Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Rational and Efficient Use of Energy dated June 28, 2010;

Pursuant to Decree No. 21/2011/NĐ-CP dated March 29, 2011 of the Government detailing and providing implementation measures for the Law on Rational and Efficient Use of Energy;

Pursuant to the proposal of the Minister of Science and Technology;

The Prime Minister decides to issue the List and Schedule for Phasing Out Energy-Using Equipment and Devices with Low Efficiency and New Construction of Low-Efficiency Power Generating Units.

DECISION:

Article 1. Scope of Regulation

1. This Decision stipulates the List and Schedule for Phasing Out Energy-Using Equipment and Devices with Low Efficiency that are not allowed to be imported, produced, and sold domestically, and New Construction of Low-Efficiency Power Generating Units.

2. This Decision does not apply to equipment and devices temporarily imported for re-export, repair replacement, and energy efficiency testing.

Article 2. Applicability

This Decision applies to state agencies, enterprises, organizations, and individuals involved in importing, producing, and selling goods as specified in Clause 1 and Clause 2 of Article 3 of this Decision.

Article 3. List of Energy-Using Equipment and Devices with Low Efficiency to be Phased Out and New Construction of Low-Efficiency Power Generating Units

1. The list includes:

a) Household appliances group: Compact fluorescent lamps, electronic ballasts for compact fluorescent lamps, electromagnetic ballasts for fluorescent lamps, straight fluorescent tubes, electric fans, refrigerators-freezers, air conditioners without ducts, household washing machines, television sets, rice cookers, and hot water storage tanks.

b) Office and commercial equipment group: Computer monitors, photocopiers, printers, and commercial refrigeration units.

c) Industrial equipment group: Three-phase asynchronous squirrel-cage motors, distribution transformers, industrial boilers.

2. Coal-fired and gas-fired power generating units in thermal power plants.

3. Details regarding Energy-Using Equipment and Devices with Low Efficiency to be phased out and New Construction of Low-Efficiency Power Generating Units are specified in Appendices I, II, and III attached to this Decision.

Article 4. Implementation Timeline

1. From the date this Decision takes effect, importation, production, and sale of equipment with energy efficiency levels below the minimum standards set forth in National Technical Regulations (TCVN) as specified in Appendix I attached to this Decision are prohibited.

2. Two years from the date this Decision takes effect, importation, production, and sale of equipment with energy efficiency levels below the minimum standards set forth in TCVN as specified in Appendix II attached to this Decision are prohibited.

3. Implementation schedule for coal-fired and gas-fired power generating units in thermal power plants begins from the date this Decision takes effect:

a) Prohibition on construction of new coal-fired and gas-fired power generating units using outdated technology with efficiency at the time of commercial operation lower than the efficiency levels specified according to each power range of the unit as specified in Appendix III attached to this Decision.

b) Prohibition on importation of old and outdated equipment for power generating units outside the power ranges specified in Appendix III attached to this Decision.

c) Non-approval of investment proposals for thermal power plants generating electricity using coal and natural gas with energy efficiency levels lower than those specified according to the power ranges of the power generating units as specified in Appendix III attached to this Decision.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The Ministry of Science and Technology shall be responsible for:

a) Taking the lead and coordinating with ministries, ministerial-level agencies, government-affiliated agencies, provincial people's committees, and centrally-administered municipal people's committees to organize guidance on building and implementing support solutions for phasing out energy-using equipment and devices and new construction of low-efficiency power generating units as stipulated in this Decision.

b) Taking the lead and coordinating with relevant ministries and sectors to develop national technical regulations on energy efficiency and minimum energy efficiency levels for high-energy-consuming equipment and devices.

c) Based on economic and social development conditions and management requirements during implementation, proactively coordinating with relevant ministries and sectors to review and propose the Prime Minister to decide on amending, supplementing, or replacing the List of Energy-Using Equipment and Devices with Low Efficiency to be Phased Out and New Construction of Low-Efficiency Power Generating Units.

2. The Ministry of Industry and Trade shall be responsible for taking the lead and coordinating with the Ministry of Science and Technology to inspect and audit compliance with regulations on phasing out energy-using equipment and devices and new construction of low-efficiency power generating units as stipulated in this Decision.

3. Ministries, sectors, and localities shall take the lead in implementing the phasing out of energy-using equipment and devices and new construction of low-efficiency power generating units based on their functions, tasks, and management authorities.

Article 6. Implementation Provisions

1. This Decision shall take effect from July 10, 2018.

Decision No. 78/2013/QĐ-TTg dated December 25, 2013 of the Prime Minister issuing the List and Schedule for Phasing Out Energy-Using Equipment and Devices with Low Efficiency and New Construction of Low-Efficiency Power Generating Units shall cease to be effective from the date this Decision takes effect.

2. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, chairpersons of provincial people's committees of centrally-administered municipalities, heads of agencies, units, organizations, and individuals related to this matter shall be responsible for implementing this Decision.
