Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
Pursuant to Decision No. 09/2011/QĐ-TTg dated January 30, 2011 of the Prime Minister on issuing standards for poor households and near-poor households applicable for the period 2011-2015.

The Minister of Labor, Invalids and Social Affairs issues this Circular amending and supplementing certain provisions of Circular No. 21/2012/TT-BLDTBXH dated September 5, 2012 guiding the procedures for investigating and reviewing poor households and near-poor households annually.
Article 1. Amending and supplementing certain provisions of Circular No. 21/2012/TT-BLDTBXH dated September 5, 2012 of the Ministry of Labor, Invalids and Social Affairs guiding the procedures for investigating and reviewing poor households and near-poor households annually.
1. Clause 1, Article 2, Chapter I shall be amended and supplemented as follows:
"1. Criteria: implemented according to the criteria prescribed in Decision No. 09/2011/QĐ-TTg dated January 30, 2011 of
2. Point a, Clause 2, Article 4, Chapter II shall be amended and supplemented as follows:
"a) Points to note: - Only income of the household over the past 12 months is counted; - Social welfare allowances from the state budget are not included in the household's income (such as social assistance for beneficiaries under relevant laws; electricity subsidies; emergency hardship assistance...)."
3. Certain contents in Appendix 7 (Form C) shall be amended and supplemented as follows:
a) Column 7, Item 7 regarding information about members of the household shall be amended and supplemented as follows:
"Objectives under policies for persons with meritorious service"
b) Column 8, Item 8 regarding information about members of the household shall be amended and supplemented as follows:
"Objectives under social assistance policies"
c) The content of the code in Column 8 shall be amended and supplemented as follows:
"Social assistance beneficiaries under relevant laws"
4. Clause 5, Article 4, Chapter II shall be amended and supplemented as follows:
"5. Classification of poor households as follows:
a) Households that have recently escaped poverty, households that have relapsed into poverty, newly poor households.
b) Poor households belonging to the category of social assistance beneficiaries.
c) Poor households with members belonging to the category of persons with meritorious service; poor households with members belonging to the category of social assistance beneficiaries."
5. Point c, Clause 1, Article 5, Chapter III shall be amended and supplemented as follows:
"c) Recognizing poor and near-poor households in the locality; reporting to the People's Committee at the district level for approval of the results of the investigation and review of poor and near-poor households in the locality."
6. Article 6, Chapter III shall be amended and supplemented as follows:
"Article 6. Time of investigation and reporting system
1. Time of organization of investigation: Investigation and review of poor and near-poor households shall be carried out from September 1st each year.
2. In cases where households in the locality experience sudden difficulties during the year due to factors such as accidents, risks, illness, etc., and need to be reviewed and added to the list of poor and near-poor households to access state support policies, the following procedure shall apply:
a) Households experiencing difficulties during the year must submit a request for confirmation by the village head and send it to the People's Committee at the commune level for receipt and processing (using Form No. 1).
b) The People's Committee at the commune level assigns the Poverty Reduction Board to organize the verification of the requests from households in accordance with the procedures and formalities stipulated in Circular No. 21/2012/TT-BLDTBXH and this Circular (including rapid identification of household characteristics, income survey, community assessment); compile a list of newly identified poor and near-poor households and report to the People's Committee at the district level for approval.
c) The People's Committee at the district level shall organize the verification and approval of the list of newly identified poor and near-poor households in communes, and report to the People's Committee at the provincial level. The time for verification and supplementary approval of newly identified poor and near-poor households shall not exceed 30 days from the date of receipt of the household's request.
d) The People's Committee at the provincial level shall compile a list of newly identified poor and near-poor households in the year; quarterly report to the Ministry of Labor, Invalids and Social Affairs.
3. Reporting system
a) Reporting time: - Submit preliminary reports to the Ministry of Labor, Invalids and Social Affairs before December 15th each year; - By January 15th each year, the Chairman of the People's Committee at the provincial level must submit a formal report on the results of the investigation and review of poor and near-poor households in the locality (Approval Decision of the People's Committee at the provincial level) to the Ministry of Labor, Invalids and Social Affairs for consolidation and issuance of the Approval Decision on the results of the investigation and review of poor and near-poor households nationwide.
Article 2. b) Content of the report: - Notification letter/report/Approval Decision. - Detailed tables and appendices: + Appendix Results of the investigation and review of poor households (Form No. 2); + Appendix Results of the investigation and review of near-poor households (Form No. 3); + Appendix Summary analysis of poor households by categories (Form No. 4); + Appendix Summary analysis of poverty causes in the locality (Form No. 5)."
Article 3. Effectiveness
Clause 1, Article 2; Point a, Clause 2, Article 4; Clause 5, Article 4; Point c, Clause 1, Article 5; Article 6; Column 7, Item 7; Column 8, Item 8 regarding information about members of the household in Appendix 7 (Form C); The content of the code in Column 8 in Appendix 7 (Form C) and Appendices No. 8, 9, 10 of Circular No. 21/2012/TT-BLDTBXH dated September 5, 2012 of the Ministry of Labor, Invalids and Social Affairs guiding the procedures for investigating and reviewing poor and near-poor households annually shall cease to be effective from the date this Circular takes effect.
2. In the course of implementation, if there are difficulties, please promptly reflect them to the Ministry of Labor, Invalids, and Social Affairs for study, amendment, and supplementation to be appropriate./.
