Decision No. 238/TM-XNK of the Ministry of Trade in 1994 promulgates the List of goods prohibited from export and import, applicable from April 1, 1994. This decision specifies the types of goods prohibited according to each group.

ON THE ISSUANCE OF THE LIST OF GOODS PROHIBITED FROM EXPORT AND IMPORT
THE MINISTER OF TRADE
Pursuant to Decree No. 95-CP dated December 4, 1993 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Trade;
Pursuant to Article 9 of Decision No. 78-TTg dated February 28, 1994 of the Prime Minister on the management of export-import activities in 1994;
After reaching consensus with the General Director of the Customs General Department,
DECISION:
Article 1. Now hereby promulgates with this Decision the List of Goods Prohibited from Export and Import.
Article 2. This list shall apply to all forms of export and import and shall take effect from April 1, 1994.
Article 3. The competent agencies under the Ministry of Trade, the Customs General Department, and the legal entities and individuals engaged in export and import activities shall be responsible for implementing this Decision.
Article 4. This list replaces the List of Goods Prohibited from Export and Import through Vietnamese Border Gates issued together with Decision No. 405-TM/XNK dated April 13, 1993 of the Ministry of Trade.

LIST OF GOODS PROHIBITED FROM EXPORT AND IMPORT
(Issued together with Decision No. 238-TM/XNK
dated March 24, 1994 of the Ministry of Trade).
I. PROHIBITED EXPORT GOODS:
1. Weapons, ammunition, explosives, military technical equipment.
2. Antiques.
3. Narcotics.
4. Toxic chemicals.
5. Round timber, sawn timber, various types of semi-finished wood products, and raw materials.
6. Wild animals and rare animals and plants.
II. PROHIBITED IMPORT GOODS:
1. Weapons, ammunition, explosives, and military technical equipment.
2. Narcotics.
3. Toxic chemicals.
4. Obscene and subversive cultural products.
5. Fireworks and children's toys that have a negative impact on personality education, social order, and public safety.
6. Cigarettes (except personal luggage within the prescribed limit).
7. Used consumer goods (including clothing, textiles, cars with fewer than 12 seats, two-wheeled and three-wheeled vehicles with engines or without engines, household electrical and electronic appliances), except for personal movable property and luggage within the specified quantity.
Some goods that may cause environmental harm and other disadvantages (such as old spare parts, tires, waste, scrap, etc.) are also classified as prohibited imports.
8. Cars and other self-propelled vehicles with left-hand drive (including disassembled units and spare parts) except for certain special types of vehicles and self-propelled vehicles with limited circulation.
Note:
1. In exceptional cases, the export and import of goods listed above shall be permitted by the Prime Minister in writing.
2. The prohibition on exporting wild animals for environmental protection purposes shall be guided by the Ministry of Forestry and the Ministry of Science, Technology, and Environment in separate documents.
3. To avoid technological obsolescence, for complete equipment and used machines with a value of 100 thousand USD or more, the managing agency (at the ministry level or provincial People's Committee) of the enterprise and the General Bureau of Standards-Measurement-Quality (Ministry of Science, Technology, and Environment) must review the import order beforehand. After obtaining approval from the General Bureau of Standards-Measurement-Quality, the Ministry of Trade will issue an import permit.
4. The Ministry of Trade, the Ministry of Home Affairs, and the Customs General Department shall coordinate to determine the categories of special types of vehicles and self-propelled vehicles as stipulated in Point II. 8.
5. After reaching consensus with the Ministry of Trade and the Ministry of Foreign Affairs, the Customs General Department shall guide the implementation of the "Movable Property" section as stipulated in Point II. 7.
