THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Article 19 of Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Considering the proposal of the Director of the Department of Personnel Organization,
DECISION:
Article 1. Position and Functions
Directorate Aquaculture is an agency under the Ministry of Agriculture and Rural Development, performing the function of advising the Minister in managing state affairs in the specialized sector and implementing state management tasks within the field of aquaculture.belonging to the scope of state management of the Ministry.The Aquaculture Cultivation Department has legal personality, its own bank account and seal, and operational funds as prescribed by law.
The headquarters of the Department is located in Hanoi City and it has a permanent office in the southern region.
1. Submit draft laws, ordinances, and draft regulatory legal documents for the specialized sector to the Ministry according to the annual legislative program and plan of the Ministry, and other projects and programs assigned by the Minister. Submit draft decisions, directives, and other documents within the authority of the Minister's command and management to the Minister.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
2. Submit to the Ministry strategies, plans, and long-term, five-year, and annual development plans; regional strategic plans, inter-regional, and inter-provincial plans, and important programs, projects, and works within the specialized sector and field managed by the Department as assigned by the Minister.
3. Issue individual documents and internal regulations within the specialized sector and field under the responsibility of the Department, and provide professional guidance and training in the specialized sector and field as assigned by the Minister. Announce detailed implementation plans for programs, projects, and initiatives managed by the Ministry to each locality and unit after the overall plan for the sector and field under the Department's jurisdiction has been approved by the Ministry.
4. Submit to the Ministry for publication strategies, plans, and development programs, and organize the direction, guidance, inspection, and supervision of the implementation of regulatory legal documents, strategies, plans, programs, projects, standards, technical regulations, procedures, norms, and economic-technical criteria within the specialized sector that have been approved; direct and organize the dissemination, popularization, and education of laws within the specialized sector under the Department's jurisdiction.
5. Regarding aquaculture:
a) Submit to the Ministry mechanisms, policies for developing aquaculture; national technical standards, management regulations, and hierarchical management of safe aquaculture zones/facilities;b) Issue cultivation procedures and norms for aquaculture facilities pursuant to the Minister's authorization;
c) Direct the implementation of food safety management systems in aquaculture;
d) Guide the implementation and organize inspections, monitoring, and certification of aquaculture facilities to ensure the safety of aquatic products;
đ) Coordinate with competent authorities to manage the leasing, extension, and recovery of land and sea surfaces for aquaculture in accordance with the law.
6. Management of aquatic seedlings:
a) Submit to the Ministry mechanisms, policies, and programs for developing aquatic seedlings; lists of permitted production, trade, and import/export aquatic seedlings; other lists concerning aquatic seedlings as prescribed by law;
b) Submit to the Ministry national technical standards for aquatic seedlings, management regulations for seedlings, aquatic seedling systems, national seedling registration, and recognition of new seedlings;
c) Define procedures, norms, techniques, and technologies for aquatic seedlings; lists of permitted production and trade of aquatic seedlings; import/export of aquatic seedlings, genetic materials, domestication, conservation, breeding, and conditions for producing and trading aquatic seedlings; criteria for the scale of seedling production farms pursuant to the Minister's authorization;
d) Direct the implementation of seedling programs. Manage the quality of aquatic seedlings and activities related to testing and inspecting seedling quality; trial and propose recognition of new aquatic seedlings;
đ) Issue, revoke certificates for conditions of seedling production and trade zones/facilities; sperm, eggs, and embryo seedlings of aquatic livestock; permits for the first import of untested aquatic seedlings; certificates for seedling production and trade operations in accordance with the authority and provisions of the law.
7. Management of feed, biological preparations, and specialized equipment in aquaculture:
a) Submit to the Ministry national technical standards for feed, raw materials for feed production, additives, and biological preparations used in aquaculture; regulations on environmental protection for feed production and trade facilities;
b) Issue lists of permitted production, trade, and import/export of aquaculture feed; prohibited and restricted biological preparations for use in aquaculture; testing procedures for feed, raw materials for feed production, and additives; management regulations for biological preparations (including non-drug preparations, pest control preparations, bottom treatment preparations) used in aquaculture pursuant to the Minister's authorization;
c) Manage and organize testing and trials of feed, raw materials for feed production, biological preparations, and specialized equipment in aquaculture;
d) Direct, monitor, and inspect conditions for feed production and trade; quality of feed, raw materials for feed production, and additives; quality of biological preparations used in aquaculture;
đ) Coordinate and oversee the testing of product quality for specialized equipment in aquaculture;
e) Issue and revoke permits for the import and export of feed, raw materials for feed production, and additives; biological preparations used in aquaculture; specialized equipment for aquaculture not yet tested or inspected; certificates for feed production and trade, biological preparations, and specialized equipment in accordance with the regulations.
8. Management of the environment in aquaculture:
e) Issuing and revoking permits for the import and export of feed, raw materials for feed production, and additives; biological products used in aquaculture; specialized equipment and materials for aquaculture that have not been tested or inspected; certificates for the production and business operation of feed, biological products, and specialized equipment and materials in accordance with regulations.
8. Environmental management in aquaculture:
a) Submit to the Ministry regulations on managing the environmental monitoring and warning system for aquaculture; national technical standards on water quality for aquaculture, production environment for seedlings, feed, biological preparations, and aquaculture; national technical standards applicable in aquaculture environmental treatment. Guide, direct, and inspect the implementation thereof.
b) Supervise, inspect, and evaluate the conditions and quality of the environment in aquaculture areas/facilities, seedling production, feed production, biological preparations; propose solutions to handle source water supply, wastewater, and improve aquaculture pond environments; manage and direct environmental monitoring and warning activities in aquaculture according to programs and plans.
c) Inspect and organize the prevention and control of aquatic diseases.
d) Chair the review of environmental impact assessment reports of planning projects and investment development projects for seedlings and aquaculture.
9. Direct aquaculture production:
a) Develop and direct the implementation of seasonal, annual, and multi-year aquaculture production plans;
b) Direct the development and inspection of concentrated aquaculture area development plans ensuring safety;
c) Direct the cultivation seasons, species, and structure, harmonize seedlings, production techniques, harvesting; coordinate water management for aquaculture; direct disease prevention, control, and disaster mitigation in aquaculture production;
c) Summarize and promote advanced models in the field of aquaculture.
10. Submit to the Ministry a list of investment development projects for aquaculture. Chair the review and perform the main investor tasks for projects assigned by the Ministry to the Bureau.
11. Organize and direct statistical investigation and database management on aquaculture production as prescribed.
12. Submit to the Ministry a list of research facilities and laboratories meeting testing, trial, and quality inspection conditions for aquaculture seeds; aquaculture environment quality; feed quality, raw materials for feed production, and additives; biological preparations, specialized equipment in aquaculture.
13. Participate in veterinary work and product hygiene and safety quality inspections in accordance with the Minister's assignment.
14. Regarding science and technology:
a) Propose to the Ministry scientific research programs, plans, and topics; application of technological progress and specialized techniques;
b) Participate in reviewing scientific tasks related to aquaculture. Chair the review of research outlines and topics; commission organizations and individuals to implement; accept and manage research results and direct the application of technological progress within the Bureau's jurisdiction;
c) Manage information on science and technology in specialized fields;
d) Participate in drafting national standards and national technical standards within the Ministry's jurisdiction as assigned by the Minister.
15. Direct the promotion of aquaculture extension activities.
16. Participate in trade promotion activities in specialized aquaculture fields as assigned by the Minister.
17. Regarding international cooperation:
a) Develop and submit to the Ministry international cooperation programs and projects within the Bureau's jurisdiction;
b) Organize the implementation of international cooperation, funded programs, and projects according to the Minister's classification.
18. Regarding administrative reform:
a) Develop and implement administrative reform plans according to the Ministry's plan and the Minister's directives;
b) Direct the review, systematization, and proposal for building institutional and legal systems within the Bureau's jurisdiction;
c) Direct the improvement of functions, tasks, and authorities of subordinate organizations towards delegation and decentralization; submit to the Ministry for task decentralization in the industry and sector to local governments;
d) Direct the implementation of regulations on self-management, responsibility for task execution, organizational structure, staffing, finance, and administrative procedure reform, modernizing office operations, and applying information technology to serve Bureau activities.
19. Regarding state management of organizations providing public services within the Bureau's jurisdiction:
a) Submit to the Ministry mechanisms, policies, and technical standards for public service provision; socialization of public service activities in the industry and sector;
b) Issue technical standards, economic-technical norms, and timeframes for public service provision within the industry and sector;
c) Guide, inspect, and support organizations providing public services within the industry and sector as prescribed by law.
20. Regarding state management of non-governmental organization activities within the Bureau's jurisdiction as assigned by the Minister:
a) Guide and create conditions for NGOs to participate in activities within the Bureau's jurisdiction; organize consultations and incorporate NGO proposals and critiques to perfect regulatory management in the industry and sector;
b) Recommend measures to address violations of law by NGOs operating in the industry and sector.
21. Regarding organizational structure, staffing, and civil servants and officials:
a) Draft the functions, tasks, authorities, and organizational structure of the Bureau; propose the establishment and restructuring of subordinate organizations;
b) Decide on the establishment of Bureau working groups; specify detailed provisions on autonomy, organizational charters, and activities for state-owned enterprises under the Bureau as prescribed;
c) Submit to the Ministry the Bureau's annual staffing plan; decide on administrative staffing allocation for Bureau agencies;
d) Decide on sending civil servants and officials abroad for study and work according to the Ministry's cadre management classification;
đ) Specify the authority and responsibility of heads of organizations under the Bureau;
e) Decide and implement specific measures to strengthen administrative discipline; organize anti-corruption, waste, bureaucracy, harshness, and arbitrary practices in Bureau units.
g) Organize the recruitment, utilization, transfer, rotation, retirement, salary system, rewards, and other systems for cadres, civil servants, and public officials under the management scope of the Bureau in accordance with the laws and the delegation of the Ministry; train and enhance professional knowledge and skills according to the assignment of the Minister;
h) Develop professional standards for civil servant and public official ranks within the industry and field according to the assignment of the Minister;
i) Report on organizational work, cadre affairs, and staffing in accordance with regulations;
22. Regarding inspection and supervision:
a) Guide and inspect the implementation of policies and laws concerning the industry and field under the management scope of the Bureau as prescribed;
b) Resolve or participate in resolving complaints, petitions, and suggestions from organizations and citizens related to the industry and field managed by the Bureau; organize citizen reception in accordance with the law;
c) Inspect and supervise the implementation of delegated management authority over the industry and field under the management scope of the Bureau and handle violations in accordance with the law;
23. Regarding financial and asset management:
a) Submit the annual budget estimate and medium-term budget plan of the Bureau to the Ministry;
b) Be responsible for finalizing accounts of financial resources directly managed by the Bureau; manage and be accountable for state assets assigned to the Bureau according to the delegation of the Minister and the provisions of the law;
24. Perform the standing committee tasks of the program development board in the aquaculture sector according to the assignment of the Minister;
25. Carry out other tasks as stipulated by specialized laws and the assignment and delegation of the Minister;
Article 3. Organizational Structure
1. Leadership of the Bureau:
The Bureau leadership consists of the Director and Deputy Directors appointed and relieved of duty by the Minister of Agriculture and Rural Development in accordance with regulations;
The Director oversees the activities of the Bureau, is responsible to the Minister of Agriculture and Rural Development, and the law for the activities of the Bureau;
Deputy Directors assist the Director in overseeing certain aspects of work according to the Director's assignment and are responsible to the Director for the assigned tasks;
2. Management Structure:
a) Aquaculture Production Department;
b) Aquatic Seed Management Department;
c) Aquatic Feed and Service Management Department;
d) Aquaculture Environment Management Department;
đ) Planning and Finance Department;
e) Inspection and Legal Affairs Department;
g) Bureau Office;
h) Southern Region Standing Unit;
3. Affiliated Public Service Units:
The Director of the Aquaculture Bureau develops proposals for establishing testing, trial, and certification public service units under the Bureau to submit to the Minister for decision;
The Director of the Aquaculture Bureau defines the functions and responsibilities of the management structure; appoints staff according to the Ministry's management delegation and promulgates the Bureau's operational regulations;
Article 4. Effective date
This Decision takes effect fifteen days after its publication in the Official Gazette;
Article 5. Responsibility for Implementation
The Director of the Aquaculture Bureau, the Head of the Ministry's Office, the Heads of Departments, the Directors of Bureaus, the Inspector General of the Ministry, and the Heads of relevant agencies and units are responsible for implementing this Decision./.
