Circular No. 231/2016/TT-BTC stipulates the level of collection, the system of collection, submission, management, and utilization of fees in the field of plant protection.

REGULATIONS ON THE LEVEL OF COLLECTION, COLLECTION SYSTEM, PAYMENT, MANAGEMENT AND USE OF FEES IN THE FIELD OF PLANT PROTECTION

BASED ON THE LAW ON FEES AND CHARGES dated November 25, 2015;

BASED ON THE LAW ON STATE BUDGET dated June 25, 2015;

BASED ON THE LAW ON PLANT PROTECTION AND QUARANTINE dated November 25, 2013;

BASED ON DECREE NO. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges;

Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Department of Tax Policy,

The Minister of Finance issues this Circular regulating the level of collection, collection system, payment, management and use of fees in the field of plant protection.

Article 1. Scope of Regulation and Applicability

1. This Circular stipulatesthe level of collection, collection system, payment,management anduse of||| in the field of plant protection.

Article 2. Persons Paying Fees

Article 3. Fee Collection Organizations

Article 4. Fee Rates

Cases Exempted from Fees1. Quarantine of imported seeds for scientific research purposes where the quantity does not exceed: ≤ 01 kg (seeds), ≤ 10 individuals (grafts, cuttings, seedlings) for one species for one import or export.

2. Quarantine of personal items brought into the country for personal use during travel.

3. Plant quarantine under diplomatic protocol when entering or leaving the country.4. Plant quarantine for national events.5. Plant quarantine for gifts from state leaders.6. Export plant quarantine for new markets.At least once a year, the collected fees shall be reported according to the budgetary regulations and the annual decision made according to the guidance at Clause 3, Article 19, Clause 2, Article 26 of Circular No. 156/2013/TT-BTC dated November 6, 2013 guiding the implementation of certain provisions of the Law on Management; the Law amending and supplementing certain provisions of the Law on Management; Decree No. 83/2013/NĐ-CP dated July 22, 2013.For organizations collecting fees that are the Plant Protection Bureau, the Inspection Bureau (in cases where they are self-financed and self-accountable for their operations using administrative funds), 75% of the collected fees will be used to cover costs according to the provisions of Article 5 of Decree No. 120/2016/NĐ-CP dated August 23, 2016. The remaining 25% will be deposited into the state budget according to the chapter and sub-item of the State Budget Manual currently in effect.For organizations collecting fees that are the Plant Protection Bureau and the Crop Cultivation and Protection Bureau:All collected fees will be retained except for the cases specified in Point b, Clause 2 of this Article. The source of funding for implementing tasks and collecting fees will be provided by the state budget within the operational plan of the collecting organization according to the established expenditure standards and norms.b) In cases where the fee-collecting organization is a state agency operating from the collected fees as stipulated in Clause 1, Article 4 of Decree No. 120/2016/NĐ-CP.3. Regularly, according to the regulations of the Plant Protection Bureau, the Inspection Bureaus (under the Plant Protection Bureau) based on the approved annual plan (divided by month and quarter), if the remaining amount after applying the prescribed ratio exceeds the approved budget, the excess must be returned to the Plant Protection Bureau for it to allocate to subordinate units to ensure sufficient funding for operations.

4. The Plant Protection Bureau shall open a bank account at the Treasury Office where its headquarters is located to manage the distribution of fees among internal units. Any balance at the end of the year will be carried over to the next year.Effective January 1, 2017, replacing Circular No. 223/2012/TT-BTC dated December 24, 2012 guiding the collection, payment, management, and other relevant matters concerning the use, receipts, declaration forms for fee collection not mentioned in this Circular shall be implemented according to the Law on Fees and Charges, Decree No. 120/2016/NĐ-CP; Circular No. 156/2013/TT-BTC guiding; Circulars on printing, issuing, and using various types of receipts for collected fees, if there are any discrepancies, please contact the Ministry of Finance;专员；审计总局；相当于部级的机关；各代表团；正式；税务总局中央直属单位；

Article 6. Declaration and Payment of Fees

Article 7. Management and Use of Fees
