Regarding the amendment of Clause 1, Clause 4, Article 1, and Article 5 Decision No. 1826/2002/QĐ-BGTVT dated June 12, 2002 issued by the Minister of Transport Based on the Prime Minister's opinion at Document No. 1740/CP-QHQT dated November 19, 2004 regarding the addition of business objectives for port operation to Bourbon Company - Ben Luc Province of Long An;
THE MINISTER OF TRANSPORTATION
Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Based on Decision No. 07/2005/QĐ-BGTVT dated January 7, 2005 issued by the Minister of Transport promulgating the regulations on port management and inland waterway wharf management;
At the proposal of the Director of the Transport Department, the Director of the Vietnam Inland Waterways Administration,
Amend Clause 1, Clause 4, Article 1, and Article 5 of Decision No. 1826/2002/QĐ-BGTVT dated June 12, 2002 issued by the Minister of Transport as follows:
DECISION:
Article 1. 1. Clause 1, Article 1: "1. The Bourbon - Ben Luc - Long An Port of Bourbon - Ben Luc - Long An Processing and Packaging Agricultural and Food Products Limited Company (hereinafter referred to as the Bourbon - Ben Luc - Long An Port) is hereby authorized to receive Vietnamese ships and foreign vessels (hereinafter referred to as ships) with a deadweight tonnage up to 5,000 DWT and a draft up to 4 meters and a air clearance height not exceeding 20 meters for entry, exit, and cargo handling operations at this port."
2. Clause 4, Article 1: "4. For ships with a draft greater than 4 meters, the Vietnam Inland Waterways Management Authority Region III shall coordinate with the Section 10 of the Vietnam Inland Waterways Management Authority, based on the actual conditions of the channel, meteorology, hydrology, and tides, to consider and decide on the permission for ships to enter, exit, and handle cargo at this wharf and shall be responsible for ensuring the safety of ships during their operations."
3. Article 5: "This Decision shall take effect fifteen days from the date of publication in the Official Gazette."
The Head of the Ministry’s Office, the Inspector General, the Director of the Transport Department, the Director of the Legal Affairs Department, the Director of the Vietnam Inland Waterways Administration, the Director of the Vietnam Maritime Administration, the Director of the Bourbon - Ben Luc - Long An Port, the Heads of relevant Departments and units shall be responsible for implementing this Decision./.
Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette.
Article 3. The Head of the Ministry’s Office, the Inspector General of the Ministry, the Director of the Transport Department, the Director of the Legal Affairs Department, the Director of the Vietnam Inland Waterways Administration, the Director of the Vietnam Maritime Administration, the Director of the Bourbon Bến Lức - Long An Port, and the Heads of relevant Departments and agencies are responsible for implementing this Decision./.
