DECISION OF THE PRIME MINISTER
Regarding special regimes for workers, staff, and officials
in Certain Industries and Occupations in State-Owned Enterprises
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government stipulating the wage scale and wage system and the allowance regime in state-owned enterprises;
Considering the proposal of the Minister of Labor, Invalids, and Social Affairs,
DECISION:
Article 1. Prescribes certain special regimes applicable to workers, staff, and officials working in some industries and professions in state-owned companies as follows:
1. A fixed meal allowance calculated in monetary terms based on actual working days:
a) Level 1: 32,000 VND/day, applicable to workers operating lighthouses and buoys; workers, staff, and officials during aerial surveying and photography, marine surveying and photography for topographic maps and sea charts;
b) Level 2: 37,000 VND/day, applicable to underground mining workers; locomotive drivers and assistant locomotive drivers; workers, staff, and officials involved in coal transportation, loading, unloading, and delivery at sea; crew members of cargo ships, construction ships, buoy-laying ships, geophysical survey ships, escort ships, and service ships; workers, staff, and officials managing and operating ship channels; air traffic controllers; technical workers directly repairing aircraft; technical workers and flight attendants on flights;
c) Level 3: 45,000 VND/day, applicable to divers; crew members of fishing vessels and transport vessels with a power of 800 horsepower or more; salvage ships; maritime search and rescue ships;
d) Level 4: 80,000 VND/day (equivalent to 5 USD/day), applicable to aircraft pilots; workers, staff, and officials working on ocean-going vessels during overseas trips;
When traveling abroad, this meal allowance will be converted into US dollars (USD) according to the average exchange rate of the Vietnamese dong against the US dollar published by the State Bank of Vietnam at that time;
e) Level 5: 110,000 VND/day (equivalent to 7 USD/day), applicable to workers, staff, and officials who are Vietnamese nationals working on offshore oil platforms and service vessels;
When the food price index published by the General Statistics Office increases by 10% or more compared to the last adjustment, the meal allowance will be adjusted accordingly;
Those entitled to the fixed meal allowance must deduct 30% from their salary, while the remaining 70% will be accounted for in production costs or business expenses, and they shall not enjoy meal allowances or physical hardship and danger allowances;
2. Safety bonus at two levels of 15% and 20% of the salary grade and position, applicable to workers, staff, and officials in certain industries and professions with special working conditions;
The specific subjects eligible for the safety bonus are detailed in the Appendix attached to this Decision;
3. Diver allowance ranging from a factor of 0.1 to 1.0 based on the general minimum wage stipulated by the Government, applicable to divers working at depths greater than 3 meters, with the allowance calculated based on actual diving hours;
4. Sea duty allowance of 110,000 VND/day (equivalent to 7 USD/day), applicable to workers, staff, and officials in the oil industry during actual working days on offshore platforms, service vessels, and offshore facilities;
5. Freshwater shortage regime: applicable to areas experiencing seasonal freshwater shortages;
Article 2
1. The regimes prescribed in Clauses 1, 2, 3, and 4 of Article 1 of this Decision shall be accounted for in production costs or business expenses and shall not be included in the unit price of wages or the wage fund of the company;
2. The regime prescribed in Clause 5 of Article 1 of this Decision shall be accounted for in production costs or business expenses for purchasing and transporting freshwater for daily use by workers, staff, and officials, after deducting the portion of freshwater costs already included in wages;
Article 3. The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with the Ministry of Finance to guide the implementation of this Decision;
Article 4. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Abolishes Decision No. 611/TTg dated September 4, 1996 of the Prime Minister regarding the allowance for workers and officials in certain special industries and professions in enterprises, and Decision No. 121/1999/QĐ-TTg dated May 8, 1999 of the Prime Minister regarding salaries and income of the Vietnam Electricity Corporation;
The regimes prescribed in this Decision shall be implemented from January 1, 2005;
Article 5. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities are responsible for implementing this Decision./.
ANNEX
Specifies the subjects entitled to the safety bonus
(Annexed to Decision No. 234/2005/QĐ-TTg dated September 26, 2005)
of the Prime Minister)
I. 20% of the salary grade and position applicable to:
1. Workers, staff, and officials managing and operating power plants and electricity production companies;
2. Workers, staff, and officials repairing, testing, and calibrating electrical equipment, managing, and operating power transmission systems with voltages of 110 kilovolts or higher;
3. Workers, staff, and officials managing and operating telecommunications networks and computer networks within the power system;
4. Workers, staff, and officials at the National Power System Dispatch Center, regional dispatch centers, and provincial dispatch centers;
The subjects mentioned in Points 1, 2, 3, and 4 above do not include clerical staff, service staff, administrative car drivers, office guards, gardeners, and florists;
5. Aircraft pilot team members;
6. Flight attendants;
7. Air traffic controllers;
8. Radar, meteorological, communication, navigation, power supply, and refrigerant charging personnel supporting aviation operations;
9. Aviation security personnel;
10. Airport operation management and supervision personnel;
11. Ground technical and commercial service personnel at airports;
12. Airport-based aircraft maintenance and repair personnel;
13. Airport lighting system management personnel; airport rescue and firefighting personnel;
14. Workers, staff, and officials operating liquefied petroleum gas (LPG) production plants, Vung Tau port terminals, Phu My terminal, and Ba Ria terminal;
15. Workers, staff, and officials directly operating condensate processing plants.
16. Workers, staff, officials operating and controlling traffic surveillance; operating electrical systems, ventilation systems, communication centers, 1,600 KW generators, uninterruptible power supplies, electrostatic precipitators, maintaining and servicing 110/220 KVA underground road tunnel substations at Hai Van Pass.
II. A rate of 15% of the rank-based salary applies to:
1. Workers, staff, officials managing and operating electrical systems with voltage below 110 KV.
2. Officials leading and managing technical aspects of electrical systems.
The subjects mentioned in points 1 and 2 above do not include those receiving a rate of 20%, nor do they include electricity billing staff, administrative support staff, janitors, administrative car drivers, permanent office staff, and gardeners.
3. Officials leading and managing aircraft technology, managing and operating flight operations, managing security and safety, serving, and related services directly related to flight activities.
4. Workers, staff, officials operating valve stations along gas pipeline routes.
5. Workers, officials from other parts of the Condensate plant, excluding administrative support staff, janitors, administrative car drivers, permanent office staff, and gardeners.
6. Workers, staff, officials from other parts involved in managing and operating the Hai Van Pass tunnel (excluding toll collection personnel)./
