Circular No. 24/2024/TT-BCT amends and supplements certain provisions of Circular No. 27/2014/TT-BCT dated September 4, 2014, issued by the Minister of Industry and Trade on the transit of goods of the Kingdom of Cambodia through the territory of the Socialist Republic of Vietnam.

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to Decree No. 96/2022/NĐ-CP dated November 29, 2022, issued by the Government detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade, which has been amended and supplemented by Decree No. 105/2024/NĐ-CP of the Government dated August 1, 2024; and amended and supplemented by Government Decree No. 105/2024/NĐ-CP dated August 1, 2024;

Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018, issued by the Government detailing some provisions of the Law on Foreign Trade Management;

Implementing the Agreement on the Transit of Goods between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia dated December 26, 2013;

At the proposal of the Director of the Department of Import-Export;

The Minister of Industry and Trade issues this Circular amending and supplementing some articles of Circular No. 27/2014/TT-BCT dated September 4, 2014, issued by the Minister of Industry and Trade on the transit of goods of the Kingdom of Cambodia through the territory of the Socialist Republic of Vietnam.

Article 1. Amending and supplementing some articles of Circular No. 27/2014/TT-BCT dated September 4, 2014, issued by the Minister of Industry and Trade on the transit of goods of the Kingdom of Cambodia through the territory of the Socialist Republic of Vietnam

1. Supplement Clause 10 of Article 3 as follows:

"10. The form of submitting the application for permission to transit goods as prescribed in Clauses 1, 2, 3, and 4 of this Article includes direct submission or via postal service or online at the Ministry of Industry and Trade's Public Service Portal"

2. Amending and supplementing Clause 11 as follows:

"Article 11. Extension of the transit period for goods
1. The extension of the transit period for goods shall be considered and resolved by the issuing authority for goods transiting under a permit and by the Customs Authority for goods transiting without a permit, in accordance with the law. Each extension shall not exceed thirty (30) days, and the total number of extensions shall not exceed three (3) times.

2. For goods stored in warehouses in Vietnam or damaged during the transit period, or if the means of transport carrying the goods is damaged during the transit period and requires additional time for storage or repair, the transit period may be extended accordingly to complete these tasks."

3. Amend Clause 4 of Article 12 as follows:

"4. In cases of force majeure as prescribed in Clause 2 of this Article, the consignor shall submit the application for permission to consume the transited goods online at the Ministry of Industry and Trade's Public Service Portal or send it directly or via postal service to the Department of Import-Export (Ministry of Industry and Trade), address: 54 Hai Ba Trung Street, Hoan Kiem District, Hanoi, Vietnam. The application shall include:
a) An original application for permission to consume transited goods (as prescribed in Appendix V attached to this Circular).
b) A copy of the transit permit already issued (with confirmation and stamp of authenticity from the consignor), if the goods are transiting under a permit.

c) Documentation proving the case of force majeure for the transited goods to be consumed in Vietnam."

"Article 15. Implementation Organization
1. The Department of Import-Export (Ministry of Industry and Trade) shall receive and review the applications as prescribed in Clauses 1, 3, and 4 of Article 3; Clause 4 of Article 12 of this Circular and report to the leadership of the Ministry of Industry and Trade for consideration and decision.

2. The Import-Export Management Office in Ho Chi Minh City (Department of Import-Export - Ministry of Industry and Trade) shall receive and review the applications and issue the transit permits as prescribed in Clause 2 of Article 3 of this Circular.

Article 2. Replacing and Revoking Certain Words, Phrases, Articles, and Annexes of Circular No. 27/2014/TT-BCT dated September 4, 2014, issued by the Minister of Industry and Trade on the transit of goods from the Kingdom of Cambodia through the territory of the Socialist Republic of Vietnam.

1. Replace the phrase "Annex 1A" with the phrase "Annex IA" in Clause 1 and Clause 4 of Article 3.

2. Replace Annex IA, Annex IB, Annex IIA, Annex IIB, and Annex V promulgated together with Circular No. 27/2014/TT-BCT with Annex I, Annex II, Annex III, Annex IV, and Annex V promulgated together with this Circular.

3. Replace the word "Khoản" with the word "khoản" in Articles and Annexes promulgated together with Circular No. 27/2014/TT-BCT.

5. Remove the phrase "extension" in Article 1, Title Chapter II.

6. Repeal Article 4, Annex IIIA, Annex IIIB, Annex IIIC, Annex IVA, Annex IVB, and Annex IVC.

Article 3. Implementation Provisions

This Circular takes effect from December 25, 2024./.
