CIRCULARAMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULAR NO. 16/2025/TT-BCT DATED FEBRUARY 1, 2025 OF THE MINISTER OF INDUSTRY AND TRADE ON THE OPERATION OF THE COMPETITIVE WHOLESALE ELECTRICITY MARKET

Provisions on issuing, revoking registration certificates, and license plates for motor vehicles

 

Pursuant to the Civil Code on November 24, 2015;

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

BASED ON THE LAW AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF 37 LAWS RELATED TO PLANNING dated November 20, 2018;

Based on Resolution No. 73/2022/QH15 dated November 15, 2022 of the National Assembly on piloting auctioning of automobile license plates;

Based on Decree No. 39/2023/NĐ-CP dated June 26, 2023 of the Government detailing certain provisions of Resolution No. 73/2022/QH15 dated November 15, 2022 of the National Assembly on piloting auctioning of automobile license plates;

Based on Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Traffic Police Corps;

The Minister of Public Security issues this Circular providing for the issuance and revocation of registration certificates and license plates for motor vehicles.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular provides for the documents and procedures for issuing and revoking registration certificates and license plates for motor vehicles as prescribed in the Road Traffic Law, including: initial vehicle registration; transfer of ownership and relocation of vehicles; issuance and replacement of vehicle registration certificates and license plates; reissuance of vehicle registration certificates and license plates; temporary vehicle registration; revocation of vehicle registration certificates and license plates; registration and issuance of license plates for vehicles won in auctions (hereinafter referred to collectively as vehicle registration); guidance on handling specific cases; forms, validity periods of vehicle registration certificates, determination of the year of manufacture of vehicles, and license plates.

Article 2. Applicability

1. This Circular applies to:

a) Police officers and non-commissioned officers of the People's Public Security performing vehicle registration duties (hereinafter collectively referred to as vehicle registration officers);

b) Registration offices;

c) Public security units and localities;

d) Organizations and individuals related to vehicle registration activities.

2. This Circular does not apply to the registration of motor vehicles of the Military used for national defense purposes.

Article 3. Principles of Vehicle Registration

1. Motor vehicles with legal origins and meeting technical safety standards and environmental protection requirements shall be registered and issued one set of license plates according to the provisions of this Circular.

2. The owner of a vehicle, whether an organization or an individual, whose place of business or residence (permanent or temporary residence) is located in a locality shall register the vehicle at the registration office of that locality, except in the cases provided for in Clause 14, Article 3 of this Circular.

3. License plates are issued and managed based on the identification code of the vehicle owner (hereinafter referred to as identification license plates). Identification license plates are license plates with designated symbols, serial numbers, size of letters and numbers, and color as prescribed in this Circular.

4. For Vietnamese citizens, license plates are managed based on their personal identification numbers.

5. For foreign nationals, license plates are managed based on their identification numbers established by the electronic identification and authentication system or their permanent resident card number, temporary resident card number, or other identification document issued by the competent authority.

6. For organizations, license plates are managed based on the electronic identification code of the organization established by the electronic identification and authentication system; if there is no electronic identification code of the organization, it will be managed based on the tax registration number or establishment decision.

7. In cases where a vehicle has exceeded its service life, is damaged, or has transferred ownership, the identification license plate of the owner shall be revoked by the registration office and reissued when the owner registers another vehicle under their ownership. The identification license plate number shall be retained for the owner for five years from the date of revocation; beyond this period, if the owner has not registered, the identification license plate number shall be transferred to the license plate warehouse for issuance to organizations and individuals according to regulations.

8. If the owner transfers their place of business or residence from one centrally governed province or city to another, they may retain the identification license plate (no need to change the license plate).

Individuals aged 15 or older may register a vehicle. In cases where individuals aged 15 to under 18 register a vehicle, they must obtain the consent of their father, mother, or guardian, and record the content "agreement," sign, and clearly write their name and relationship to the person being supervised in the application form for vehicle registration.

10. The declaration of vehicle registration shall be carried out through the National Public Service Portal or the Ministry of Public Security Public Service Portal (hereinafter collectively referred to as the public service portal). The vehicle owner uses the declared file code on the public service portal to complete the vehicle registration procedures. In cases where it cannot be done on the public service portal due to lack of electronic data or technical errors, the vehicle owner shall declare and complete the procedures directly at the registration office.

11. Payment of registration fees shall be made through banks or payment intermediaries connected and integrated to provide online payment services on the public service portal; in cases where it cannot be done on the public service portal, payment shall be made at the registration office.

12. Receiving the results of vehicle registration shall be done online on the public service portal or through postal services (in cases of full online public services) or received at the registration office according to the owner's request.

13. Electronic data of documents and certificates in the vehicle file accepted from the public service portal or databases of ministries and sectors, or scanned (scanned) data from documents in the file, chassis number, frame number, administrative procedure resolution results from paper documents, signed with the digital signature of the vehicle registration officer or the registration office (hereinafter collectively referred to as digitized files) have the same legal value as paper documents.

14. Organizations and individuals who win the auction of automobile license plates may choose to register and issue the license plates won in the auction at the Traffic Police Department, Highway Traffic Police Department - Railway Traffic Police Department, Highway Traffic Police Department of the Provincial Public Security Office, or Central City (hereinafter collectively referred to as the Traffic Police Department) where the vehicle owner has a headquarters or residence, or at the Traffic Police Department managing the license plates won in the auction.

15. Organizations and individuals violating traffic order and safety who do not comply with administrative penalty decisions in the field of traffic shall not have their vehicle registrations processed; after complying with the administrative penalty decision in the field of traffic, they may register the vehicle according to the provisions of this Circular.

Article 4. Vehicle Registration Authorities

1. The Traffic Police Department under the Ministry of Public Security shall register vehicles for agencies and organizations specified in Appendix No. 01 issued together with this Circular; motor vehicles of diplomatic missions, representative offices of international organizations in Vietnam, and motor vehicles of foreign nationals working in such agencies.

2. The Traffic Police Departments shall register the following types of vehicles (except those specified in Clause 1 of this Article):

a) Motor vehicles, trailers, semi-trailers, and other vehicles similar to motor vehicles (hereinafter referred to as motor vehicles) of organizations and individuals whose headquarters or residence are located in districts, cities directly under central government, cities, counties, and towns within provinces where the Traffic Police Departments are headquartered;

b) Motor vehicles registered with license plates obtained through auction; first-time registration of seized vehicles according to the law and motorcycles with engine displacement of 175 cm3 or more of organizations and individuals in localities;

c) Motor vehicles, motorcycles, motorbikes (including electric motorcycles) and other vehicles similar to motorcycles (hereinafter referred to as motorcycles) of foreign organizations and individuals, including consular agencies in localities.

3. District-level public security organs (hereinafter referred to as district-level public security organs) shall register the following types of vehicles: motor vehicles and motorcycles of domestic organizations and individuals whose headquarters or residence are located in localities (except those specified in Clauses 1, 2, and 4 of this Article).

4. Village-level public security organs (hereinafter referred to as village-level public security organs) shall implement vehicle registration (except for cases specified in Clauses 1 and 2 of this Article) as follows:

a) Village-level public security organs of counties and towns directly under central government shall register motorcycles of domestic organizations and individuals whose headquarters or residence are located in localities;

b) Village-level public security organs of counties, towns, and cities in provinces (excluding village-level public security organs where the Traffic Police Departments, county-level public security organs, and town-level public security organs are headquartered) that have a new registration volume of 150 vehicles/year or more (on average over the last three years) shall register motorcycles of domestic organizations and individuals whose headquarters or residence are located in localities.

5. For special areas, based on the actual number of registered vehicles, the nature of the area, and geographical distance, the Director of the provincial public security organ shall coordinate with the Traffic Police Department to decide on organizing vehicle registration as follows:

a) For villages with fewer than 150 newly registered motorcycles per year, the village-level public security organ shall directly register vehicles or entrust the county-level, town-level, or city-level public security organs or village-level public security organs authorized to register vehicles to organize vehicle registration in clusters;

b) For villages with a number of vehicles exceeding the registration capacity of the village-level public security organ, in addition to the direct registration by the village-level public security organ, the county-level, town-level, or city-level public security organs, or nearby village-level public security organs authorized to register vehicles may provide support to organize cluster-based vehicle registration for domestic organizations and individuals whose headquarters or residence are located in the area.

6. The vehicle registration authorities shall ensure material resources and arrange convenient locations to receive and process vehicle registration files and procedures, prioritizing the acceptance and processing of vehicle registration procedures through the public service portal. The registration location must have a guide map, schedule for receiving citizens, identification badges of registration officers, seating, parking space, suggestion box, and publicly display regulations on vehicle registration procedures, registration fees, violations, and penalties for non-compliance with registration regulations.

 

Article 5Responsibilities of vehicle registration authorities and registration officers

1. Accepting, checking vehicle files, inspecting vehicles in person, engraving engine and chassis numbers, and digitizing vehicle files into the vehicle registration and management system.

2. If the vehicle file and electronic data comply with regulations, they shall accept and process the vehicle registration. In case the procedures are not compliant, they shall provide specific and detailed guidance, record the guidance content on the File Guidance Form, and be responsible for the content of the guidance provided.

3. During the implementation process, registration officers must strictly adhere to the police force's orders, maintain proper conduct, and respect the people. They shall follow the provisions of this Circular and other relevant laws concerning vehicle registration work. It is strictly prohibited to add registration procedures contrary to the provisions of this Circular.

Article 6Responsibilities of vehicle owners

1. Comply with legal regulations on vehicle registration. Implement vehicle registration procedures through the public service portal, provide and declare truthful, complete, and accurate information as required for vehicle registration. Bear legal responsibility for the legality of the vehicle and its registration file. Strictly prohibit any fraudulent behavior in the registration file, illegal intervention in the public service portal, or the vehicle registration and management system to alter electronic data or tamper with the vehicle's engine and chassis numbers for registration purposes.

2. Bring the vehicle to the vehicle registration authority specified in Article 4 of this Circular for inspection when registering for the first time, transferring ownership, moving the vehicle, modifying, or changing the color. In case the vehicle registration certificate or license plate is blurred, damaged, or lost, the owner must report it and apply for replacement or reissue of the vehicle registration certificate and license plate (hereinafter referred to as replacement or reissue) according to regulations.

3. Within thirty days from the date the competent authority issues a certificate of technical safety and environmental protection for modified motor vehicles or changes in the name of the owner or changes in the address of the headquarters or residence to another province or centrally-administered city, or upon expiration of the vehicle registration certificate, the owner must go to the vehicle registration authority to apply for replacement or cancellation of the vehicle registration certificate and license plate (hereinafter referred to as cancellation) according to regulations.

4. When selling, giving away, inheriting, exchanging, contributing capital, allocating, or transferring vehicles (hereinafter referred to as transferring ownership rights):

a) The vehicle owner must retain the vehicle registration certificate and license plate (not to hand over to the organization or individual receiving the transfer of ownership of the vehicle) and submit these documents to the vehicle registration authority for the cancellation procedure; in cases where the vehicle ownership is transferred along with the license plate won through auction, the vehicle owner must submit the vehicle registration certificate to the vehicle registration authority for the cancellation procedure;

b) Within thirty days from the date of completing the documents for transferring ownership of the vehicle, the vehicle owner must complete the cancellation procedure; if the vehicle owner fails to complete the cancellation procedure within this period or hands over the vehicle registration certificate and license plate to the organization or individual receiving the transfer of ownership to complete the cancellation procedure, before handling the matter, the vehicle registration authority shall issue a decision to impose penalties on the vehicle owner for failing to complete the cancellation procedure as prescribed;

If the vehicle owner does not complete the cancellation procedure after transferring the ownership of the vehicle, they shall be held responsible under the law for any violations related to that vehicle;

c) After the vehicle owner completes the cancellation procedure, the organization or individual receiving the transfer of ownership must complete the procedure to register the change of name for the vehicle according to the regulations;

5. Within seven days from the date the vehicle reaches its end of service life, becomes unusable due to damage, or is destroyed due to external causes, the vehicle owner must declare this on the public service portal and submit the vehicle registration certificate and license plate to the vehicle registration authority or the police station of the commune where the owner resides (regardless of the owner's place of residence) for the cancellation procedure;

Article 7Term for processing registration vehicles

1. Issuing a vehicle registration certificate: Not exceeding two working days from the date all valid documents are received, except when reissuing a vehicle registration certificate which requires verification as stipulated in Clause 2 of this Article;

2. The term for verifying the loss of a vehicle registration certificate when issuing a replacement vehicle registration certificate is thirty days; the verification period is not included in the term for issuing a replacement vehicle registration certificate as stipulated in Clause 1 of this Article;

3. Issuing a first-time identification number plate: Issued immediately upon receipt of a valid vehicle registration application;

4. Replacing a vehicle number plate, reissuing a vehicle number plate, issuing a number plate won through auction, reissuing an identification number plate: Not exceeding seven working days from the date all valid documents are received;

5. Issuing a temporary vehicle registration, issuing a certificate of cancellation of vehicle registration and number plate:

a) In cases where the entire online public service process is completed on the public service portal: After the person submitting the application for a temporary vehicle registration form or the application for cancellation of vehicle registration and number plate has paid the prescribed fee (in the case of a temporary vehicle registration), the vehicle registration authority will check the documents to ensure they are valid and provide the result of the administrative procedure within eight hours from the date of receiving the application from the public service portal;

b) In cases where part of the online public service process is completed: One working day (for temporary vehicle registration); not exceeding two working days from the date all valid documents are received (for issuing a certificate of cancellation of vehicle registration and number plate);

6. The time for delivering the results of vehicle registration as stipulated in Clauses 1, 3, 4, and 5 of this Article is calculated from the date all valid documents are received and the vehicle registration and management system has received the verified result of the completion of the payment of the vehicle registration fee from the public service portal;

Chapter II

DOCUMENTS, PROCEDURES FOR VEHICLE REGISTRATION

Section 1

INITIAL VEHICLE REGISTRATION FIRST TIME

Article 8. Initial vehicle registration dossier

The initial vehicle registration dossier includes:

1. Vehicle registration application form.

2. Owner's documents.

3. Vehicle documents.

Article 9. Vehicle registration application form vehicles

1. The owner logs into the public service portal and is responsible for fully declaring all contents prescribed in the vehicle registration application form, signing digitally or signing, clearly stating their full name, and affixing a stamp (if it is an organization or entity).

2. After successfully declaring, the owner receives the online registration dossier code, the schedule for dossier resolution notified by the public service portal via SMS or email to proceed with vehicle registration procedures; provide the registration dossier code to the registration authority to process the vehicle registration according to regulations; in cases where the procedure cannot be completed on the public service portal, the owner shall directly declare the vehicle registration application form at the registration authority.

Article 10. Owner’s Documents

1. For Vietnamese owners: Use level 2 electronic identity account to perform vehicle registration procedures on the public service portal or present national identification card, passport.

For military forces: Present People's Public Security identification card, People's Army identification card, or confirmation letter from the head of the working unit at battalion level or higher, police station or equivalent (in cases where they have not been issued a force identification card).

2. Foreign owners

a) For owners who are members of diplomatic missions, consular offices, or international organizations' representative offices in Vietnam: Present diplomatic identification card, official identification card, consular identification card, honorary consular identification card, general identification card (still valid) and submit an introduction letter from the State Protocol Department or Provincial Department of Foreign Affairs;

b) In cases where foreign owners reside and work in Vietnam (excluding those specified in point a of this clause): Present permanent residence card or temporary residence card (valid for at least six months in Vietnam).

3. Organizational owners

a) For organizational owners (excluding those specified in point b of Clause 3 of this Article): Use level 2 electronic identity account to perform vehicle registration procedures on the public service portal; in cases where the organization has not been issued a level 2 electronic identity account, present tax registration notification or establishment decision.

In cases of vehicles belonging to military enterprises, an additional introduction letter from the Motorcycles Bureau, General Technical Department, Ministry of National Defense must be provided;

In cases of vehicles engaged in commercial road transport operations, an additional copy of the commercial road transport license issued by the Department of Transport must be provided along with the original for verification; in cases of vehicles belonging to other organizations or individuals, a lease agreement or business cooperation agreement or service agreement must be provided;

b) For owners who are diplomatic missions, consular offices, and international organizations' representative offices in Vietnam: Use level 2 electronic identity account to perform vehicle registration procedures on the public service portal; in cases where the organization has not been issued a level 2 electronic identity account, present tax registration notification and submit an introduction letter from the State Protocol Department or Provincial Department of Foreign Affairs;

c) Individuals introduced by organizations or entities to handle registration procedures must submit the owner's documents as prescribed in Clause 1, Clause 2 of this Article and present personal identification documents as prescribed in Clause 1, Clause 2 of this Article.

4. Individuals authorized to resolve vehicle registration procedures, in addition to the owner's documents as prescribed in Clause 1, Clause 2, Clause 3 of this Article, must also present personal identification documents and submit a notarized or certified power of attorney.

Article 11. Documents of the vehicle

1. Vehicle origin documents

a) For imported vehicles

Electronic data of imported vehicle information is received by the vehicle registration and management system from the public service portal or customs agency database;

For vehicles without electronic customs data, imported before December 1, 2020, the origin document is: Vehicle import origin declaration form (for vehicles imported under trade contracts), temporary import vehicle permit (for vehicles imported under temporary import and re-export regimes for entities entitled to diplomatic privileges and immunities under laws or international treaties to which Vietnam is a party);

b) For domestically produced and assembled vehicles

Electronic data of the Quality Inspection Certificate upon Factory Release is received by the vehicle registration and management system from the public service portal or inspection agency database;

In cases where there is no electronic Quality Inspection Certificate upon Factory Release, the origin document for domestically produced and assembled vehicles is the Quality Inspection Certificate for Road Motor Vehicles (paper version) as prescribed;

c) For vehicles confiscated according to the law

The confiscation decision or the decision establishing the ownership of the people for confiscated vehicles according to the law or the extract of the judgment content regarding the confiscation of vehicles (hereinafter referred to as the confiscation decision) is the original issued for each vehicle, in which all basic characteristics of the vehicle must be fully recorded: brand, model number, type of vehicle, engine number, chassis number, cylinder capacity; the vehicle must be complete, with the engine assembly, frame, and technical specifications.

Invoice for sale of state assets or invoice for sale of confiscated assets according to the law.

2. Ownership transfer documents, including one of the following documents:

a) Electronic invoice data received by the vehicle registration and management system from the public service portal or tax administration database. In cases where the vehicle does not have electronic invoice data, a paper invoice or an invoice converted from an electronic invoice to a paper invoice according to the law must be provided;

b) The decision of the competent authority or document on the sale, gift, inheritance of the vehicle, financial certificates of the vehicle in accordance with the provisions of the law. Documents on the sale, gift, inheritance of vehicles by individuals must be notarized or certified or confirmed by the agency, organization, unit where they are working (for armed forces and foreigners working at diplomatic agencies, consular agencies, representative offices of international organizations that register vehicles according to the address of the working agency, organization, unit).

c) For vehicles of public security agencies for liquidation: The decision on liquidation of vehicles by the competent authority and invoice for selling state assets or invoice for selling state property.

d) For vehicles of military agencies for liquidation: The letter confirming that the vehicle has been removed from military equipment of the Motor-Cycle Department, General Technical Department, Ministry of National Defense and invoice in accordance with regulations.

3. Vehicle stamp duty certificate

Electronic stamp duty data is received by the vehicle registration and management system from the public service portal or the database of the tax administration agency;

In case the vehicle does not have electronic stamp duty data, it must have a receipt for payment into the state budget or other stamp duty payment documents as prescribed; for vehicles exempted from stamp duty, there must be a notification of stamp duty payment from the tax administration agency, including information on stamp duty exemption.

Article 12. Registrationprocedures for the first time

1. Organizations and individuals registering vehicles shall comply with the provisions of Article 9 of this Circular; bring the vehicle to the registration agency and submit the documents specified in Articles 10 and 11 of this Circular.

2. After the vehicle registration officer checks the vehicle file and the actual vehicle and confirms their compliance, the license plate will be issued in accordance with the following provisions:

a) Issue a new license plate for cases where the vehicle owner has not yet been issued an identity license plate or already has an identity license plate but is currently registered for another vehicle;

b) Reissue the license plate according to the identity license plate number for cases where that identity license plate number has been revoked.

In cases where the vehicle or vehicle file does not comply with the regulations, the file shall be supplemented and completed according to the guidance of the vehicle registration officer on the file guidance form.

3. Receive a notice to collect the result, pay the vehicle registration fee, and receive the vehicle license plate (in cases where a license plate is issued in accordance with point a, Clause 2, Article 12 of this provision); in cases where the vehicle owner requests to collect the registration result through postal services, register with the postal service provider.

4. Receive the vehicle registration certificate and license plate (in cases where a license plate is issued in accordance with point b, Clause 2, Article 12 of this provision) at the registration agency or from the postal service provider.

REGISTRATION TRANSFER OF OWNERSHIP AND MOVEMENT OF VEHICLES VEHICLE

Article 13. Cases of transferring ownership and moving vehicles

1. When transferring ownership of a vehicle or transferring the headquarters or place of residence from one centrally governed city or province to another (hereinafter referred to as original owner movement), the vehicle owner must complete the procedure to recover the file from the agency managing the vehicle file.

2. Organizations and individuals receiving the transfer of ownership of a vehicle, the vehicle owner (in cases of original owner movement) shall complete the procedure for transferring ownership and moving the vehicle at the vehicle registration agency in accordance with the provisions of Article 4 of this Circular.

Article 14. Documents for registration transfer and vehicle relocationregistration transfer, vehicle relocation

1. Documents for recovery

a) Vehicle registration recovery declaration form and license plate;

b) Vehicle owner's documents as prescribed in Article 10 of this Circular;

c) Two copies of engine and frame number inspections;

d) Vehicle registration certificate;

đ) License plate;

In case of original owner relocation, the vehicle owner does not need to return the license plate except when the registered license plate has three or four digits, then the three or four digit plates must be returned;

In case the vehicle registration certificate or license plate is lost, the reason must be clearly stated in the vehicle registration recovery declaration form;

e) Copy of the ownership transfer document as prescribed in Clause 2, Article 11 of this Circular (except in cases of original owner relocation).

2. Documents for registration transfer and vehicle relocation

a) Vehicle registration declaration form;

b) Vehicle owner's documents as prescribed in Article 10 of this Circular;

c) Ownership transfer document as prescribed in Clause 2, Article 11 of this Circular (except in cases of original owner relocation);

d) Stamp duty payment receipt as prescribed in Clause 3, Article 11 of this Circular;

đ) Vehicle registration recovery certificate.

Article 15. Procedures for registration transfer and vehicle relocation

1. Recovery procedures

a) The vehicle owner declares the vehicle registration recovery form on the public service portal; provides the online registration file code; submits the recovery documents as prescribed in Clause 1, Article 14 of this Circular and receives the appointment letter for the vehicle registration result according to regulations;

b) After verifying the valid vehicle documents, the registration authority issues the vehicle registration recovery certificate (with attached engine and frame number inspections and stamped with the registration authority's seal on the engine and frame number inspections): one copy given to the vehicle owner; one copy kept in the vehicle file; if the vehicle registration certificate is lost, verification shall be conducted according to regulations.

2. Registration transfer and vehicle relocation procedures

a) Organizations or individuals receiving ownership transfer, vehicle owners (in cases of original owner relocation): Declare the vehicle registration form as prescribed in Article 9 of this Circular; bring the vehicle for inspection, provide the online registration file code and submit the documents as prescribed in Clause 2, Article 14 of this Circular;

b) After verifying the valid vehicle documents and actual vehicle conditions, the registration authority will issue the license plate as prescribed in Clause 2, Article 12 of this Circular;

c) Receive the appointment letter for the registration result, pay the registration fee and receive the license plate (if issued according to point a, Clause 2, Article 12 of this Circular); if the vehicle owner requests to receive the registration result through postal services, they should register with the postal service provider;

d) Receive the vehicle registration certificate and license plate (if issued according to point b, Clause 2, Article 12 of this Circular) at the registration authority or from the postal service provider.

In cases of original owner relocation, the identification license plate (five-digit plate) remains unchanged; if the old license plate has three or four digits, it will be replaced with an identification license plate according to this Circular.

 

 

Section 3

ISSUE, REISSUE

VEHICLE REGISTRATION CERTIFICATE, LICENSE PLATE

Article 16. In cases ofreplacement, reissue

1. Cases of replacing the vehicle registration certificate and license plate: Vehicle modification; change of paint color; vehicles that have been registered with white background license plates with black letters and numbers changing to yellow background license plates with black letters and numbers (vehicles engaged in commercial transportation by automobile) and vice versa; extension of the vehicle registration certificate; changes in owner information (owner name, personal identification number, address); damaged, faded, torn vehicle registration certificates; damaged, faded, broken license plates or if the vehicle owner requests to replace the old vehicle registration certificate and license plate with new ones according to this Circular.

2. Cases of reissuing the vehicle registration certificate and license plate: Lost vehicle registration certificate; lost license plate.

Article 17. Documents for renewal2. Vehicle owner's documents as prescribed in Article 10 of this Circular., reissue

1. Vehicle registration application form.

3. Certificate of vehicle registration (in case of renewing the certificate of vehicle registration) or license plate (in case of renewing the license plate).

4. Other documents:

a) In case of renewing the license plate from a yellow background with black letters and numbers to a white background with black letters and numbers, there must be an additional decision on revoking the business operation permit or the decision on revoking the emblem or sign.

b) In case of modifying the vehicle by replacing the engine assembly or chassis assembly, there must be additional documents on origin, tax documents, and ownership transfer documents of the engine assembly or chassis assembly as prescribed in Article 11 of this Circular.

c) In case of modifying the vehicle by replacing the engine assembly or chassis assembly that are not of the same brand, there must be an additional certificate of roadworthiness and environmental protection for modified motor vehicles as prescribed.

d) In case of modifying the vehicle by replacing the engine assembly or chassis assembly of a registered vehicle, there must be a certificate of recovery of the registration and license plate of that registered vehicle.

Article 18. Procedures for renewal

1. Full online public service process for issuing a new certificate of vehicle registration or license plate (except for vehicles already registered with three or four digit license plates). a) The vehicle owner fills out the application form for vehicle registration as prescribed in Article 9 of this Circular and attaches a scanned copy of the engine number and frame number according to the regulations on the public service portal., reissue

b) After checking the vehicle documents and ensuring they are valid, the vehicle registration authority sends a notification to the vehicle owner to pay the registration fee and postal service fees on the public service portal to obtain the registration results.

c) The vehicle owner receives the certificate of vehicle registration or license plate according to the regulations through the postal service.

2. Partial online public service process (except for cases prescribed in Clause 1 of this Article)

a) The vehicle owner fills out the application form for vehicle registration as prescribed in Article 9 of this Circular, submits the renewal or replacement documents as prescribed in Article 17 of this Circular, and pays the required fees; the vehicle owner does not need to bring the vehicle for inspection (except for modified vehicles or those with changed paint color).

b) After checking the vehicle documents and ensuring they are valid, the vehicle registration authority issues a new certificate of vehicle registration or license plate according to the regulations; the vehicle owner can collect the registration results at the vehicle registration authority or through the postal service.

In case of renewing or replacing the certificate of vehicle registration or license plate, the identification number remains unchanged; for vehicles already registered with three or four digit license plates, they will be issued a new identification number according to the regulations (the old certificate of vehicle registration and three or four digit license plates will be withdrawn).

In case of changing the license plate from a white background with black letters and numbers to a yellow background with black letters and numbers or vice versa, a new identification number will be issued (if there is no existing identification number) or the identification number will be reissued (if there is an existing identification number).

Chapter 4

TEMPORARY VEHICLE REGISTRATION

1. Exported, imported, or produced and assembled vehicles moving from the factory to the port or warehouse, or from the port, factory, or dealership to the registration office or other storage facilities.

Article 19. In case registration vehicles 2. Vehicles undergoing procedures for recall for re-exportation or transfer of ownership.

3. Vehicles operating within limited areas (vehicles not participating in road traffic).

4. Vehicles registered abroad and permitted by competent authorities, including right-hand drive vehicles (reverse steering) entering Vietnam for transit, temporary importation, or re-exportation with a time limit to participate in conferences, exhibitions, sports events, tourism; except for cases where temporary license plates are not required under international treaties to which Vietnam is a party.

5. Vehicles temporarily imported, re-exported, or produced and assembled in Vietnam for testing on public roads.

6. Vehicles serving conferences organized by the Party and State.

5. Vehicles temporarily imported for re-export or vehicles produced or assembled in Vietnam undergoing trial runs on public roads.

Article 20. Temporary vehicle registration file

1. Vehicle registration application form.

3. Certificate of vehicle registration (in case of renewing the certificate of vehicle registration) or license plate (in case of renewing the license plate).

3. Vehicle documents, including one of the following documents:

a) Electronic data or a copy of the original vehicle certificate in accordance with Clause 1, Article 11 of this Circular or a copy of the invoice or warehouse release note (in the case provided for in Clause 1, Article 19 of this Circular);

b) Present the vehicle registration certificate; if the vehicle has not been registered, it must have the original vehicle certificate in accordance with Clause 1, Article 11 of this Circular (in the case provided for in Clause 3, Article 19 of this Circular);

c) A permit to participate in traffic issued by the competent authority, accompanied by a list of vehicles and a photocopy of the vehicle registration from the country of origin (in the case provided for in Clause 4, Article 19 of this Circular);

d) A confirmation document that the vehicle meets technical safety standards and environmental protection requirements, and is permitted to run trial tests on public roads by the Vietnam Registration Agency (in the case provided for in Clause 5, Article 19 of this Circular);

đ) A document from the competent authority approving the temporary vehicle registration application, accompanied by a list of vehicles (in the case provided for in Clause 6, Article 19 of this Circular).

4. In cases where the vehicle owner processes the procedures to recover the vehicle for re-export to their home country or transfer ownership of the vehicle, they can be issued a temporary vehicle registration along with the recovery file (if the owner requests) without having to provide a temporary vehicle registration file.

Article 21. Procedures for temporary vehicle registration

1. Implementing online public service throughout the process, for cases provided for in Clause 1, Article 19 of this Circular

a) The vehicle owner fills out the vehicle registration form and sends a scanned copy of the sales invoice or warehouse release note through the public service portal;

b) After verifying the valid file, the registration agency notifies the owner to pay the prescribed fee; the owner receives the verification result and prints the temporary vehicle registration certificate through the public service portal.

b) After checking the vehicle documents and ensuring they are valid, the vehicle registration authority issues a new certificate of vehicle registration or license plate according to the regulations; the vehicle owner can collect the registration results at the vehicle registration authority or through the postal service.

a) The vehicle owner fills out the vehicle registration form on the public service portal; provides the online vehicle registration file code and submits the temporary vehicle registration documents as stipulated in Article 20 of this Circular; if unable to complete online, the owner may fill out the form directly at the nearest registration agency;

b) After receiving and verifying the valid file, the registration agency collects the fee and issues the temporary vehicle registration certificate and temporary license plate to the owner according to regulations.

Article 22. Validity period of the temporary vehicle registration certificate

1. For cases provided for in Clause 1 and Clause 2, Article 19 of this Circular: The temporary vehicle registration certificate is valid for 15 days; it can be extended once for up to 15 days. When extending, the owner must fill out the temporary vehicle registration form on the public service portal or directly at the registration agency.

2. For cases provided for in Clause 3, Clause 4, Clause 5, and Clause 6, Article 19 of this Circular: The validity period of the temporary vehicle registration certificate will be recorded according to the time allowed by the competent authority for those activities.

3. Vehicles registered temporarily are allowed to participate in traffic within the period, route, and scope of operation specified in the temporary vehicle registration certificate.

 

Section 5

RECOVERYOFTHE REGISTRATION CERTIFICATE AND LICENSE PLATE

Article 23. In case recovery of the registration certificate and license plate

1. Vehicles that are unusable due to damage or destruction for reasons beyond control.

2. Vehicles that have exceeded their usage period and are not allowed to operate according to the law.

3. Stolen vehicles, seized vehicles that cannot be found, or abandoned vehicles, where the owner requests the recovery of the registration certificate and license plate.

4. Imported tax-exempt vehicles or temporarily imported vehicles by foreign organizations, individuals that are re-exported, transferred ownership, or destroyed.

5. Vehicles registered in economic zones as prescribed by the Government when re-exported or transferred to Vietnam.

6. Vehicles processing name change or relocation registration procedures.

7. Vehicles that have had their engines or frames removed to register for other vehicles.

8. Vehicles that have been registered but were later discovered to have false files or vehicles with conclusions from competent authorities indicating that engine numbers or frame numbers have been cut, welded, drilled, erased, or license plates issued incorrectly.

Article 24. Recovery File recovery

1. For cases provided for in Clause 1, Clause 2, and Clause 3, Article 23 of this Circular: The recovery file shall comply with Points a, b, d, đ of Clause 1, Article 14 of this Circular.

2. For cases provided for in Clause 4, Clause 5, Clause 6, and Clause 7, Article 23 of this Circular: The recovery file shall comply with Clause 1, Article 14 of this Circular.

For vehicles belonging to diplomatic missions, consular agencies, representative offices of international organizations in Vietnam, or foreign nationals who are members of these agencies or organizations, a letter of introduction from the State Protocol Department (for diplomatic missions and representative offices of international organizations) or the Department of Foreign Affairs (for consular agencies) is required.

3. For cases provided for in Clause 8, Article 23 of this Circular, the registration agency issues a decision to recover the registration and license plate without requiring a recovery file.

Article 25. Procedures for Revocation

1. For cases prescribed in Clauses 1, 2, and 3 of Article 23 of this Circular, where online public service transactions are fully implemented

a) The vehicle owner declares the revocation application form for vehicle registration and license plate on the public service portal and submits the vehicle registration certificate and license plate to the registration authority through postal services;

b) After receiving and checking the valid file, the registration authority issues the revocation certificate for vehicle registration and license plate to the vehicle owner on the public service portal.

b) After checking the vehicle documents and ensuring they are valid, the vehicle registration authority issues a new certificate of vehicle registration or license plate according to the regulations; the vehicle owner can collect the registration results at the vehicle registration authority or through the postal service.

a) The vehicle owner declares the revocation application form for vehicle registration and license plate on the public service portal; provides the online registration file code and submits the revocation file according to Article 24 of this Circular; receives the appointment letter for the result of vehicle registration according to regulations;

b) After receiving and checking the valid file, the registration authority issues the revocation certificate for vehicle registration and license plate according to regulations; one copy is returned to the vehicle owner; one copy is kept in the vehicle file.

In cases of revocation prescribed in Clauses 4, 5, 6, and 7 of Article 23 of this Circular, the revocation certificate for vehicle registration and license plate must be affixed with the chassis number and engine number copies and stamped with the overlapping seal of the registration authority on the engine number and chassis number copies.

Article 26. Responsibilities of Public Security Units and Localities in the Revocation of Vehicle Registration Certificates and License Plates recovery of vehicle registration certificate, license plate

1. Responsibilities of the Registration Authority

a) Based on the list of vehicles that have exceeded their service life or are not allowed to operate according to the law provided by the inspection agency or competent state agencies, the registration authority must review and notify organizations or individuals owning such vehicles to complete the revocation procedures. If the vehicle owner does not complete the revocation procedures within thirty days from the date of notification, administrative violations will be handled according to the law;

b) Update the vehicle owner's declaration information on the electronic information page of the Traffic Police Department or the public service portal regarding vehicles that have exceeded their service life, scrapped vehicles, non-operational damaged vehicles, or vehicles destroyed due to external causes, which require revocation procedures according to this Circular;

c) Notify the list of vehicles that have exceeded their service life, are not allowed to operate, or have been stolen according to the law to local public security units responsible for traffic safety and order to discover and handle them according to the law, and notify the vehicle owners via email addresses or text messages or the public service portal;

d) For vehicles registered according to Clause 8 of Article 23 of this Circular, the registration authority must notify the vehicle owner and issue a decision to revoke the registration and license plate. For files concluded by authorized agencies as fake files or where the engine number or chassis number has been cut, welded, drilled, or erased, they must be transferred to the investigation agency for clarification and handling according to the law.

2. Responsibilities of Public Security Units and Localities and Functional Forces Responsible for Ensuring Traffic Safety and Order

a) Through traffic safety and social order management work, identify vehicles belonging to the categories prescribed in Clauses 2, 3, and 8 of Article 23 of this Circular, prepare records, handle them according to the law, and notify the registration authority in writing to monitor;

b) Based on the list of vehicles that have exceeded their service life or are not allowed to operate according to the law provided by the registration authority, the commune-level public security agency notifies the vehicle owner or the person currently using the vehicle whose place of residence is within its jurisdiction, and proceeds to revoke the vehicle registration certificate and license plate and issue the revocation certificate (in paper or electronic form). If the commune-level public security agency has not been authorized to register vehicles, it shall proceed to revoke and hand over the vehicle registration certificate and license plate to the county-level public security agency in its locality to carry out the revocation process on the vehicle registration and management system according to regulations;

c) In cases where a vehicle involved in a traffic accident is destroyed and cannot be used, the agency handling the traffic accident temporarily retains the vehicle registration certificate and license plate and notifies the registration authority in writing to complete the revocation procedures according to regulations.

Chapter 6

REGISTRATION AND ISSUANCE OF LICENSE PLATES FOR VEHICLES WON IN AUCTIONS

Article 27. Documents for Registration and Issuance of License Plates for Vehicles Won in Auctions

1. For Unregistered Vehicles

a) Vehicle registration documents as stipulated in Article 8 of this Circular;

b) Confirmation of the license plate won in the auction issued by the Traffic Police Department, still within the validity period; if expired, an additional confirmation of extension issued by the Traffic Police Department is required.

2. For Registered Vehicles Owned by Organizations or Individuals Who Won the Auction

a) Vehicle registration declaration form;

b) Vehicle registration certificate and license plate;

If the agency implementing the registration and issuance of license plates for vehicles won in auctions is different from the agency managing the registration files of the winning organization or individual, the vehicle owner must complete the revocation procedures for the previously registered vehicle;

c) Confirmation of the license plate won in the auction issued by the Traffic Police Department, still within the validity period; if expired, an additional confirmation of extension issued by the Traffic Police Department is required.

3. For Vehicles Receiving Ownership Transfer from Other Organizations or Individuals

a) Vehicle registration declaration form;

b) Proof of ownership transfer of the vehicle as prescribed in Clause 2 of Article 11 of this Circular;

c) Proof of stamp duty as prescribed in Clause 3 of Article 11 of this Circular;

d) Certificate of revocation of vehicle registration and license plate;

đ) Confirmation of the license plate won in the auction issued by the Traffic Police Department, still within the validity period; if expired, an additional confirmation of extension issued by the Traffic Police Department is required.

Article 28. Vehicle Registration Procedures

1. Organizations and individuals who win the auction for automobile license plates shall carry out vehicle registration as follows:

a) Fill out the vehicle registration application form in accordance with Article 9 of this Circular;

b) Bring the vehicle to the Traffic Police Office where their headquarters or residence is located or the Traffic Police Office managing the license plate won at the auction for inspection; provide the online registration file code and submit the vehicle file in accordance with Article 27 of this Circular;

c) After the vehicle registration officer checks that the vehicle file and the actual vehicle meet the requirements, the organization or individual will be issued the license plate won at the auction; receive the appointment letter for the registration result and pay the registration fee as prescribed; if the vehicle owner wishes to receive the registration result through public postal service, they must register with the public postal service unit;

d) Receive the registration result from the registration authority or from the public postal service unit.

2. In case of transferring ownership of the vehicle without the license plate won at the auction

a) The vehicle owner submits the file and completes the procedure for revocation in accordance with Clause 1, Article 14 and Clause 1, Article 15 of this Circular;

b) The organization or individual receiving the transfer of ownership submits the file and completes the procedure for transferring the vehicle registration in accordance with Clause 2, Article 14 and Clause 2, Article 15 of this Circular.

3. In case of transferring ownership of the vehicle along with the license plate won at the auction

a) The vehicle owner submits the file and completes the procedure for revocation in accordance with Clause 1, Article 14 and Clause 1, Article 15 of this Circular; the vehicle owner does not need to return the license plate won at the auction but must submit a copy of the ownership transfer document and present the original for verification (the ownership transfer document must clearly indicate the transfer of ownership of the vehicle along with the auctioned license plate);

b) The organization or individual receiving the transfer of ownership submits the file and completes the procedure for transferring the vehicle registration in accordance with Clause 2, Article 14 and Clause 2, Article 15 of this Circular and retains the license plate won at the auction (the ownership transfer document must clearly indicate the transfer of ownership of the vehicle along with the auctioned license plate).

An organization or individual that has received the transfer of ownership of the vehicle along with the license plate won at the auction may not continue to transfer the ownership of the vehicle along with the license plate won at the auction to another organization or individual; they can transfer the ownership of the vehicle in accordance with the provisions of the law.

Article 29. Management of License Plates Won at Auction after Vehicle Registration

1. During the usage period, if the vehicle registration certificate or license plate is damaged, lost, or when the vehicle is being repaired, repainted, the vehicle owner (the organization or individual who won the auction for the license plate) shall complete the procedures for replacement or reissue at the registration authority that registered and issued the license plate for the vehicle in accordance with Articles 16, 17, and 18 of this Circular.

2. When moving the headquarters or place of residence to another province or centrally administered city, the vehicle owner shall complete the procedures for revocation and registration in accordance with Articles 13, 14, and 15 of this Circular.

Section 7

GUIDANCE ON RESOLVING SPECIFIC CASES

Article 30Cases related to the engine number and chassis number of vehicles

1. Vehicles that have not been registered or have already been registered with the engine number and chassis number cut, welded, drilled, modified, or erased; decisions to confiscate without recording the engine number and chassis number or noting "unidentifiable," "no number," or "no number" shall not be processed for registration.

2. Imported, domestically produced, or assembled vehicles that have not been registered:

a) In cases where the vehicle only has the VIN number and lacks the engine number and chassis number, the registration authority shall reapply the chassis number according to the VIN and reapply the engine number according to the license plate number;

b) For vehicles with the engine number and chassis number marked on the Etekét, painted, or stamped (lade), and which are faded, rusted, or corroded due to environmental factors, the registration authority shall reapply the engine number and chassis number according to the origin document specified in Point a and Point b, Clause 1, Article 11 of this Circular;

c) For vehicles with the engine number and chassis number incorrectly stamped and accompanied by a confirmation document from the manufacturer, the registration shall be processed and the engine number and chassis number reapplied according to the license plate number; for imported vehicles, the confirmation document from the foreign manufacturer must be legalized by consular certification;

d) For vehicles with the engine number and chassis number incorrectly stamped and accompanied by a conclusion that the engine number and chassis number are original, the registration shall be processed.

3. In cases where the engine block or chassis frame has been replaced without numbers, the engine number and chassis number shall be reapplied according to the license plate number.

4. Registered vehicles whose engine number and chassis number have become corroded, faded, or rusted during use, or have lost one or more characters, and have been concluded by an appraisal agency to be original, shall have the numbers reapplied according to the origin document specified in Clause 1, Article 11 of this Circular.

5. Vehicles confiscated according to the law with the engine number and chassis number or with the engine number and chassis number cut, welded, drilled, modified, or erased, and the original engine number and chassis number cannot be determined, if they meet the conditions for registration to participate in traffic, before confiscation, the agency responsible for handling the property shall coordinate with the local Traffic Police Office to organize the reapplication of the engine number and chassis number according to the principle: serial code of the local registration authority, year, number of the temporary detention record, professional qualification certificate; the confiscation decision or confiscation record shall be noted according to the engine number and chassis number reapplied by the Traffic Police Office according to the principle in this clause, accompanied by the decision to reapply the engine number and chassis number as the basis for processing the registration (the engine number and chassis number imprint after reapplication must be affixed to the decision to reapply the engine number and chassis number).

6. In all cases, the reapplication of the engine number and chassis number as stipulated in Points a, b, and c, Clauses 2, 3, 4, and 5 of this Article must be carried out by the registration authority.

Article 31. Registration of Vehicle Transfer for Vehicles with Multiple Ownership Transfers

1. Organizations and individuals currently using the vehicle shall go to the agency managing the registration files of that vehicle to complete procedures for recovery and transfer of ownership registration at the registration agency where their office or residence is located as stipulated in Article 4 of this Circular; if the management agency is also the agency handling the transfer of ownership registration, then there is no need to complete the recovery procedure.

2. Documents and Procedures for Recovery

Organizations and individuals currently using the vehicle shall submit the documents and complete the recovery procedures according to Articles 14 and 15 of this Circular at the agency managing the registration files of that vehicle.

3. Documents and Procedures for Transfer of Ownership Registration

Organizations and individuals shall present the documents specified in Article 10 of this Circular and submit the following documents:

a) Vehicle registration application form, clearly stating the purchase and sale process and committing to responsibility for the lawful origin of the vehicle;

b) Proof of ownership transfer from the owner of the vehicle and proof of ownership transfer from the final seller (if applicable);

c) Proof of stamp duty as prescribed in Clause 3 of Article 11 of this Circular;

d) Certificate of recovery of registration and license plate (with the engine number and chassis number affixed and stamped by the registration agency on the certificate of recovery of registration and license plate).

In cases where the agency managing the vehicle files is also the agency handling the transfer of ownership registration, organizations and individuals currently using the vehicle shall submit the vehicle registration certificate and license plate instead of the certificate of recovery of registration and license plate.

4. Responsibilities of the Registration Agency

a) In cases where organizations and individuals currently using the vehicle have proof of ownership transfer from the owner of the vehicle and proof of ownership transfer from the final seller: Within two working days from the date of receiving all valid vehicle documents, the registration agency shall issue a decision to impose penalties for not completing the recovery procedures as prescribed and proceed with the transfer of ownership registration as stipulated in Article 15 of this Circular;

b) In cases where organizations and individuals currently using the vehicle do not have proof of ownership transfer from the owner of the vehicle and proof of ownership transfer from the final seller: The registration agency shall issue a temporary permit allowing the use of the vehicle for thirty days. Within two working days from the date of receiving the application for transfer of ownership registration, the registration agency must notify the original owner and the registration agency that registered the vehicle; publicly announce the receipt of the application for registration from organizations and individuals at the registration agency's office; search and verify stolen vehicle records and registration data. If there is no dispute or complaint within thirty days, the registration agency shall issue a decision to impose penalties for not completing the recovery procedures and proceed with the transfer of ownership registration as stipulated in Article 15 of this Circular.

5. Responsibilities of Units Managing Stolen Vehicle Databases and Seized Vehicle Databases

Within seven working days from the date of receiving the notification from the registration agency requesting verification, the unit managing the stolen vehicle database and seized vehicle database shall respond in writing to the registration agency.

Article 32. Resolution of Certain Cases When Registering and Issuing License Plates

1. Regarding Invoices

a) For vehicles registered for the first time after being sold through multiple organizations or enterprises: Original invoice or electronic invoice data of the final selling organization or enterprise;

b) For vehicles of enterprises or business establishments: Value-added tax invoices or sales invoices as prescribed by law; in cases of purchasing auctioned vehicles from state agencies: State asset sale invoices or public asset sale invoices; in cases of vehicles confiscated according to law: Confiscated asset sale invoices as prescribed by law or state asset sale invoices or public asset sale invoices (original or certified copies); for financial institutions' auctioned vehicles: Invoices as prescribed or electronic data of the above types of invoices;

c) Organizations and individuals contributing capital to enterprises with contribution documents being minutes of contributions or minutes of asset delivery; when withdrawing capital from the enterprise, they must have minutes of vehicle return, minutes of asset delivery, and invoices as prescribed by law (in cases where there is an invoice when contributing capital to the enterprise).

2. Regarding Modified Vehicles

a) In cases where imported used vehicles are modified before registration, the initial registration documents as stipulated in Article 8 of this Circular and the certificate of roadworthiness and environmental protection for modified motor vehicles as prescribed;

b) Not registering other modified passenger cars or specialized vehicles converted in function before five years and refrigerated vehicles converted before three years (from the date of importation);

c) Not using total engine or frame assemblies to replace other vehicles that have exceeded their service life, scrapped vehicles, vehicles not allowed to operate according to law, tax-exempt vehicles, temporarily imported and re-exported vehicles of diplomatic missions, consular offices, or international organizations enjoying privileges and immunities or consular privileges;

d) Throughout the usage period, each vehicle can only change one of the two assemblies, either the engine or the frame (not both).

3. Trailers, Semi-trailers, Towing Units: Origin documents are certificates of roadworthiness and environmental protection for imported motor vehicles (for license plate registration).

4. Vehicles belonging to goods inventory disposal stored in port, warehouse, or storage areas under customs jurisdiction as prescribed by law shall comply with the vehicle documents as stipulated in Articles 9 and 10, Clause 3, Article 11 of this Circular, accompanied by:

a) Invoice for sale of public assets (one original copy);

b) Auctioned asset purchase and sale contract (one original copy);

c) Warehouse dispatch note of the entity responsible for storing and preserving goods (one original copy).

Specifically, for vehicles prohibited from importation according to government regulations, a confiscation decision as stipulated in Point c, Clause 1, Article 11 of this Circular is required.

5. Vehicles requiring additional import tax payment shall comply with the documents as stipulated in Article 8 of this Circular, accompanied by:

a) Decision on additional tax collection issued by the competent customs authority;

b) Payment receipt for import tax deposited into the state budget.

6. For national reserve vehicles, the application dossier shall comply with the provisions of Article 9, Article 10, Clause 1, and Clause 3 of Article 11 of this Circular, accompanied by the decision on selling state reserve goods issued by the head of the ministry or sector managing such goods; if multiple vehicles are sold under one decision, each vehicle must have one copy (a certified copy by the ministry or sector managing state reserve goods).

In cases where there are no original import certificates for the vehicles, a confirmation letter from the customs authority (one original per vehicle) specifying the vehicle's characteristics: type, brand, model number, engine number, chassis number, cylinder capacity, year of manufacture must be provided.

7. Vehicles sold to ensure enforcement of court judgments or debt recovery

a) If the vehicle has a valid original file and proof of lawful ownership of the person whose property was processed, registration will be processed. In cases where the origin of the vehicle is unclear or there is no proof of lawful ownership of the person whose property was processed, the application will not be accepted, and the owner will be guided to the place that issued the auction sale decision for resolution;

b) For vehicles sold by enforcement agencies to ensure enforcement of court judgments, the vehicle registration dossier includes: A copy of the court decision or record of judgment or enforcement decision of the competent civil enforcement agency, payment receipts or handover records;

In cases where the vehicle has not been registered, the registration dossier shall be supplemented according to the provisions of Article 8 of this Circular;

In cases where the vehicle has already been registered, the buyer shall recover the registration certificate and license plate according to the provisions of Article 14 of this Circular (if the registration certificate is no longer available, a confirmation letter from the enforcement agency must be provided), and submit the supplementary vehicle registration dossier including: Vehicle registration form, owner's documents as stipulated in Article 10 of this Circular, tax payment receipt as stipulated in Article 11 of this Circular, certificate of recovered registration certificate and license plate;

c) For vehicles pledged by financial institutions to recover debts, the vehicle registration dossier includes: A copy of the pledge agreement or credit agreement or guarantee agreement for loan application combined with credit agreement (signed by the financial institution); invoice as prescribed by law.

In cases where the vehicle has not been registered, the registration dossier shall be supplemented according to the provisions of Article 8 of this Circular;

In cases where the vehicle has already been registered, the buyer shall recover the registration certificate and license plate according to the provisions of Article 14 of this Circular (if the registration certificate is no longer available, a confirmation letter from the financial institution must be provided), and submit the supplementary vehicle registration dossier including: Vehicle registration form, owner's documents as stipulated in Article 10 of this Circular, tax payment receipt as stipulated in Article 11 of this Circular, certificate of recovered registration certificate and license plate;

d) For vehicles with a compulsory seizure decision by a competent authority to secure the payment of overdue taxes and fines as prescribed by law in the customs field, the dossier shall comply with the provisions of Article 8 of this Circular, accompanied by: A copy of the compulsory seizure decision using asset seizure measures for auction sale, asset auction record of the competent authority; invoice as prescribed by law.

8. Foreign leased special purpose vehicles

a) The dossier shall comply with the provisions of Article 9, Article 10, Clause 1, and Clause 3 of Article 11 of this Circular;

b) Lease agreement.

9. For vehicles registered under foreign aid projects that have expired and handed over to Vietnam, the transfer registration dossier shall comply with the provisions of Article 14 of this Circular, accompanied by:

a) Decision establishing full ownership rights over the vehicle (for central agencies, it is a document from the head of the ministry, for local agencies, it is a document from the Chairman of the Provincial People's Committee) and handover record of assets received from the donor;

b) In cases where aid project vehicles expire and need to be sold, a decision on asset disposal by the competent authority is required.

10. For vehicles registered under a project that are transferred to another project for continued use, the transfer registration dossier shall comply with the provisions of Article 14 of this Circular, accompanied by:

a) Transfer document of the foreign project owner;

b) Confirmation letter of aid goods from the competent state agency.

11. For registered vehicles now subject to asset disposal decisions by competent authorities to recover assets from terminated projects and other state assets, the transfer registration dossier shall comply with the provisions of Article 14 of this Circular, accompanied by:

a) Asset disposal decision by the competent authority;

b) Invoice for the sale of state assets or public asset sale invoice issued by the competent state agency in case of asset disposal through sale or liquidation; handover record in case of asset disposal through reallocation.

12. For registered vehicles of enterprises that have been dissolved and are now liquidating assets, the buyer shall process the transfer registration according to the provisions of Articles 14 and 15 of this Circular, accompanied by:

a) Registration certificate;

b) Dissolution decision by the competent authority or a copy of the decision revoking the business registration certificate.

13. Vehicles that are jointly owned by spouses

Registered vehicles (named for both spouses or only one spouse) where the named person in the registration certificate has died or gone missing (with death certificate or court declaration of disappearance) can be processed for transfer registration if the heir agrees in writing as prescribed.

14. When processing transfer registration, replacement, or reissue of the registration certificate or license plate for vehicles that have been mortgaged, a confirmation letter of mortgage release from the competent state agency (in paper or electronic form) must be provided.

15. Registration of vehicles with origins confiscated according to the law

a) Vehicles with origins confiscated according to the law do not require an original file but the source documents must comply with point c, clause 1 of Article 11 of this Circular;

b) In cases where the confiscation decision does not specify the vehicle's characteristics, a confiscation record signed by the authorized confiscator must be provided, which must include all vehicle characteristics as stipulated in point c, clause 1 of Article 11 of this Circular;

c) In cases where the confiscation decision or confiscation record does not fully specify the vehicle's characteristics; the vehicle is incomplete, the engine and frame do not match technical specifications, registration will not be processed.

d) For vehicles that have been registered and issued license plates and are subsequently confiscated, after completing the registration procedures for the confiscated vehicle, the registration authority shall notify the management agency to cancel the file.

16. Registration of name transfer and movement of vehicles belonging to the military and military enterprises

a) Military vehicles and military enterprise vehicles that have been registered with the police authority and are now being transferred to the Vehicle-Motorcycle Bureau shall have their files recovered according to Clause 2, Article 24 of this Circular and the Decision on transferring vehicles for registration at the Ministry of National Defense signed by the head of the Ministry of National Defense; after completing the procedures, the vehicle owner will be issued a certificate of file recovery, license plate, and original file;

b) Military enterprise vehicles that have been registered with the police authority and are now transferring ownership while continuing to register with the police authority shall follow the name transfer registration procedures stipulated in Articles 14 and 15 of this Circular;

c) Military vehicles and military enterprise vehicles registered with military authorities and now being transferred to civilian ownership shall follow the vehicle registration procedures stipulated in Article 8 of this Circular, accompanied by: Vehicle registration certificate and vehicle file registered by the military authority;

17. Temporary imported vehicles and project vehicles not yet expired, transferred within Vietnam

a) The vehicle owner shall complete the cancellation procedures at the registration authority according to Article 25 of this Circular; then proceed to the customs authority to complete the transfer procedures, pay taxes as prescribed, and submit the transfer documents and stamp duty receipts to the registration authority to complete the name transfer registration procedures as prescribed;

b) In cases where the customs authority collects additional taxes or the competent authority of the Ministry of Finance responds in writing that no additional taxes need to be collected, the vehicle can be registered for name transfer, and such documents shall be kept in the vehicle file;

18. Imported vehicles exempt from tax that have been used in Vietnam and whose import tax value is 0% as prescribed by law; vehicles that are movable assets of Vietnamese citizens residing abroad who have been settled for permanent residence in Vietnam and arrived at a Vietnamese port before April 1, 2014 may be registered for name transfer according to this Circular;

Vehicles of those Vietnamese citizens arriving at a Vietnamese port from April 1, 2014 must first register the vehicle before transferring it; when transferring the vehicle, proof of additional tax collection as prescribed must be provided to register for name transfer according to this Circular;

19. Unregistered vehicles that have lost all vehicle documents or part of the documents (ownership transfer documents, stamp duty receipts, origin documents): The vehicle registration officer shall guide the vehicle owner to contact the issuing agencies to request copies of the documents. For domestically produced and assembled vehicles, the production and assembly facility must issue a Quality Inspection Certificate upon factory release (paper copy if there is no electronic data).

Article 33Issuing control stickers for automobiles with economic zone license plates in accordance with the Government's regulations to operate domestically

1. Documents and procedures

a) Vehicle registration certificate with economic zone license plates;

b) Origin documents for imported vehicles.

2. The authority responsible for issuing control stickers (Traffic Police Department) shall check and compare against the list of managed vehicles, record in the tracking book, and issue control stickers on the same day.

3. Control stickers shall not exceed a validity period of 30 days from the date of issuance. The sticker shall be affixed in the upper right corner inside the front windshield of the vehicle.

4. The control sticker issuance certificate and the tracking book for automobiles operating domestically in Vietnam must be numbered sequentially from 01 to the end, bound into volumes, and managed according to the file system of the Ministry of Public Security.

Chapter III

BIU MODEL, VALIDITY PERIOD OF THE VEHICLE REGISTRATION CERTIFICATE, DETERMINATION OF THE YEAR OF MANUFACTURE OF THE VEHICLE AND LICENSE PLATE NUMBER

. Appendices and forms used in vehicle registration

Article 341. Attached to this Circular are the following appendices:

a) Appendix No. 01: Authorities and units registering automobiles at the Traffic Police Corps;

b) Appendix No. 02: License plate symbols for domestic automobiles and motorcycles;

c) Appendix No. 03: License plate symbols for foreign organizations and individuals' automobiles and motorcycles;

d) Appendix No. 04: Specifications of license plates, letters, and numbers on domestic and foreign organizations and individuals' automobile, motorcycle, tractor, trailer, and semi-trailer license plates.

2. Attached to this Circular are the following forms:

a) Motorcycle and motorbike registration certificate (Form DKX01);

b) Automobile registration certificate (Form DKX02);

c) Trailer and semi-trailer registration certificate (Form DKX03);

d) Temporary vehicle registration certificate (electronic version) (Form DKX04);

đ) Temporary vehicle registration certificate (Form DKX05);

e) Tractor registration certificate (Form DKX06);

g) Certificate of vehicle registration cancellation and license plate return (Form DKX07);

h) Decision on vehicle registration cancellation and license plate return (Form DKX08);

i) Decision on engine and frame number sealing (Form DKX09);

k) Control sticker issuance certificate (Form DKX10);

l) Economic zone temporary import and re-export automobile tracking book (Form DKX11);

m) Vehicle registration declaration form (Form DKX12);

n) Vehicle registration cancellation and license plate return declaration form (Form DKX13);

o) File guidance form (Form DKX14).

If a vehicle has a structure similar to a certain type of vehicle, it shall use the registration certificate model of that type of vehicle.

. Validity period of the vehicle registration certificate

Article 351. The automobile, passenger car, and converted vehicle registration certificates shall be recorded according to the usage period as prescribed by law.

2. The registration certificates for automobiles and motorcycles of foreign individuals who are members of diplomatic missions, consular offices, and international organization representative offices shall be recorded according to the validity period on their diplomatic identification cards, service identification cards, consular identification cards, honorary consular identification cards, and ordinary identification cards; for foreign individuals living and working in Vietnam, the validity period shall be recorded according to their permanent residence card or temporary residence card.

3. The registration certificates for diplomatic missions, consular offices, and international organization representative offices shall initially have a validity period of five years and can be renewed every three years.

3. The initial validity period of the vehicle registration certificate for automobiles and motorcycles issued to diplomatic missions, consular posts, and representative offices of organizations shall be five years and may be extended for three years each time.

Article 36. Determination of the Year of Vehicle Production

For imported vehicles and vehicles produced or assembled from chassis or complete imported automobiles, the vehicle owner must present a certificate of quality or notification of exemption from inspection for safety and environmental protection of imported motor vehicles issued by competent authorities to determine the year of production of the vehicle; in other cases, the year of production is determined based on the tenth character of the engine number or frame number according to current standards.

Article 37. Provisions on license plates

1. Regarding the material of license plates: License plates for vehicles shall be made of metal with reflective film and hidden police security symbols in accordance with the technical standards for motor vehicle license plates issued by the Ministry of Public Security; for temporary license plates prescribed in Appendix No. 02 attached hereto, they shall be printed on paper.

2. The symbols, serial numbers, and sizes of characters and numbers on registration license plates for various types of vehicles shall comply with the provisions set out in Appendices No. 02, No. 03, and No. 04 attached hereto.

3. Passenger cars shall be equipped with two license plates: one short-sized plate measuring 165 mm in height and 330 mm in length; one long-sized plate measuring 110 mm in height and 520 mm in length.

a) Arrangement of characters and numbers on license plates of domestic organizations, agencies, and individuals: The first two digits are the registration location code, followed by the registration series (letters); the second group of numbers consists of five natural numbers from 000.01 to 999.99 representing the registration sequence.

b) Arrangement of characters and numbers on license plates of foreign organizations, agencies, and individuals: The first two digits are the registration location code, followed by the second group consisting of three natural numbers representing the country or territory name, and the third group is the series number indicating the foreign organization or individual category, and the fourth group consists of two natural numbers from 01 to 99 representing the registration sequence.

c) License plates for tractors, trailers, and semi-trailers consist of one plate mounted at the rear of the vehicle, measuring 165 mm in height and 330 mm in length; the arrangement of characters and numbers on the plate follows the same pattern as domestic passenger car license plates.

4. Motorcycles shall be issued one license plate mounted at the rear of the vehicle, measuring 140 mm in height and 190 mm in length.

a) Arrangement of characters and numbers on license plates of domestic organizations, agencies, and individuals: The first group consists of the registration location code and registration series. The second group consists of five natural numbers from 000.01 to 999.99 representing the registration sequence.

b) Arrangement of characters and numbers on license plates of foreign organizations and individuals: The first group consists of the registration location code, the second group consists of the country or territory name code, the third group is the registration series, and the fourth group consists of three natural numbers from 001 to 999 representing the registration sequence.

5. Color and serial numbers of license plates for domestic organizations, agencies, and individuals:

a) Passenger car license plates have a blue background with white characters and numbers, using one of the following eleven letters in sequence for the serial number: A, B, C, D, E, F, G, H, K, L, M, issued to vehicles of Party organs; Office of the President; Office of the National Assembly and organs of the National Assembly; Office of Delegations of the National Assembly, People's Councils at all levels; Central Steering Committees; People's Public Security, People's Courts, People's Procuratorates; Ministries, bodies equivalent to ministries, government organs; National Traffic Safety Committee; People's Committees at all levels and specialized organs under provincial and district People's Committees; political-social organizations (including Vietnam Fatherland Front, Vietnam General Confederation of Labor, Communist Youth Union Ho Chi Minh, Vietnam Women's Union, Vietnam Veterans Association, Vietnam Farmers' Union); public service units, except for public driving test centers; project management boards with state management functions;

b) Motorcycle license plates have a blue background with white characters and numbers, using one of the following eleven letters in sequence for the serial number: A, B, C, D, E, F, G, H, K, L, M combined with one natural number from 1 to 9, issued to vehicles of entities specified in point a of this clause;

 

c) Passenger car license plates have a white background with black characters and numbers, using one of the following twenty letters in sequence for the serial number: A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y, Z, issued to domestic organizations and individuals not falling within the scope specified in point a of this clause;

d) Motorcycle license plates have a white background with black characters and numbers, using one of the following twenty letters in sequence for the serial number: A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y, Z combined with one of the following twenty letters: A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y, Z, issued to domestic organizations and individuals not falling within the scope specified in point a of this clause;

đ) Passenger car license plates have a yellow background with black characters and numbers, using one of the following twenty letters in sequence for the serial number: A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y, Z, issued to vehicles engaged in commercial transportation by automobile;

e) Passenger car and motorcycle license plates have a yellow background with red characters and numbers, including the registration location code and two-letter abbreviations of economic zones as prescribed by the Government;

g) Some special cases include:

License plates marked "CD" are issued to special-purpose vehicles, including motorcycles used by the People's Public Security for security purposes;

License plates marked "KT" are issued to military enterprises upon request of the Vehicle Bureau;

License plates marked "RM" are issued to trailers and semi-trailers;

License plates marked "MK" are issued to tractors;

License plates marked "TĐ" are issued to domestically produced and assembled vehicles, including four-wheeled passenger and cargo vehicles with engines, approved by the Prime Minister for pilot implementation;

License plates marked "HC" are issued to automobiles with limited operating ranges;

Vehicles with a structure similar to a certain type of vehicle shall be issued registration plates of that type.

The colors of license plates for the series mentioned above shall comply with the provisions set out in point a and point c of Clause 5 of this Article.

6. Colors and serial numbers of license plates for foreign organizations, agencies, and individuals

a) White background plate, red letters, black numbers, with the series symbol "NG" in red issued to vehicles of diplomatic missions, consular offices, and foreign nationals holding diplomatic identification cards from those organizations. Notably, the license plates for Ambassadors and Consuls General have registration number 01 and a red horizontal bar across the nationality and registration number groups (plate 01 is reissued when registering a new vehicle).

b) White background plate, red letters, black numbers, with the series symbol "QT" in red issued to vehicles of international organization representative offices and foreign nationals holding diplomatic identification cards from those organizations. Notably, the license plates for heads of United Nations organization representative offices have a red horizontal bar across the nationality and registration number digits.

c) White background plate, black letters and numbers, with the series symbol "CV" issued to vehicles of administrative and technical staff holding service identification cards from diplomatic missions, consular offices, and international organizations.

d) White background plate, black letters and numbers, with the symbol "NN" issued to vehicles of organizations, representative offices, and foreign individuals, except for the subjects specified in points a, b, and c of this clause.

7. The issuance of license plate series by local public security agencies must be carried out sequentially according to the license plate symbol order from low to high, and must use all 20 series of one symbol before switching to a new symbol.

8. For motor vehicles (excluding motor vehicles with nine seats or fewer), the vehicle owner must mark or affix the license plate number on the rear panel and both sides of the vehicle; write the name of the agency, unit, and cargo weight, self-weight on both side doors of the vehicle (except for personal vehicles).

9. License plates must be produced at enterprises and production units of license plates under the Ministry of Public Security. The production and supply of license plates shall be carried out according to the requirements of the vehicle registration authority. The initial sample product (size, quality, security) must be inspected and accepted for quality by the Traffic Police Corps before being allowed to produce and supply license plates to the vehicle registration authority; during the production and supply of license plates, enterprises and production units of license plates must maintain statistics, update data, and connect and share this data with the registration and management system.

Chapter IV

IMPLEMENTING PROVISIONS

Article 38. Effective date

1. This Circular takes effect from August 15, 2023.

2. This Circular replaces Circular No. 58/2020/TT-BCA dated June 16, 2020, issued by the Minister of Public Security, stipulating the procedures for issuing and revoking registration certificates and license plates for road traffic vehicles (partially repealed by Circular No. 65/2022/TT-BCA dated December 30, 2022, issued by the Minister of Public Security, abolishing in whole or in part certain regulatory legal documents).

3. This Circular abolishes Article 3, Clause 2, Clause 3, Clause 4, Clause 5, Clause 6, Clause 7, Clause 8, Clause 9, Clause 10 of Article 7 of Circular No. 15/2022/TT-BCA dated April 6, 2022, issued by the Minister of Public Security, amending and supplementing some articles of Circular No. 43/2017/TT-BCA dated October 20, 2017, issued by the Minister of Public Security, regarding the procedures for issuing and revoking certificates of eligibility for security and public order and examination for issuance of security certificates; Circular No. 45/2017/TT-BCA dated October 20, 2017, issued by the Minister of Public Security, regarding the procedures for registering stamp samples, revoking and invalidating stamps, invalidating the use value of stamps, inspecting the management and use of stamps; Circular No. 58/2020/TT-BCA dated June 16, 2020, issued by the Minister of Public Security, stipulating the procedures for issuing and revoking registration certificates and license plates for road traffic vehicles; Circular No. 65/2020/TT-BCA dated June 19, 2020, issued by the Minister of Public Security, stipulating the tasks, powers, forms, contents, and procedures for patrol, control, and administrative violation handling on road traffic by traffic police; Circular No. 68/2020/TT-BCA dated June 19, 2020, issued by the Minister of Public Security, stipulating the procedures for patrol, control, and administrative violation handling on waterways by maritime police; Circular No. 73/2021/TT-BCA dated June 29, 2021, issued by the Minister of Public Security, stipulating the samples of passports, travel documents, and related forms.

Article 39. Transitional Provisions

1. For vehicles that have registered five-digit license plates before this Circular takes effect and have not yet completed the procedures for recovery, such license plate numbers shall be determined as the identification license plates of the vehicle owners.

2. For vehicles that have registered five-digit license plates, if the vehicle owners have completed the recovery procedures before this Circular takes effect, such license plate numbers shall be transferred to the license plate warehouse for issuance according to regulations.

3. For vehicles that have registered five-digit license plates with the symbols "LD", "DA", "MD", "R", they shall continue to be permitted to participate in traffic, including when exchanging or reissuing license plates, except in cases where the vehicle owners request to change to license plates in accordance with this Circular.

4. For vehicles that have registered three or four-digit license plates, they shall continue to be permitted to participate in traffic, except in cases where the vehicle owners request to change to identification license plates or when the vehicle owners implement procedures for exchanging vehicle registration certificates, exchanging license plates, reissuing vehicle registration certificates, reissuing license plates, or registering transfer of ownership or relocation of vehicles in accordance with this Circular, then the three or four-digit license plates shall be recovered and exchanged for identification license plates in accordance with regulations.

5. For commune police forces authorized to register motorcycles before this Circular takes effect, they shall continue to implement vehicle registration in accordance with this Circular.

6. The model of the vehicle registration certificate issued together with Circular No. 58/2020/TT-BCA of the Minister of Public Security and five-digit license plates for cars, trailers, semi-trailers, and motorcycles produced before this Circular takes effect shall continue to be used until their expiration.

Article 40Responsibility for Implementation

1. The Director of the Traffic Police Corps shall be responsible for directing, urging, inspecting, and guiding local public security organs to implement this Circular.

2. Heads of units under the Ministry of Public Security, Directors of provincial and centrally-administered city public security departments, and related agencies and units shall be responsible for implementing this Circular.

3. During the implementation of this Circular, if there are difficulties or obstacles, local police units shall report to the Ministry of Public Security (through the Traffic Police Department) for timely guidance.
