JOINT CIRCULAR

GUIDELINES ON REGIME OF WORK AND RESPONSIBILITY ALLOWANCES FOR TEACHERS SERVING AS HEADS OF THE HO CHI MINH YOUTH UNION

Pursuant to Decree No. 25/CP dated May 23, 1993 of the Government on the temporary regulations for new salary system for civil servants, administrative and public service officials, and armed forces personnel;

Pursuant to Decision No. 243/CP dated June 25, 1979 of the Council of Ministers (now the Government) on the organization and staffing of general education schools;

Pursuant to Decree No. 90/CP dated November 24, 1993 of the Government on the framework of the national education system;

Pursuant to Circular No. 5742/KTTH dated October 10, 1995 of the Prime Minister on the settlement of responsibility allowances for teachers serving as Heads of the Youth Union in general education schools.

The Joint Circular of the Government Organization and Civil Service Board, Ministry of Education and Training, Ministry of Finance, and Central Committee of the Communist Youth Union of Ho Chi Minh City guides the selection and utilization of teachers serving as Heads of the Ho Chi Minh Youth Union in general education schools as follows:

I. OBJECTS, SELECTION CRITERIA, APPOINTMENT OF TEACHERS TO SERVE AS HEADS OF THE YOUTH UNION

1. Objects and criteria:

Teachers from schools aged between 18 and 35 who meet the following criteria shall be selected and appointed as Heads of the Youth Union in general education schools.

1.1. Possess good moral qualities, be exemplary (if within the age range for developing members, they must be members of the Ho Chi Minh Communist Youth Union).

1.2. Be enthusiastic and have talent for organizing social activities, understand youth organizations, be healthy enough... and know how to mobilize students, social forces, and all people to participate in Youth Union work.

1.3. Hold a teaching qualification certificate (secondary teacher training, college teacher training, university teacher training).

In particular, for mountainous provinces, highland areas, remote regions, islands, and far-flung areas, the requirement is to hold a teaching qualification certificate (in accordance with the Ministry of Education and Training's regulations on training teachers for mountainous provinces, highland areas, remote regions, and islands).

1.4. Have been trained or furthered in vocational skills related to Youth Union work.

2. Appointment of teachers to serve as Heads of the Youth Union:

Based on the objects and selection criteria, the Principal, together with the Ho Chi Minh Communist Youth Union organization of the school, will jointly propose to the Department of Education and Training of the district (city district, town, provincial city directly under the province) or the Provincial Department of Education and Training according to the management level of civil servants and officials for review and approval.

The Department of Education and Training or the Provincial Department of Education and Training will issue a decision appointing teachers as Heads of the Youth Union after reaching a consensus with the County (district, town, provincial city directly under the province) Youth Union Council.

II. LABOR REGIME AND STAFFING OF TEACHERS SERVING AS HEADS OF THE YOUTH UNION

1. The term of appointment for teachers serving as Heads of the Youth Union is at least five years.

2. Full-time Heads of the Youth Union are exempt from teaching cultural subjects. Part-time Heads of the Youth Union must participate in teaching some hours or some sessions as follows:

- Substitute for sick or maternity leave teachers.

- Or may teach the number of periods prescribed for one class (or several classes) in their subject.

If due to a shortage of teachers or professional requirements, the principal assigns full-time or part-time Heads of the Youth Union to teach beyond the regular schedule, the additional hours or sessions taught will be counted as overtime teaching time and paid according to the current overtime teaching rate.

3. Teaching load of teachers serving as Heads of the Youth Union:

All primary schools, lower secondary schools (grades 1-2), middle schools (grade 2); upper secondary schools (grades 2-3):

3.1. In highland, island, and remote areas:

- Schools with more than 19 classes: Full-time Heads of the Youth Union do not teach. If a full-time Head of the Youth Union is assigned to teach, the hours or sessions taught will be paid according to the current overtime rate.

- Schools with 10 to 19 classes: Part-time Heads of the Youth Union teach three periods per week in middle schools or three sessions per week in primary schools.

3.2. In other areas:

- Schools with 28 or more classes: Full-time Heads of the Youth Union do not teach. If a middle school teacher is assigned to teach four periods per week or a primary school teacher is assigned to teach one session per week, the hours or sessions taught will be paid according to the current overtime rate.

- Schools with 18 to 27 classes: Part-time Heads of the Youth Union teach eight periods per week in middle schools or two sessions per week in primary schools.

- Schools with fewer than 18 classes: Part-time Heads of the Youth Union teach ten periods per week in middle schools or three sessions per week in primary schools.

4. Staffing of teachers serving as Heads of the Youth Union:

Each primary school, middle school, lower secondary school, and upper secondary school (only counting grade 2 classes) can appoint one teacher to serve as a full-time or part-time Head of the Ho Chi Minh Youth Union. The staffing of teachers serving as Heads of the Youth Union is specified as follows:

4.1. In highland, island, and remote areas:

- Schools with more than 19 classes: One full-time Head of the Youth Union position is allocated.

- Schools with 19 classes or fewer implement the part-time regime.

4.2. In other areas:

- Schools with 28 or more classes allocate one teacher position.

- Schools with 18 to 27 classes allocate staffing equivalent to three-quarters of a teacher position.

- Schools with fewer than 18 classes allocate staffing equivalent to half a teacher position.

III. POLICY REGIME FOR TEACHERS SERVING AS HEADS OF THE YOUTH UNION

1. Policy regime:

Teachers appointed to serve as Heads of the Youth Union in general education schools (including both full-time and part-time Heads of the Youth Union) enjoy the following benefits:

1.1. Receive responsibility allowance based on a coefficient as follows:

- Teachers serving as Heads of the Youth Union in Class I schools receive a responsibility allowance coefficient of 0.30 times the minimum wage.

- Teachers serving as Heads of the Youth Union in Class II schools receive a responsibility allowance coefficient of 0.20 times the minimum wage.

- Teachers serving as Heads of the Youth Union in Class III schools receive a responsibility allowance coefficient of 0.10 times the minimum wage.

Upon ceasing to serve as the overall team leader, one shall not be entitled to this additional allowance.

The determination of the school category for calculating the responsibility allowance for the position of teacher - Overall Team Leader is based on Section I of Circular No. 10/GD-ĐT dated July 29, 1994, issued by the Ministry of Education and Training.

1.2. Teachers shall have their salaries classified and be entitled to various allowances and other benefits as teachers (annual leave, summer vacation, attendance at professional training courses, provision of office supplies...).

1.3. They shall enjoy reward systems similar to those for teachers and any honors agreed upon between the Central Committee of the Ho Chi Minh Communist Youth Union and the Ministry of Education and Training.

- Outstanding Overall Team Leaders at all levels shall be equivalent to outstanding teachers at the same level and shall be eligible for Teacher Merit Medals, Medals for Youth Development, and other medals awarded by the Ho Chi Minh Communist Youth Union.

1.4. In addition to the above regulations, depending on specific conditions in each locality, additional policies may be considered to facilitate the activities of overall team leaders, such as organizing annual visits and exchanges of advanced experiences, providing material conditions for their activities...

2. Policy on utilization:

2.1. Teachers appointed as overall team leaders who perform their duties well shall be rewarded; if they violate discipline, they shall be dealt with according to current regulations.

2.2. After completing their term as overall team leaders, teachers shall be reassigned to their original teaching positions by the schools where they worked.

2.3. During their tenure as overall team leaders, teachers shall participate in regular training and upgrading courses organized by the Ministry of Education and Training and the Ho Chi Minh Communist Youth Union.

IV. IMPLEMENTATION

1. Provincial People's Committees, Departments of Education and Training, Departments of Finance and Prices, and Provincial Youth Unions of the Ho Chi Minh Communist Youth Union shall assist the People's Committees of centrally governed cities and provinces in implementing this Circular.

2. Starting from the 1995-1996 academic year, localities shall review the cadre of overall team leaders in general education schools and select candidates for the next five years who meet the required standards. For overall team leaders over 35 years old with experience and good health, who have not been replaced, consideration may be given to retaining them for a period not exceeding five years.

Where there is no overall team leader or where the existing overall team leader has not received vocational training in youth work, candidates meeting the criteria set out in Section I of this Circular shall be selected for vocational training before being officially appointed.

In mountainous, island, and remote areas where there is a shortage of teachers, if localities have assigned trained and experienced youth workers as overall team leaders, plans should be made to provide pedagogical training within two years so that no overall team leaders in schools lack such training. From now on, non-teachers shall not be employed as overall team leaders in schools.

The funds for implementing the responsibility allowance for overall team leaders and for retraining and vocational training in pedagogy and youth work shall come from the regular budget for education and training.

This Circular takes effect from January 1, 1996. Any previous provisions contrary to this Circular are null and void. During implementation, if there are any issues, localities are requested to report to the Interdepartmental Working Group - Personnel Department of the Government, the Ministry of Education and Training, the Ministry of Finance, and the Central Committee of the Ho Chi Minh Communist Youth Union for prompt resolution.
