Approving the Program to Assist Persons with Disabilities for the Period 2006-2010

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on Persons with Disabilities dated July 30, 1998;

Considering the proposal of the Minister of Labor, Invalids and Social Affairs;

Pursuant to …;

Article 1. Approves the Program to Assist Persons with Disabilities for the Period 2006-2010, with the following main contents:

1. Objectives

Improving the quality of life for persons with disabilities; gradually creating conditions for persons with disabilities to participate equally in social activities; building a social environment that increasingly cares better about the rights of persons with disabilities.

2. Targets

a) At least 80% of provinces and cities have self-reliance organizations of persons with disabilities;

b) Approximately 70% of disabled women are assisted in various forms;

c) Approximately 70% of persons with disabilities have access to healthcare services, approximately 3,000 people undergo orthopedic surgery and rehabilitation;

d) 70% of children with disabilities participate in education in all forms; 100% of children with disabilities attending school are exempted or granted reduced tuition fees according to state regulations.

đ) Approximately 80,000 persons with disabilities will be trained in vocational skills and provided suitable employment at vocational training centers, production, business, and service establishments under all economic sectors nationwide;

e) 100% of new construction projects and public transportation facilities must comply with current regulations; 20% to 30% of existing facilities will be renovated to facilitate accessibility for persons with disabilities;

g) The ratio of persons with disabilities accessing the Internet and related services shall be at least one-fourth of the national average;

h) 100% of persons with disabilities who need and meet the criteria will have access to loans from National Target Programs on Poverty Reduction and Employment;

i) 22% of persons with disabilities will engage in sports training.

3. Main Activities of the Program

a) Enhancing awareness about disability issues and persons with disabilities;

b) Surveying the situation and status of persons with disabilities nationwide, based on which new or revised and supplemented legal documents and assistance mechanisms and policies for persons with disabilities will be developed;

c) Establishing standards for classification and grading of functional activity and reduced capacity of persons with disabilities in Vietnam;

d) Supporting and facilitating the establishment of self-reliance organizations of persons with disabilities and associations of parents and families of persons with disabilities;

đ) Assisting disabled women;

e) Early detection, intervention, and rehabilitation for persons with disabilities based on community involvement, particularly among children;

g) Assisting in cultural education;

h) Assisting in vocational training and job creation;

i) Facilitating access to and use of construction and public transportation facilities;

k) Facilitating access to and use of information and telecommunications, including information and communication technologies;

l) Creating conditions for persons with disabilities to access social welfare programs and the National Target Program on Poverty Reduction;

m) Monitoring, inspecting, supervising, and evaluating.

4. Implementation Period

From 2006 to 2010.

5. Implementation Measures

a) Mobilizing resources to implement the Program:

To ensure the achievement of the Program's objectives, a multi-source resource mobilization mechanism will be applied:

- Central budget;

- Local budgets;

- Integration with other policies and programs;

- Mobilizing from organizations and individuals both domestically and internationally.

b) Strengthening the participation of the public, especially persons with disabilities themselves:

- Providing full information to the public about the state's policies towards persons with disabilities and their families;

- Encouraging public participation in all Program activities, particularly persons with disabilities.

c) Strengthening division of labor and decentralization in management:

- Central level: developing mechanisms, policies, national criteria and plans; allocating resources and organizing supervision and evaluation of Program implementation;

- Provincial and district levels: planning assistance for persons with disabilities in their respective areas; supplementing resources and proactively allocating them to communes; guiding and supervising commune-level implementation; surveying, statistics, and reporting to the central government the number of persons with disabilities;

- Commune level: Identifying persons with disabilities, mobilizing local resources, implementing policies in the area, and conducting self-supervision and evaluation.

d) Building and improving the quality of cadres working on assistance for persons with disabilities:

- Completing the cadre team working on assistance for persons with disabilities at all levels;

- Developing training and capacity-building programs for cadres working on assistance for persons with disabilities.

đ) Studying and revising assistance mechanisms and policies for persons with disabilities:

- Gradually reforming the payment mechanism for services provided to persons with disabilities towards direct state payment for medical, educational, and vocational training services for persons with disabilities or reimbursement on behalf of persons with disabilities to service providers, both public and private, to improve service quality and equal access to these services;

- Revising the level of assistance for orthopedic equipment and rehabilitation;

- Revising the subsidy standards for vocational training and cultural education;

- Revising the criteria for identifying beneficiaries of assistance policies towards expanding the target group in line with socio-economic development.

e) Strengthening international cooperation in assisting persons with disabilities:

- Fully implementing the Government's commitments within the framework of the Biwako Millennium Action Plan;

- Maintaining and expanding comprehensive relations with regional and global organizations in disability assistance activities.

6. Funding: The funding for implementing the Program will be allocated in the annual state budget according to the current state budget decentralization and mobilized from organizations and individuals both domestically and internationally as prescribed by law.

7. Implementation

a) Ministry of Labor, Invalids and Social Affairs:

- Taking the lead and coordinating with relevant agencies and localities to organize the implementation of the Program, regularly reporting to the Prime Minister;

- Continuing to review and evaluate the results of implementing the Ordinance on Persons with Disabilities and related legal documents; taking the lead and coordinating with relevant ministries and sectors to study and propose measures to revise and supplement or submit to competent authorities for revision and supplementation of assistance policies for persons with disabilities;

- Guiding provincial and centrally-administered city competent agencies to establish and utilize the Fund for Employment of Persons with Disabilities;

- Promote vocational training activities and job creation for persons with disabilities towards learning trades and passing on skills.

b) The Ministry of Health:

- Develop and implement plans for healthcare services for persons with disabilities, focusing on early detection, early intervention, and functional rehabilitation programs based on community involvement;

- Guide the implementation of policies for fee exemptions and reductions for persons with disabilities who are in poverty;

- Take the lead and coordinate with the Ministry of Education and Training to research and incorporate training programs for specialized staff in functional rehabilitation into university, college, and vocational school curricula;

- Take the lead and coordinate with the Ministry of Labor, Invalids, and Social Affairs to refer to international experiences and those of the World Health Organization (WHO) in developing classification standards for the functional abilities and impairments of persons with disabilities.

c) The Ministry of Education and Training:

- Develop and implement action plans for educating children with disabilities from 2006 to 2010 and subsequent years, focusing on integration and community-based approaches;

- Standardize the use of language and symbols for persons with disabilities nationwide.

d) The Ministry of Culture, Sports, and Tourism:

- Direct the intensification of publicity efforts to raise awareness about disability issues, including the prevention of disabilities, and to promote measures that facilitate the participation of persons with disabilities in cultural activities and their integration into society;

- Direct media agencies to develop special sections and topics for publicizing assistance to persons with disabilities through mass media.

đ) The Sports Committee:

- Develop exercise programs to guide persons with disabilities in participating in community-based physical training;

- Direct the Disabled Sports Association to build sports training and competition movements; propose appropriate forms and levels of recognition for persons with disabilities who achieve success in sports training and competitions;

- Take the lead and coordinate with relevant agencies to create favorable conditions for persons with disabilities to participate in international sports competitions.

e) The Posts and Telecommunications Ministry: take the lead and coordinate with the Ministry of Science and Technology to establish regulations encouraging research, production, and application of products suitable for assisting persons with disabilities to easily access and use communication and information technology services.

g) The Construction Ministry: take the lead and coordinate with relevant ministries and sectors to direct the construction of new projects and the upgrading of existing ones according to the Public Building Construction Standards number QCXDVN 01: 2002 and the standards number TCXD Vietnam 246: 2002, TCXDVN 265: 2002, TCXDVN 266: 2002; review and amend these standards or issue new ones to ensure that new constructions are accessible to persons with disabilities.

h) The Ministry of Transport:

- Take the lead and coordinate with relevant ministries and sectors to direct the design and construction of new projects and the upgrading and renovation of existing ones to ensure accessibility for persons with disabilities according to established standards;

- Take the lead and coordinate with the Ministry of Industry to renovate and produce new means of transportation for public use to facilitate safe and convenient access for persons with disabilities.

i) The Ministry of Finance, the Ministry of Planning and Investment:

- Be responsible for budget balancing for ministries, sectors, and localities to implement the project according to the current state budget allocation;

- The Ministry of Finance takes the lead and coordinates with the Ministry of Labor, Invalids, and Social Affairs to draft guidelines for the use of funds to implement the Project.

k) The Ministry of Home Affairs studies, revises, and supplements mechanisms and policies to facilitate the establishment of self-reliant organizations of persons with disabilities and parent associations of persons with disabilities to enable these organizations to operate effectively and practically.

l) The Ministry of Justice takes the lead and coordinates with the Ministry of Labor, Invalids, and Social Affairs, the Ministry of Culture, Sports, and Tourism, and central press and broadcasting agencies to intensify education and publicity on laws concerning persons with disabilities.

m) People's Committees of provinces and centrally governed cities:

- Direct competent agencies to determine the number, classify, and rank persons with disabilities according to regulations and guidance from the Ministry of Health and related ministries and sectors;

- Develop plans and organize the implementation of social welfare policies, medical assistance, educational support, vocational training, employment creation, cultural, and sports activities for persons with disabilities.

n) The Vietnam Television, Voice of Vietnam Radio, and Vietnam News Agency develop and publicize special sections and topics on assisting persons with disabilities.

o) - Request the Central Committee of the Fatherland Front of Vietnam and political-social organizations, social organizations to actively participate in implementing this Project within their respective functions and responsibilities.

- Request the Vietnam Women's Union to take the lead and coordinate with relevant agencies to direct the implementation of assistance activities for women with disabilities.

p) During the appraisal, approval, and acceptance of investment projects, ministries, ministerial-level agencies, government-affiliated agencies, and provincial and centrally governed city people's committees direct competent agencies to strictly adhere to standards to ensure that persons with disabilities can access and benefit from economic and social development policies and use public facilities.

Article 2. This Decision shall take effect fifteen days after its publication in the Official Gazette.

Article 3. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, and chairpersons of provincial and centrally governed city people's committees are responsible for enforcing this Decision.
