Pursuant to the Maritime Code of Vietnam dated June 14, 2005;

Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transportation;

Pursuant to Decree No. 71/2006/NĐ-CP dated July 25, 2006 of the Government on port management and maritime channels;

Based on the opinions of the People's Committee of Nam Dinh Province at Official Letter No. 196/UBND-VP3 dated October 3, 2006;

At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration.

DECISION:

Article 1.

1. Now announcing the port waters within the jurisdiction of Nam Dinh Province, including:

a) The water area before the wharf of the Hai Thinh and Thinh Long ports.

b) The water area of the port channel, branch port channel, pilot station, quarantine zone, anchorage, and storm shelter area as specified in point a of this clause.

2. The water area before the wharf, anchorage, transshipment area, and other storm shelters are announced according to the provisions of the law.

Article 2. The scope of the port waters within the jurisdiction of Nam Dinh Province is measured from the highest tide level and is defined as follows:

1. The seaward boundary: limited by straight lines connecting the following coordinate points:

A1: 19059’45”N, 106011’23”E;

A2: 19058’21”N, 106010’11”E;

A3: 19055’33”N, 106013’11”E;

A4: 19055’33”N, 106013’23”E;

A5: 19059’45”N, 106013’23”E;

A6: 19055’45”N, 106011’35”E.

2. The landward boundary: limited from point A1 and A2 running along both banks of the Ninh Co River to the straight line crossing the river 800 meters upstream from the Hai Thinh port wharf.

Article 3. The pilot station, quarantine zone, anchorage, and storm shelter for vessels entering the port waters within the jurisdiction of Nam Dinh Province are specifically defined as follows:

1. Pilot station and quarantine zone: the water area limited by a circle with a radius of 0.4 nautical miles, with the center located at coordinates:

190 58’ 42” N, 1050 57’33” E.

2. Anchorage and storm shelter: the water area limited from the straight line crossing the river at the upper end of the Hai Thinh port wharf to the straight line crossing the river 800 meters upstream from the Hai Thinh port wharf.

Article 4. The Nam Dinh Marine Port Authority shall be responsible for:

1. Performing its duties and powers as prescribed by the Vietnam Maritime Code and related laws concerning maritime activities in the port waters within the jurisdiction of Nam Dinh Province.

2. Based on actual conditions regarding weather, waves, draft, and vessel tonnage, designate specific locations for vessels to pick up and drop off pilots, undergo quarantine, anchor, transship, and avoid storms within the water areas specified in Article 3 of this Decision, ensuring maritime safety, maritime security and preventing environmental pollution.

Article 5. Outside the water areas specified in Articles 2 and 3 of this Decision, the Nam Dinh Marine Port Authority shall also be responsible for state management of maritime safety and security in the sea areas within the jurisdiction of Nam Dinh Province.

Article 6. This Decision takes effect fifteen days after its publication in the Official Gazette and revokes Decision No. 290/1999/QĐ-BGTVT dated February 3, 1999 of the Minister of Transportation on the water areas of the Hai Thinh Port and the responsibility area of the Hai Thinh Port Authority.

Article 7. The Head of the Ministry’s Office, the Inspector General, Heads of Departments under the Ministry, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterways Administration, Directors of the Nam Dinh Department of Transport, Directors of the Nam Dinh Marine Port Authority, Heads of agencies, units, and individuals concerned are responsible for implementing this Decision./.
