Regarding the amendment of Circular No. 09/2005/TT-BYT dated March 28, 2005 of the Ministry of Health guiding the conditions for determining individuals exposed to HIV or infected with HIV due to occupational accidents or risks

THE MINISTER OF HEALTH

Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Article 21 of the Ordinance on Prevention and Control of Infection with Human Immunodeficiency Virus (HIV/AIDS) dated May 31, 1995;

Pursuant to Article 10 of Decree No. 34/CP dated June 1, 1996 of the Government guiding the implementation of the Ordinance on Prevention and Control of Infection with Human Immunodeficiency Virus (HIV/AIDS);

Pursuant to Decision No. 265/2003/QĐ-TTg dated December 16, 2003 of the Prime Minister regarding the treatment of individuals exposed to HIV or infected with HIV/AIDS due to occupational accidents or risks;

At the proposal of the Director of the Legal Department and the Director of the National Center for HIV/AIDS Prevention and Control,

DECISION:

Article 1. Amending Point a, Clause 3, Part III concerning the authority to issue Certificates of Exposure to HIV and Certificates of HIV Infection due to Occupational Accidents or Risks as follows:

a) The Ministry of Health (National Center for HIV/AIDS Prevention and Control) shall issue Certificates of Exposure and Certificates of HIV Infection for cases where individuals are exposed to HIV or infected with HIV while working at agencies or units under the management of central ministries and sectors (in accordance with the model attached as Appendix 2 to this Circular).

Article 2. Amending the model of Certificates of Exposure to HIV and Certificates of HIV Infection due to Occupational Accidents or Risks stipulated in Appendix 2 issued together with Circular No. 09/2005/TT-BYT dated March 28, 2005 of the Ministry of Health guiding the determination of individuals exposed to HIV or infected with HIV due to Occupational Accidents or Risks as follows:

Replacing the phrase "Preventive Medicine and HIV/AIDS Control Center" with the phrase "National Center for HIV/AIDS Prevention and Control".

Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 4. Comrades: Director of the Office, Director of the Legal Department, Director of the National Center for HIV/AIDS Prevention and Control, Director of the Treatment Department of the Ministry of Health, Heads of units directly under the Ministry, Heads of Health Departments of Ministries, Directors of Provincial Health Services under the Central Government, and related units are responsible for implementing this Decision./.
