DECREE
On Exit and Entry Procedures

THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Resolution No. 38/CP dated May 4, 1994 of the Government on reforming administrative procedures in handling citizens' and organizations' affairs;
At the proposal of the Minister of Interior, the Minister of Foreign Affairs, and the Chairman of the Office of the Government,
DECREE:
PART I
PROCEDURES FOR EXIT AND ENTRY
Article 1.
1. The Prime Minister shall examine and decide on exit for Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of People's Committees of provinces and centrally-administered cities (hereinafter referred to as Heads of Ministries and Provinces);
2. Heads of Ministries and Provinces shall examine and decide on exit for:
Civil servants, employees, and those under the establishment of lower-level state agencies and enterprises as stipulated in Clause 1 of this Article (including those sent by state agencies and enterprises to work at social organizations, non-state economic organizations, foreign-invested enterprises, and organizations of foreign countries in Vietnam).
Chairmen of Boards of Directors, General Managers of non-state economic organizations (including joint-stock companies and limited liability companies with state enterprises as shareholders) decided or permitted to be established by Heads of Ministries and Provinces.
Heads of Ministries and Provinces may delegate authority to Heads of public institutions (General Bureaus or Sector Management Bureaus under Ministries, Research Institutes, Academies, or National Universities...), Directors of provincial Departments, General Managers of national-scale state enterprises that regularly have international relations, to decide and bear responsibility for civil servants, employees, and staff under their management (both personnel and professional matters) going abroad to implement agreements or contracts signed with foreign countries regarding economic cooperation, trade, science, technology, training, labor, experts, etc., which have been approved by the Ministry and Province.
Such delegation must be documented with signatures, seals, and clearly defined scope of authority and responsibilities of the authorized person to the Ministry of Foreign Affairs and the Ministry of Interior;
3. The authority to examine and decide on exit for civil servants, employees, and staff under the management of central-level Party and mass organizations (People's Front, General Confederation of Labor, Women's Union, Communist Youth Union, Veterans Association, Farmers' Association) shall be implemented according to the regulations of the Central Committee Secretariat of the Communist Party;
4. The Minister of Interior shall examine and decide on exit for Vietnamese citizens not falling within the provisions of Clauses 1, 2, and 3 above, such as:
Citizens applying to go abroad for study, medical treatment, tourism, labor, visiting relatives (excluding cases where spouses or children under 16 years old apply to visit relatives who are civil servants, employees, or staff of Vietnamese representative offices abroad) or for other personal purposes;
Members of social organizations and professional associations (excluding central-level mass organizations) sent abroad by their organizations;
Members of non-state economic organizations: joint-stock companies, limited liability companies, cooperatives, production groups, private enterprises... sent abroad by their organizations;
Vietnamese citizens working in 100% foreign-invested enterprises, joint ventures with foreign countries, branches of foreign companies, and representative offices of foreign organizations and international organizations in Vietnam, applying to go abroad for personal reasons or being sent abroad by these organizations.
Article 2. The procedures for exit for the subjects specified in Clauses 1, 2, and 3 of Article 1 are as follows:
1. First-time exit:
a) The competent authority must send the Ministry of Foreign Affairs and the Ministry of Interior a document and list of personnel approved for exit;
b) The applicant must fill out an application form for passport and visa (according to the model prescribed by the Ministry of Foreign Affairs and the Ministry of Interior), attach a photograph, sign, and affix the seal of confirmation from the Head of the directly managing agency. If the Head of the competent authority directly signs the confirmation on the application form, then the document mentioned in point a of this clause is not required.
The person responsible for deciding on exit bears legal responsibility for personnel and consulting relevant authorities for complex cases (as stipulated in Article 3 of the Regulation on Management of Outbound and Inbound Delegations attached to Decree No. 12-CP dated December 1, 1992 of the Government);
2. Subsequent exits: if the time between the previous exit and the current one does not exceed 12 months, only a document from the competent authority approving the exit along with the applicant's valid passport is required. The applicant still needs to fill out a visa application form but does not need the signature of confirmation from the Head of the agency or unit as in the first time;
3. The Ministry of Interior shall not review personnel for civil servants, employees, staff, and those under the establishment of state agencies and enterprises (including those working under long-term contracts) sent abroad. If personnel found to belong to the category not allowed to exit or not yet permitted to exit due to national security reasons or currently under criminal investigation (indictment, serving sentence... as prescribed by law), the Ministry of Interior has the right to suspend exit and promptly inform relevant authorities;
4. Issuance of passports and exit visas:
a) The Ministry of Foreign Affairs is responsible for issuing passports and exit visas for subjects as stipulated in Articles 5 and 6 of Decree No. 48/CP dated July 8, 1993 of the Government.
The Ministry of Interior is responsible for issuing passports and exit visas for subjects as stipulated in Clause 1 and 2 of Article 7 of Decree No. 48/CP dated July 8, 1993 of the Government.
b) Within five days from receiving complete and valid documents, the Ministry of Foreign Affairs and the Ministry of Interior must complete the issuance of passports and exit visas for the applicant.
An exit visa may be issued for one or multiple entries at one or more international border gates of Vietnam, depending on work requirements and the request of the head of the competent authority deciding on exit.
Article 3. For Vietnamese citizens falling under the provisions of Clause 4, Article 1, the procedures for handling exit are as follows:
1. Application dossier for passport and exit visa:
a) One application form (as prescribed by the Ministry of Public Security) with photograph and confirmation of agreement from:
The head of state agencies, organizations, and state-owned enterprises for personnel within the state payroll (including those within the state payroll who are assigned to work in social organizations, state-owned economic organizations, foreign-invested enterprises, and foreign organizations in Vietnam);
The police station or commune (place of residence) for non-state payroll personnel applying for exit for purposes of social organizations, state-owned economic organizations, foreign-invested enterprises, foreign organizations in Vietnam, and other personal purposes.
The person signing the confirmation on the applicant's form must bear legal responsibility for the personnel they certify (currently not having security issues, not being pursued for criminal responsibility);
b) Invitation letter or guarantee letter from the organization or relative abroad (original submission is not required and does not need confirmation from the Vietnamese representative office abroad on the invitation letter).
2. The Ministry of Public Security is responsible for:
a) Not allowing exit in cases where individuals fall under the category of not being allowed to exit due to national security reasons or are currently being pursued for criminal responsibility (under investigation or serving a sentence...) as stipulated by law;
b) Issuing passports and exit visas to the subjects specified in Clause 3, Article 7 of Decree No. 48/CP dated July 8, 1993 of the Government;
c) Time limit for issuing passports and exit visas:
Seven days, counted from the date of receiving complete valid application files for exit for market research, market survey, and implementation of economic, trade, service, training, labor, expert contracts...;
Ten days, counted from the date of receiving complete valid application files for other personal purposes.
Chapter II
ENTRY PROCEDURES
Article 4.
1. The Prime Minister examines and decides on entry for state delegations (both members and attendants); guests representing foreign governments, United Nations organizations with positions from ministerial level, provincial level or equivalent and above coming to work, visit, meet, survey, exchange experience, seek medical treatment... upon invitation by equivalent levels in Vietnam;
2. The Minister of Foreign Affairs notifies the Vietnamese representative offices abroad to issue visas for the following subjects after notifying the personnel factors to the Ministry of Public Security:
Staff and employees of foreign diplomatic missions, consular offices, and representative offices of international organizations, intergovernmental organizations (including family members and personal servants accompanying them);
Foreign nationals sent or recommended (through diplomatic channels) by their government or international organizations, intergovernmental organizations to work with representative offices or to visit relatives who are staff or employees of their representative offices in Vietnam;
Urgent cases due to diplomatic and humanitarian needs;
3. Invitations for foreign guests to work with central-level Party and mass organizations' agencies shall be carried out according to the regulations of the Central Committee Secretariat of the Communist Party;
4. Procedures for handling entry for guests falling under the provisions of this Article are as follows:
a) When there is a decision by the competent authority as stated in Clauses 1, 2, and 3 above, the agency or organization entrusted with the task of welcoming and arranging the program of activities for the guest has the responsibility to notify the list of personnel to the Ministry of Public Security for monitoring;
b) The Vietnamese representative office abroad is responsible for handling diplomatic procedures and issuing visas (if necessary) upon receipt of telegrams from the Ministry of Foreign Affairs;
c) The Ministry of Public Security will not handle entry permit procedures for guests specified in this Article if it discovers that the personnel belong to the category not allowed to enter Vietnam. In such cases, the Ministry of Public Security will coordinate with the Ministry of Foreign Affairs to refuse entry.
Article 5. For guests entering without a visa requirement under the Agreement signed between the Government of Vietnam and the Government of another country, the procedures for handling are as follows:
The agency or organization welcoming the guest has the responsibility to notify the Ministry of Public Security at least five days before the guest's entry about the necessary personnel factors, purpose, program of activities, and temporary stay period in Vietnam;
If personnel are found to belong to the category not allowed to enter Vietnam, the Ministry of Public Security will not allow entry or compel departure according to the law;
The border police station at the international border gate is responsible for issuing a limited-term residence certificate upon request of the welcoming agency or organization in accordance with the Agreement signed between the two countries;
Article 6. For guests requiring visa issuance within the time frame specified in the Agreement signed between the Government of Vietnam and the Government of another country, the procedures for handling are as follows:
The Vietnamese representative office abroad, upon receiving the visa application file of the guest, has the responsibility to promptly telegram necessary details to the Ministry of Public Security and domestic agencies or organizations requested by the guest to work with, and can charge the guest for the cost of the telegram (two-way) based on local prices;
After the time frame specified in the Agreement (starting from the date of receiving the application file and sending the telegram), if the representative office does not receive a reply from the domestic side, then:
+ The representative office will refuse to issue a visa for guests without domestic agencies or organizations to welcome or receive;
+ The representative office has the right to issue a visa for guests with proof showing they have been invited or received by domestic agencies or organizations, while simultaneously telegraphing (guest's name, passport number, visa number and date of issue, entry date) to the Ministry of Public Security and the welcoming agency for monitoring and management;
If personnel are found to belong to the category not allowed to enter Vietnam, the Ministry of Public Security will not allow entry or compel departure.
Article 7. For foreigners and overseas Vietnamese (referred to collectively as guests) not falling under the provisions of Article 4, Article 5, and Article 6 of this Decree, if entering Vietnam, they must go through the personnel review and entry permit issuance process by the Ministry of Public Security before being issued a visa. The specific procedures are as follows:
1. Guests invited by Vietnamese agencies, organizations, social organizations, and economic entities with legal personality (hereinafter referred to as agencies or organizations) for work purposes at those agencies or organizations shall:
The head of the inviting agency or organization shall submit a document along with a list and necessary personnel factors to request the Ministry of Public Security to review personnel and issue an entry permit;
The Ministry of Public Security shall be responsible for reviewing and responding (granting or not) within five days from the date of receiving complete and valid documents;
Vietnamese diplomatic missions abroad shall issue visas to guests based on the telegraphic content from the Ministry of Public Security;
2. For guests invited by joint ventures with foreign countries, wholly foreign-owned enterprises, branches of foreign companies, representative offices of foreign economic organizations in Vietnam to carry out production and business objectives consistent with their establishment permits or registration for activities in Vietnam, and guests invited by relatives who are Vietnamese citizens permanently residing in Vietnam to visit their homeland, the procedures for handling are as follows:
a) In case of applying for normal entry:
The head of the enterprise, branch, representative office... or citizen shall submit a document or application requesting the Ministry of Public Security to issue an entry permit along with a list of personnel (according to the model prescribed by the Ministry of Public Security);
The Ministry of Public Security shall be responsible for reviewing and responding (granting or not) within five days from the date of receiving complete and valid documents;
Vietnamese diplomatic missions abroad shall issue visas to guests upon receipt of the telegraph from the Ministry of Public Security;
b) In case of applying for entry to implement investment projects that have been granted licenses by the State Committee for Cooperation and Investment, Vietnamese diplomatic missions abroad are authorized to issue visas within five days from the date of receiving complete and valid documents (as stipulated in Article 95 of Decree No. 18/CP dated April 16, 1993 of the Government). After issuing the visa, the diplomatic mission must telegraph (name, passport number, visa number and date, purpose and duration of entry) to the Ministry of Public Security and the welcoming agency for monitoring and management;
3. In cases where there is no agency, organization, or individual in Vietnam to invite and welcome guests but the guests have proactively approached Vietnamese diplomatic missions abroad to apply for a visa to enter Vietnam for the purpose of investigating business potential, investment, sightseeing, tourism..., the procedures for handling are as follows:
a) Vietnamese diplomatic missions abroad shall be responsible for promptly telegraphing to one of the following business service organizations and charge telegraph fees (two-way) according to local prices:
Trade Service Corporation (TSC) under the Vietnam Chamber of Commerce and Industry;
Investment consulting companies introduced or designated by the State Committee for Cooperation and Investment (one company per Northern, Central, and Southern regions);
International Tourism Companies of Vietnam designated by the General Administration of Tourism (one company per region);
b) Upon receiving the telegraph from Vietnamese diplomatic missions abroad, the aforementioned business service organizations shall be responsible for processing the application for an entry permit at the Ministry of Public Security and charging service fees (in addition to visa fees) according to the fee schedule prescribed by the Ministry of Finance - Ministry of Foreign Affairs - Ministry of Public Security;
c) The Ministry of Public Security shall be responsible for replying to the application for an entry permit within a maximum of five working days from the date of receiving complete and valid documents and telegraphing to Vietnamese diplomatic missions abroad to issue visas according to the requirements of service organizations;
d) Vietnamese diplomatic missions abroad shall issue visas to guests based on the telegraphic content from the Ministry of Public Security.
Article 8. For guests invited by Party and State agencies at provincial level and above and people's organizations at central level for work purposes from the second time onwards, provided that the time between entries does not exceed twelve months, Vietnamese diplomatic missions abroad shall issue visas to guests based on the invitation letters or invitations from domestic agencies (presented by the guests), then telegraph (name, passport number, visa number and date, entry time) to the Ministry of Public Security and welcoming agencies for monitoring and management.
Article 9.
1. Entry visas to Vietnam must be directly stamped into the guest's passport, no separate visa papers shall be issued except in special cases decided by the Central Committee Secretariat of the Communist Party of Vietnam or the Prime Minister;
2. Visa fees must be collected strictly according to the fee schedule prescribed by the Ministry of Finance - Ministry of Foreign Affairs - Ministry of Public Security and publicly announced; no agency, organization, or individual may collect outside of these regulations. Service fees and telegraph charges stipulated in Article 6 and Article 7 of this Decree must be charged separately and not combined with visa fees.
Chapter III
IMPLEMENTING PROVISIONS
Article 10.
1. Exit and entry management must follow a unified authority. The Ministries of Foreign Affairs and Public Security and Vietnamese diplomatic missions abroad must closely cooperate and maintain smooth communication. The Ministry of Finance shall allocate funds for the Ministry of Foreign Affairs and Public Security to modernize the information network serving exit and entry management, ensuring safety and speed from within the country to abroad, from central exit and entry management agencies to localities and international border gates;
2. The Ministry of Public Security shall quickly consolidate and reorganize the management, control, and exit and entry procedures at international border gates (land, rail, water, air) into a unified authority. This reorganization must be completed within ninety days from the effective date of this Decree.
Article 11. This Decree takes effect from April 1, 1995; it replaces Decision No. 193/CT dated May 10, 1987 and No. 48/CT of the Chairman of the Council of Ministers (now the Prime Minister); all provisions in Decrees No. 12/CP dated December 1, 1992, No. 04/CP dated January 18, 1993, and No. 48/CP dated July 8, 1993 of the Government and previous provisions of ministries, ministerial-level agencies, government agencies, and People's Committees of provinces and centrally-administered cities that conflict with this Decree are hereby abolished.
Article 12. The Minister of Interior Affairs, the Minister of Foreign Affairs, and the Minister of Finance shall, within their respective functions and assigned tasks, issue detailed guidance documents no later than twenty days from the date this Decree takes effect to implement the provisions of this Decree.
Article 13. The ministers, heads of ministerial-level agencies, heads of government agencies, and chairpersons of provincial People's Committees under the direct jurisdiction of the central government are responsible for its implementation./.
