Regulations on functions, tasks, powers, and organizational structure

of the Planning and Finance Department

At the proposal of the Director of the Cinema Department.

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Considering the proposal of the Head of the Planning and Finance Department and the Head of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1. Position and Functions

The Planning and Finance Department is an agency of the Ministry of Culture, Sports and Tourism with the function of advising the Minister on state management over planning, investment, finance, and public services in the fields of culture, family, sports, and tourism in accordance with the Party's guidelines and State laws.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. To take the lead or coordinate with relevant agencies and units in drafting and submitting to the Minister strategic plans, long-term, five-year, and annual plans; national target programs, action programs, and important national projects; draft regulatory legal documents; participate in drafting and negotiating international agreements and treaties within the scope of planning, investment, finance, and public services of the Ministry and the cultural, sports, and tourism sectors.

2. To take the lead in reviewing or coordinating with relevant agencies and units in drafting and submitting to the Minister for approval and issuance according to their authority or submission to competent authorities for approval and issuance of proposals, projects, plans, annual programs, action programs of the Ministry, systems, policies, economic standards, technical norms, prices within the scope of planning and finance of the Ministry and the cultural, sports, and tourism sectors.

3. To organize or coordinate in guiding, inspecting, and evaluating the implementation of strategic plans, long-term, five-year, and annual plans; national target programs, action programs, and important national projects; systems, policies, economic standards, technical norms, prices; regulatory legal documents related to the functions and tasks of the Department.

4. To take the lead in guiding subordinate budgetary units of the Ministry in preparing and consolidating annual state budget estimates and submitting them to the Minister; allocate the state budget estimates to subordinate budgetary units of the Ministry, sponsored and commissioned units according to regulations and guide the organization of implementation after approval.

5. To review and approve financial final accounts of subordinate budgetary units of the Ministry; prepare reports, consolidate state budget final accounts and financial transparency; manage the use of state assets of subordinate budgetary units of the Ministry according to regulations; inspect accounting work and financial management; monitor the implementation of the state budget of the Ministry. To take the lead in auditing final accounts of completed projects funded by the state budget through the Ministry and submit them to the Minister for approval.

6. To assist the Minister in implementing state management over basic construction investment within the authority of the Ministry of Culture, Sports and Tourism as prescribed by law;

To implement state management over basic construction investment for the Vietnam Cultural Village - Tourism Village according to the authority prescribed by law;

To take the lead in organizing reviews and submitting to the Minister for approval and organizing the implementation of programs and projects under the Ministry of Culture, Sports and Tourism according to the law.

7. To implement reporting, statistics, and information databases on economic matters assigned. To monitor and evaluate the economic efficiency and investment contributions to society of enterprises operating in the fields of culture, family, sports, and tourism.

8. To assist the Minister in managing the implementation of the State's ownership rights in state-owned enterprises directly under the Ministry of Culture, Sports and Tourism; to be the focal point for directing state-owned enterprises that have been privatized to transfer state capital to the State Capital Investment Corporation as the representative owner; to carry out inspections and supervision of enterprises engaged in production and service activities in the fields of culture, family, sports, and tourism in accordance with the provisions of the law.

9. To guide the preparation and participate in reviewing projects with domestic and foreign investment; to guide the preparation, consolidation, and implementation of plans for programs and projects from official development assistance (ODA) funds.. To be the focal point for state management over import and export for business purposes of specialized goods in the fields of culture, family, sports, and tourism as prescribed by law.

10. To participate in guiding and inspecting the implementation of the program for administrative reform in the field of public finance in the areas of culture, family, sports, and tourism.

11. To take the lead in implementing thrift and anti-waste practices among administrative agencies, public institutions, and state-owned enterprises directly under the Ministry and the cultural, sports, and tourism sector in accordance with the law.

12. To inspect and supervise planning and finance matters concerning state budget support for the activities of associations, federations, unions, and non-governmental organizations in the fields of culture, family, sports, and tourism in accordance with the law.

13. To serve as the permanent member of the steering committee for economic integration at the international level; development of key economic regions; national target programs; socialization in the fields of culture, family, sports, and tourism. To participate in the steering committees for branch target programs and reform and development of state-owned enterprises directly under the Ministry.

14. To organize training and professional development in planning and finance for cadres, civil servants, and employees working in planning and finance in administrative agencies, public institutions, and state-owned enterprises directly under the Ministry and the cultural, sports, and tourism sector. To coordinate with the Cadre and Civil Servant Organization Department in appointing chief accountants at subordinate units of the Ministry.

15. To be the focal point for planning and finance related to ensuring security and defense for the Ministry of Culture, Sports and Tourism.

16. To manage civil servants; to implement policies and systems for cadres and civil servants under the Department's jurisdiction; to manage the Department's assets, finances, files, and documents according to current State regulations and the Minister's delegated management authority.

17. To perform other tasks assigned by the Minister.

Article 3. Organizational Structure

1. The Head and Deputy Heads of the Department.

2. Functional and professional divisions:

a) Planning and Comprehensive Department;

b) Basic Construction Department;

c) Budget - Public Service Department;

d) Public Service Management Department;

e) Inspection and Settlement Department.

The Director of the Planning and Finance Department is responsible for arranging civil servants according to the structure of positions and professional standards; establishing and promulgating regulations on the operation of the department.

Article 4. Effective date

1. This Decision takes effect fifteen days after its publication in the Official Gazette and replaces Decision No. 56/2004/QĐ-BVHTT dated July 14, 2004 of the Minister of Culture and Information regarding the functions, tasks, powers, and organizational structure of the Planning and Finance Department.

2. Abolish previous provisions that are contrary to this Decision.

Article 5. Responsibilities for Implementation

The Director of the Planning and Finance Department, the Director of the Office, the Director of the Cadre and Civil Servant Organization Department, the Heads of agencies and units under the Ministry, and related organizations and individuals are responsible for implementing this Decision./.
