Establishment of the Management Board of Moi Bai Border Economic Zone, Tay Ninh Province

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;

Pursuant to Decision No. 140/2007/QĐ-TTg dated August 24, 2007 of the Prime Minister on the issuance of the Operation Regulation of Moi Bai Border Economic Zone, Tay Ninh Province;

Considering the proposal of the Chairman of the People's Committee of Tay Ninh Province at Document No. 3000/TTr-UBND dated November 12, 2007 and Document No. 112/TTr-UBND dated January 16, 2008; of the Minister of Home Affairs at Document No. 3741/TTr-BNV dated December 26, 2007; of the Minister of Planning and Investment at Circular No. 377 BKH/TM&DV dated January 17, 2008,

Article 1. On the establishment and definition of the position and functions of the Management Board of Moi Bai Border Economic Zone, Tay Ninh Province

1. Establish the Management Board of Moi Bai Border Economic Zone, Tay Ninh Province (hereinafter referred to as the Management Board).

2. The Management Board is a state management agency under the People's Committee of Tay Ninh Province; it has the function of managing investment, construction, and development of Moi Bai Border Economic Zone, Tay Ninh Province according to the Operation Regulation, planning, plan, and implementation schedule approved by competent state authorities.

3. The Management Board has legal personality, has a bank account, office premises, and a seal with the National Emblem; it is the focal point for the provincial budget plan of Tay Ninh Province. The operating funds of the Management Board and the operating funds for public services are provided from the state budget according to the provisions of the law.

Article 2. Tasks and powers of the Management Board

The Management Board performs tasks and powers as prescribed in:

1. Article 81 of Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;

2. Article 18 of the Operation Regulation of Moi Bai Border Economic Zone, Tay Ninh Province issued together with Decision No. 140/2007/QĐ-TTg dated August 24, 2007 of the Prime Minister;

3. Other relevant legal documents and other tasks and powers assigned by the People's Committee of Tay Ninh Province.

Article 3. Organizational structure and staffing of the Management Board

1. Organizational Structure:

a) The Management Board has a Director appointed and relieved of duty by the Chairman of the People's Committee of Tay Ninh Province; some Deputy Directors and some members appointed and relieved of duty by the Chairman of the People's Committee of Tay Ninh Province upon the recommendation of the Director of the Management Board;

b) The Management Board has an assisting apparatus including: Office, specialized departments;

c) Affiliated units of public service. Based on the requirements and tasks of developing Moi Bai Border Economic Zone, Tay Ninh Province in each specific phase, the Director of the Management Board shall submit to the Chairman of the People's Committee of Tay Ninh Province for decision within the scope of authority regarding the organizational structure of the Management Board.

2. Staffing:

a) Staffing of the Management Board includes: Director, specialized Deputy Directors and staffing of the Office and specialized departments;

b) Staffing of the Management Board is decided by the Chairman of the People's Committee of Tay Ninh Province according to the regulations on the decentralization of administrative and public service staff management and the staffing management mechanism for public service units of the State.

3. The Director of the Management Board shall submit to the People's Committee of Tay Ninh Province for detailed regulations on the functions, tasks, powers, and organizational structure of the Management Board in accordance with the provisions of the law.

Article 4. Effective date

This Decision shall take effect from the date of signing.

Article 5. Responsibilities for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairman of the People's Committee of Tay Ninh Province, Director of the Management Board of Moi Bai Border Economic Zone, Tay Ninh Province, Heads of agencies and units, organizations, and individuals concerned are responsible for implementing this Decision./.
