Regarding the postponement of the recovery of budget funds advanced for collection in the State budget estimate for 2009

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 179/2007/ND-CP dated December 3, 2007 of the Government promulgating the Operational Regulations of the Government;

Pursuant to Resolution No. 30/2008/NQ-CP dated December 11, 2008 of the Government;

Considering the proposal of the Minister of Planning and Investment at Circular No. 851/TTr-BKH dated February 13, 2009; The opinion of the Ministry of Finance at Document No. 1454/BTC-NSNN dated February 9, 2009;

DECISION:

Article 1.

1. Postpone the recovery of the amount of budget funds advanced for collection in the State budget estimate for 2009, which is 33,917,740,000 VND, including 15,546,000,000 VND for the budget estimate of ministries, agencies under the Government, other agencies at the central level, economic groups, and the 91 Corporation, and 18,371,740,000 VND for the budget estimate of provinces and centrally-administered cities.

2. The remaining amount of budget funds advanced for collection in 2009 is 25,250,200,000 VND, including 15,850,200,000 VND for the budget estimate of ministries, agencies under the Government, other agencies at the central level, economic groups, and the 91 Corporation, and 9,400,000,000 VND for the budget estimate of provinces and centrally-administered cities.

(The amounts of budget funds postponed for recovery and those required to be recovered by the relevant agencies and units are detailed in the attached Appendix).

Article 2. The amount of budget funds advanced for collection in the State budget estimate for 2009 specified in Point 2, Article 1 of this Decision replaces the amount of budget funds advanced for collection according to Decision No. 1676/QD-TTg dated November 19, 2008 of the Prime Minister regarding the State budget estimate for 2009.

Article 3.

1. Entrust the Minister of Planning and Investment to notify ministries, agencies under the Government, other agencies at the central level, economic groups, the 91 Corporation, and related localities of the amount of budget funds advanced for postponed recovery and the amount of budget funds advanced for recovery as stipulated in Article 1 of this Decision for implementation.

2. The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of Finance and relevant ministries and agencies to balance sources to arrange for the repayment of budget funds advanced by ministries, agencies under the Government, other agencies at the central level, economic groups, the 91 Corporation, and localities in the budget estimate for 2010 and subsequent years.

Article 3. This Decision shall take effect from the date of signing.

Article 4. Ministers of Planning and Investment, Finance, and other ministers, heads of ministerial-level agencies, agencies directly under the Government, other agencies at the central level, Chairmen of People's Committees of provinces and centrally-administered cities, economic groups, the 91 Corporation, and heads of relevant agencies (as specified in Article 1) are responsible for implementing this Decision./.
