CIRCULAR

Guidelines for Implementing the System of Statistics and Periodic Reporting on Occupational Accidents

- Based on Article 108 of the Labor Code dated June 23, 1994;

- Based on Decree No. 06/CP dated January 20, 1995 of the Government detailing certain provisions of the Labor Code regarding occupational safety and health;

The Ministry of Labor, Invalids, and Social Affairs guides the implementation of the system of statistics and periodic reporting on occupational accidents as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. The subjects to which this applies include the following entities (referred to collectively as the premises):

- State-owned enterprises;

- Enterprises and production and business service establishments belonging to various economic sectors;

- Individuals using labor to conduct production and business activities;

- Foreign-invested enterprises, enterprises within export processing zones, industrial parks;

- Public service units, production and business service units under administrative agencies, political social organizations, people's mass organizations; enterprises under the People's Army and the People's Public Security Forces;

- Administrative public service agencies;

- Agencies and organizations of political social organizations, people's mass organizations;

- Foreign or international organizations in Vietnam that employ Vietnamese workers.

2. General principles for implementing the system of statistics and periodic reporting on occupational accidents:

a. All occupational accidents where the injured worker must take leave from work for one day or more must be recorded and reported periodically;

If the premise has its main office located in a particular locality, the direct employer must report periodically about occupational accidents to the Department of Labor, Invalids, and Social Affairs in that locality and the immediate superior management agency (if any);

c. Occupational accidents in the fields of radiation, oil exploration and exploitation, road transport, railway, waterway, air transport, and premises under the People's Army and the People's Public Security Forces, in addition to reporting to the Labor, Invalids, and Social Affairs agency and the immediate superior management agency (if any), must also report to the specialized State management agency for occupational safety and health at the central level;

d. During the reporting period, if no occupational accidents occur, the premise must still submit a written report clearly stating "no occupational accidents occurred."

II. REGIME OF STATISTICS AND PERIODIC REPORTING ON OCCUPATIONAL ACCIDENTS:
1. The regime of statistics on occupational accidents shall be implemented as follows:

Premises must record all cases of occupational accidents involving workers under their management according to Appendix No. 1. In this appendix, attention should be paid when entering information into certain columns in the occupational accident statistics form:

- Column 11: Record the factors causing injury according to Appendix 1A;

- Column 12: Mark an asterisk (x) for cases where death occurs at the time of the occupational accident or during initial treatment;

- Column 13: Mark an asterisk (x) for serious occupational accidents according to Appendix 1B;

- Column 14: Mark an asterisk (x) for remaining occupational accidents (minor occupational accidents).

2. The regime of periodic reporting on occupational accidents shall be carried out as follows:

a. Premises must compile the situation of occupational accidents for the first six months of the year and for the entire year according to Appendix No. 2; report to the Department of Labor, Invalids, and Social Affairs before July 10 for the mid-year report and before January 15 of the following year for the annual report;

b. The Department of Labor, Invalids, and Social Affairs and specialized State management agencies for occupational safety and health at the central level must compile the situation of occupational accidents for the first six months of the year and for the entire year according to Appendix No. 3; report to the Ministry of Labor, Invalids, and Social Affairs (Labor Protection Department) before July 20 for the mid-year report and before January 31 of the following year for the annual report.

III. IMPLEMENTATION:

1. The regime of statistics and periodic reporting on occupational accidents pursuant to this Circular shall take effect from January 1, 1997. Provisions on statistics and periodic reporting on occupational accidents prior to this Circular are hereby abolished.

2. Provincial Departments of Labor, Invalids, and Social Affairs directly under the Central Government are responsible for disseminating and guiding the implementation of this Circular to all premises in their localities.

3. Ministries, sectors, and localities are responsible for directing and supervising premises under their management to properly implement the regime of statistics and periodic reporting on occupational accidents.

4. Ministries and sectors at the central level, based on the regulations on the regime of statistics and periodic reporting on occupational accidents in this Circular, shall provide specific guidance suitable to the characteristics of their sector to compile the situation of occupational accidents at premises under their direct management.

Any difficulties encountered during implementation should be reported by ministries, sectors, and localities to the Ministry of Labor, Invalids, and Social Affairs for study and resolution.
