CIRCULAR

Amending and supplementing some provisions of Circular No. 258/1998/TT-BGTVT dated August 18, 1998 guiding the implementation of the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China and the Protocol thereon; and Circular No. 10/2006/TT-BGTVT dated November 1, 2006 guiding the implementation of the Agreement and the Protocol thereon on road transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia

of the Ministry of Transport of Vietnam and the Ministry of Transport of China to implement the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China;

and Circular No. 10/2006/TT-BGTVT dated November 1, 2006 of the Ministry of Transport guiding the implementation of certain provisions of the Agreement and the Protocol thereon implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia

On the basis of the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China signed on November 22, 1994;

On the basis of the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia signed on June 1, 1998;

On the basis of the Protocol of the Ministry of Transport of Vietnam and the Ministry of Transport of China to implement the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China signed on June 3, 1997;

On the basis of the Protocol implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia signed on October 10, 2005;

The Minister of Transport hereby promulgates the following:

Article 1. Amending and supplementing some contents of Circular No. 258/1998/TT-BGTVT dated August 18, 1998 guiding the implementation of the Protocol of the Ministry of Transport of Vietnam and the Ministry of Transport of China to implement the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China

Pursuant to Decree No. 51/2008/NĐ-CP dated April 28, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

1. Clause 2 of Section IV is amended as follows:

"2. The application for international road transport permit includes:

a) Application form for Vietnam-China international road transport permit;

b) Copy of the business registration certificate for transportation or copy of the transportation business license for units required to have such a license;

c) Copy of the vehicle registration certificate;

d) Copy of the technical safety inspection and environmental protection certificate of the vehicle;

đ) Copy of the driver's license suitable for the type of vehicle being operated;

e) Copy of the compulsory motor vehicle liability insurance certificate."

2. Clause 4 is added to Section IV as follows:

"4. Procedure, method, and time limit for implementation:

a) The transport unit submits one set of application documents to the Department of Transport; the Department of Transport checks, accepts the documents, issues a notice of result delivery date; In case the documents need to be supplemented or corrected, the Department of Transport directly informs or notifies in writing the missing or incorrect information to the transport unit;

b) Within three working days from the date of receipt of complete documents as prescribed, the Department of Transport issues the international road transport permit for vehicles of the transport unit;

c) The submission of documents and issuance of results shall take place at the Department of Transport Office or through postal service."3. The application form for Vietnam-China international road transport permit is amended according to Appendix No. 1 attached hereto.

b) Within three working days from the date of receipt of complete files in accordance with the regulations, the Department of Transport shall issue an international road transport permit for the vehicles of the transport unit;

c) The acceptance of applications and delivery of results shall be conducted at the Department of Transport's office or through postal service.

3. The application form for issuing an international transport permit between Vietnam and China shall be amended according to Appendix No. 1 issued together with this Circular.

Article 2. Amend and supplement some contents of Circular No. 10/2006/TT-BGTVT dated November 1, 2006 of the Ministry of Transport guiding the implementation of certain provisions of the Agreement and Protocol to implement the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.

1. Point a Clause 2 Section III shall be amended as follows:

"a) Is a business entity, cooperative (referred to collectively as a business entity) established in accordance with Vietnamese law;"

2. Clause 4 Section III shall be amended as follows:

b) Within three working days from the date of receipt of complete documents as prescribed, the Department of Transport issues the international road transport permit for vehicles of the transport unit;

a) The business entity submits one (1) set of application files to the General Department of Transportation of Vietnam. The General Department of Transportation of Vietnam reviews, accepts the files, writes a notice of the date for delivering the result. The General Department of Transportation of Vietnam directly notifies or informs in writing the incomplete or required modifications to the business entity;

b) Within three (3) working days from the date of receiving complete files as prescribed, the General Department of Transportation of Vietnam issues an international road transport permit to the business entity;

c) The General Department of Transportation of Vietnam collects the fee for issuing the permit according to the regulations of the Ministry of Finance;

d) The acceptance of files and delivery of results at the Office of the General Department of Transportation of Vietnam or through postal service."

3. Clause 1 Section IV shall be amended as follows:

"1. Permit recipients

Vehicles owned by business entities, cooperatives that have been granted an international road transport permit by the competent authority of Vietnam."

4. Point a Clause 3 Section IV shall be amended as follows:

"a) Application form for issuing an international road transport permit for vehicles crossing the Vietnam-Cambodia border according to Model No. 8 issued together with this Circular;"

5. Clause 4 Section IV shall be amended as follows:

"4. Procedures, methods, and time limits for implementation

a) Implemented according to Clause 4 Section III of this Circular;

b) In the case of vehicles operating fixed-route passenger transport services, the General Department of Transportation of Vietnam issues a written approval for the business entity to operate on the route. The Department of Transportation bases its directives for bus stations to enter into contracts for passenger pick-up and drop-off at the station on the approval letter from the General Department of Transportation of Vietnam;

c) In cases where multiple vehicles meet the conditions for obtaining an international road transport permit, the General Department of Transportation of Vietnam prioritizes issuance of permits in the following order: fixed-route passenger transport vehicles, contractual passenger transport vehicles, and tourist passenger transport vehicles; while also considering the submission time of the application files to issue permits based on the principle of granting permits to vehicles that submitted their files earlier."

6. The Application Form for Issuing an International Road Transport Permit for Vehicles Crossing the Vietnam-Cambodia Border shall be amended according to Appendix No. 2 issued together with this Circular.

Article 3. Effectiveness

This Circular shall take effect forty-five days from the date of signature.

Article 4. Responsibilities for Implementation

1. The Director-General of the General Department of Transportation of Vietnam is responsible for coordinating with relevant agencies within the transportation sector to direct, urge, and monitor the implementation of the provisions of this Circular.

2. The Head of the Ministry's Office, the Inspector-General of the Ministry, Heads of Departments, Directors of Provincial and Municipal Departments of Transportation under the Central Government; Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
