DECISION OF THE PRIME MINISTER

On the List of State Secrets of Top Secret and High Secret Levels

of the Foreign Affairs Sector

PRIME MINISTER 

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Considering the proposal of the Minister of Foreign Affairs and the Minister of Public Security,

DECISION:

Article 1. The list of state secrets of the utmost confidentiality level Top Secret of the Foreign Affairs Sector includes the following contents:

1. The major foreign policy guidelines, policies, and implementation plans of the Party and State that have not been or will not be announced.

2. The Party and State's guidelines for resolving border disputes, protecting sovereignty, and rights of the Socialist Republic of Vietnam that have not been or will not be announced.

3. Information and materials about high-level secret meetings between our Party and State leaders and foreign organizations, leaders, and individuals that have not been or will not be announced.

4. Information and materials from foreign countries or international organizations transferred to Vietnam, which according to the transferring party's requirements have not been or will not be announced.

Article 2. The list of state secrets of the highest confidentiality level of the Foreign Affairs Sector includes the following contents:

1. The content of negotiations and signed documents between our country and foreign countries or international organizations held by the Ministry of Foreign Affairs that have not been or will not be announced.

2. Negotiation strategies, related preparatory materials, and negotiation content for resolving border disputes on land, at sea, islands, continental shelf, and airspace with neighboring countries that have not been or will not be announced.

3. Directives from Party and State leaders to the Ministry of Foreign Affairs regarding foreign affairs work that have not been announced.

4. Information, materials, and maps related to national borders determining sovereignty transferred from abroad to Vietnam according to the transferring party's requirements that have not been or will not be announced.

5. Files, materials, and maps related to boundary markers and national borders that have not been announced.

6. Proposals regarding the establishment or withdrawal of overseas representative offices or the establishment, termination of diplomatic relations between Vietnam and other countries that have not been announced.

Important directive and guidance materials for overseas representative offices' activities. Materials sent back by representative offices concerning sensitive issues or special partners.

Materials on the organization and special operations of the Foreign Affairs Sector. Important evaluation materials on the international situation, international and regional organizations, important countries internationally, and countries with special relations.

8. Documents specifying communication information technical parameters of the Ministry of Foreign Affairs.

Article 3. This Decision shall take effect fifteen days after its publication in the Official Gazette and shall replace Decisions No. 730/TTg dated December 1, 1994 of the Prime Minister on the List of State Secrets in the Foreign Affairs Sector and Decision No. 324/TTg dated May 27, 1995 of the Prime Minister on the List of State Secrets of the Government Border Committee.

Article 4. The Minister of Foreign Affairs is responsible for organizing the implementation of state secret protection work in agencies and units under their jurisdiction and guiding and inspecting the enforcement of this Decision.

Article 5. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial People's Committees under the central government are responsible for implementing this Decision.
