REGULATIONS
ON TRAINING AND CAPACITY BUILDING FOR STAFF AND CIVIL SERVANTS

PART I
GENERAL PROVISIONS
Article 1. Scope and Applicability
This Regulation stipulates the management and implementation of training and capacity building for staff and civil servants under the Government Inspectorate (hereinafter referred to as staff and civil servants).
Article 2. Interpretation of Terms
1. Training through the system of diplomas is a type of training linked to the issuance of diplomas in accordance with the Education Law and corresponding diplomas issued by foreign countries (hereinafter referred to as training).
2. Training through capacity building is a form of regular training aimed at updating knowledge and improving professional skills, completing job qualification standards and ranks suitable for each position (hereinafter referred to as capacity building).
Article 3. Principles of training and capacity building
1. Training and capacity building must be consistent with requirements, tasks, and plans for training and capacity building in the strategic development plan for human resources of the Government Inspectorate;
2. Training and capacity building must be aligned with the cadre planning for leadership and management cadres and professional cadres, consistent with the functions and tasks of the Government Inspectorate;
3. Training and capacity building must be consistent with the job qualifications, ranks, and positions of staff and civil servants.
Chapter II
CONDITIONS FOR ASSIGNING TO TRAINING AND CAPACITY BUILDING
CONDITIONS FOR OPERATING SHIPBUILDING SERVICES INCLUDING NEW CONSTRUCTION AND CONVERSION OF SHIPS
1. Staff and civil servants must have political integrity, moral character, comply well with internal regulations of the agency, demonstrate responsibility in work, complete assigned tasks satisfactorily, and commit to long-term employment at the Government Inspectorate as stipulated in this Regulation;
2. Staff and civil servants within the cadre planning and training and capacity building plan of the agency that has been approved;
3. Meet all selection criteria set by the training and capacity building institution.
Article 5. Conditions for assigning to training
In addition to the conditions stipulated in Article 4 of this Regulation, staff and civil servants assigned to training must meet the following conditions:
1. For Doctoral training:
Have worked for at least 12 months for newly received staff and civil servants and 36 months for newly recruited staff and civil servants into the official establishment of the Government Inspectorate (excluding probationary and trial periods).
2. For Master's training:
Have worked for at least 12 months for newly received staff and civil servants and 24 months for newly recruited staff and civil servants into the official establishment of the Government Inspectorate (excluding probationary and trial periods).
3. For second bachelor's degree training:
Have worked for at least 12 months for newly received staff and civil servants and 24 months for newly recruited staff and civil servants into the official establishment of the Government Inspectorate (excluding probationary and trial periods);
Second bachelor's degree training must be relevant to the assigned professional work.
4. For political theory training:
For Bachelor's and Advanced Political Theory training: the target group includes staff and civil servants within the planning for leadership at the Department level and above;
For Intermediate Political Theory training: the target group includes staff and civil servants who have not yet been recognized as having intermediate political theory qualifications as prescribed;
Meet other conditions as prescribed by the Central Organization Committee and the National Academy of Political Science and Public Administration Ho Chi Minh City.
Article 6. Conditions for sending for training and development
Based on job requirements and position standards, rank, title of civil servants to be sent for theoretical political training, administrative management knowledge, inspection business knowledge, computer knowledge, foreign language and other supplementary knowledge.
Article 7. Training and Development Abroad
For those sent for training and development abroad using state budget funds or partially supported by the state budget: shall implement according to the current state regime and policies; Other subjects: decided by the General Inspector.
Chapter III
RIGHTS, RESPONSIBILITIES OF CIVIL SERVANTS AND VIOLATION HANDLING
Article 8. Rights of Civil Servants
1. Training and Development within the country or joint training with foreign countries:
1.1. Training:
1.1.1. For civil servants under planning who are sent for training by the agency:
They are arranged to take leave from work to attend classes and review according to the notice of the training institution. If they are sent to study outside working hours, they will be arranged to take leave during review and final examination periods according to the regulations of the training institution;
During the period of being sent for training, civil servants will receive full salary and other benefits as prescribed. The time spent studying by civil servants will be counted as continuous service time;
The agency will pay all tuition fees and material costs according to the regulations of the training institution for domestic training institutions; 25% of tuition fees and material costs for training institutions linked with foreign countries.
1.1.2. For civil servants not under planning who are approved by the General Inspector to participate in and pass training courses with majors suitable for their current jobs, directly serving to improve the quality of professional work, must study outside working hours, be reasonably assigned tasks by the agency to create favorable conditions for participation in studies, and be supported with 50% of tuition fees according to the regulations for domestic training institutions.
1.1.3. Civil servants transferred from other agencies to work at the Government Inspectorate, if currently enrolled in training courses, can continue their studies if the major is suitable for their professional work and the unit's mission, and will be supported with 50% of tuition fees and material costs according to the remaining study period regulations for domestic training institutions.
1.2. Development:
The agency will pay all tuition fees, material costs, and other expenses according to the regulations.
2. Training and Development Abroad:
Implemented according to the current state regime and policies and the General Inspector.
3. Priority Subjects:
Civil servants belonging to priority groups as prescribed by the state will be considered for early dispatch for training by twelve months earlier as stipulated in Article 5 of this Regulation.
Article 9. Responsibilities of Civil Servants
1. Civil servants must continuously study to enhance their theoretical level, knowledge, professional skills, and other supplementary knowledge;
2. After being dispatched for training, civil servants must work at the Government Inspectorate for at least three times the duration of the training course;
3. After each training period, civil servants dispatched for training and development must report their study results to the direct supervisor of the unit managing and utilizing civil servants (for domestic courses). At the end of the course, they must report their study results and submit certificates and diplomas (certified copies) to the Cadre and Civil Servant Organization Department;
Civil servants dispatched for training and development abroad must report their study results to the direct supervisor of the unit managing and utilizing civil servants and the Cadre and Civil Servant Organization Department within fifteen days upon returning to the country, and provide course content if requested; submit study materials as reference materials at the agency;
4. Upon completion of the Master's or Doctoral program, civil servants must submit one copy of the thesis or dissertation or its translation (if studied abroad) along with the original, file.doc, to the agency library or upload it to the internal network, and report research results before the Scientific Council if required.
Article 10. Handling of violations
Civil servants violating the training and development rules and regulations will be subject to disciplinary action depending on the severity, including criticism, warning, evaluation, commendation, reward, or disciplinary action.
1. Civil servants dispatched for training and development who violate the training and development rules and regulations will be reported back to the unit for handling through criticism, warning, evaluation, commendation, reward, or disciplinary action.
2. Civil servants during the period of being dispatched for training or after being dispatched for training who unilaterally quit their job or terminate their contract without completing the minimum service period as stipulated in Clause 2 of Article 9 of this Regulation must compensate for training costs.
3. Compensation for training costs for civil servants shall be implemented according to the current state regulations.
Chapter IV
TRAINING AND DEVELOPMENT MANAGEMENT
Article 11. Building training and development plans
1. Based on their functions, tasks, cadre planning, and results of cadre assessment, Departments, Bureaus, and responsible units shall build annual and long-term training and development plans and submit them to the Cadre Organization Department no later than October 31 each year.
2. The Cadre Organization Department shall build the agency's cadre and civil servant training and development plan based on the training and development plans of Departments, Bureaus, and units, and balance among resources, and submit for approval by the Chief Inspector and notify units of the annual training and development plan by January 31 each year.
Article 12. Specific provisions on training and development management
1. Cadres and civil servants may not register for or participate in more than two training or development courses simultaneously.
2. Cadres and civil servants who are assigned to attend but do not take the examination (except for valid reasons) or fail to be admitted will not be allowed to attend similar courses within the following 12 months.
3. For postgraduate training levels, each cadre and civil servant may only register for no more than two times at one level of domestic training and no more than three times at foreign training.
4. Cadres and civil servants who have completed one level of training must wait at least 24 months before being considered for higher-level training (if available), except in cases where they have outstanding academic performance and are recommended by the training institution to continue higher-level training, which is decided by the Chief Inspector.
Article 13. Management Responsibilities
Responsibilities of Departments, Bureaus, and units in managing cadre and civil servant training and development:
1. The Cadre and Civil Servant Department:
Building training and development plans as stipulated in Article 11 of this Regulation;
Cooperating with the Office of the Government Inspector General to build the agency’s training and development budget plan;
Managing and monitoring cadres and civil servants assigned for training and development, receiving and arranging work after cadres and civil servants complete overseas training programs;
Annually and urgently reporting to the Chief Inspector the results of cadre and civil servant training and development.
2. The Office of the Government Inspector General:
Determining the annual budget allocated for training and development according to the approved plan by the Chief Inspector;
Establishing, issuing, and guiding units to uniformly implement cost standards and financial expenditure regulations in the field of training and development;
Cooperating with the Cadre Organization Department to implement the budget plan serving the agency's training and development work.
3. Departments, Bureaus, and subordinate units:
Building training and development plans as stipulated in Article 11 of this Regulation;
Implementing regulations on selecting and assigning cadres and civil servants for training and development according to the approved plan;
After training and development, cadres and civil servants must be arranged in accordance with cadre planning and specialized knowledge acquired, creating conditions for cadres and civil servants to apply and promote learned knowledge in practice.
Chapter V
IMPLEMENTATION
Article 14. Implementation clause
The Cadre Organization Department is responsible for guiding, monitoring, and urging the implementation of this Regulation, and periodically reporting to the Chief Inspector on the implementation situation. If issues requiring amendments or supplements arise during the implementation process, they should be reflected to the Chief Inspector (through the Cadre Organization Department) for consolidation and submission to the Chief Inspector for consideration and decision.
