Pursuant to Decision No. 135/1999/QĐ-BNN-KHCN dated October 1, 1999 of the Minister of Agriculture and Rural Development on the Regulation on Formulation, Review, and Issuance of Industry Standards;

Considering the proposal of the Director of the Department of Science and Technology and the Director of the Water Resources Engineering Bureau.

REGULATIONS ON FORMULATION AND ISSUANCE OF OPERATIONAL PROCEDURES FOR SYSTEMS

1. General Provisions

1.1. Scope of Application

This standard applies to the formulation, submission, review, and issuance of operational procedures for irrigation works systems (excluding dike and flood control projects) managed by the Ministry of Agriculture and Rural Development for water supply and drainage services for agricultural production, domestic use, and other economic sectors.

When implementing this standard, relevant standards and current legal regulations must also be adhered to.

For irrigation works systems within the scope of a single district, this standard may be applied to develop operational procedures when necessary, ensuring service to production and safety of the works.

1.2. Applicability Objectives.

1.2.1. For newly constructed irrigation works systems: Based on this standard, the project management board formulates the operational procedures for the system, submits them to the competent authority for approval, and hands them over to the organization or individual managing and operating the system for implementation.

1.2.2. For currently operating irrigation works systems: Based on this standard, the organization or individual managing and operating the irrigation works system formulates and modifies the operational procedures for the system, and submits them to the competent authority for approval.

1.3. Terms and Definitions.

In this standard, the following terms are understood as follows:

1.3.1. "Irrigation Works"are structures belonging to infrastructure aimed at exploiting the benefits of water; preventing and combating damage caused by water; protecting the environment and maintaining ecological balance."

1.3.2. "System of Irrigation Works"consists of irrigation works that are directly related to each other in terms of exploitation and protection within a specific area."

1.3.3. "Operational Procedures for Irrigation Works Systems"is a document specifying principles, responsibilities, procedures for operating works, and technical parameters in the system serving agricultural production, domestic use, and other economic sectors; ensuring that works operate within their capacity and safely, harmonizing interests between water supply and drainage requirements."

1.3.4. "Opening" refers to opening gates higher than the water surface (flat gates, curved gates); both gate wings are fully opened to the designed extent (hinged gates) or fully opened to the cross-sectional area of the culvert (cone valves, plug valves).

1.3.5. "Closing" refers to closing gates down to the bottom of the culvert (flat gates, curved gates); both gate wings are tightly closed together (hinged gates) or fully closed to the cross-sectional area of the culvert (cone valves, plug valves).

1.3.6. "Regulating" refers to adjusting water levels or flow rates to meet water supply and drainage requirements.

1.3.7. "Controlling" refers to ensuring that water levels or flow rates do not exceed or fall below a specified limit.

2. Provisions on Basic Documents and Technical Calculation Content.

2.1. Basic Documents for Technical Calculations.

2.1.1. For newly constructed irrigation works systems:

- Planning documents for the system and design documents for the works.

- Meteorological and hydrological data.

- Other related documents.

2.1.2. For currently operating irrigation works systems:

- Planning documents for the system and design documents for the works.

- Meteorological and hydrological data during operation management.

- Current status documents of the works and water supply and drainage requirements in the system.

- Other related documents during operation management.

2.2. Content of Technical Calculations.

2.2.1. Rechecking meteorological and hydrological parameters, including:

- Average rainfall; annual rainfall distribution and frequency.

- Evaporation, humidity, temperature... monthly throughout the year.

- Water source variation (water level, flow rate corresponding to the design frequency of the system).

- Rechecking water quality according to production and environmental requirements.

2.2.2. Rechecking the capacity of irrigation works in the system (water level, flow rate).

2.2.3. Rechecking water supply requirements in the system on a monthly basis throughout the year, including:

- Domestic use.

- Agricultural production.

- Environmental protection.

- Other water usage requirements.

2.2.4. Rechecking the capacity and drainage requirements in the system on a seasonal basis.

2.2.5. Calculating the balance between the capacity and water supply or drainage requirements in the system on a monthly basis throughout the year (quantifying surplus, shortage, adequacy on a monthly or seasonal basis).

2.2.6. Developing safe, reasonable, and effective system operation plans for irrigation works, corresponding to various scenarios calculated for water balance in the system.

3. Draft the "operating procedure for the water conservancy works system"

3.1. The operating procedure for the water conservancy works system is specified in Appendix A of this standard.

3.2. Principles for compiling the content of the procedure:

3.2.1. The content must be clearly, accurately, concisely stated without repetition.

3.2.2. Articles and clauses that are mandatory shall be stipulated.

3.2.3. Terms that may lead to multiple interpretations shall not be used.

3.2.4. The use of non-common terms (local terms) shall be minimized. When using terms not defined in related legal documents, they must be defined.

3.2.5. Abbreviations and mathematical or technical symbols should not be used unless absolutely necessary.

3.2.6. The units of measurement used in the procedure shall be those of the Socialist Republic of Vietnam.

4. Reviewing, approving, and issuing the operating procedure for the water conservancy works system

4.1. Documents for review.

4.1.1. Documents for review include:

- The proposal for approval and issuance according to Appendix B of this standard.

- The draft "Operating procedure for the water conservancy works system" according to Section 3.1 of this standard.

- Technical calculation documents and results according to Article 2.2 of this standard.

- Documents and materials used during the procedure development process.

- Opinions from local authorities and relevant sectors.

- Other related documents attached.

4.1.2 All documents for review shall be placed in a hard cover folder, with the name of the operating procedure for the water conservancy works system on the outside of the folder, and a list of the number of documents, materials, maps, etc., inside the folder (accompanied by a soft disk or CD containing all the contents of the documents in sequence).

4.2. Content of the review.

4.2.1. Checking and evaluating the used documents, solutions, methods, and technical calculation results, the rationality of selected technical indicators.

4.2.2. Evaluating the effectiveness of solutions and operation procedures for water conservancy works in the system corresponding to cases set out in the procedure.

4.2.3. Evaluating the rationality and feasibility of specific provisions in the procedure.

4.2.4. Checking the legality of the draft procedure document.

4.3. Time limit for review.

4.3.1. The review must be completed within 60 days from the date of receipt of complete documents as prescribed.

4.3.2. In case the documents for review do not meet requirements (quantity, quality), the reviewing agency shall issue a document requesting the submitting agency or drafting unit to amend, supplement, and perfect the documents.

4.4. Documents for approval and issuance.

4.4.1. All documents of the procedure according to Article 4.1 of this standard.

4.4.2. Report on the results of the procedure review by the reviewing agency according to Appendix C of this standard.

4.4.3. Draft decision on approval and issuance of the procedure by the competent authority according to Appendix D of this standard.

4.4.4. Related documents and files according to administrative procedures prescribed by the approving and issuing authority.

4.5. Agencies responsible for reviewing, approving, and issuing.

4.5.1. The Minister of Agriculture and Rural Development shall approve and issue the operating procedure for the inter-provincial water conservancy works system where the Minister serves as the Chairman of the Management Board of the system.

For other inter-provincial water conservancy works systems, the Minister of Agriculture and Rural Development shall delegate the Chairman of the People's Committee of the province or city benefiting most in the system to approve and issue.

The Water Resources Administration shall take the lead and coordinate with relevant agencies to review the procedure approved and issued by the Minister of Agriculture and Rural Development.

4.5.2. The Chairman of the People's Committee of the province or centrally-administered city shall approve and issue the procedure for water conservancy works systems within the province or inter-provincial systems delegated by the Minister of Agriculture and Rural Development.

The Department of Agriculture and Rural Development shall take the lead and coordinate with relevant agencies to review the procedure approved and issued by the Chairman of the People's Committee of the province or centrally-administered city.

5. Archiving and distributing the operating procedure for the water conservancy works system.

5.1. Archiving documents..
