Issuing Economic and Technical Standards for Comprehensive Survey and Exploration of Marine Resources and Environment at Depths of 20 Meters or More Using Ships

Pursuant to the Law on Marine Resources, Environment and Islands No. 82/2015/QH13 dated June 25, 2015 of the National Assembly;

Pursuant to Decree No. 40/2016/NĐ-CP dated May 15, 2016 of the Government detailing the implementation of certain provisions of the Law on Marine Resources, Environment, and Islands;

Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director of the Vietnam Marine and Island Administration, the Head of the Planning and Finance Department, and the Head of the Legal Department;

The Minister of Natural Resources and Environment issues this Circular on Economic and Technical Standards for Comprehensive Survey and Exploration of Marine Resources and Environment at Depths of 20 Meters or More Using Ships.

Article 1. Attached to this Circular are the Economic and Technical Standards for Comprehensive Survey and Exploration of Marine Resources and Environment at Depths of 20 Meters or More Using Ships.

Article 2. Effectiveness

1. This Circular takes effect from February 15, 2024.

2. This Circular replaces Circular No. 38/2010/TT-BTNMT dated December 14, 2010 of the Minister of Natural Resources and Environment stipulating economic and technical standards for survey and comprehensive exploration of marine resources and environment using ships (hereinafter referred to as Circular No. 38/2010/TT-BTNMT).

Article 3. Transitional Provisions

For specialized tasks and projects implementing surveys and explorations of marine resources and environment that have been approved according to the standards of Circular No. 38/2010/TT-BTNMT and are being implemented or have not yet commenced before the effective date of this Circular shall continue to be carried out based on the approved bases, except where there is a requirement to implement according to the provisions of this Circular.

Article 4. Implementation

1. Ministries, ministerial-level agencies, government agencies, provincial People's Committees under central cities, Heads of units under the Ministry of Natural Resources and Environment, and related organizations and individuals are responsible for implementing this Circular.

2. In the process of implementation, if there are difficulties or obstacles, relevant agencies, organizations, and individuals shall promptly report to the Ministry of Natural Resources and Environment for consideration and resolution./.
