Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Tourism Law on June 14, 2005;
Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
At the proposal of the Minister of Culture, Sports and Tourism,
The Government promulgates the Decision stipulating the functions, tasks, powers, and organizational structure of the Tourism Administration under the Ministry of Culture, Sports and Tourism.
Article 1. Position and Functions
1. The Tourism Administration is an organization under the Ministry of Culture, Sports and Tourism, performing the function of advising and assisting the Minister of Culture, Sports and Tourism in managing state administration and enforcing laws on tourism throughout the country, managing public services related to tourism in accordance with the provisions of the law.
2. The Tourism Administration has legal personality, has a seal in the shape of the National Emblem, has its own account at the State Treasury, and has its headquarters in Hanoi City.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the Minister of Culture, Sports and Tourism for submission to the Government and the Prime Minister to decide:
a) Draft laws, ordinances; draft resolutions of the National Assembly and the Standing Committee of the National Assembly; draft resolutions and decrees of the Government on tourism and other projects and programs assigned by the Minister of Culture, Sports and Tourism;
b) Strategies and overall plans for tourism development; national tourism promotion programs, national tourism action programs, tourism projects and programs, and important national works on tourism; draft decisions and directives of the Prime Minister on tourism;
c) Negotiations, signing, joining international treaties and agreements on tourism in accordance with the law; allowing the establishment of representative offices of foreign tourism organizations and regional organizations in Vietnam;
d) Applications for recognition of national tourist areas, national tourist routes, and national tourist spots.
2. Submit to the Minister of Culture, Sports and Tourism for decision:
a) Long-term, five-year, and annual plans for tourism development; tourism projects and programs;
b) Circulars, decisions, and directives on tourism; regulations on standards and economic and technical norms and other documents in the field of tourism;
c) Regulations on standards, procedures, and files for ranking accommodation facilities, cruise ships, tourist areas, and tourist spots, issuing standard signs for service providers in the tourism industry;
d) Rules for investigating, evaluating, and classifying tourism resources; rules for managing tourist areas within administrative boundaries of two provinces or centrally-administered cities or more;
đ) Regulations on protecting, restoring, developing, exploiting, and using tourism resources and tourism environments in national tourist areas and spots;
e) Regulations and guidelines on conditions, procedures, and files for issuing, changing, reissuing, and revoking tour guide certificates;
g) Serving as the permanent Secretariat of the Tourism Vocational Certificate Issuance Council (VTCB) according to the mutual recognition agreement of ASEAN countries signed by Vietnam in 2009;
h) Regulations on job titles in the tourism sector;
i) Documents guiding the implementation of legal provisions on travel agency operations; accommodation services; tourism promotion and publicity; tourism development planning; tourism area development operations, and other tourism services.
3. The Tourism Administration directs and organizes the implementation of:
a) Guidance, inspection, and responsibility for implementing regulatory documents, strategies, plans, programs, and projects on tourism that have been approved by competent authorities;
b) Organizing domestic and international tourism promotion activities; coordinating regional and local tourism promotion activities according to the division of responsibilities by the Minister of Culture, Sports and Tourism;
c) Developing tourism promotional products, national, regional, and international tourism programs, events, conferences, and exhibitions;
d) Studying, surveying, evaluating, and classifying domestic and international tourism markets; researching and proposing mechanisms and policies for developing tourism markets, products, and human resources;
đ) Building and guiding the use, exploitation, and management of the national tourism database and organizing tourism information at international border gates and tourist areas;
e) Inspecting the implementation of international treaties on tourism signed or joined by the Socialist Republic of Vietnam, international agreements, and internationally-funded tourism programs and projects according to the division of responsibilities by the Minister of Culture, Sports and Tourism and in accordance with the law;
g) Implementing tourism investment projects within the scope of authority assigned by the Minister of Culture, Sports and Tourism and in accordance with the law;
h) Deciding on the ranking and revocation of the ranking of accommodation facilities and cruise ships rated three stars or higher, and high-end categories for vacation homes and apartments according to the law;
i) Issuing, reissuing, extending, changing, amending, supplementing, and revoking international travel agency licenses; issuing, extending, changing, amending, and revoking licenses for establishing branches of foreign tourism enterprises in Vietnam according to the law;
k) Managing the issuance of tour guide cards and tour guide certificate according to the law;
l) Managing subordinate public institutions under the Tourism Administration and organizations providing public services in the tourism sector according to the division of responsibilities by the Minister of Culture, Sports and Tourism;
m) Organizing scientific research, applying technological advancements, and environmental protection in the tourism and tourism resource sectors according to the division of responsibilities by the Minister of Culture, Sports and Tourism;
n) Assisting the Minister of Culture, Sports and Tourism in managing non-governmental organizations and associations in the tourism sector according to the law;
o) Implementing administrative reform according to the goals and content of the administrative reform program approved by the Minister of Culture, Sports and Tourism;
p) Organizing inspections, cooperating in audits, implementing anti-corruption, thrift, and anti-negative practices, and other violations of the law in the tourism sector according to the law;
q) Organizing competitions and awards in tourism activities according to the division of responsibilities by the Minister of Culture, Sports and Tourism and according to the law;
r) Manage the organizational structure, civil servant establishment, job positions, and staff structure by occupational titles and number of personnel in public service units under the Tourism Administration; decide on rotation, transfer, appointment, dismissal, removal from office, retirement, resignation, commendation, and disciplinary actions; implement systems, policies, and coordinate training and development for cadres, civil servants, staff members, and tourism workers according to the classification and regulations of the Minister of Culture, Sports and Tourism and as prescribed by law;
s) Manage financial resources and assets assigned and organize the implementation of the budget allocated according to the provisions of the law;
t) Perform other tasks and authorities delegated by the Minister of Culture, Sports and Tourism and as prescribed by law;

6. Organization and Cadre Department.

11. The Tourism Information Center.
Units specified from Clause 1 to Clause 7 of this Article are organizations assisting the Director General in performing state management functions; units specified from Clause 8 to Clause 11 of this Article are public service units directly subordinate to the Tourism Administration.
The Director of the Tourism Administration shall stipulate the functions, tasks, powers, and organizational structures of the organizations and units under the Tourism Administration.
Article 4. Leadership of the Tourism Administration.
1. The Tourism Administration has a Director General and not more than three Deputy Directors General.
2. The Director General and Deputy Directors General are appointed, dismissed, rotated, and transferred by the Minister of Culture, Sports and Tourism according to the provisions of the law.
3. The Director General of the Tourism Administration is responsible to the Minister of Culture, Sports and Tourism and to the law for all activities of the Tourism Administration. Deputy Directors General of the Tourism Administration are responsible to the Director General and to the law for the areas of work they are assigned.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from May 2, 2014, and replaces Decision No. 63/2008/QĐ-TTg dated May 19, 2008, of the Prime Minister stipulating the functions, tasks, authorities, and organizational structure of the Tourism Administration under the Ministry of Culture, Sports and Tourism.
2. The Minister of Culture, Sports and Tourism, the Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairpersons of provincial People's Committees directly under the central government, and the Director General of the Tourism Administration are responsible for implementing this Decision./.
