REGARDING THE ASSIGNMENT OF TASKS FOR CONFIRMING INADEQUATE CONDITIONS FOR ELECTRICITY SUPPLY

Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;

Pursuant to the Electricity Law dated December 3, 2004;

Pursuant to Decree No. 105/2005/NĐ-CP dated August 17, 2005 of the Government detailing and guiding the implementation of certain provisions of the Electricity Law;

Pursuant to Circular Jointly Issued No. 02/2003/TTLT-BCT-BNV dated October 29, 2003 of the Ministry of Industry and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of specialized agencies assisting People's Committees in managing industry at local levels;

At the proposal of the Director of the Electricity Regulatory Authority,

DECISION:

Article 1. Assign the Departments of Industry of provinces and centrally governed cities to confirm inadequate conditions for electricity supply for distribution networks with voltage up to 35kV in their respective localities upon the request of the distribution units.

Article 2. The area confirmed as having inadequate conditions for electricity supply is an area without a distribution network or where the existing distribution network is overloaded.

Confirming inadequate conditions for electricity supply shall be carried out based on the approved power development plan, the construction plan for the distribution network within the annual plan period of the distribution unit, and must ensure the quality of electric energy in accordance with the Electricity Law and related regulatory legal documents.

Article 3. This Decision takes effect from the date of issuance. The Departments of Industry of provinces and centrally governed cities are responsible for organizing its implementation and sending copies of the confirmation documents to the Electricity Regulatory Authority for consolidation and reporting to the Ministry of Industry.

Article 4. The Head of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, Directors of Provincial and Centrally Governed City Departments of Industry, and distribution units are responsible for implementing this Decision.
