Pursuant to the Road Traffic Law No. 23/2008/QH12 dated November 13, 2008;

This Circular prescribes procedures for receiving, providing health care for domestic violence victims and statistical reports on domestic violence victims at medical facilities.

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Department of Medical Examination and Treatment - Ministry of Health and the Director of the Department of Transport Health - Ministry of Transport,

The Minister of Health and the Minister of Transport issue this Joint Circular to regulate health standards for drivers, regular health check-ups for automobile drivers, and regulations on medical facilities conducting health examinations for drivers.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates health standards for drivers, health examinations for drivers, regular health examinations for automobile drivers (hereinafter referred to as health examinations for drivers), and regulations on medical facilities conducting health examinations for drivers.

2. This Circular applies to drivers, employers of automobile drivers, medical facilities conducting health examinations for drivers, and relevant agencies, organizations, and individuals.

Article 2. General Principles

1. Health examinations for drivers must be conducted at medical facilities that have been granted permission to operate medical examination and treatment services according to the Law on Medical Examination and Treatment (hereinafter referred to as medical facilities) and must comply with the provisions of this Circular.

2. Health examinations for drivers must be carried out in accordance with the health standards prescribed in Clause 1, Article 3 of this Circular.

2. Regular health examinations only apply to professional automobile drivers (those who make a career out of driving automobiles) as stipulated by labor laws.

Chapter II

HEALTH STANDARDS FOR DRIVERS, HEALTH EXAMINATIONS FOR DRIVERS

Article 3. Health Standards for Drivers

1. Attached to this Circular is the "Table of Health Standards for Drivers" in Appendix No. 01.

2. The Table of Health Standards for Drivers prescribed in Clause 1 of this Article does not apply to two-wheeled motorcycle drivers with cylinder capacity under 50 cm³.³.

Article 4. Health Examinations for Drivers

1. Procedures for conducting health examinations and issuing Health Certificates for drivers shall be implemented in accordance with Articles 5 and 8 of Circular No. 14/2013/TT-BYT dated May 6, 2013, issued by the Minister of Health guiding health examinations (hereinafter referred to as Circular No. 14/2013/TT-BYT).

2. The format of the Health Certificate for drivers shall be uniformly applied in accordance with the provisions set forth in Appendix No. 02 attached to this Circular.

Article 5. Regular Health Examinations for Automobile Drivers

1. Procedures for conducting regular health examinations and returning health examination books for automobile drivers shall be implemented in accordance with Articles 5 and 8 of Circular No. 14/2013/TT-BYT.

2. The format of the Regular Health Examination Book for drivers shall be uniformly applied in accordance with the provisions set forth in Appendix No. 03 attached to this Circular.

Chapter III

MEDICAL FACILITIES CONDUCTING HEALTH EXAMINATIONS FOR DRIVERS

Article 6. Provisions on Personnel, Infrastructure, Equipment, and Scope of Professional Activities

Medical facilities conducting health examinations for drivers must meet the following requirements:

1. Regarding personnel: meeting the requirements as prescribed in Article 9 of Circular No. 14/2013/TT-BYT.

2. Regarding infrastructure and equipment: meeting the requirements as specified in the List prescribed in Appendix No. 04 attached to this Circular.

3. Regarding scope of professional activities: having a scope of professional activities suitable for examining and detecting diseases and disabilities as prescribed in the Table of Health Standards for Drivers in Clause 1, Article 3 of this Circular.

In cases where medical facilities do not have electroencephalogram measuring devices, they are permitted to enter into contracts for technical support with other medical facilities that have been authorized to perform electroencephalogram techniques.

Article 7. Medical facilities meeting the conditions for conducting health examinations for drivers

A medical facility that meets the conditions to conduct health examinations for drivers is a facility that satisfies all the conditions stipulated in Article 6 of this Circular and has announced its qualification to conduct health examinations for drivers in accordance with Circular No. 14/2013/TT-BYT.

Article 8. Time and procedure for processing the announcement of medical facilities meeting the conditions for conducting health examinations for drivers

The time and procedure for processing the announcement of medical facilities meeting the conditions for conducting health examinations for drivers as stipulated in Article 7 of this Circular shall be carried out in accordance with Article 13 of Circular No. 14/2013/TT-BYT.

Chapter IV

RESPONSIBILITIES FOR IMPLEMENTATION

Article 9. Responsibilities of healthcare staff and medical facilities in conducting health examinations for drivers

1. Responsibilities of healthcare staff

a) Fulfilling tasks assigned by authorized authorities.

b) Verify and compare the photograph in the Health Examination Certificate before conducting a health examination for a driver.

c) Strictly follow the professional procedures and guidelines to ensure the accuracy and truthfulness of the examination results and bear legal responsibility for their conclusions.

d) In cases where it is difficult to make a conclusion, the examining physician shall request a specialized consultation as prescribed.

2. Responsibilities of medical facilities

a) Adhere to the provisions of this Circular and bear legal responsibility for the health examination results conducted by their facility for drivers.

b) Maintain health examination records for drivers, and bear responsibility for reporting on health examination activities for drivers and compiling them into comprehensive reports on the professional activities of the facility in accordance with laws on statistics and reporting.

Article 10. Responsibilities of drivers

1. Provide full and truthful information about their health status, medical history, and disabilities when undergoing health examinations and bear legal responsibility for the information provided.

2. Follow the instructions and directions of healthcare staff during the health examination process.

3. Must proactively undergo a health re-examination after treatment for illnesses or accidents affecting driving ability.

4. Comply with periodic and ad hoc health examination requirements from state management agencies for health or transportation (Vietnam Highway Administration, Provincial Departments of Transportation) or employers.

Article 11. Responsibilities of employers of automobile drivers

1. Employ drivers who meet the health standards specified in this Circular.

2. Organize regular health examinations for automobile drivers under their management in accordance with labor laws.

3. Implement periodic and ad hoc health examinations as stipulated in Clause 4 of Article 10 of this Circular.

4. Manage and monitor the health and health records of drivers in accordance with the law.

Article 12. Responsibilities of the Department of Health and state management agencies for health of ministries and sectors

1. Direct and guide health examination activities for drivers at medical facilities within their jurisdiction as stipulated in Clause 2 of Article 12 of Circular No. 14/2013/TT-BYT.

2. Inspect and audit health examination activities for drivers at medical facilities in accordance with regulations; suspend or recommend suspension of health examination activities or handle violations related to health examinations for drivers within their authority.

3. Publicly announce the list of medical facilities meeting the conditions for conducting health examinations for drivers within their management scope on the Department of Health's or state management agency for health of ministries and sectors' websites, and simultaneously submit a report in writing to the Department of Medical Examination and Treatment under the Ministry of Health.

Article 13. Responsibilities of the Department of Medical Examination and Treatment under the Ministry of Health

1. Directing and guiding the health examination activities for drivers at medical examination and treatment facilities nationwide.

2. Inspecting and supervising the health examination activities for drivers conducted by medical examination and treatment facilities in accordance with regulations; suspending or recommending suspension of operations or handling violations within their authority against medical examination and treatment facilities conducting driver health examinations without meeting the conditions stipulated in this Circular.

Chapter V

IMPLEMENTING PROVISIONS

Article 14. Costs of Health Examinations for Drivers

1. Agencies, organizations, and individuals requesting health examinations for drivers must pay the costs of health examinations to the medical examination and treatment facility performing the examinations according to the service fees for medical examinations and treatments approved by competent state authorities or agreed upon between the two parties.

2. In cases where the person undergoing health examinations or periodic health examinations for driving requests more than one Driver's Health Certificate, additional fees and charges must be paid in accordance with the provisions of the law.

3. In cases where health examinations for drivers are carried out in accordance with Clause 3 of Article 11 of this Circular, the costs of health examinations for drivers shall be borne by the agency making the request.

Article 15. Effective Date

1. This Circular takes effect from October 10, 2015.

2. The regulations on health standards applicable to motor vehicle drivers issued together with Decision No. 4132/QĐ-BYT dated October 4, 2001 of the Minister of Health shall cease to be effective from the date this Circular comes into force.

Article 16. Transitional Provisions

Medical examination and treatment facilities currently conducting health examinations for drivers before the date this Circular takes effect may continue to conduct such examinations until December 31, 2015. From January 1, 2016, these facilities wishing to continue conducting health examinations for drivers must comply with the provisions of Article 6 of this Circular and submit a written report to the competent state management body for health care in accordance with Clause 2 of Article 12 of Circular No. 14/2013/TT-BYT regarding the supplementation of human resources, equipment, and scope of specialized activities as prescribed.

Article 17. Reference Provisions

Where referenced documents in this Circular are replaced or amended, implementation shall be in accordance with the replacing or amending documents.

During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to report to the Ministry of Health and the Ministry of Transport for consideration and resolution./.
