Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 44/2011/ND-CP dated June 14, 2011 of the Government amending and supplementing Article 3 of Decree No. 189/2007/ND-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Resolution No. 06/NQ-CP dated March 7, 2012 promulgating the Government's Action Program for the 2011-2016 term;

At the proposal of the Director of the Planning Department,

DECISION:

Article 1. Attached hereto is the Industry and Trade Sector's Action Program to implement Resolution No. 06/NQ-CP dated March 7, 2012 promulgating the Government's Action Program for the 2011-2016 term.

Article 2. This Decision shall take effect from the date of signing.

Article 3. The Director of the Ministry’s Office, the Inspector General of the Ministry, Heads of agencies and units under the Ministry, Chairmen of Councils of Members, Chairmen of Councils of Management, General Directors of Economic Groups, State-owned Corporations, and Enterprises under the Ministry, Directors of Provincial Departments of Industry and Trade shall be responsible for implementing this Decision.

ACTION PROGRAM OF THE INDUSTRY AND TRADE SECTOR

Implementing Resolution No. 06/NQ-CP promulgating the Government's Action Program for the 2011-2016 term

I. OBJECTIVES AND REQUIREMENTS OF THE PROGRAM

1. Objectives: The objective of the Program is to successfully implement Resolution No. 06/NQ-CP dated March 7, 2012 promulgating the Government's Action Program for the 2011-2016 term.

2. The remaining 60% shall be used to supplement the operating funds of units directly responsible for public debt management at the Ministry of Finance (outside the regular state budget allocation for ongoing operations as currently provided) for the purposes specified in Article 4 of this Decision. The requirements of the Program demand that agencies, units, and enterprises under the Industry and Trade Sector, Provincial Departments of Industry and Trade actively and proactively contribute to the common cause of the entire sector to successfully implement the Government's Action Program for the 2011-2016 term; focusing on stabilizing macroeconomic conditions, ensuring social welfare, maintaining reasonable growth rates, restructuring the economy in conjunction with reforming the growth model.

II. TASKS TO BE CONCENTRATED ON GUIDANCE AND MANAGEMENT

1. Stabilize macroeconomic conditions, control inflation, ensure sustainable economic development

a) Utilize public financial resources effectively. Reform public expenditure policies, linking annual state budget preparation with medium-term financial planning and expenditure. Strictly monitor and audit the use of state budgets and assets at budgetary units. Publicize the results of inspections, audits, and handling actions at each level and unit; disclose the financial status of state-owned enterprises, economic groups, and state corporations.

b) Strengthen market management in anti-smuggling, counterfeiting, commercial fraud, and food safety violations; intellectual property rights violations; inspect and supervise compliance with price regulations, price labeling, and sales according to labeled prices; promptly address cases of profiteering, hoarding goods, spreading false information to inflate prices, destabilize markets, and harm consumer interests. Ensure balance between supply and demand for goods serving production and people's livelihoods, especially those in border and island areas.

c) Enhance macroeconomic analysis and forecasting. Improve the system of information and data for assessing industry and trade situations and developing policies; establish coordination mechanisms; strengthen the capacity of industry and trade officials in monitoring, evaluating, and forecasting to serve the development and management of industry and trade plans, as well as timely warning of impacts on the economy.

2. Restructure the economy in conjunction with reforming the growth model towards improving quality, efficiency, and competitiveness

Alongside continuing structural changes within the Industry and Trade Sector and in each field, during the 2011-2016 term, focus on restructuring the Industry and Trade Sector in investment and state-owned enterprise fields.

a) Restructure investment, with emphasis on public investment, aiming to gradually reduce the proportion and improve the effectiveness of state budget and government bond capital.

Strengthen management of state budget and government bond capital investments; concentrate funds on power projects, urgent projects to complete and put into operation quickly to maximize benefits; prioritize funding for essential and urgent projects and counterpart funds for ODA projects; strictly control and clearly define sources of capital for newly initiated projects.

Participate in perfecting systems, policies, and orientations for attracting investment in power projects; enhance the quality of planning and resolutely implement investments according to plans.

b) Restructure state-owned enterprises, with emphasis on economic groups and state corporations, to improve operational efficiency and better fulfill their roles.

Conduct classification of state-owned enterprises under the Industry and Trade Sector based on clearly defining the roles of the State and state-owned enterprises to implement restructuring plans and organizational reforms by business sectors, regardless of management levels. Comprehensively restructure each state-owned enterprise regarding organizational models, management, finance, production and business development plans, product structures, human resources; perfect regulations on the rights, obligations, and responsibilities of shareholders, shareholder representatives, and managers in state-owned enterprises, management mechanisms for state capital and assets in enterprises, supervision, inspection mechanisms, and sanctions.

Implement financial transparency and public disclosure of state-owned enterprises' operations within the Industry and Trade sector; gradually create an equal competitive environment for enterprises under other economic sectors, control monopolies, while establishing mechanisms and policies to promote restructuring in the private business sector. State-owned corporations and conglomerates shall focus solely on their core business areas; complete the divestment from non-core business investments by 2015.

3. Develop industries and fields

Establish mechanisms and policies within the Industry and Trade sector to promote structural transformation towards leveraging comparative advantages, maximizing potential and efficiency. Diversify industries and professions to create more jobs and income for workers. Strengthen collaboration, exploit and enhance the strengths of each economic region; facilitate the development and role of key economic regions, creating a ripple effect for other economic regions.

a) Vigorously transform the industrial and construction structure towards modernization, improving quality and competitiveness. Develop foundational industries with comparative advantages and significance for rapid, efficient, sustainable development, enhancing economic independence and autonomy, gradually participating effectively in global distribution networks. Prioritize the development of supporting industries, industries serving agriculture and rural areas; concentrate on developing the energy industry, high-tech industries with high added value and many export products. Review and minimize the establishment of new coastal economic zones, industrial parks, border economic zones; set criteria for selecting certain economic zones and industrial parks for focused investment; prioritize investment order within each zone according to a timeline for early operation; at the same time, pay attention to building welfare facilities for workers in these zones.

b) Effectively develop the service sector, especially high-value services with great potential and competitiveness, to achieve higher growth rates than production sectors and higher than GDP growth. Focus on developing service areas with high added value, potential, and competitiveness. Vigorously develop science and technology services, education and training, employment and social security services. Improve the quality of service products and the competitiveness of Vietnamese service businesses in domestic, regional, and international markets; actively exploit the potential and advantages of each service area, strengthen cooperation between service areas to compete and develop together.

c) Leverage the potential and strengths of each region, create connections between regions for balanced and sustainable development. Review, adjust, and supplement planning and establish appropriate mechanisms and policies for all regions to develop together. Promote the development of key economic regions, providing impetus and a ripple effect for other regions; simultaneously, create conditions for faster development in areas with many difficulties, particularly border areas, islands, Southwest, Central Highlands, Northwest, and western central provinces. Gradually reduce disparities in development levels and living standards between regions.

d) Efficiently mobilize and utilize resources. Review and simplify administrative procedures, encourage and create favorable conditions to attract both domestic and foreign investors to invest and operate in Vietnam. Promote socialization in investment development; mobilize capital from various economic sectors through appropriate investment mechanisms and forms such as BOT, BT, BTO, PPP, etc., for electricity infrastructure investment. Develop clear policies and strategies for attracting FDI and ODA funds. Establish and improve mechanisms and policies to ensure the efficient use of resources and overall economic performance, protecting the environment.

Enhance measures to promote reform and improve the operational effectiveness of state-owned enterprises in the Industry and Trade sector to maintain and enhance the leading role of the state economy. Reorganize and innovate state-owned enterprises towards retaining only large-scale corporations, total state-owned enterprises operating in critical sectors of the economy. Continue to restructure business lines and capital and assets of state-owned enterprises. Vigorously develop private economic models, create conditions for the formation of some private economic groups, and encourage private participation in state economic groups. Encourage the development of various types of enterprises with mixed ownership forms such as joint-stock companies, limited liability companies, partnerships, cooperatives.

4. Further perfect the socialist-oriented market economy system

Focus on drafting laws and ordinances according to the Law and Ordinance Construction Program of the 13th National Assembly and annually, ensuring quality and progress. Prioritize projects related to the three breakthroughs of the Socio-Economic Development Strategy 2011-2020, including: Perfecting the socialist-oriented market economy system; rapidly developing human resources, especially high-quality human resources; building a synchronized infrastructure system, including some modern works, focusing on transportation systems and large urban infrastructure.

Regularly review to promptly identify and proactively amend and supplement deficiencies and limitations in laws and regulatory legal documents within the scope of authority, and submit to competent authorities for decision-making amendments and supplements to move towards a unified, synchronized, accessible, and applicable legal system, consistent with international integration requirements. Focus on the following priorities:

- Ensure freedom of business and equality among economic sectors. Continue to strongly innovate and improve the efficiency of state-owned enterprises, especially economic groups and holding companies.

- Continue to innovate in building and enforcing laws to ensure fair and transparent competition among businesses from all economic sectors.

5. Improve the quality of education and training, the quality of human resources; develop science and technology and knowledge-based economy.

a) Implement measures to enhance the quality of training at all levels in educational institutions under the Ministry to meet the demand for human resources for industry development, actively contributing to implementing new economic growth models, increasing labor productivity, improving efficiency, protecting the environment, and sustainable development. Reform the education management mechanism, develop the teaching staff and administrative personnel, strengthen autonomy and responsibility for educational and training institutions; Promote socialization, maximize the participation of businesses in developing education and training.

b) Focus on key investment in science and technology to directly serve the goal of technological innovation and enhancing the competitiveness of the industry; create national products with high productivity and added value, applying advanced technology; form a system of science and technology enterprises. Enhance scientific research capabilities, creativity, and technological innovation, increase the contribution rate of science and technology to boost productivity, quality, and competitiveness of products. Fundamentally reform the financial mechanism to suit the characteristics of science and technology activities.

6. Protect and improve the environment, proactively prevent and mitigate the consequences of natural disasters, effectively respond to climate change.

Focus on effectively implementing the National Target Program on responding to climate change; the National Target Program on mitigating pollution and improving the environment; and the Action Plan for responding to climate change in the industry.

Efficiently use, manage, and exploit natural resources, ensuring environmental balance and ecological equilibrium. Proactively respond to climate change, particularly sea level rise. Gradually integrate climate change content into planning and development plans for the industry. Participate in building and implementing the Green Growth Strategy, the National Action Plan to implement the Sustainable Development Strategy for the period 2011-2015 in industry activities.

Fundamentally reform the management mechanism for mineral resource exploitation, ensuring exploitation according to planning, focusing on economic, social, environmental, and national defense effectiveness. Cease raw ore mining for export.

7. Actively and proactively integrate internationally.

Expand foreign relations, proactively integrate, enhance Vietnam's position on the international stage. Synchronize and comprehensively implement diplomatic activities with a focus, making relationships with partners deep, stable, and sustainable, paying attention to countries sharing borders with Vietnam. Actively and effectively integrate internationally, contributing to rapid, sustainable development, and building an independent and self-reliant economy. Fulfill international commitments responsibly. Leverage and mobilize resources from overseas Vietnamese communities for national development.

Emphasize administrative reform, enhance capacity and efficiency in state management; strengthen anti-corruption work.

Continue to vigorously promote administrative reform; implement the overall administrative reform program for the 2011-2020 period, focusing on simplifying administrative procedures related to business and citizen activities. Improve the quality and effectiveness of inter-agency coordination of state administrative agencies under the Ministry and provincial Industry and Trade Departments. Clearly define the functions, tasks, authorities, and responsibilities of the Ministry and provincial Industry and Trade Departments. Organize the construction, revision, supplementation, and completion of the standard job titles for civil servants and officials (including leadership and management positions). Continue to build a professional cadre, improve the quality and capability of the civil servant corps, especially those directly involved in policy formulation and leadership; establish a civil servant structure linked to job positions; implement the career employment system firmly. Continue to reform incentive policies, motivate, and encourage cadres and civil servants.

Firmly and synchronously implement anti-corruption measures; strengthen preventive measures to curb corruption. Highlight the responsibility of heads of agencies and units. Strengthen inspection and supervision to promptly identify, correct, and handle deficiencies and violations in state management, economic and social management, and compliance with policies and laws by organizations and individuals; promptly resolve complaints and petitions and public grievances in accordance with the law.

III. IMPLEMENTATION

1. Based on the main tasks and contents of this Action Program, according to the assigned functions, tasks, and authorities, the Heads of agencies and units under the Ministry, Economic Groups, Holding Companies, and Industry and Trade Departments of provinces and centrally-administered cities shall direct the development of their own Action Programs for the entire term, concretizing them into annual plans; continue to build, review, revise, supplement mechanisms, policies, plans, programs, projects, and proposals to be submitted to the Government and Prime Minister throughout the Government's term. The Heads of agencies and units under the Ministry are responsible for organizing the implementation of assigned tasks and work contents, ensuring timely progress and quality.

2. The heads of agencies and units under the Ministry shall concentrate on directing, strengthening inspection, and urging the implementation of this Action Program; annually (before November 30 each year), agencies, units, Departments of Industry and Trade, and enterprises shall organize reviews to assess the results of the program's implementation and report to the Ministry (Planning Department) for consolidation and reporting to the Government.

3. Entrust the Planning Department to take the lead, coordinate with the Ministry’s Office and units under the Ministry to monitor, urge the implementation of the Action Program, regularly report and recommend measures necessary to ensure the comprehensive and effective implementation of this Action Program to the Ministry for submission to the Government and the Prime Minister.

4. During the process of organizing the implementation, if it is deemed necessary to amend and supplement specific contents in the Government's Action Program for the 2011-2016 term, units shall proactively report to the Ministry for submission to the Prime Minister for consideration and decision./.
