Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Organization of the People's Courts 2002;

Pursuant to Article 66, Article 68, and Article 70 of the Civil Procedure Code 2004;

Pursuant to the Ordinance on Judges and Lay Assessors of the People's Courts 2002;

Pursuant to the Ordinance on Prosecutors of the People's Procuratorates 2002;

At the proposal of the President of the Supreme People's Court, the Prosecutor General, the Minister of Home Affairs, the Minister of Finance, the Minister of National Defense, the Minister of Public Security, and the Minister of Justice.

Article 1.The trial allowance for persons conducting proceedings and participating in proceedings at a trial held in one day shall be regulated as follows:

1. The presiding judge of the trial shall be entitled to a trial allowance of VND 50,000 (fifty thousand dong).

2. Judges and prosecutors participating in the trial shall be entitled to a trial allowance of VND 30,000 (thirty thousand dong).

3. Court secretaries, court security officers, and escort police shall be entitled to a trial allowance of VND 20,000 (twenty thousand dong).

4. Lay assessors and military assessors shall be entitled to a trial allowance of VND 50,000 (fifty thousand dong), including days spent researching case files at all levels of courts.

5. Experts invited by the court to attend the trial shall be entitled to a trial allowance of VND 40,000 (forty thousand dong).

6. Interpreters invited by the court to interpret at the trial shall be entitled to a trial allowance ranging from VND 50,000 (fifty thousand dong) to VND 500,000 (five hundred thousand dong).

7. Witnesses summoned by the court to attend the trial shall be entitled to a trial allowance of VND 30,000 (thirty thousand dong).

Lay assessors, military assessors, experts, interpreters, and witnesses shall have their travel expenses reimbursed according to regulations.

12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentThe source of funds for paying trial allowances shall be allocated in the annual state budget estimates of judicial agencies in accordance with the State Budget Law.

Article 3. The Supreme People's Court shall take the lead and coordinate with the Supreme People's Procuracy, the Ministry of Home Affairs, the Ministry of Finance, the Ministry of National Defense, the Ministry of Public Security, and the Ministry of Justice to guide the implementation of this Decision.

Article 4.This Decision shall take effect fifteen days after its publication in the Official Gazette. This Decision replaces Decision No. 154/TTg dated March 12, 1996 of the Government Chairman regarding the implementation of trial allowances.

Article 5.The President of the Supreme People's Court, Ministers, Heads of ministerial-level agencies, Heads of central government agencies, and Chairmen of provincial/municipal People's Committees shall be responsible for implementing this Decision./.
