Regulations on functions, tasks, powers, and organizational structure

of the Plant Quarantine Region IV Inspection Office

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Plant Protection and Quarantine Law 2001;

Pursuant to Decree No. 86/2003/ND-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decision No. 88/2003/QD-BNN dated September 4, 2003 of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Plant Protection Department;

Considering the proposal of the Director of the Plant Protection Department and the Director of the Cadre and Civil Servant Affairs Department,

DECISION:

The Plant Quarantine Region IV Inspection Office is a unit under the Plant Protection Department, having the function of state management over plant quarantine, possessing legal personality, its own seal, operational funds, and bank accounts as prescribed by law. Its scope of operation includes the provinces of Bình Định, Phú Yên, Khánh Hòa, Kon Tum, Gia Lai, and Đắk Lắk. The office's headquarters is located at 66 Lê Hồng Phong Street, Quy Nhơn City, Bình Định Province.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Implement plant quarantine on objects subject to plant quarantine for export, import, temporary import for re-export, temporary export for re-import, transit, and handle such objects according to the provisions of laws and international agreements on plant quarantine that Vietnam has signed and joined.

2. Issue certificates of plant quarantine and certificates of fumigation disinfection practice according to the provisions of law;

3. Collect fees and charges related to plant quarantine work according to the provisions of law;

4. Manage and implement disinfection according to the provisions of law;

5. Train and provide professional training on plant quarantine and disinfection for provincial plant protection sub-departments within the region;

6. Guide, inspect, and urge the implementation of domestic plant quarantine work for provinces and cities within the region;

7. Conduct specialized inspections according to the assigned level and resolve complaints and denunciations regarding plant quarantine according to the assigned authority;

8. Participate in building standards, procedures, and experimental surveys on plant quarantine;

9. Participate in international cooperation programs on plant quarantine;

10. Manage civil servants, finance, assets, and other resources assigned;

11. Perform other tasks assigned by the Director of the Plant Protection Department.

Article 3. Organizational Structure

1. Leadership of the Office: The leadership of the Plant Quarantine Region IV Inspection Office consists of the Office Director and Deputy Directors appointed by the Director of the Plant Protection Department in accordance with regulations. The Office Director manages the activities of the Office, is responsible to the Director of the Plant Protection Department and to the law regarding the Office’s activities and assigned tasks. Deputy Directors assist the Office Director and are responsible to the Office Director and to the law for the tasks they are assigned. The number of Deputy Directors shall not exceed two.

2. Management Structure of the Sub-Department

2.1 Supporting Departments:

a) Administrative General Department;

b) Technical Department;

c) Export and Import Plant Quarantine Department.

2. Subordinate Plant Quarantine Stations: These stations have their own seals to carry out plant quarantine tasks as prescribed by law. The Director of the Plant Protection Department will establish the Rules of Operation for these units.

Article 4. Effective date

This Decision takes effect fifteen days after its publication in the Official Gazette of the Government. This Decision replaces Decision No. 74/NN-TCCB/QĐ dated February 8, 1994, issued by the Minister of Agriculture and Food Industry (now the Ministry of Agriculture and Rural Development), concerning the functions, duties, authorities, and organizational structure of the Plant Quarantine Region IV Inspection Office. Previous regulations contrary to this Decision are hereby abolished.

Article 5. Responsibilities for Implementation

The Head of the Ministry's General Office, the Director of the Cadre and Civil Servant Affairs Department, the Director of the Plant Protection Department, the Heads of relevant agencies and units under the Ministry, and the Director of the Plant Quarantine Region IV Inspection Office are responsible for implementing this Decision.
