of Labor, Invalids, and Social Affairs of the locality where the college vocational school or branch of the college vocational school implementing the joint training project is located for territorial management purposes.
2. For Joint Training Projects at the Intermediate Level
a) The joint training dossier shall be carried out in accordance with the provisions of Article 14 of Decree No. 73/2012/ND-CP. The proposal for approval of the joint training project with a foreign country shall be jointly signed by all parties and follow the model attached as Appendix 2 to this Circular;
b) Submit six sets of joint training dossiers (including one original set) to the Department of Labor, Invalids, and Social Affairs;
c) Within five working days from the date of receipt of the dossier, the Department of Labor, Invalids, and Social Affairs shall organize the verification of the dossier's validity. If the dossier is not valid, the Department of Labor, Invalids, and Social Affairs shall issue a written response to the parties involved in the joint training project to complete the dossier;
d) Within ten working days from the date of receipt of a valid dossier, the Department of Labor, Invalids, and Social Affairs shall organize the review of the joint training project at the intermediate level;
đ) Within five working days from the date of the review results, the Director of the Department of Labor, Invalids, and Social Affairs shall issue a Decision to Approve the Joint Training Project at the Intermediate Level; if the joint training project is not approved, a written response must be issued stating the reasons;
e) Within two working days from the date of the decision approving the joint training project, the Department of Labor, Invalids, and Social Affairs shall send a copy of the decision approving the joint training project at the intermediate level to the General Department of Vocational Training for monitoring and management.
Chapter 3.
VOCATIONAL TRAINING INSTITUTIONS WITH FOREIGN CAPITAL INVESTMENT
Article 12. Regulations on the organization and operation of vocational training institutions with foreign investment vocational training institution with foreign investment capital
1. The regulations on the organization and operation of vocational training institutions with foreign investment shall include the following main contents:
a) Name of the vocational training institution;
b) Tasks and powers of the vocational training institution;
c) Vocational training activities;
d) Tasks and powers of teachers, lecturers, and vocational training management staff;
đ) Tasks and powers of trainees;
e) Organizational structure and personnel of the vocational training institution;
g) Financial resources, facilities, and equipment of the vocational training institution;
h) Relationships between the vocational training institution and enterprises, families, and society;
i) Inspection, supervision, commendation, and handling of violations.
2. Approval of the regulations on organization and operation
Vocational training institutions with foreign investment must establish and approve their organizational operation regulations before registering for vocational training activities with the competent authority.
Article 13. Organizational structure of vocational training institutions with foreign investment, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP functions of a vocational training institution with foreign investment capital
1. For vocational college and vocational secondary school
a) Board of directors (principal, deputy principals);
b) Training department, other specialized departments, faculties, and subject groups;
c) Student classes;
d) Departments serving vocational training.
2. For vocational training centers
a) Director, several deputy directors;
b) Specialized departments including: training, organization, administration, accounting, equipment management;
c) Student classes.
Article 14. Management staff and teachers, lecturers of vocational training institutions with foreign investmenton with foreign investment capital
1. The principal or director of a vocational training institution with foreign investment capital is the legal representative of the institution and is responsible for managing the vocational training activities of the school or center in accordance with Vietnamese law. The person nominated for the position of principal or director must meet the following standards and conditions:
1. The principal or director of a vocational training institution with foreign investment represents the institution before the law and is responsible for managing the vocational training activities of the institution according to Vietnamese law. The person nominated as principal or director must meet the following criteria and conditions:
a) Clear personal history;
b) Hold a master's degree or higher for the principal of a vocational college; hold a bachelor's degree or higher for the principal of a vocational secondary school; hold an associate degree or higher for the director of a vocational training center in a relevant field corresponding to the training tasks of the institution; have undergone training and development in school management;
c) Have at least five years of teaching experience or involvement in vocational training management;
d) The principal or director must ensure that they are not civil servants or state employees.
2. Authority to recognize principals and directors
a) The Minister of Labor, Invalids and Social Affairs recognizes the principal of a vocational college with foreign investment upon the proposal of the organization or individual proposing to establish the college;
b) The Chairman of the People's Committee of the province or centrally governed city recognizes the principal of a vocational secondary school and the director of a vocational training center with foreign investment within their jurisdiction upon the proposal of the organization or individual proposing to establish the school or center.
Article 15. Procedures, formalities, and authority for granting permission to establish vocational training institutions
1. For college-level vocational schools
a) The application dossier for granting permission to establish a college-level vocational school shall be implemented in accordance with Clause 1 of Article 37 of Decree No. 73/2012/NĐ-CP. The application document for granting permission to establish a college-level vocational school shall follow the model set out in Appendix 3 attached hereto.
b) Submit six sets of the application dossier for granting permission to establish a school (including one original set) at the General Department of Vocational Training, Ministry of Labor, Invalids and Social Affairs;
c) Within five working days from the date of receiving a valid dossier, the General Department of Vocational Training shall organize the verification of the validity of the application dossier for granting permission to establish a school in accordance with the regulations.
In case the application dossier for granting permission to establish a school is not valid, within five working days from the date of receipt of the dossier, the General Department of Vocational Training shall issue a response document to the organization or individual requesting permission to establish a school and clearly state the reasons.
d) Within five working days from the date of receiving a complete and valid dossier, the General Department of Vocational Training shall send the application dossier for granting permission to establish a school to the Ministry of Public Security and the People's Committee of the province or centrally-run city where the school's main office is located to seek their opinions.
đ) Within thirty working days from the date of receiving a valid dossier, the General Department of Vocational Training shall prepare a report on the examination and submit it to the Minister of Labor, Invalids and Social Affairs for consideration and decision.
In case the dossier is not valid, within five working days, the General Department of Vocational Training shall issue a response document to the organization or individual requesting permission to establish a school and clearly state the reasons.
e) Within ten working days from the date of receiving the proposal and the examination report on granting permission to establish a foreign-invested college-level vocational school from the Director-General of the General Department of Vocational Training, the Minister of Labor, Invalids and Social Affairs shall issue a decision granting permission to establish a foreign-invested college-level vocational school.
2. For intermediate-level vocational schools and vocational training centers
a) The application dossier for granting permission to establish an intermediate-level vocational school or a vocational training center shall be implemented in accordance with Clause 1 of Article 37 of Decree No. 73/2012/NĐ-CP. The application document for granting permission to establish an intermediate-level vocational school or a vocational training center shall follow the model set out in Appendix 3a attached hereto.
b) Submit six sets of the application dossier for granting permission to establish a school or center (including one original set) at the Department of Labor, Invalids and Social Affairs;
c) Within five working days from the date of receiving a valid dossier, the Department of Labor, Invalids and Social Affairs shall organize the verification of the validity of the application dossier for granting permission to establish a school or center in accordance with the regulations.
In case the application dossier for granting permission to establish a school or center is not valid, within five working days from the date of receipt of the dossier, the Department of Labor, Invalids and Social Affairs shall issue a response document to the organization or individual requesting permission to establish a school or center and clearly state the reasons.
d) Within five working days from the date of receiving a complete and valid dossier, the Department of Labor, Invalids and Social Affairs shall send the application dossier for granting permission to establish a school or center to the provincial or centrally-run city police force to seek their opinions.
đ) Within thirty working days from the date of receiving a valid dossier, the Department of Labor, Invalids and Social Affairs shall prepare a report on the examination and submit it to the Chairman of the Provincial People's Committee for consideration and decision.
e) Within ten working days from the date of receiving the proposal and the examination report on granting permission to establish an intermediate-level vocational school or a vocational training center from the Director of the Department of Labor, Invalids and Social Affairs, the Chairman of the Provincial People's Committee shall issue a decision granting permission to establish a foreign-invested intermediate-level vocational school or vocational training center.
In case the dossier is not approved, within five working days from the date of receipt of the opinion of the Chairman of the Provincial People's Committee, the Department of Labor, Invalids and Social Affairs shall issue a response document to the organization or individual requesting permission to establish a school or center and clearly state the reasons.
g) Within five working days from the date of signing the decision granting permission to establish an intermediate-level vocational school or vocational training center, the person authorized under point đ of this Article shall be responsible for sending the decision granting permission to establish a foreign-invested intermediate-level vocational school or vocational training center to the General Department of Vocational Training, Ministry of Labor, Invalids and Social Affairs for monitoring and management.
3. Foreign-invested vocational training institutions and branch offices of foreign-invested vocational training institutions that have been granted Investment Certificates simultaneously serving as Business Registration Certificates and Licenses for Vocational Training activities prior to the effective date of Decree No. 73/2012/NĐ-CP shall not need to re-examine the conditions for granting permission to establish in accordance with Clause 1 of Article 36 of Decree No. 73/2012/NĐ-CP, but must supplement and complete the dossier within six months from the effective date of Decree No. 73/2012/NĐ-CP to obtain a Decision granting permission to establish a vocational training institution or branch office, specifically:
a) The application document for granting permission to establish a vocational training institution shall follow the model set out in Appendix 3b attached hereto.
b) A certified copy of the Investment Certificate simultaneously serving as a Business Registration Certificate and an adjusted Investment Certificate (if any).
c) An active License for Vocational Training activities.
d) Report on the implementation of the investment project.
đ) Report on the results of vocational training activities over the last three years.
e) The investor shall prepare three sets of the dossier (including one original set) and submit it to the General Department of Vocational Training for the establishment dossier of a college-level vocational school and branch office of a college-level vocational school with foreign investment; submit it to the Department of Labor, Invalids and Social Affairs for the establishment dossier of an intermediate-level vocational school, vocational training center and branch office of an intermediate-level vocational school, vocational training center with foreign investment, at the location where the school or center's main office is situated.
g) Within fifteen working days from the date of receiving valid documents, the Vocational Training General Department shall prepare a verification report to be submitted to the Minister of Labor, Invalids and Social Affairs for consideration and decision on the establishment of vocational colleges and branch schools with foreign investment capital; the Department of Labor, Invalids and Social Affairs shall prepare a verification report to be submitted to the Chairman of the People's Committee of the province for consideration and decision on the establishment of intermediate vocational schools, vocational training centers and branch schools with foreign investment capital.
h) Within two years from the effective date of Decree No. 73/2012/NĐ-CP, vocational training institutions with foreign investment capital that have been granted permission to establish must ensure conditions regarding investment capital, investment quota; material infrastructure and equipment; management staff, teachers, and lecturers according to Articles 28, 29, 30, and 31 of Decree No. 73/2012/NĐ-CP; otherwise, their vocational training activities will be suspended.
Article 16. Procedures and formalities for accepting applications, verifying, and issuing permits for vocational training operations
1. For vocational colleges and their branches
a) The application for vocational training operation shall be carried out in accordance with the provisions of Article 47 of Decree No. 73/2012/NĐ-CP, including:
- A registration document for vocational training operations following the model attached as Appendix 4 issued together with this Circular;
- A registration report for vocational training operations explaining how the vocational college or its branch has met the conditions stipulated in Articles 28, 29, 30, and 31 of Decree No. 73/2012/NĐ-CP (following the model attached as Appendix 4a issued together with this Circular);
b) Submit six sets of application documents for vocational training operations (including one original set) to the Vocational Training General Department under the Ministry of Labor, Invalids and Social Affairs;
c) Within twenty working days from the date of receiving valid documents, the Vocational Training General Department shall organize an actual inspection of the conditions ensuring vocational training operations as prescribed. In cases where the conditions are not met for submission to the Minister of Labor, Invalids and Social Affairs for issuance of a permit for vocational training operations, a written response must be provided, clearly stating the reasons;
d) Within seven working days from the date of the actual inspection, the Vocational Training General Department shall prepare an inspection report to be submitted to the Minister of Labor, Invalids and Social Affairs for consideration and issuance of a permit for vocational training operations for the vocational college or its branch (following the model attached as Appendix 5 issued together with this Circular);
đ) Within two working days from the date of issuance of the permit for vocational training operations, the Vocational Training General Department shall send a copy of the permit for vocational training operations to the Department of Labor, Invalids and Social Affairs at the location where the vocational college or its branch conducts vocational training operations for area-based management.
2. For intermediate vocational schools, vocational training centers
a) The application for vocational training operation shall be carried out in accordance with the provisions of Article 47 of Decree No. 73/2012/NĐ-CP, including:
- A registration document for vocational training operations following the model attached as Appendix 4 issued together with this Circular;
- A registration report for vocational training operations explaining how the intermediate vocational school, vocational training center, or its branch has met the conditions stipulated in Articles 28, 29, 30, and 31 of Decree No. 73/2012/NĐ-CP (following the model attached as Appendix 4a issued together with this Circular).
b) Submit six sets of application documents for vocational training operations (including one original set) to the Department of Labor, Invalids and Social Affairs at the location where the intermediate vocational school, vocational training center, or its branch conducts vocational training operations;
c) Within fifteen working days from the date of receiving complete valid documents, the Department of Labor, Invalids and Social Affairs shall organize an inspection of the conditions ensuring vocational training operations. In cases where the conditions are not met for issuance of a permit for vocational training operations, a written response must be provided, clearly stating the reasons;
d) Within five working days from the date of the actual inspection, the Director of the Department of Labor, Invalids and Social Affairs shall consider and issue a permit for vocational training operations for intermediate vocational schools, vocational training centers, and their branches (following the model attached as Appendix 5a issued together with this Circular);
đ) Within two working days from the date of issuance of the permit for vocational training operations, the Department of Labor, Invalids and Social Affairs shall send a copy of the permit for vocational training operations to the Vocational Training General Department for overall management.
Article 17. Competence to issue licenses for vocational training activities
1. The Minister of Labor - Invalids and Social Affairs shall issue Licenses for vocational training activities for vocational college schools and branch offices of such schools.
2. The Director of the Department of Labor - Invalids and Social Affairs shall issue Licenses for vocational training activities for intermediate vocational schools, vocational training centers, and branch offices of these schools/centers where the vocational training activities are organized.
Article 18. Cases for supplementary registration, adjustment of vocational training activities adjustment of vocational training activities
Vocational training establishments with foreign investment capital that have been issued Licenses for vocational training activities must carry out supplementary registration and adjustment of vocational training activities in the following cases:
1. Increasing the scale of admissions for each trade at the level of vocational college; exceeding 10% for the intermediate vocational level, and 20% for the basic vocational level compared to the admission scale recorded in the License for vocational training activities.
2. Adding new trades to be trained.
3. Supplementing or changing the level of training or adjusting the admission scale among different levels of training and among different trades within the same group of trades.
4. Dividing, splitting, merging, or having changes in investment permits related to the contents recorded in the License for vocational training activities.
5. Moving the main office or branch office to another location, where the main office or branch office is the direct place organizing vocational training activities.
6. Establishing a new branch office that organizes vocational training activities.
Article 19. Documents for supplementary registration, adjustment of vocational training activities
1. The documents for supplementary registration, adjustment of vocational training activities in the cases stipulated in Clauses 1, 2, 3, and 4 of Article 18 of this Circular include:
a) A registration document for supplementary or adjusted vocational training activities (in accordance with the model attached as Appendix 4b to this Circular);
b) A report on supplementary or adjusted vocational training activities explaining how the vocational training establishment or its branch has met the conditions prescribed in Articles 28, 29, 30, and 31 of Decree No. 73/2012/ND-CP (in accordance with the model attached as Appendix 4c to this Circular).
2. The documents for supplementary registration, adjustment of vocational training activities in the cases stipulated in Clauses 5 and 6 of Article 18 of this Circular:
a) For vocational colleges and their branches, they shall be carried out in accordance with the provisions of Clause 1 of this Article;
b) For intermediate vocational schools and vocational training centers: If the supplementary vocational training activities are conducted in the same province or centrally-run city as the main office, then the supplementary license application documents shall be carried out in accordance with the provisions of Clause 1 of this Article; if the supplementary vocational training activities are conducted in a different province or centrally-run city from the main office, in addition to the documents required under Clause 1 of this Article, there must also be:
- A certified copy of the Decision allowing the establishment of a vocational training establishment or opening a branch of a vocational training establishment, or a document from the competent authority regarding the relocation of the main office or branch of a vocational training establishment;
- Regulations on the organization and operation of the vocational training establishment or its branch;
- Reports on the progress of implementing the investment project, the situation of capital contribution and borrowing, and the total amount of investment capital already implemented;
- A list of staff responsible for the branch and the organizational structure of the branch for the case of establishing a branch of a vocational training establishment;
- Training regulations;
- Provisions on inspection, evaluation, and recognition of completion of course subjects, modules, and training levels (if not specified in the training program);
- Samples of certificates to be used.
Article 20. Procedures, formalities, and authority for issuing supplementary and amended vocational training permitson
1. Procedures and formalities for college-level vocational schools
The procedures and formalities for registering supplementary and amended vocational training activities shall be carried out in accordance with Clause 1 of Article 16 of this Circular.
2. Procedures and formalities for intermediate vocational schools and vocational training centers
a) In cases prescribed in Clauses 1, 2, 3, and 4 of Article 18 of this Circular, the procedures and formalities for issuing supplementary vocational training permits shall be carried out in accordance with Clause 2 of Article 16 of this Circular;
b) In cases prescribed in Clauses 5 and 6 of Article 18 of this Circular, the procedures for issuing supplementary vocational training permits shall be as follows:
- In the case of establishing a new branch or transferring the main office or another branch of an intermediate vocational school or vocational training center to a different location within the same province or centrally governed city, the procedures for issuing supplementary vocational training permits shall be carried out in accordance with Clause 2 of Article 16 of this Circular;
- In the case of establishing a new branch or transferring the main office or another branch of an intermediate vocational school or vocational training center to a different location outside the province or centrally governed city where the main office is located, the intermediate vocational school or vocational training center must submit a notification letter to the state agency that issued the permit for the unit's vocational training activities and file the supplementary vocational training activity registration form at the Department of Labor, Invalids, and Social Affairs where the unit's other branch is located, in accordance with Clause 2 of Article 16 of this Circular.
3. Authority for issuing supplementary vocational training permits shall be carried out in accordance with Article 17 of this Circular.
4. Supplementary and amended vocational training permits shall be implemented according to the model specified in Appendices 5b and 5c attached to this Circular.
Chapter 4.
IMPLEMENTATION
Article 21. Responsibilities of the Vocational Training General Department
1. Guide and organize vocational training and capacity-building activities to enhance state management capabilities for Departments of Labor, Invalids, and Social Affairs regarding foreign cooperation and investment in the vocational training sector.
2. Inspect and supervise the implementation of joint training programs; approve the establishment, division, separation, merger, consolidation, dissolution, and operation of vocational training institutions and branches of vocational training institutions with foreign capital; representative offices of foreign vocational training institutions in Vietnam; and allow vocational training activities in accordance with the law.
Article 22. Responsibilities of Departments of Labor, Invalids, and Social Affairs
1. Every six months and annually, compile and report to the Vocational Training General Department and the Ministry of Labor, Invalids, and Social Affairs on joint training activities; approval of the establishment, division, separation, merger, consolidation, dissolution, and operation of intermediate vocational schools, vocational training centers, and branches of vocational training institutions with foreign capital within their jurisdiction.
2. Inspect and supervise joint training activities; approve the establishment, division, separation, merger, consolidation, dissolution of vocational training institutions and branches of vocational training institutions with foreign capital in Vietnam; and allow vocational training activities in accordance with the law.
Article 23. EffectivenessImplementation
1. This Circular takes effect from December 2, 2013.
2. Abolish the provisions on issuing certificates of registration for vocational training activities for college-level vocational schools, intermediate vocational schools, and vocational training centers with foreign capital as stipulated in Circular No. 29/2011/TT-BLDTBXH dated October 24, 2011, issued by the Minister of Labor, Invalids, and Social Affairs on the registration of vocational training activities.
3. During the implementation process, any arising issues or difficulties (if any) should be promptly reported to the Ministry of Labor, Invalids, and Social Affairs for research, revision, and supplementation./.

For the application for permission to operate vocational training at a branch, it is necessary to supplement the list of branch managers and the organizational structure of the branch;
(7) Area of vocational training facility/branch; classrooms; conference hall; working area; library; practical/workshop areas; common technical equipment; dormitory, club; technical, health facilities; facilities serving recreational, cultural, artistic, and sports activities;
(8) If a trade has multiple levels of training (College, Technical College, Secondary), a joint report on infrastructure, equipment; teachers can be submitted;
(9) Evidence files for infrastructure include Land Use Right Certificate or lease, purchase, transfer contracts for training sites. If it is a lease contract for training sites, facilities, and equipment, it must have at least a five-year validity period;
(10) Teacher evidence files:
Each teacher must have the following evidence (photocopies without notarization):
- Employment decision or labor contract (for full-time teachers, lecturers); invited teaching contract (for invited teachers, lecturers);
- Professional degree certificates;
- Vocational pedagogical certificate (if there is no bachelor's degree in technical pedagogy);
(11) Detailed vocational training program attached. A program includes:
- Decision to issue the program by the head of the vocational training institution;
- Detailed vocational training program.
(12) Report on the conditions to ensure vocational training activities for the second trade as for the first trade;
(13) If there is a branch, continue reporting the conditions;

(7) Instructor documentation:
Each instructor/lecturer must have the following proofs (photocopies without notarization):
- Employment decision or labor contract (for full-time teachers, lecturers); invited teaching contract (for invited teachers, lecturers);
- Work permit for foreign instructors/lecturers;
- Professional qualification certificates (certified translations for foreign certificates);
- Vocational pedagogical certificate (if there is no bachelor's degree in technical pedagogy);
(8) Detailed vocational training program attached. A program includes:
- Decision to issue the program by the head of the vocational training institution;
- Detailed vocational training program.
(9) Report on continued conditions ensuring vocational training activities for the second trade as for the first;
(10) If there are sub-campuses, continue reporting on conditions;
