CIRCULAR
REGULATIONS ON QUALITY MANAGEMENT OF RADIO AND TELEVISION SERVICES
Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Pursuant to the Law on Telecommunications dated November 23, 2009;
Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to the Government Decree No. 06/2016/NĐ-CP dated January 18, 2016 on management, provision, and use of radio and television services;
Article 1. Amending and supplementing some articles of Circular No. 19/2016/TT-BTTTT dated June 30, 2016 of the Minister of Information and Communications on forms for registration declaration, application for license, certificate, license, and business report as prescribed in Decree No. 06/2016/NĐ-CP dated January 18, 2016 of the Government on management, provision, and use of radio and television services.
The Minister of Information and Communications issues this Circular to regulate quality management of radio and television services.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Circular regulates the quality management of radio and television services.
2. This Circular applies to state agencies responsible for managing the quality of radio and television services, and organizations and individuals involved in providing, using, and testing such services in Vietnam.
Article 2. Interpretation of Terms
In this Circular, the following terms are understood as follows:
1. Radio and television services include:
a) Satellite television service;
b) Terrestrial television service;
c) Analog cable television service;
d) Digital cable television service;
đ) Internet Protocol Television (IPTV) service;
e) Mobile terrestrial television service;
g) Satellite mobile television service;
h) Mobile television service on terrestrial mobile communication networks;
i) Radio and television service on the Internet.
2. Service providers are enterprises providing radio and television services as defined in Clause 8, Article 3 of Decree No. 06/2016/NĐ-CP dated January 18, 2016 of the Government on the management, provision, and use of radio and television services.
3. Designated testing units are units designated by the Ministry of Information and Communications to test the quality of radio and television services according to current regulations.
Article 3. Contents of Quality Management of Radio and Television Services
1. Announcing the quality of radio and television services.
2. Reporting on the quality of radio and television services.
3. Publicizing information about the quality of radio and television services.
4. Supervising, inspecting, and handling violations related to the quality of radio and television services.
Article 4. Responsibilities for Quality Management of Radio and Television Services
1. The Radio, Television, and Electronic Information Administration is the agency entrusted by the Ministry of Information and Communications to implement national administrative tasks regarding the quality of radio and television services nationwide. The Radio, Television, and Electronic Information Administration is responsible for leading and coordinating with provincial-level Information and Communications Departments to implement quality management of radio and television services at local levels.
2. Provincial Information and Communications Departments are agencies implementing national administrative tasks for radio and television services at the local level, and are responsible for:
a) Managing the quality of radio and television services within their jurisdiction according to assigned functions and tasks;
b) Inspecting, identifying, and reporting existing issues regarding the quality of services within their jurisdiction; reporting and proposing measures to the Ministry of Information and Communications for handling these issues.
3. Service providers are responsible for managing the quality of radio and television services provided by them:
a) Adhering to regulations on quality management of radio and television services stipulated in this Circular and other relevant legal documents;
b) Ensuring and maintaining the quality of radio and television services at the announced level. When incidents occur or when the quality of radio and television services falls below the announced level, immediate measures must be taken to restore service quality;
c) Being accountable for the quality of radio and television services provided to users according to service usage contracts and relevant laws.
Chapter II
QUALITY MANAGEMENT OF RADIO AND TELEVISION SERVICES BY SERVICE PROVIDERS
Section 1. ANNOUNCEMENT OF QUALITY OF RADIO AND TELEVISION SERVICES
Article 5. Responsibilities for Announcing the Quality of Radio and Television Services
The service provider shall be responsible for announcing the quality of radio and television services, with the level of announcement not being lower than the level prescribed in the corresponding national technical regulations for radio and television services provided by the service provider.
Article 6. Procedures for Announcing the Quality of Radio and Television Services
1. The service provider shall submit the announcement quality service dossier for radio and television through the postal system or directly to the Radio, Television and Electronic Information Administration.
2. Application components include:
a) A letter regarding the announcement of the quality of radio and television services according to the model at Appendix I of this Circular;
b) The announcement of the quality of radio and television services according to the model at Appendix II of this Circular;
c) A list of quality indicators for radio and television services according to the model at Appendix III of this Circular.
3. Number of dossiers: 01 set.
4. Within five (05) days from the date of receipt of the announcement quality service dossier of the service provider, the Radio, Television and Electronic Information Administration shall be responsible for:
a) Issuing the "Announcement Acceptance Certificate for the Quality of Radio and Television Services" in cases where the dossier is appropriate according to the model at Appendix IV of this Circular;
b) Responding in writing to the service provider, clearly stating the reasons for not issuing the "Announcement Acceptance Certificate for the Quality of Radio and Television Services" in cases where the dossier is inappropriate.
5. After receiving the "Announcement Acceptance Certificate for the Quality of Radio and Television Services", the service provider shall be responsible for:
a) Announcing the "Announcement of the Quality of Radio and Television Services" and "List of Quality Indicators for Radio and Television Services" on the unit's electronic information page according to Article 8 of this Circular;
b) Posting the "Announcement of the Quality of Radio and Television Services" and "List of Quality Indicators for Radio and Television Services" in places easily readable at all transaction points.
Article 7. Deadline for Announcing the Quality of Radio and Television Services
At the latest within sixty (60) days from the date the service provider officially provides the service or from the date the new national technical regulation issued by the Ministry of Information and Communications becomes effective or when the service provider changes the content of the announcement of the quality of radio and television services, the service provider shall implement the procedures for announcing the quality of radio and television services as stipulated in Article 6 of this Circular.
Article 8. Announcement on the Service Provider’s Electronic Information Page
The service provider shall be responsible for announcing information about the management of the quality of radio and television services provided by their own unit at the quality management section on the unit's electronic information page, including:
1. Radio and television services currently provided by the unit along with the name and logo of the service; In case of using an application installed on terminal devices to provide the service, provide the name and logo of the application.
2. The announcement of the quality of radio and television services for each type of radio and television service currently provided by the unit.
3. Service prices, package prices linked to basic technical information and specifications of the service and package for pay radio and television units.
4. The most recent periodic report on the quality of radio and television services that the unit has submitted to the Radio, Television and Electronic Information Administration.
5. Address, phone number, email box for receiving and resolving complaints and customer support.
6. Procedure for receiving and resolving customer complaints.
Section 2. SELF-AUDIT, SUPERVISION AND REPORTING OF RADIO AND TELEVISION SERVICE QUALITY
Article 9. Self-audit regulations
Within the latest sixty (60) days from the date the service provider officially provides radio and television services, the service provider must issue internal regulations on self-auditing the quality of radio and television services, including:
1. The process for implementing self-audits to ensure compliance with the provisions of this Circular.
2. The process for conducting measurements and evaluating the actual quality of radio and television services according to published National Technical Regulations and addressing non-compliance points with published National Technical Regulations.
Article 10. Service Provider's Quality Monitoring
1. The service provider must monitor the quality of radio and television services provided by the provider, ensuring stable service and quality consistent with National Technical Regulations.
2. In case of service interruptions affecting one or more centrally governed provinces/cities for five (05) hours or more continuously, the service provider shall submit a written report within three (03) days from the incident date regarding the cause, impact level, and corrective measures to the Radio, Television and Electronic Information Administration and the Information and Communications Departments where the incident occurred.
Article 11. Reporting on the Quality of Radio and Television Services
1. The service provider shall implement a semi-annual reporting system. Reports must be submitted before the thirty-first (31) day of January and July each year, including:
a) Results of self-audits and monitoring of the quality of radio and television services as stipulated in this Circular;
b) Quality service data reports that include measurement results at all centrally governed provinces/cities within the service area as specified in the License. Measurement and evaluation must be conducted for each type of service provided by the unit.
2. Every twenty-four (24) months, the results of measuring the quality of radio and television services must be reported by a designated inspection unit.
3. Sample measurement
In accordance with national technical service standards and requirements, as follows:
a) For satellite television services: The minimum number of samples corresponding to the number of centrally governed provinces/cities within the coverage area of the business;
b) For terrestrial television services: The minimum number of samples corresponding to the number of broadcast stations within the coverage area of the business;
c) For cable television services: The minimum number of samples corresponding to the number of subscriber concentration points closest to subscribers within the network establishment range of the business.
4. Inspection results must be documented in writing according to the template in Appendix V of this Circular titled "Periodic Report on the Quality of Radio and Television Services" and sent directly or via postal service to the Radio, Television and Electronic Information Administration, along with an electronic copy to the email address [email protected].
5. Service providers with headquarters or branches in centrally governed provinces/cities must submit "Periodic Report on the Quality of Radio and Television Services" according to the template in Appendix VI of this Circular to the Information and Communications Department where the headquarters or branch is registered.
6. Service providers are responsible for submitting ad hoc reports upon request by competent state management agencies.
7. Service providers are responsible for retaining data and documents used to prepare quality service reports for at least twenty-four (24) months from the reporting date. Upon request by competent state management agencies, service providers shall:
a) Explain, provide data and documents used to prepare the report and bear responsibility for their timeliness, accuracy, and completeness;
b) Provide technical support for state management agencies to verify the data.
Chapter III
STATE MANAGEMENT OF RADIO AND TELEVISION SERVICE QUALITY
Mục 1. INSPECTION AND SUPERVISION OF THE QUALITY OF RADIO AND TELEVISION SERVICES
Article 12. Forms of Inspection
1. Regular Inspection
a) Annually, the Radio, Television, and Electronic Information Administration shall develop and issue an inspection plan for service providers based on the inspection plan issued by the Radio, Television, and Electronic Information Administration, the Departments of Information and Communications shall develop and issue inspection plans for radio and television service providers within their jurisdiction;
b) The Radio, Television, and Electronic Information Administration and the Departments of Information and Communications shall closely cooperate in developing and implementing inspection plans to ensure effectiveness and avoid overlap.
2. Surprise Inspection
In cases where necessary, the Radio, Television, and Electronic Information Administration decides to conduct surprise inspections of the quality of radio and television services provided by service providers; the Department of Information and Communications decides to conduct surprise inspections of service providers within its jurisdiction.
Article 13. Procedures and Contents of Inspection
1. The competent state management agency shall issue a decision for each inspection round, specifying the composition of the inspection team, the content, and the time of inspection, and send it to the service provider at least seven (07) days before the inspection date for regular inspections; immediate inspections shall be conducted for surprise inspections.
2. Content of inspection
a) Compliance with regulations on announcing the quality of radio and television services;
b) Compliance with regulations on reporting the quality of radio and television services;
c) Compliance with regulations on self-inspection of the quality of radio and television services;
d) Compliance with regulations on self-supervision of the quality of radio and television services;
đ) Other quality management contents of radio and television services according to the regulations of the Ministry of Information and Communications.
3. Inspections must be recorded in a Record. The inspection record must have the signature of the head of the inspection team and the legal representative or the person authorized in writing by the service provider. If the legal representative or the person authorized to represent the service provider does not sign the record, the record signed by the head of the inspection team and the members of the inspection team still has validity.
4. In cases where necessary, the head of the inspection team may decide to conduct measurements to evaluate the quality of radio and television services provided by the service provider.
5. If violations of quality management regulations for radio and television services are discovered, the inspection team shall report to the competent state management agency issuing the inspection decision to handle the violation according to the provisions of the law on administrative violation handling.
6. The competent state management agency issuing the inspection decision must implement the archiving of inspection files and results.
Article 14. Quality Supervision of Services by State Management Agencies
1. In cases where necessary, the Radio, Television, and Electronic Information Administration shall organize the implementation of supervision and decide to select designated measurement units according to the regulations to perform quality monitoring measurements in accordance with this Circular, suitable for the scope of service provision by the service provider.
2. Quality supervision of radio and television services must comply with relevant regulations and national technical standards corresponding to the monitored services.
Article 15. Measurement for inspection and supervision
1. The measurement for the work of inspecting and supervising the quality of broadcasting and television services shall be carried out by the designated measurement unit.
2. The state management agency shall select the designated measurement unit to serve inspection and supervision and shall be responsible for paying the costs of measurement, sampling, testing, and other costs as prescribed by law.
3. The designated measurement unit conducting the measurement of the quality of broadcasting and television services to serve inspection and supervision shall bear legal responsibility for the results of the measurement; retain measurement data for at least twenty-four (24) months from the date of establishing the report on the measurement results and provide explanations and supply such data to the competent authority upon request.
Article 16. Responsibilities of the inspected and supervised entity
1. The head of the entity being inspected or the person authorized under the law must cooperate with the inspection team throughout the inspection process and facilitate the inspection work.
2. Prepare all necessary contents, documents, data, and equipment for measurement, supervision, and inspection; be responsible for the accuracy of the data and documents; explain and provide data and documents as required by the inspection team.
3. Provide signals, access rights to services, decoding devices; offer free service for broadcasting and television services to serve measurement, supervision, and inspection of quality.
4. Immediately implement measures to address existing issues regarding the quality of broadcasting and television services according to the requirements of the inspection team.
Section 2. PUBLIC INFORMATION ON THE QUALITY OF BROADCASTING AND TELEVISION SERVICES
Article 17. Period for Publicizing Information
Within the first twenty (20) days of February (02) and August (08) each year, the Radio, Television, and Electronic Information Administration shall publicize information about the quality of broadcasting and television services on its electronic information website at the domain name www.abei.gov.vn.
Article 18. Information to be Publicized
1. The situation of implementing the announcement of the quality of broadcasting and television services and the quality indicators of broadcasting and television services that the service provider has announced.
2. The compliance with reporting systems and quality indicators reported by the service provider.
3. The results of the inspection and supervision of the quality of broadcasting and television services by state management agencies.
Chapter IV
IMPLEMENTING PROVISIONS
Article 19. Effective Date
1. This Circular takes effect from January 4, 2017.
2. Within sixty (60) days from the effective date of this Circular, service providers currently offering broadcasting and television services shall be responsible for completing the procedures for announcing the quality of services in accordance with Article 6 and issuing internal regulations on self-inspection of broadcasting and television service quality in accordance with Article 9 of this Circular.
Article 20. Responsibility for Implementation
The Director of the Office, the Director of the Radio, Television, and Electronic Information Administration, the Heads of Ministries' Agencies and Units, the Directors of Provincial Departments of Information and Communications, General Directors, Directors of broadcasting and television service providers, and related organizations and individuals are responsible for implementing this Circular./.
