Decree No. 15/2017/NĐ-CP The Minister of Agriculture and Rural Development issues this Circular guiding certain provisions of the Livestock Law on management of livestock breeds and breeding products.

On the basis of Fisheries Law 2017;

At the proposal of Director General of the Fisheries General Department,

The Minister of Agriculture and Rural Development issues the Circular stipulating fishing vessel inspectors; recognition of fishing vessel inspection facilities; ensuring technical safety of fishing vessels,developmentfishing patrol vessels; registration of fishing vessels, fisheries service vessels; cancellation of fishing vessel registration and mark ing of fishing vessels.June 2024;This Circular stipulates standards, duties, vocational training, procedures, and formalities for issuing, revoking inspection cards and technical seals for fishing vessel inspectors; recognition of facilities meeting conditions for fishing vessel inspections; ensuring technical safety of fishing vessels, fishing patrol vessels; registration of fishing vessels, fisheries service vessels; cancellation of fishing vessel registration and marking of fishing vessels.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular applies to organizations and individuals related to management, design, construction, modification, repair, and ensuring technical safety of fishing vessels, fishing patrol vessels; registration of fishing vessels, fisheries service vessels.

Article 2. Applicability

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1.  is a person with expertise and vocational skills meeting the standards and being issued an inspection card and technical seal for fishing vessel inspectors to carry out fishing vessel inspections as prescribed by law.Fishing vessel inspection, fishing patrol vessel inspection

2.  is the technical management activity of fishing vessels, fishing patrol vessels, reviewing design documentation, and conducting supervision of technical safety during new construction, modification, annual, dockside, periodic, unscheduled, repair and restoration of fishing vessels, fishing patrol vessels, aiming to ensure technical safety for vessels operating under certain conditions.Technical safety supervision of fishing vessels, fishing patrol vessels

3.  is the process of inspecting and evaluating the compliance of the hull, engine, propulsion system, safety equipment, fishing gear, processing equipment, sorting, processing, preservation equipment installed on fishing vessels, fishing patrol vessels with current technical regulations and national standards.New construction of fishing vessels, fishing patrol vessels

4.  is the process of shipbuilding from laying the keel or similar construction stage until delivery for operation.Modification of fishing vessels, fishing patrol vessels

5.  is the repair work that affects the technical performance of the vessel (changing basic dimensions, replacing the main engine, function, operational area of the vessel).Repair and restoration of fishing vessels, fishing patrol vessels

Chapter II

Article 4. Categories of fishing vessel inspectors

Fishing vessel inspectors are divided into three categories as follows:

1. Category III fishing vessel inspector.

2. Category II fishing vessel inspector.

3. Category I fishing vessel inspector.

3. Inspector of the first class.

Article 5. Third-Class Vessel Inspection Officer

1. Criteria for Third-Class Vessel Inspection Officer:

a) Graduated from a college or higher in one of the relevant technical fields related to fishing vessels, marine vessels, electricity, refrigeration, machine manufacturing, or equipment installation on vessels;

b) Possessing a minimum level 1 proficiency in foreign languages according to the Vietnamese Foreign Language Competency Framework or equivalent;

c) Meeting basic standards for using information technology;

d) Holding a certificate for training in the business of third-class fishing vessel inspection officers;

đ) Having at least one year of practical training in vessel inspection operations at an inspection facility for those with a college degree; six months for those with a bachelor's degree or higher.

2. Duties of Third-Class Vessel Inspection Officer:

Inspecting and evaluating the annual technical condition of various types of fishing vessels according to their specialized training.

Article 6. Second-Class Vessel Inspection Officer

1. Criteria for Second-Class Vessel Inspection Officer:

a) Graduated from a college or higher in one of the relevant technical fields related to fishing vessels, marine vessels, electricity, refrigeration, machine manufacturing, or equipment installation on vessels;

b) Possessing a minimum level 2 proficiency in foreign languages according to the Vietnamese Foreign Language Competency Framework or equivalent;

c) Meeting basic standards for using information technology;

d) Already holding a technical card and stamp for third-class fishing vessel inspection officers and having continuously performed fishing vessel inspection work for at least three years for those with a bachelor's degree; five years for those with a college degree;

đ) Holding a certificate for training in the business of second-class fishing vessel inspection officers.

2. Duties of Second-Class Vessel Inspection Officer:

a) Reviewing technical designs for new construction, modification, restoration, construction design, completion design of fishing vessels, machinery, and equipment installed on fishing vessels according to specialized training;

b) Inspecting and evaluating the technical condition of newly constructed, initial, periodic, dockside, and abnormal conditions of various types of fishing vessels according to specialized training;

c) Inspecting and supervising the manufacture of materials, machinery, and equipment installed on fishing vessels.

In addition to the duties of third-class fishing vessel inspection officers, second-class fishing vessel inspection officers perform the following tasks:

Article 7. First-Class Vessel Inspection Officer

1. Criteria for First-Class Vessel Inspection Officer:

a) Graduated from a bachelor's degree or higher in one of the relevant technical fields related to fishing vessels, marine vessels, electricity, refrigeration, machine manufacturing, or equipment installation on vessels;

b) Possessing a minimum level 3 proficiency in foreign languages according to the Vietnamese Foreign Language Competency Framework or equivalent;

c) Meeting basic standards for using information technology;

d) Already holding a technical card and stamp for second-class fishing vessel inspection officers and having continuously performed fishing vessel inspection work for at least three years;

đ) Holding a certificate for training in the business of first-class fishing vessel inspection officers.

2. Duties of First-Class Vessel Inspection Officer:

In addition to the duties of second-class fishing vessel inspection officers, first-class fishing vessel inspection officers participate in technical appraisals and determine the causes of accidents involving fishing vessels.

Article 8. Training in the Business of Fishing Vessel Inspection Officers

1. The Fisheries General Department organizes training in the business of fishing vessel inspection officers and issues certificates of training in the business of fishing vessel inspection officers.

2. The training program for fishing vessel inspection officers and the criteria for training instructors are stipulated in Appendix I attached to this Circular.

3. Individuals applying for training in the business of fishing vessel inspection officers must submit the following documents:

a) An application form for participation in training in the business of fishing vessel inspection officers according to Form No. 01.DKV in Appendix II attached to this Circular;

b) A copy of the diploma and certificate of specialized qualifications, and presenting the original for verification if submitting directly, or a certified copy if sending through postal service or online (if applicable);

c) Two color photographs (3 x 4 cm).

4. Individuals will be issued a certificate of training in the business of fishing vessel inspection officers according to Form No. 02.DKV in Appendix II attached to this Circular upon completion of the training course in the business of fishing vessel inspection officers and meeting the final examination requirements.

Article 9. Issuance of Technical Cards and Seals for Fishing Vessel Surveyors

1. The authority to issue is the General Department of Fisheries.

2. The documents include:

a) An application form for issuance of technical cards and seals for fishing vessel surveyors according to Form No. 03.DKV attached as Appendix II of this Circular;

b) A copy of the Certificate of Professional Training for fishing vessel surveyors of Class I, II, or III;

c) Two color photographs (3 x 4 cm).

3. Implementation Procedures

a) Individuals submit one set of application documents directly at the General Department of Fisheries or send them through postal services or via electronic means (national single window portal, online public services, electronic software, email, fax) if available;

b) In case of direct submission, the General Department of Fisheries checks the completeness of the application documents and responds immediately upon receipt;

c) In case of submission through postal services or electronic means, within two working days from the date of receipt, the General Department of Fisheries examines the completeness of the application documents; if the documents are incomplete, the General Department of Fisheries issues a written notice requesting supplementation;

d) Within fifteen days from the date of receiving complete application documents, the Director of the General Department of Fisheries decides on the issuance of technical cards and seals for fishing vessel surveyors according to Form No. 04.DKV attached as Appendix II of this Circular; in case of non-issuance, the General Department of Fisheries provides a written response with detailed reasons;

đ) The General Department of Fisheries delivers the results directly at the place where the application was submitted or sends them through postal services;

4. The technical card for fishing vessel surveyors has a validity period of thirty-six months from the date of issuance. Such cards are reissued when they expire or are lost or damaged.

Article 10. Revocation of Technical Cards and Seals for Fishing Vessel Surveyors

1. Fishing vessel surveyors shall have their technical cards and seals revoked if they fall under any of the following circumstances:

a) Submitting falsified application documents to obtain technical cards and seals;

b) Fabricating inspection records or intentionally distorting inspection results;

c) Not adhering to inspection procedures or relevant technical standards for fishing vessels, national standards, and related regulations.

2. The Director of the General Department of Fisheries is responsible for revoking the technical cards and seals of fishing vessel surveyors in cases stipulated in Clause 1 of this Article.

3. Fishing vessel surveyors who violate the provisions in point c of Clause 1 of this Article may only be considered for reissuance of technical cards and seals twelve months after the revocation decision.

Chapter III

RECOGNITION OF ELIGIBLE SURVEYING FACILITIES FOR FISHING VESSELS

Article 11. Issuance of Certificates of Eligibility for Surveying Facilities for Fishing Vessels

1. The authority to issue is the General Department of Fisheries.

2. The documents include:

a) An application form for issuance of certificates of eligibility for surveying facilities for fishing vessels according to Form No. 01.CN attached as Appendix III of this Circular;

b) A list of physical facilities and technical equipment;

c) A list of fishing vessel surveyors;

d) A copy of the Certificate of Quality Management System Application according to ISO 9001 standard (for Class I and Class II surveying facilities); original inspection and supervision procedures for fishing vessels established by the surveying facility (for Class III surveying facilities);

3. Procedures for implementation:

a) Organizations and individuals submit one set of application documents directly at the General Department of Fisheries or send them through postal services or via electronic means (national single window portal, online public services, electronic software, email, fax) if available;

b) In case of direct submission, the General Department of Fisheries checks the completeness of the application documents and responds immediately upon receipt;

c) In case of submission through postal services or electronic means, within two working days from the date of receipt, the General Department of Fisheries examines the completeness of the application documents; if the documents are incomplete, the General Department of Fisheries issues a written notice requesting supplementation;

d) Within twenty days from the date of receiving complete application documents, the General Department of Fisheries completes on-site inspections at the facility, the content and inspection records according to Form No. 02.CN attached as Appendix III of this Circular;

đ) Within ten working days from the end of the inspection, if the inspection results meet the requirements, the General Department of Fisheries issues a certificate of eligibility for surveying facilities for fishing vessels according to Form No. 03.CN attached as Appendix III of this Circular and issues technical seals and professional stamps for fishing vessel surveys. The model of technical seals, professional stamps for fishing vessel surveys, and usage principles are according to Form No. 04.CN attached as Appendix III of this Circular. In case of non-issuance of the certificate of eligibility for surveying facilities for fishing vessels, the General Department of Fisheries provides a written response with detailed reasons;

e) The General Department of Fisheries delivers the results directly at the place where the application was submitted or sends them through postal services;

4. Maintenance inspection of surveying facilities for fishing vessels:

a) The General Department of Fisheries conducts maintenance inspections of recognized surveying facilities for fishing vessels every twenty-four months;

b) The content of maintenance inspections of surveying facilities for fishing vessels is carried out according to Form No. 02.CN attached as Appendix III of this Circular;

c) Inspection results are notified to the surveying facility for fishing vessels no later than ten working days from the end of the inspection. If the surveying facility does not meet the conditions, the General Department of Fisheries decides to revoke the certificate of eligibility for surveying facilities for fishing vessels.补充

2. The documents include:

Article 12. Reissuing the Certificate of Eligibility for Vessel Inspection Facilities

1. The authority to issue is the General Department of Fisheries.

2. The documents include:

a) A request for reissuing the Certificate of Eligibility for Vessel Inspection Facilities according to Form No. 05.CN - Appendix III issued together with this Circular;

b) The original Certificate of Eligibility for Vessel Inspection Facilities in case it is damaged or information has changed.

3. Procedures for implementation:

a) Organizations and individuals submit one set of application documents directly at the General Department of Fisheries or send them through postal services or via electronic means (national single window portal, online public services, electronic software, email, fax) if available;

b) In case of direct submission, the General Department of Fisheries checks the completeness of the application documents and responds immediately upon receipt;

c) In case of submission through postal services or electronic means, within two working days from the date of receipt, the General Department of Fisheries examines the completeness of the application documents; if the documents are incomplete, the General Department of Fisheries issues a written notice requesting supplementation;

d) Within five working days from the date of receiving complete files as prescribed, the Director of the Fisheries General Department shall reissue the Certificate of Eligibility for Vessel Inspection Facilities according to Form No. 03.CN - Appendix III issued together with this Circular; in case the Certificate of Eligibility for Vessel Inspection Facilities cannot be reissued, the Fisheries General Department shall reply in writing and specify the reasons.

đ) The General Department of Fisheries delivers the results directly at the place where the application was submitted or sends them through postal services;

Chapter IV

TECHNICAL SAFETY OF FISHING VESSELS AND INSPECTION VESSELS

Article 13. Inspection of Fishing Vessels and Inspection Vessels

1. Fishing vessels as stipulated in Clause 1, Article 67 of the Fisheries Law, and inspection vessels must undergo inspection.

2. Fishing vessels with a maximum length under twelve meters must be equipped with safety equipment during operation according to Appendix IV issued together with this Circular.

Article 14. Contents of Inspection of Fishing Vessels

1. Review design documentation for new construction, alteration, repair, and restoration of fishing vessels.

2. Supervise technical safety of fishing vessels during new construction, alteration, annually, on slipways, periodically, abnormally, and during repair and restoration.

3. Inspect machinery and equipment required to be inspected and installed on fishing vessels.

4. Participate in technical appraisal and determination of causes of accidents and incidents related to the technical condition of fishing vessels upon request.

5. Inspection of fishing vessels shall be carried out in accordance with technical standards and regulations for fishing vessels and related technical standards and regulations according to Appendix V issued together with this Circular.

Article 15. Forms of Technical Safety Inspection of Fishing Vessels

1. Initial inspection for the following types of vessels:

a) Newly constructed fishing vessels;

b) Fishing vessels that have not been issued a Technical Safety Certificate.

2. Abnormal inspection for fishing vessels involved in accidents, repaired after accidents; at the request of the vessel owner or competent authority.

3. Periodic inspection:

a) Periodic inspection includes: Annual inspection; inspection on slipways; periodic inspection;

b) The period for periodic inspection shall be carried out in accordance with the provisions of technical standards and regulations related to fishing vessels.

Article 16. Review of Design Documentation for Fishing Vessels

1. Fishing vessels with a maximum length of twelve meters or more must have reviewed technical design documentation before new construction or alteration; in the case of newly constructed traditional wooden fishing vessels, they must have reviewed design samples approved by the vessel inspection facility.

2. Authority to review design documentation for fishing vessels:

a) Type I vessel inspection facilities shall review design documentation for new construction, alteration, completion, repair, and restoration of all types of fishing vessels;

b) Type II vessel inspection facilities shall review design documentation for new construction, alteration, completion, repair, and restoration of fishing vessels with a maximum length under twenty-four meters;

c) Type III vessel inspection facilities shall review design documentation for new construction, alteration, completion, repair, and restoration of fishing vessels with a maximum length under fifteen meters.

3. Documents include:

a) A request for reviewing design documentation for fishing vessels according to Form No. 01.BD - Appendix VI issued together with this Circular;

b) Design documentation for fishing vessels (three sets).

4. Procedure for implementation:

a) Organizations and individuals submit one set of documentation directly at the vessel inspection facility as prescribed in Clause 2 of this Article or send through postal service;

b) In case of direct submission: The vessel inspection facility checks the components of the documentation and replies immediately when organizations or individuals submit the documentation;

c) In case of submission through postal service: Within two working days, the vessel inspection facility examines the completeness of the documentation; if the documentation is incomplete, the vessel inspection facility shall notify organizations or individuals in writing to supplement;

d) Within twenty days (for new construction design documentation, first time) or ten working days (for alteration, repair, and restoration design documentation), from the date of receiving complete documentation as prescribed, the vessel inspection facility shall conduct a design review; if the requirements are not met, the vessel inspection facility shall reply to organizations or individuals; if the requirements are met, the vessel inspection facility shall issue a Certificate of Design Review for Fishing Vessels according to Form No. 02.BD - Appendix VI issued together with this Circular and sign and stamp the design documents;

e) The vessel inspection facility shall deliver the results directly at the place where the documentation was received or send through postal service.

Article 17. Issuing the Certificate of Technical Safety for Fishing Vessels

1. The authority to issue the certificate is the vessel inspection facility.

2. The documents include:

a) An application form for issuing the Certificate of Technical Safety for Fishing Vessels according to Model No. 03.BĐ in Appendix VI issued together with this Circular;

b) A copy of the design dossier that has been reviewed (for newly built or modified fishing vessels);

c) In accordance with the construction schedule, organizations or individuals applying for the Certificate of Technical Safety for Fishing Vessels must submit to the vessel inspection facility certified copies of conformity certificates, compliance certificates, and accompanying documents for domestically produced machinery and equipment, or certificates of origin, quality certificates, and technical manuals for installation, operation, and maintenance provided by manufacturers for imported machinery and equipment before installation on the vessel.

3. Procedures for implementation:

a) Organizations or individuals shall submit one set of documents directly at the vessel inspection facility or send them through postal services or via the internet (email, fax) if available;

b) In case of direct submission: The vessel inspection facility checks the components of the documentation and replies immediately when organizations or individuals submit the documentation;

c) In cases where documents are submitted through postal services or via the internet: Within no more than two working days from receipt, the vessel inspection facility will review the completeness of the documents; if the documents are incomplete, the vessel inspection facility will notify the organization or individual in writing to supplement the missing information;

d) Within one working day from the date of receiving complete documents as required, the vessel inspection facility will agree on the time and place for inspection with the organization or individual requesting it;

đ) The vessel inspection facility will conduct technical safety supervision of fishing vessels according to the technical standards for fishing vessels and related technical standards and regulations. If the results are not satisfactory, they will notify the organization or individual in writing with specific reasons; if the results meet the requirements, within three working days from the completion of the inspection, the vessel inspection facility will issue the following documents to the vessel owner:

The Technical Inspection Report of Fishing Vessels according to Models No. 04a.BĐ to No. 04n.BĐ in Appendix VI issued together with this Circular.

The Certificate of Technical Safety for Fishing Vessels according to Model No. 05.BĐ in Appendix VI issued together with this Circular.

The Vessel Inspection Logbook for the first inspection or modification according to Model No. 06.BĐ in Appendix VI issued together with this Circular;

e) The vessel inspection facility will deliver the results directly at the location where the documents were received or send them through postal services.

Article 18. Inspection of Fisheries Surveillance Vessels

1. The content and procedures for inspecting technical safety, reviewing design dossiers, and issuing Certificates of Technical Safety for Fisheries Surveillance Vessels at the vessel inspection facility shall be carried out according to Articles 14, 15, 16, and 17 of this Circular.

2. In cases where the fisheries surveillance vessel management organization selects an inspection facility other than the vessel inspection facility for the inspection of fisheries surveillance vessels, the provisions of the selected inspection organization shall apply.

Chapter V

REGISTRATION OF FISHING VESSELS AND FISHERIES SERVICE VESSELS; DELETION OF FISHING VESSEL REGISTRATION AND MARKING OF FISHING VESSELS

Article 19. Registration of Fishing Vessels and Fisheries Service Vessels

1. Fishing vessels with a maximum length of six meters or more and fisheries service vessels must be registered in accordance with this Circular before being put into operation.

2. At the same time, each fishing vessel or fisheries service vessel can only be registered at one registration agency and can only be issued one registration certificate.

3. The registration agency for fishing vessels and fisheries service vessels is responsible for recording in the National Register of Fishing Vessels according to Model No. 01.ĐKT in Appendix VII issued together with this Circular before issuing the Registration Certificate for Fishing Vessels and Fisheries Service Vessels.

Article 20. Provisions on Registration Number and Name of Fishing Vessels and Fisheries Service Vessels

1. The registration number shall be written on both sides of the vessel's hull at the bow. In cases where small vessels cannot write the registration number on the bow, it shall be affixed to the outside of the cabin wall or sleeping quarters' wall. If the vessel does not have a cabin or sleeping quarters, it shall be written or affixed to any visible part of the vessel.

2. Characters and numbers must be neatly written and clearly legible in Latin script with uniform strokes, contrasting colors between characters/numbers and background for clear visibility.

3. The size of characters and numbers must be proportionate to the size of the vessel, with the stroke thickness of characters and numbers not less than 30 mm and the height of characters and numbers not less than 200 mm. For very small vessels, the size of characters and numbers must ensure clarity and easy visibility.

4. The registration number of fishing vessels consists of three groups of characters (from left to right), separated by a hyphen (-) as follows:

a) The first group: Abbreviated letters of the name of the province or centrally-administered city according to Appendix VIII issued together with this Circular;

b) The second group: Consists of five digits from 00001 to 99999.

c) The third group: Consists of two letters: "TS" (Fisheries).

5. The registration number of fisheries service vessels consists of three groups of characters (from left to right), separated by a hyphen (-) as follows:

a) The first group consists of two letters "KN" for fisheries patrol, inspection, surveillance, monitoring, and control vessels, and "NC" for research and assessment vessels;

b) The second group consists of three digits according to Appendix IX issued together with this Circular;

c) The third group consists of two letters "VN" for centrally-managed vessels or abbreviated letters of the name of the province or centrally-administered city according to Appendix VIII issued together with this Circular for locally-managed vessels.

6. The name of fishing vessels is self-determined by the vessel owner and marked above the cabin wall.

Article 21. Registration of Fishing Vessels and Fisheries Service Vessels

1. Authority for registering fishing vessels and fisheries service vessels:

a) Provincial-level state management agencies for fisheries issue registration for fishing vessels within their jurisdiction;

b) The General Department of Fisheries issues registration for fisheries service vessels.

2. Documents required for newly-built vessels include:

a) Application form for registration of fishing vessels and fisheries service vessels according to Model No. 02.DKT in Appendix VII issued together with this Circular;

b) Original Certificate of Completion issued by the shipbuilding facility owner according to Model No. 03.DKT in Appendix VII issued together with this Circular;

c) Original approval document for new construction for fishing vessels or an approval document from the competent authority for fisheries service vessels;

d) Original receipt for initial registration tax payment or original application form for initial registration fee with confirmation from the tax authority;

đ) Color photograph (9x12 cm, showing the entire vessel from both sides);

e) Certified copy of the Technical Safety Certificate of the vessel (for vessels with a maximum length of 12 meters or more).

3. Documents required for modified vessels include:

a) Documents as specified in points a, d, đ, e of Clause 2 of this Article;

b) Original Modification and Repair Certificate according to Model No. 04.DKT in Appendix VII issued together with this Circular;

c) Original previous registration certificate;

d) Approval document for modification for fishing vessels or an approval document from the competent authority for fisheries service vessels.

4. Documents required for purchased or gifted vessels include:

a) Documents as specified in points a, d, đ, e of Clause 2 of this Article;

b) Original ownership transfer document according to regulations;

c) Approval document for purchase and sale of fishing vessels, except for those sold within the same province or centrally-administered city;

d) Original previous registration certificate attached to the original registration documents of the vessel;

đ) Original cancellation registration certificate.

5. Documents required for imported vessels include:

a) Documents as specified in points a, d, đ, e of Clause 2 of this Article;

b) Certified copy of the import permit for fishing vessels issued by the competent authority;

c) Original cancellation registration certificate accompanied by a certified copy of the Vietnamese translation for previously registered fishing vessels and fisheries service vessels;

d) Certified copy of the customs declaration with confirmation of completed customs procedures;

đ) Certified copy of receipts for taxes paid as prescribed by Vietnamese law.

6. Documents required for bareboat chartered vessels include:

a) Documents as specified in points a, đ, e of Clause 2 and points c, d, đ of Clause 5 of this Article;

b) Original approval document for bareboat charter issued by the competent Vietnamese authority;

c) Original bareboat charter contract.

7. Implementation procedure:

a) Organizations and individuals submit one set of documents directly to the competent authority as stipulated in Clause 1 of this Article or send them through postal services or online (national single window portal, online public services, electronic software, email, fax) if available;

b) In case of direct submission: The competent authority as stipulated in Clause 1 of this Article will check the documents and provide immediate feedback when organizations or individuals submit the documents;

c) In case of submission through postal services or online: Within two working days, the competent authority as stipulated in Clause 1 of this Article will review the completeness of the documents. If the documents are incomplete, the competent authority will notify organizations or individuals in writing to supplement the missing documents;

d) Within three working days from the date of receiving complete documents, the competent authority as stipulated in Clause 1 of this Article is responsible for processing the registration, entering the Fishing Vessel and Fisheries Service Vessel Register, issuing the Fishing Vessel and Fisheries Service Vessel Registration Certificate according to Model No. 05.DKT in Appendix VII issued together with this Circular, and issuing the Fishing Vessel Crew List according to Model No. 06.DKT in Appendix VII issued together with this Circular; if the Registration Certificate is not issued, the competent authority will provide a written response with the reasons;

đ) The competent authority as stipulated in Clause 1 of this Article will deliver the results directly at the place of document submission or send them through postal services.

Article 22. Re-registration of fishing vessels and fisheries service vessels

1. The Certificate of Registration for fishing vessels and fisheries service vessels shall be reissued in the following cases:

a) Lost, torn, or damaged;

b) Change of vessel name, call sign (if any), or technical specifications of the vessel;

c) Change of information of the owner in the Certificate of Registration for fishing vessels;

d) Fishing vessels have reached the expiration date for leasing to foreign organizations or individuals.

b) Change of vessel name, call sign (if any), or technical specifications of the vessel;

2. The documents include:

a) A declaration requesting reissue of the Certificate of Registration for fishing vessels and fisheries service vessels according to Model No. 07.ĐKT Appendix VII issued together with this Circular;

b) Original Certificate of Registration for fishing vessels and fisheries service vessels; in case the Certificate of Registration for fishing vessels is lost, the vessel owner must declare and specify the reason;

c) Certified copy of the Certificate of Technical Safety for fishing vessels;

d) Color photograph (9 x 12 cm, showing the entire vessel from both sides).

3. Procedures for implementation:

a) Organizations and individuals submit one set of documents directly at the competent authority specified in Clause 1, Article 21, or send through postal services or via online environment (national single window portal, online public services, electronic software, email, fax) if available;

b) In case of direct submission of documents: The competent authority specified in Clause 1, Article 21, will check the document components and respond immediately when the organization or individual submits the documents;

c) In case of submission of documents through postal services or online environment: Within no more than two working days, the competent authority specified in Clause 1, Article 21, will examine the completeness of the documents; if the documents are incomplete, the competent authority specified in Clause 1, Article 21, will issue a written notice for the organization or individual to supplement;

d) Within three working days from the date of receiving complete documents as prescribed, the competent authority specified in Clause 1, Article 21, will reissue the Certificate of Registration for fishing vessels and fisheries service vessels. In case of non-reissuance of the Certificate of Registration for fishing vessels and fisheries service vessels, the competent authority will respond in writing and specify the reasons;

đ) The competent authority specified in Clause 1, Article 21, will deliver the results directly at the place where the documents were received or send them through postal services.

4. The Certificate of Registration for fishing vessels and fisheries service vessels that is reissued must retain the original registration number and clearly indicate the issuance time.

Article 23. Temporary Registration of Fishing Vessels and Fisheries Service Vessels

1. Fishing vessels and fisheries service vessels shall be issued a Temporary Certificate of Registration in the following cases:

a) Vessels without a receipt for payment of stamp duty;

b) Newly built vessels moving to their official registration location;

c) Imported vessels or bareboat chartered vessels returning to the first Vietnamese port.

2. The documents include:

a) Declaration requesting issuance of a Temporary Certificate of Registration for fishing vessels and fisheries service vessels according to Model No. 08.ĐKT Appendix VII issued together with this Circular;

b) Certified copy or certified copy and presentation of the original Certificate of Technical Safety for fishing vessels, shipbuilding contract, and acceptance certificate;

c) Certified copy of relevant documents for imported vessels or bareboat chartered vessels returning to the first Vietnamese port, including: Permit for importation or bareboat chartering, cancellation registration certificate for used vessels, shipbuilding contract and termination agreement for newly built vessels, valid technical safety certificate or classification certificate for at least six months issued by the inspection organization of the country where the vessel was registered, business registration certificate for corporate owners, and identity card or citizen identification card for individual owners;

d) Color photograph (9 x 12 cm, showing the entire vessel from both sides).

3. Procedures for implementation:

a) Organizations and individuals submit one set of documents directly at the competent authority specified in Clause 1, Article 21, or send through postal services or via online environment (national single window portal, online public services, electronic software, email, fax) if available;

b) In case of direct submission of documents: The competent authority specified in Clause 1, Article 21, will check the document components and respond immediately when the organization or individual submits the documents;

c) In case of submission of documents through postal services or online environment: Within no more than two working days, the competent authority specified in Clause 1, Article 21, will examine the completeness of the documents; if the documents are incomplete, the competent authority specified in Clause 1, Article 21, will issue a written notice for the organization or individual to supplement;

d) Within three working days from the date of receiving complete documents as prescribed, the competent authority specified in Clause 1, Article 21, will issue a Temporary Certificate of Registration for fishing vessels and fisheries service vessels according to Model No. 09.ĐKT Appendix VII issued together with this Circular; in case of non-issuance of the Temporary Certificate of Registration for fishing vessels and fisheries service vessels, the competent authority will respond in writing and specify the reasons;

đ) The competent authority specified in Clause 1, Article 21, will deliver the results directly at the place where the documents were received or send them through postal services.

4. The Temporary Certificate of Registration for fishing vessels and fisheries service vessels has a maximum validity period of ninety days from the date of issuance.

Article 24. Deletion of Fishing Vessel Registration

1. The dossier shall include:

a) The application for deletion of fishing vessel registration according to Form No. 10.DKT Appendix VII issued together with this Circular;

b) The original Certificate of Fishing Vessel Registration; in case the Certificate of Fishing Vessel Registration is lost, the vessel owner must declare and specify the reason.

"2. Implementation procedures:"

a) Organizations and individuals submit one set of documents directly at the competent authority specified in Clause 1 of Article 21 or send through postal service or via online environment (national single window portal, online public services, electronic software, email, fax) if available;

b) In case of direct submission of documents: The competent authority specified in Clause 1, Article 21, will check the document components and respond immediately when the organization or individual submits the documents;

c) In case of submission of documents through postal services or online environment: Within no more than two working days, the competent authority specified in Clause 1, Article 21, will examine the completeness of the documents; if the documents are incomplete, the competent authority specified in Clause 1, Article 21, will issue a written notice for the organization or individual to supplement;

d) Within three working days from the date of receiving complete documents as prescribed, the competent authority specified in Clause 1 of Article 21 shall issue the Certificate of Deletion of Fishing Vessel Registration according to Form No. 11.DKT Appendix VII issued together with this Circular; in case the Certificate of Deletion of Fishing Vessel Registration is not issued, the competent authority must respond in writing and specify the reason;

đ) The competent authority specified in Clause 1, Article 21, will deliver the results directly at the place where the documents were received or send them through postal services.

3. The Certificate of Deletion of Fishing Vessel Registration shall be issued one original copy to the vessel owner.

4. For fishing vessels that are destroyed, dismantled, or sunk irretrievably as stipulated in Point a Clause 1 of Article 72 of the Fisheries Law, the vessel owner must return the original Certificate of Fishing Vessel Registration to the registration authority within thirty days from the date of destruction, dismantling, or sinking of the fishing vessel (except in cases where the Certificate of Fishing Vessel Registration is lost); the fishing vessel registration authority shall delete the name of the fishing vessel from the National Register of Fishing Vessels.

5. For fishing vessels missing as stipulated in Point b Clause 1 of Article 72 of the Fisheries Law, the registration authority of the missing fishing vessel must announce on mass media. Within thirty days after one year from the date of announcement, the vessel owner of the missing fishing vessel must return the original Certificate of Fishing Vessel Registration to the registration authority (except in cases where the Certificate of Fishing Vessel Registration is lost); the fishing vessel registration authority shall delete the name of the fishing vessel from the National Register of Fishing Vessels.

Article 25. Marking of Fishing Vessels

1. For fishing vessels engaged in fisheries with a maximum length from six meters to less than twelve meters, the entire cabin must be painted blue; in case the vessel does not have a cabin, the entire dry side of the vessel must be painted blue.

2. For fishing vessels engaged in fisheries with a maximum length from twelve meters to less than fifteen meters, the entire cabin must be painted yellow; in case the vessel does not have a cabin, the entire dry side of the vessel must be painted yellow.

3. For fishing vessels engaged in fisheries with a maximum length of fifteen meters or more, the entire cabin must be painted light gray; in case the vessel does not have a cabin, the entire dry side of the vessel must be painted light gray.

Chapter VI

RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

Article 26. General Department of Fisheries

1. Organize, direct uniformly, guide, and inspect activities related to fishing vessel inspection, registration, and fisheries service vessel registration throughout the country.

2. Develop plans for vocational training of fishing vessel inspectors and announce them on the General Department of Fisheries' electronic information website.

3. Uniformly manage technical seals and professional stamps in fishing vessel inspection work; issue and revoke technical seals and professional stamps in fishing vessel inspection work for inspection facilities and fishing vessel inspectors nationwide; guide their use and inspect the management and use of technical seals and professional stamps used in fishing vessel inspection work.

4. Propose the establishment, supplementation, or amendment of technical standards and regulations concerning fishing vessels to be submitted to competent state agencies for promulgation and guidance on their application nationwide.

Article 27. Departments of Agriculture and Rural Development of provinces and centrally governed cities

1. Organize the implementation of regulations on inspection, registration of fishing vessels, and registration of crew members at the local level.

3. Direct the Fishery Service or the Fishing Port Management Organization to confirm changes in crew members or persons working on fishing vessels in the Crew Logbook of Fishing Vessels.

2. Regularly report monthly, quarterly, annually, or urgently to the General Department of Fisheries on the situation of fishing vessel registration according to Model No. 01.BC in Appendix X issued together with this Circular.

Article 28. Inspection Stations for Fishing Vessels

1. Enter into the Fishing Vessel Technical Management Register according to Model No. 02.BC in Appendix X issued together with this Circular before issuing the Certificate of Technical Safety for Fishing Vessels and Fisheries Law Enforcement Vessels.

2. Regularly report monthly, quarterly, annually, or urgently to the Department of Agriculture and Rural Development at the local level, and the General Department of Fisheries on the results of reviewing design documents for fishing vessels and fisheries law enforcement vessels according to Model No. 03.BC in Appendix X issued together with this Circular, and the situation of inspecting fishing vessels and fisheries law enforcement vessels according to Model No. 04.BC in Appendix X issued together with this Circular.

3. Manage and use seals and technical stamps granted according to regulations; supervise the use of technical seals by inspectors under their management. In case the inspection station for fishing vessels is dissolved or transferred to other tasks, the inspection station for fishing vessels shall be responsible for recovering seals and technical stamps granted and submitting them to the General Department of Fisheries.

4. In case seals become worn out or damaged, the inspection station for fishing vessels that is assigned to use the seal must return the old seal to the General Department of Fisheries and submit a written request to engrave a new seal.

Article 29. Units Constructing New or Refitting Fishing Vessels

1. Before commencing construction of new, refitted, or repaired fishing vessels, they must present the construction technology process to the inspection station for fishing vessels (where safety technical inspection is requested); comply with the inspection and supervision steps notified by the inspection station for fishing vessels.

2. Regularly or urgently report to the Department of Agriculture and Rural Development at the local level, and the General Department of Fisheries on the situation of constructing new, refitting fishing vessels according to Model No. 05.BC in Appendix X issued together with this Circular.

Article 30. Inspectors of Fishing Vessels

1. Manage and use the inspector's card and technical seal for fishing vessel inspection in accordance with the intended purpose and legal regulations.

2. Perform the task of inspecting the technical safety of fishing vessels according to their technical expertise and in accordance with the assigned tasks.

3. Use the technical seal for inspectors within the validity period indicated on the inspector's card; in case the inspector's card expires, the inspector may continue using the seal only after the card has been reissued according to regulations.

Article 31. Owners of Fishing Vessels and Fisheries Law Enforcement Vessels

1. Carry on board the original or certified copy of the Registration Certificate for Fishing Vessels and Fisheries Law Enforcement Vessels; the original certificate of technical safety for fishing vessels and related documents concerning fishery activities.

2. Only operate fishing vessels after obtaining the Certificate of Technical Safety and only operate within permitted sea areas.

3. Regularly check the technical condition of the vessel before setting sail for operations.

4. Maintain the technical condition between two inspections and inform the inspector of any damages or incidents discovered since the last inspection, as well as the repair measures taken.

5. Mark fishing vessels and paint the vessel number on the vessel according to regulations and repaint when the number becomes unclear.

Chapter VII

IMPLEMENTING PROVISIONS

Article 32. Transitional Provisions

1. Fishing vessel inspectors appointed before the effective date of this Circular shall continue to maintain their inspector rank until the expiration date of their inspector card.

2. All fisheries law enforcement vessels must re-register according to this Circular before January 1, 2020.

3. Fishing vessels operating before the effective date of this Circular must mark their vessels according to this Circular before January 1, 2020.

Article 33. Effective Date

1. This Circular shall take effect from January 1, 2019.

2. This Circular replaces:

a) Decision No. 96/2007/QD-BNN dated November 28, 2007 of the Ministry of Agriculture and Rural Development promulgating the regulation on inspection of fishing vessels;

b) Decision No. 10/2006/QD-BTS dated July 3, 2006 of the Ministry of Fisheries regulating the registration of fishing vessels and crew members;

c) Circular No. 13/2013/TT-BNNPTNT dated February 6, 2013 of the Ministry of Agriculture and Rural Development regulating fishing vessel inspectors;

d) Circular No. 02/2007/TT-BTS dated July 13, 2007 of the Ministry of Fisheries guiding the implementation of Decree No. 66/2005/NĐ-CP dated May 19, 2005 of the Government on ensuring safety for people and fishing vessels engaged in fishery activities;

đ) Decision No. 122/2008/QD-BNN dated December 18, 2008 of the Ministry of Agriculture and Rural Development promulgating regulations on seal models and usage rules for technical and professional seals in fishing vessel inspection work;

e) Circular No. 25/2013/TT-BNNPTNT dated May 10, 2013 of the Ministry of Agriculture and Rural Development detailing the implementation of certain provisions of Decree No. 33/2010/NĐ-CP dated March 31, 2010 of the Government on managing fishing activities by organizations and individuals of Vietnam in various sea areas and detailing the implementation of Article 3 of Decree No. 53/2012/NĐ-CP dated June 20, 2012 of the Government amending and supplementing certain provisions of decrees in the field of fisheries;

g) Directive No. 54/2008/CT-BNN dated April 21, 2008 of the Ministry of Agriculture and Rural Development on strengthening the management of fishing vessels and addressing the issue of unregistered fishing vessels operating in various waters;

3. This Circular abolishes:

a) Article 5 and Article 6 of Circular No. 24/2011/TT-BNNPTNT dated April 6, 2011 of the Ministry of Agriculture and Rural Development amending, supplementing, and abolishing certain administrative procedures in the fisheries sector according to Resolution No. 57/NQ-CP dated December 15, 2010 of the Government.

b) Clause 5 of Article 14 and Point d of Clause 2 of Article 15 of Circular No. 12/2014/TT-BNNPTNT dated April 8, 2014 of the Ministry of Agriculture and Rural Development stipulates the emblem, flag, traditional flag, uniform, sample card of Fisheries Inspector, and paint color of Fisheries Inspection vessel.

4. During the implementation process, if any issues arise or difficulties occur, organizations and individuals shall promptly report to the General Department of Fisheries for consolidation and reporting to the Minister of Agriculture and Rural Development for consideration and decision.
