Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
At the request of the Minister of Home Affairs,
DECISION:
Article 1. Position and Functions
1. The National Academy of Administration is a public service organization under the Ministry of Home Affairs and is subject to state management by the Minister of Home Affairs.
2. The National Academy of Administration is the National Center, autonomous and responsible for its organizational structure, staffing, and finances in accordance with the law; it performs the functions of training and enhancing the cadre of civil servants, public officials, and state employees at all levels, grassroots civil servants, reserve civil servants, teaching staff, research fellows in administrative and state management specialties; conducting administrative and state management scientific research and advising the Government on administrative and state management issues.
3. The National Academy of Administration has a seal in the shape of the State Emblem.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Organizing training and enhancing knowledge, skills, and administrative and state management expertise for the following subjects:
a) Administrative civil servants and public officials at the specialist, senior specialist, and top specialist ranks, and other administrative civil servant positions at all levels;
b) Public officials and civil servants specializing in administration within the administrative machinery from central to grassroots levels.
2. Assisting the Minister of Home Affairs in managing uniformly and guiding the implementation of programs and contents for training and enhancing public officials and civil servants regarding administration and state management.
3. Organizing legal knowledge enhancement and state and administrative management for provincial People's Council representatives and organizing language training for ethnic minority areas' public officials and civil servants according to the directives of the Minister of Home Affairs.
4. Providing pre-service training for reserve civil servants before their appointment to civil service positions.
5. Regularly and non-regularly training bachelor's and postgraduate degrees in administrative and state management specialties in accordance with the law.
6. Training and enhancing the teaching staff about administration and state management for educational institutions with administrative and state management specialties.
7. Conducting administrative and state management scientific research, applying scientific and technological advancements to serve the teaching activities of the Academy, schools, and centers for training and enhancing public officials and civil servants nationwide; providing scientific and practical evidence, advising the Ministry of Home Affairs and the Government on strategies and measures to improve the quality of public officials and civil servants, reforming the organizational structure and the administrative system.
8. Taking the lead or participating and coordinating with units of the Ministry of Home Affairs in drafting normative legal documents and other documents to be submitted to competent authorities:
a) Long-term and short-term strategic plans, planning, and programs for training and enhancing public officials and civil servants;
b) Regulations on management and issuance of certificates to graduates from training and enhancement courses on administration and state management;
c) Admissions regulations, rights and obligations of students, regulations on appointing graduates to civil service positions;
d) Teaching, learning, and graduation examination regulations for training and enhancement courses on administration and state management;
đ) Programs and plans for scientific research in the field of administration and state management;
e) Programs, contents, and textbooks for training and enhancing public officials and civil servants in various types of training and enhancement.
9. Uniformly organizing the implementation of training and enhancement programs and contents for public officials and civil servants and mid-level administrative training nationwide.
10. Organizing the compilation of textbooks and materials for training and enhancing public officials and civil servants; guiding professional operations for educational institutions in implementing training and enhancement programs, contents, methods of teaching, examination regulations, and management and issuance of certificates.
11. Building and implementing international cooperation plans with administrative academies and schools of other countries and international organizations in accordance with the law.
12. Deciding and directing the implementation of administrative reform programs for organizations and units directly under the National Academy of Administration according to the division of labor assigned by the Minister of Home Affairs.
13. Inspecting, examining, resolving complaints and grievances, and handling violations in accordance with the law.
14. The National Academy of Public Administration shall receive documents, materials, and necessary information from the Government and Ministries, agencies at the ministerial level, and other agencies under the Government; it may request the Ministries, agencies at the ministerial level, other agencies under the Government, and provincial people's committees to assign collaborators to participate in teaching, receive and support students for internships, field surveys, and cooperate in administrative science research and state management work.

Article 3. Training and Development Programs of the Academy
1. Program on training and development of knowledge in public administration and state management.
2. Pre-service training program.
3. Regular and non-regular undergraduate and postgraduate programs in public administration according to specialized fields in public administration and state management.
4. Program on training and development of lecturers and researchers in public administration and state management.
5. Specialized training and development program.
Article 4. Organizational Structure of the Academy
a) Academy Leadership:
The National Administration Academy has a Director, who is assisted by Deputy Directors. The Director of the National Administration Academy is appointed by the Prime Minister upon the proposal of the Minister of Home Affairs. The Director of the National Administration Academy is responsible to the Minister of Home Affairs for all activities of the National Administration Academy.
The Deputy Directors of the National Administration Academy are appointed by the Minister of Home Affairs upon the proposal of the Director of the National Administration Academy. The Deputy Directors of the National Administration Academy are responsible to the Director of the National Administration Academy for tasks assigned by the Director.
The Director of the National Administration Academy is responsible for drafting the Academy's operational regulations to be submitted to the Minister of Home Affairs for consideration and decision.
b) Institutes:
1. Institute of the National Administration Academy in Ho Chi Minh City;
2. Institute of the National Administration Academy in Hue City;
3. Regional Institutes.
The establishment of regional institutes is decided by the Prime Minister based on the proposal of the Minister of Home Affairs.
The functions, tasks, powers, and organizational structure of the institutes are regulated by the Minister of Home Affairs based on the proposal of the Director of the National Administration Academy.
c) Organizations assisting the Director in managing the Academy:
1. Personnel Organization Board;
2. Training Board;
3. International Cooperation Board;
4. Office;
5. Education and Training Inspection Board.
d) Training and Development Units:
1. Department of Training and Civil Servant Development;
2. Postgraduate Department;
3. Basic Theory Department;
4. State and Law Department;
5. Administrative Studies Department;
6. Administrative Documents and Technology Department;
7. Economic Public Administration Management Department;
8. Social Public Administration Management Department;
9. Public Financial Management Department;
10. Organization and Human Resources Management Department;
11. Specialized Departments and other specialized subjects.

1. Institute of Administrative Science Research;
2. State Management Magazine;
3. Information Technology and Library Center;

The establishment, restructuring, dissolution of the management system, training and development units, and non-profit organizations of the National Administration Academy are decided by the Minister of Home Affairs based on the proposal of the Director of the National Administration Academy.
Article 5. Effectiveness
This Decision takes effect fifteen days from the date of publication in the Official Gazette.
Article 6. Responsibility for Implementation
The Minister of Home Affairs, Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of People's Committees of provinces and centrally governed cities, and the Director of the National Administration Academy are responsible for implementing this Decision./.
