Pursuant to the Higher Education Law on June 18, 2012;
Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 141/2013/NĐ-CP dated October 24, 2013 of the Government detailing and guiding the implementation of certain provisions of the Higher Education Law;
7. Components of a training program include a group of courses and other learning and research activities with common characteristics in specialized fields; clearly playing a role in achieving a set of goals and requirements of the training program. These components are used to design the overall structure of the training program (such as general education, basic sciences, core subjects, internships and experiences, scientific research, and other components).
The Minister of Education and Training issues this Circular prescribing national standards for higher education institutions.
Article 1. Scope of Regulation and Applicability
1. This Circular prescribes national standards for higher education institutions; the evaluation process, application for recognition of meeting national standards; issuance and revocation of certificates for higher education institutions that meet national standards.
2. This Circular applies to universities, university-level schools (including member universities of national universities and regional universities), academies (hereinafter referred to collectively as higher education institutions), and related organizations and individuals.
Article 2. Interpretation of Terms
In this Circular, the following terms are understood as follows:
1. National standards for higher education institutions are a set of criteria including minimum requirements that must be met as a basis for competent authorities to evaluate and recognize higher education institutions as meeting national standards and to develop appropriate policies for higher education institutions that meet national standards.
2. Criteria are detailed contents of each evaluation standard, specified in Points within Clauses of Article 3 of this Circular.
3. Directly constructed floor area serving education and training is the total floor area of the following items: auditoriums, lecture halls, various types of classrooms, libraries, learning resource centers, laboratories, practice rooms, workshops, multi-purpose sports halls, offices for professors, and offices for subject lecturers.
4. Students include regular students, postgraduate students, and doctoral candidates studying and researching at higher education institutions.
5. Teaching-research group is a group of faculty members and researchers in the same or closely related fields, conducting in-depth research on a specific field, closely integrating teaching and scientific research, working in laboratories and research centers equipped with necessary facilities for teaching and research, maintaining close cooperation with international partners in the same field.
Article 3. Standards for Higher Education Institutions Meeting National Standards
1. Standard 1: Land, Infrastructure, and Equipment
a) The land area allocated to higher education institutions shall be at least 25m² per student, and the directly constructed floor area serving education and training shall be at least 3m² per student.
b) Construction projects shall comply with current national standards (TCVN) for university building design.
c) There shall be sufficient equipment and facilities to meet the requirements for education and scientific research; there shall be specialized practical facilities and equipment according to the quality assurance requirements for specific training programs.
d) Libraries and information learning centers shall have sufficient textbooks and reference books for all training programs; they shall have access rights to at least one international scientific database and at least one international scientific journal (print or electronic) for each training program.
e) Information technology infrastructure shall connect all relevant units, ensuring accessibility and usage according to the hierarchical management of the higher education institution; the website shall provide all required public information as stipulated by law and other necessary information about the organizational structure and activities of the higher education institution for students and interested parties to search.
2. Standard 2: Faculty, Researchers, and Administrative Staff
a) Full-time faculty, full-time researchers, visiting lecturers, and administrative staff shall meet the job position standards prescribed by relevant legal documents.
b) Full-time faculty shall deliver at least 80% of the course content for each training program.
c) The student-to-full-time faculty ratio, determined by training program, shall not exceed 10 students per full-time faculty member for arts and physical education programs; 15 students per full-time faculty member for medical and pharmaceutical programs; and 20 students per full-time faculty member for other programs.
d) Full-time faculty and full-time researchers with doctoral degrees shall account for at least 40% of the total number of full-time faculty and researchers for research-oriented higher education institutions, 25% for application-oriented higher education institutions, and 10% for practice-oriented higher education institutions.
For training programs and specializations oriented towards research at research-oriented higher education institutions, this ratio shall not be less than 50%.
e) For research-oriented higher education institutions, the proportion of faculty and researchers with professor and associate professor titles among those with doctoral degrees shall be at least 30%.
3. Standard 3: Training Programs and Educational Activities
a) The scale, fields, and levels of training shall be consistent with the stratification regulations for higher education institutions and shall meet the human resource development needs of localities and the country at specific stages.
b) Training programs shall be regularly updated; high-quality training programs, foreign language training programs, and master's and doctoral training programs shall have corresponding reference programs from developed countries that have been accredited by recognized educational quality assessment organizations; they shall have equivalent specialized course content; the content of training programs and the origin of reference programs shall be publicly disclosed on the training institution's website.
c) The exit standards for training programs shall be publicly disclosed; there shall be tools and methods to quantitatively assess the criteria of the exit standards that have been committed to.
d) All training programs shall be organized and managed under a credit system for both regular and continuing education forms.

4. Tiêu chuẩn 4: Hoạt động khoa học và công nghệ và hợp tác quốc tế
a) Cơ cấu hoạt động đào tạo và khoa học công nghệ đáp ứng quy định về phân tầng, khung xếp hạng và tiêu chuẩn xếp hạng cơ sở giáo dục đại học.
b) Mỗi ngành đào tạo có ít nhất 1 nhóm giảng dạy-nghiên cứu đảm bảo kết hợp chặt chẽ giữa đào tạo, nghiên cứu khoa học và chuyển giao công nghệ.
c) Có ít nhất 90% giảng viên cơ hữu thực hiện đầy đủ nhiệm vụ nghiên cứu khoa học và có kết quả theo quy định hiện hành đối với các chức danh giảng viên tương ứng.
d) Có ít nhất 40% học viên cao học và nghiên cứu sinh tham gia các hoạt động khoa học và công nghệ.
đ) Dành ít nhất 4% kinh phí từ nguồn thu học phí để hỗ trợ hoạt động nghiên cứu khoa học của sinh viên.
e) Có tổ chức nghiên cứu và phát triển hoặc tổ chức dịch vụ khoa học và công nghệ hoặc doanh nghiệp khoa học và công nghệ.
g) Có tạp chí khoa học chuyên ngành được xuất bản trực tuyến hoặc bản in.
h) Công khai khung giám sát, đánh giá chi phí, hiệu quả, tác động, tính bền vững của các đề tài, chương trình, dự án nghiên cứu và triển khai của cơ sở giáo dục đại học.
i) Có ít nhất 5 chương trình hợp tác đào tạo, nghiên cứu khoa học với các trường đại học của các nước phát triển và 3 chương trình hợp tác đào tạo, trao đổi sinh viên với các trường đại học nước ngoài.
5. Tiêu chuẩn 5: Tài chính
a) Đảm bảo ít nhất 80% chi thường xuyên bằng nguồn thu sự nghiệp và nguồn thu khác theo quy định của pháp luật (bao gồm cả nguồn ngân sách cấp bù cho các đối tượng sinh viên được miễn học phí theo quy định hiện hành).
b) Đảm bảo ít nhất 50% chi đầu tư tăng cường cơ sở vật chất, bồi dưỡng nâng cao năng lực giảng viên, nghiên cứu khoa học và các hoạt động khác bằng nguồn thu sự nghiệp và nguồn thu khác theo quy định của pháp luật.
c) Đảm bảo thực hiện đầy đủ các chế độ, chính sách đối với người học theo quy định hiện hành.
d) Thực hiện đúng các quy định của pháp luật về tài chính, kế toán và kiểm toán.
đ) Thực hiện đầy đủ nghĩa vụ tài chính, thuế đối với Nhà nước và các quy định pháp luật về tài chính, kế toán.
6. Tiêu chuẩn 6: Kiểm định chất lượng giáo dục
a) Đã được kiểm định chất lượng giáo dục trường đại học theo quy định của Bộ Giáo dục và Đào tạo và giấy chứng nhận đạt chất lượng còn thời hạn tính đến thời điểm xét công nhận cơ sở giáo dục đại học đạt chuẩn quốc gia.
b) Đã có ít nhất 30% tổng số các chương trình đào tạo được kiểm định bởi một tổ chức kiểm định của Việt Nam hoặc một tổ chức kiểm định quốc tế được Bộ Giáo dục và Đào tạo công nhận.
7. Tiêu chuẩn 7: Kết quả xếp hạng
Được xếp hạng 1 theo quy định của khung xếp hạng cơ sở giáo dục đại học hiện hành tại thời điểm đề nghị công nhận cơ sở giáo dục đại học đạt chuẩn quốc gia và duy trì trong thời gian chứng nhận đạt chuẩn quốc gia còn hiệu lực.
8. Tiêu chuẩn 8: Sự hài lòng của sinh viên và của người sử dụng lao động
Trong khoảng thời gian 12 tháng tính đến thời điểm cơ sở giáo dục đại học nộp hồ sơ đăng ký công nhận đạt chuẩn quốc gia:
a) 70% số sinh viên tốt nghiệp có việc làm phù hợp với chuyên môn được đào tạo sau 1 năm kể từ khi tốt nghiệp.
b) 80% số sinh viên năm cuối hài lòng về chương trình đào tạo và môi trường học tập, nghiên cứu khoa học của cơ sở giáo dục đại học.
c) 80% số cựu sinh viên được lấy ý kiến của 3 khóa tốt nghiệp gần nhất hài lòng về tính thực tiễn của chương trình đào tạo, khả năng thích nghi của sinh viên tốt nghiệp với môi trường công tác với số mẫu lấy ý kiến ít nhất là 10% số lượng sinh viên tốt nghiệp và không ít hơn 50 phiếu cho mỗi khóa đào tạo.
d) 70% người sử dụng lao động được lấy ý kiến có tuyển dụng sinh viên tốt nghiệp trong 3 năm gần nhất hài lòng về chất lượng sinh viên tốt nghiệp với số mẫu lấy ý kiến ít nhất là 10 cho mỗi lĩnh vực đào tạo.
Article 4. Procedure for evaluating higher education institutions to meet national standards
1. Higher education institutions shall prepare self-assessment reports based on the criteria stipulated in Article 3 of this Circular and submit registration files for recognition of meeting national standards to the Ministry of Education and Training.
2. The Ministry of Education and Training shall designate a reputable and experienced educational quality assurance organization (hereinafter referred to as the organization for assessing higher education institutions to meet national standards) to conduct evaluations and on-site inspections at higher education institutions according to the criteria stipulated in Article 3 of this Circular.
3. The organization for assessing higher education institutions to meet national standards shall conduct on-site evaluations at the institution according to the criteria stipulated in Article 3 of this Circular and report the evaluation results to the Ministry of Education and Training.
4. Based on the registration file for recognition of national standards submitted by the training institution and the assessment results of the organization for assessing higher education institutions to meet national standards, the Ministry of Education and Training will consider recognizing the higher education institution as meeting national standards.
Article 5. Registration File for Recognition of Meeting National Standards
1. The registration file for recognition of meeting national standards includes:
a) A request from the higher education institution seeking recognition of meeting national standards, clearly stating the request for recognition of meeting national standards according to the criteria for research-oriented, application-oriented, or practice-oriented higher education institutions;
b) Documentation evidencing the mission and objectives consistent with the request in the request; organizational structure and documents issued by the higher education institution in accordance with the Higher Education Law, University Charter, and related regulations;
c) A report on the self-assessment results of the higher education institution approved by the Board of Directors or the Board of Trustees.
2. Two copies of the file shall be directly submitted or sent by post to the Ministry of Education and Training.
Article 6. Recognition of Higher Education Institutions Meeting National Standards
1. Within ten working days from the date of receipt of the complete file of the higher education institution as prescribed in Article 5 of this Circular, the Ministry of Education and Training shall send a letter along with one copy of the training institution's file to the organization for assessing higher education institutions to meet national standards to conduct evaluations and on-site inspections at the higher education institution.
2. Within sixty working days from the date of receipt of the designation letter from the Ministry of Education and Training, the organization for assessing higher education institutions to meet national standards shall conduct evaluations and on-site inspections at the higher education institution and submit the evaluation results to the Ministry of Education and Training.
3. Based on the file and the evaluation results of the organization for assessing higher education institutions to meet national standards, within ten working days, or exceptionally not more than twenty working days, the Minister of Education and Training shall:
a) Issue a decision to recognize and issue a certificate of meeting national standards to the higher education institution if it meets at least 90% of the total number of criteria of the standards stipulated in Article 3 of this Circular; in which, no standard has less than 80% of the total number of criteria of that standard;
b) Send a reply letter to the higher education institution in cases where it does not meet the requirements set out in Point a, Clause 3 of this Article.
Article 7. The Validity of the National Standard Certification for Higher Education Institutions
1. The National Standard Certification for Higher Education Institutions is valid for a period of five years from the date of issuance. During the time the National Standard Certification for Higher Education Institutions is effective, the Ministry of Education and Training shall conduct periodic inspections to verify compliance with the standards set forth in Article 3 of this Circular regarding higher education institutions.
2. The contents of information recorded on the National Standard Certification for Higher Education Institutions are specified in the Appendix attached to this Circular.
Article 8. Revocation of the National Standard Certification for Higher Education Institutions
1. The National Standard Certification for Higher Education Institutions shall be revoked in the following cases:
a) The higher education institution engages in fraud to obtain national standard certification;
b) The higher education institution fails to meet the conditions stipulated in Point a, Clause 3, Article 6 of this Circular during the validity period of the National Standard Certification for Higher Education Institutions through periodic inspections conducted by the Ministry of Education and Training.
2. The Minister of Education and Training shall issue a decision to revoke the National Standard Certification for Higher Education Institutions.
Article 9. Responsibilities of Higher Education Institutions
1. Develop plans to meet the standards prescribed in Article 3 of this Circular to obtain national standard certification.
2. Prepare documentation and follow the procedures for registering to achieve national standard certification as prescribed in Articles 4 and 5 of this Circular six months before the National Standard Certification for Higher Education Institutions expires if there is a desire to do so.
3. Retain all relevant files related to the evaluation and certification of higher education institutions achieving national standards during the validity period of the National Standard Certification for Higher Education Institutions.
Article 10. Responsibilities of the Organization Evaluating National Standard Certification for Higher Education Institutions
1. Organize inspection teams to assess the actual level of compliance with the standards set forth in Article 3 of this Circular for higher education institutions and bear responsibility for the assessment results.
2. Provide assessment documents and materials upon written request by competent state management agencies.
3. Store assessment-related documents and materials according to legal regulations on record keeping.
Article 11. Implementation Provisions
1. This Circular takes effect from November 9, 2015.
2. Ministers of Ministries, Heads of ministerial-level agencies and agencies under the Government, Chairmen of People's Committees of provinces and centrally governed cities directly managing higher education institutions, Directors of the Office, Deputy Ministers of the Department of Higher Education, Heads of units related to the Ministry of Education and Training, Presidents of universities and academies, Deans of university schools, and related agencies and organizations are responsible for implementing this Circular.
