THE MINISTER OF INDUSTRY AND TRADE

Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade concerning international trade activities and foreign trade agency buying, selling, processing, and transit operations;

Pursuant to Decision No. 41/2005/QD-TTg dated March 2, 2005 of the Prime Minister promulgating the Import Permit Issuance Regulation;

At the proposal of the Director of the Import-Export Department.

DECISION:

Article 1. The automatic import permit regime shall be applied to goods listed in Appendix No. 01 issued together with this Decision.

Article 2. Temporary import for re-export, temporary export for re-import, transshipment, non-trade import, and import for production and processing for export to foreign countries are not within the scope of this Decision and shall be carried out in accordance with current regulations.

Article 3. The automatic import permit shall be granted in the form of confirmation of the importer's registration for each consignment. The Director and Deputy Director of the Import-Export Department shall be responsible for confirming such registrations.

Article 4. The application package for an automatic import permit includes:

- An automatic import registration form: two copies according to the model at Appendix No. 02 issued together with this Decision.

- A copy of the business registration certificate: one copy (certified true copy by the trader) for new traders registering for import.

- A copy of the import contract: one copy (certified true copy by the trader).

- A copy of the letter of credit or payment document or bank payment confirmation: one copy (certified true copy by the trader).

- A copy of the bill of lading or transport document of the consignment: one copy (certified true copy by the trader).

- A report on the implementation of importation according to the model at Appendix No. 03 issued together with this Decision for consignments previously granted permits by the Ministry of Industry and Trade (if applicable), accompanied by a customs declaration confirmed as actually imported (certified true copy by the trader).

Article 5. The application package (for permit issuance) shall be sent via postal service or submitted directly to the Office of the Ministry of Industry and Trade. Permit officers will not directly accept applications.

Article 6. The permit issuance period under the automatic regime is ten working days from the date the Ministry of Industry and Trade receives a complete and valid application package.

Article 7. When handling import procedures, in addition to the import documentation required under current regulations, the trader must present to the customs authority one copy of the import registration form confirmed by the Ministry of Industry and Trade.

Article 8. Within five days from the completion of customs procedures for the imported consignment, the trader must submit to the Ministry of Industry and Trade a report on the import situation according to the model at Appendix No. 03 issued together with this Decision.

Article 9. This Decision takes effect twenty-one days from its publication in the Official Gazette and ceases to be effective on December 31, 2008.

Article 10. The Head of the Office of the Ministry, the Director of the Import-Export Department, Heads of units under the Ministry, traders, and related agencies are responsible for implementing this Decision./.
