Enforcement Officers and Notaries

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for civil servants, public officials, and employees, military personnel, and police officers;

Considering the proposals of the Minister of Justice, the Minister of Home Affairs, and the Minister of Finance,

1. The job responsibility allowance system stipulated in this Decision shall apply to certain judicial positions working at civil enforcement agencies and state notary offices.

DECISION:

Article 1. Scope of Application

2. The subjects eligible to receive the job responsibility allowance system stipulated in this Decision include: Enforcement Officers of provincial civil enforcement agencies (hereinafter referred to collectively as Provincial Enforcement Officers), Enforcement Officers of district, urban district, and town-level civil enforcement agencies (hereinafter referred to collectively as District Enforcement Officers), and Notaries.

3. Enforcement Officers of military regions and the Navy do not fall within the scope of subjects eligible to receive the job responsibility allowance system stipulated in this Decision.

1. The job responsibility allowance system for Enforcement Officers is specified as follows:

Article 2. Special Allowance Level Received

a) A rate of 25% applies to Provincial Enforcement Officers;

b) A rate of 30% applies to District Enforcement Officers.

2. The job responsibility allowance system for Notaries is specified as follows: a rate of 15% applies to Notaries.

3. The rates of job responsibility allowances are calculated based on the current grade and step salary plus leadership position allowances and seniority allowances exceeding the ceiling (if applicable).

Source of funding

Article 3. 1. The source of funding for the job responsibility allowance system for Enforcement Officers shall be allocated from the annual budget of the Ministry of Justice according to the provisions of the State Budget Law.

2. The source of funding for the job responsibility allowance system for Notaries shall be allocated from the annual local budget according to the provisions of the State Budget Law.

1. This Decision shall take effect fifteen days after its publication in the Official Gazette and shall replace Decision No. 76/2001/QĐ-TTg dated May 14, 2001 of the Prime Minister.

Article 4. Effectiveness

2. The job responsibility allowance system for Enforcement Officers shall be implemented from October 1, 2004.

3. The job responsibility allowance system for Notaries shall be implemented from the date this Decision takes legal effect.

1. The Ministry of Justice shall take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Finance to guide the implementation of this Decision.

Article 5. Guidance and Responsibility for Implementation

2. Ministers, heads of ministerial-level agencies, heads of agencies under the Government, and Chairpersons of provincial and municipal People's Committees directly under the central government shall be responsible for enforcing this Decision.

The ministers, heads of ministerial-level agencies, heads of government agencies, and chairpersons of provincial people's committees under the direct control of the central government shall be responsible for implementing this Decision.
