CIRCULAR

ISSUING REGULATIONS ON FORENSIC PSYCHIATRIC EXAMINATION PROCEDURES AND FORMS FOR USE IN SUCH EXAMINATIONS

 IN FORENSIC PSYCHIATRIC EXAMINATIONS

Pursuant to the Law on Forensic Appraisal No. 13/2012/QH13 dated June 20, 2012;

Pursuant to the Government's Decree No. 75/2017/NĐ-CP dated June 20, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Department of Medical Examination and Treatment;

The Minister of Health issues this Circular on forensic psychiatric examination procedures and forms for use in forensic psychiatric examinations.

Article 1. Forensic psychiatric examination procedures and forms for use in forensic psychiatric examinations

1. Appendix 1 to this Circular provides the forensic psychiatric examination procedures.

2. Appendix 2 to this Circular provides the forms for use in forensic psychiatric examinations upon request of competent authorities (hereinafter referred to as "upon request"), specifically as follows:

a) Form No. 1: Record of handover and receipt of case files for forensic psychiatric examination.

b) Form No. 2: Record of receiving the person under examination who is currently detained.

c) Form No. 3: Record of handover of the person under examination who is currently detained.

d) Form No. 4: Record of receiving the person under examination who is not currently detained.

đ) Form No. 5: Record of handover of the person under examination who is not currently detained.

e) Form No. 6: Record of the forensic psychiatric examination process upon request.

g) Form No. 7: Conclusion of forensic psychiatric examination upon request.

h) Form No. 8: Record of the forensic psychiatric re-examination process upon request or special examination upon request.

i) Form No. 9: Conclusion of forensic psychiatric re-examination upon request or special examination upon request.

k) Form No. 10: Record of verification of the person under examination upon request or upon demand.

3. Appendix 3 to this Circular provides the forms for use in forensic psychiatric examinations upon request of organizations and individuals (hereinafter referred to as "upon request"), specifically as follows:

a) Form No. 1: Record of handover and receipt of case files for examination upon request.

b) Form No. 2: Record of receiving the person under examination upon request.

c) Form No. 3: Record of handover of the person under examination upon request.

d) Form No. 4: Record of the forensic psychiatric examination process upon request.

đ) Form No. 5: Conclusion of forensic psychiatric examination upon request.

Article 2. Effective Date

1. This Circular takes effect from November 1, 2019.

2. Circular No. 18/2015/TT-BYT dated July 14, 2015 of the Minister of Health on forensic psychiatric examination procedures and forms for use in forensic psychiatric examinations shall be repealed from the date this Circular takes effect.

Article 3. Reference Provisions

In cases where the documents cited in this Circular and its appendices are replaced or amended, they shall be implemented according to the replacement or amendment documents.

Article 4. Responsibilities for Implementation

1. The Department of Medical Examination and Treatment - Ministry of Health shall be responsible for implementing this Circular.

2. The Heads of the Office of the Ministry, the Inspectorate of the Ministry, the Heads of Departments, Directors of the General Departments, the Director of the Health Services of provinces and centrally governed cities, forensic examination organizations, forensic psychiatric examination organizations, and other relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.

During implementation, if there are difficulties or obstacles, the agencies, organizations, and individuals concerned are requested to promptly report to the Ministry of Health (Department of Medical Examination and Treatment) for consideration and resolution./.
