RESOLVES
SUPPLEMENTING THE TASKS AND POWERS OF THE PEOPLE'S COUNCIL AND THE PEOPLE'S COMMITTEE AT THE PROVINCE AND DISTRICT LEVELS AND REDEFINING THE NUMBER OF MEMBERS OF THE PEOPLE'S COMMITTEES AT THE PROVINCE AND DISTRICT LEVELS
NATIONAL ASSEMBLY STANDING COMMITTEE
Pursuant to Article 53 of the 1959 Constitution;
BASED ON THE LAW ON THE ORGANIZATION OF THE PEOPLE'S COUNCILS AND THE ADMINISTRATIVE COMMITTEES AT ALL LEVELS, OCTOBER 27, 1962;
WHILE AWAITING THE NEW CONSTITUTION AND NEW LAWS ON THE ORGANIZATION OF THE PEOPLE'S COUNCILS AND THE PEOPLE'S COMMITTEES AT ALL LEVELS;
TO ENSURE THE CONDITIONS FOR THE PEOPLE'S COUNCILS AND THE PEOPLE'S COMMITTEES AT THE PROVINCE AND DISTRICT LEVELS TO PERFORM THEIR TASKS AND POWERS IN THE CURRENT REVOLUTIONARY PHASE;
At the proposal of the Council of Ministers;
RESOLUTION:
Article 1. The tasks and powers of the People's Council at the district level as stipulated in Article 16 of the Law on the Organization of the People's Councils and Administrative Committees at All Levels, October 27, 1962, are now supplemented as follows:
- BASED ON THE RESOURCES AND MATERIAL AND TECHNICAL INFRASTRUCTURE OF THE DISTRICT, THE NEED TO IMPROVE THE LIVING STANDARDS OF THE POPULATION, AND THE OBLIGATION TO CONTRIBUTE TO THE STATE, AS WELL AS THE TASKS AND TARGETS SET BY THE PEOPLE'S COMMITTEE OF THE PROVINCE OR THE CITY UNDER THE CENTRAL GOVERNMENT, THE PEOPLE'S COUNCIL AT THE DISTRICT LEVEL SHALL DECIDE THE PLAN FOR THE ECONOMIC AND CULTURAL DEVELOPMENT OF THE DISTRICT.
- THE PEOPLE'S COUNCIL AT THE DISTRICT LEVEL SHALL REVIEW THE BUDGET ESTIMATE AND APPROVE THE FINAL ACCOUNTS OF THE DISTRICT BUDGET.
Article 2. THE NUMBER OF MEMBERS OF THE PEOPLE'S COMMITTEES AT THE PROVINCE AND DISTRICT LEVELS IS REDefined AS FOLLOWS:
- THE PEOPLE'S COMMITTEES AT THE PROVINCE AND CITY LEVELS UNDER THE CENTRAL GOVERNMENT SHALL HAVE BETWEEN 17 AND 21 MEMBERS.
- THE PEOPLE'S COMMITTEES AT THE DISTRICT LEVEL AND EQUIVALENT LEVELS SHALL HAVE BETWEEN 11 AND 15 MEMBERS.
Article 3. THE GOVERNMENT COUNCIL GUIDES THE IMPLEMENTATION OF THIS RESOLUTION.
